Náhrada újmy při ublížení na zdraví / Damages for personal injury

Molnár, Peter January 2015 (has links)
Damages for personal injury The diploma thesis focuses on the analysis and evaluation of the recodified legal regulation on damages for non-pecuniary loss arising from personal injury in the light of its comparison with the relevant English common law. On the background of the historical evolution of the method for assessing the amount of damages for non-pecuniary loss arising from personal injury, as well as through the comparison of Metodika Nejvyššího soudu k náhradě nemajetkové újmy při ublížení na zdraví (bolest a ztížení společenského uplatnění podle § 2958 občanského zákoníku) with Guidelines for the Assessment of General Damages in Personal Injury Cases, the diploma thesis arrives at a conclusion in favour of the development and application of the former, which it deems to have been a suitably chosen pre-emptive measure that would allow Czech legal practice to approach damages for non-pecuniary loss arising from personal injury in a consistent and proportionate fashion right from the moment of the coming into effect of Act No. 89/2012 Coll., the Civil Code, without having to overcome a period of relative legal uncertainty, during which standardised amounts of damages would have been developed through judicial practice, as was the case in the English common law. As regards the...

Is Love a Battlefield? The New Politics of Marriage Equality in the Aging War on Terror

Givelber, Jackie 01 January 2017 (has links)
When Donald Trump took the stage as the Republican presidential nominee at the Republican National Convention in July 2016, he made a historical appeal to LGBTQ Americans: to the boisterous applause of a Republican audience, he promised "to protect LGBTQ citizens from the violence and oppression of a hateful foreign ideology." Utilizing this historical moment as an indicator of shifting political views around LGBTQ rights in the Republican Party and the US nation-state as a whole, this paper links contemporary iterations of the War on Terror to the legalization of same-sex marriage in June 2015. Connecting same-sex marriage to the US nation-building project, I argue that the "dignity" newly available to certain queer folks via the institution of marriage makes possible an articulation of queer-defensibility that services a Republican investment in the aging War on Terror and the sustained targeting and hyper-surveillance of Muslims globally.

[en] THE DEMOCRATIC ELITISM AND DISCOURSES OF THE BRAZILIAN SUPREME COURT / [pt] O ELITISMO DEMOCRÁTICO E DISCURSOS DO STF

SHANDOR TOROK MOREIRA 08 January 2013 (has links)
[en] How the Brazilian Supreme Court (BSC) reconstructs the relation between State and Citizenship in contemporary Brazil, especially concerning the national democracy? The public discourse manufactured by the BSC whilst deciding certain cases was investigated through the lenses of two theoretical models of democracy, democratic elitism and participatory publics, in search for evidences of discourse power abuse. Such abuse is characterized by the influence of the democratic elitism framework and its potential to reproduce and reinforce an institutional design unable to counteract the problematic action repertoir of the Brazilian political elite.

Vondráčková, Pavlína January 2015 (has links)
State supervision of financial activities The topic of this dissertation thesis is the state supervision of financial activities. The topic is really wide, so the author can take into account all of the financial relationships related to this area. This thesis focused on theoretical issues, on the legal relationships in this area, and specifically on the selected areas, in which was a drafted question later on in detail analyzed. In the theoretical area are considered terms such as regulation, supervision and control. The aim was to define these concepts theoretically, to chart their frequency and semantic nature in the area of financial activities. The aim of this thesis was also to investigate, whether it is possible to set out the terms that are used both in everyday and in professional life in an identical meaning, and define specifically for the area of financial law. It has been found that it is very difficult, if not impossible task, as any definition cannot cover the diversity, frequency and a steady increase in the financial legal relations. Higher attention is paid to external control exercised by the Supreme Audit Office. This issue is consider to be very important, but it is underappreciated and very sporadically also published, which is inconvenient and inadequate to the importance of...

[en] JUDICIAL REVIEW AND PROCEDURAL JUDICIAL ACTIVISM / [pt] CONTROLE JUDICIAL DE CONSTITUCIONALIDADE E ATIVISMO JUDICIAL PROCESSUAL

JOSE GOMES RIBERTO SCHETTINO 13 April 2009 (has links)
[en] Judicial review of legislation originated in the United States of America with the ruling in the Marbury v. Madison case, back in 1803. The expansion of judicial activity into domains not originally imagined by the ideologues of judicial review will be expounded by means of a retrospective analysis of doctrine and case-law arising from said ruling in the USA, as well as of the rise of Kelsenfashioned constitutional adjudication in Europe. Such phenomenon is herein conceptualized as judicial activism and henceforth marked as material or substantive judicial activism as distinct from the procedural or formal type. Premised, thus, on the historical nature of judicial review and the influence of both the American and the European models have born on Brazil, an analysis is made of the expansion of Supremo Tribunal Federal adjudication in Brazil in the past few years, be it through the widening of its constitutional jurisdiction, be it through the enlargement both in duration and in function of the effects of its rulings as a result of procedural-based judicial activism.

Recurso especial repetitivo: análise crítica do julgamento por amostragem / Repetitive special appeal: a critical approach regarding the sampling judgment by the Brazilian Superior Court of Justice

Souza, Michel Roberto Oliveira de 19 May 2014 (has links)
The aim of this work is to provide a critical approach regarding the trial of the so-called repetitive special appeals by the Brazilian Superior Court of Justice (STJ). Sampling judgment is a technique that identifies repetitive law issues in several special appeals, chooses those appeals that will be tried as representative of the controversy and paralyzes the remaining appeals about that same topic. In the analysis it was found that sampling judgment is an appropriate collective appellate adjudication to address the problem concerning the excessive amount of judicialization and mass claims. However, for proper use of its potential, this study concludes that the identity crisis of the Superior Court of Justice must be overcome, shaping it to contemporary functions of the Supreme Courts, as well as problems related to the instability of its jurisprudence and low compliance to its precedents. In order to obtain an adequate implementation of repetitive special appeals, as an example of sampling judgment, the managerial aspect of this collective appellate adjudication model needs to be emphasized, similar to what occurs in the experiences of other countries regarding multiparty adjudication models. To adapt repetitive special appeals to the model of sampling judgment in its effective potential, the procedural aspects should be improved to ensure the effectiveness of the right of adversarial proceedings by amici curiae.

The performance of the Brazilian Supreme Court in the post-88: impact on the balance of powers.

Paula, Carolina Gattolin de 27 February 2014 (has links)
After the promulgation of the Constitution of 1988, Brazilian Supreme Court became part of everyday life of the population due to the various information about its trials, which involve, increasingly, political issues that impact the life of Brazilian population. Such performance of the Court has aroused some criticism, mainly related to its democratic legitimacy to decide on political affairs and to the violation of the principle of the separation of Powers. This debate is embedded in the broader context of the Brazilian Judiciary protagonism in the XXI Century, specially expressed by the expansion of constitutional jurisdiction, which is due to the consolidation of the judicial review system and a \"new\" constitutional interpretation. Indeed, Constitution of 1988 expanded the powers of the Supreme Court, urging the exercise of its political function. The criticisms addressed to the Court by reason of its performance with respect to policy issues are related to two phenomena: the \"judicialization of politics\" and \"judicial activism\", which are considered by the doctrine as an undue interference by the Judiciary on the performance of the Legislative and Executive branches. Cases such as the recognition of homo-affective union were considered stable expression of activism. However, it is possible to approach more flexibly the issue of democratic legitimacy of the Court and of the separation of powers more flexibly. Theories of dialogue present a new proposal for interaction between the Supreme Court and the legislature, giving more current understanding of democracy and separation of powers. It reveals an alternative to waive predominance of the Legislature or the Judiciary to give the \"last decision\" on the constitutionality of laws and normative acts. Thus, this study aims to demonstrate, there to seek outlets to the rigid structure of Montesquieus Separation of Powers, so that the Constitution can be achieved through effective collaboration of Powers.
