Transfer Pricing är ett internationellt fenomen som tar sikte på de transaktioner som företas mellan bolag i intressegemenskap. Regler som reglerar prissättningen av sådana typer av transaktioner har funnits i svensk skatterätt sedan 1920-talet, men det är inte först de senaste årtiondena transaktionerna kraftigt uppmärksammats av de internationella skattemyndigheterna. Den prissättning som bolag i multinationella koncerner tillämpar på transaktioner avseende varor och tjänster mellan bolag i olika stater kan nämligen användas för att transportera vinstmedel till lågbeskattande länder, och därigenom finns en risk för att skattebasen eroderas i den stat vinstmedlen allokeras bort från. Det är därför av vikt att dessa transaktioners prissättning motsvarar vad oberoende parter hade avtalat. Om prissättningen avviker från vad oberoende parter hade avtalat finns det i Sverige en möjlighet för Skatteverket att korrigera priset enligt den s.k. korrigeringsregeln i 14 kap. 19 § IL. I dessa fall korrigeras prissättningen till det pris som Skatteverket anser utgör ett armlängdspris, d.v.s. det pris som parter med ett armlängds avstånd sinsemellan hade avtalat. Det innebär i regel att bolagets intäkter höjs. Problem uppkommer när det rätta priset ska bestämmas. I Sverige finns sedan 2007 ett dokumentationskrav för bolag som företar den här typen av transaktioner, dels för att bolagen ska göras medvetna om valet av prissättningsmetod, dels för att Skatteverket lättare ska kunna utföra kontroller. Exakt vad dokumentationen ska innehålla och vilken betydelse den har för bevisprövningen vid tillämpning av korrigeringsregeln är enligt min mening inte klarlagt. Den här uppsatsen syftar till att utreda vilken betydelse internprissättningsdokumentationen har för bevisprövningen vid tillämpning av korrigeringsregeln i 14 kap. 19 § IL. Med beaktande av OECD:s slutrapport av BEPS Action 13, och Skatteverkets förslag om ett utvidgat dokumentationskrav till följd av denna slutrapport, är syftet även att utreda om de nya föreslagna dokumentationsreglerna kan komma att påverka bevisprövningen. Syftet har huvudsakligen besvarats med hjälp av den rättsdogmatiska metoden. Vad som enligt min mening utgör gällande rätt avseende dels internprissättningsdokumentation, dels bevisprövning, har klarlagts genom att tolka och systematisera de relevanta rättskällorna. Uppsatsen innehåller även en redogörelse för Skatteverkets förslag avseende det utvidgade dokumentationskravet och en jämförelse mellan detta och de nuvarande reglerna. Efter att ha analyserat lagstiftning, förarbeten, rättspraxis och doktrin har följande framkommit. Skatteverket har ensamt bevisbördan för att en felprissättning föreligger. Beviskravet är högre för efterbeskattning och skattetillägg. Internprissättningsdokumentationen har betydelse vid bevisprövningen av huruvida oriktig uppgift föreligger eller inte vid tillämpning av korrigeringsregeln när de uppgifter som lämnats i inkomstdeklarationen ska revideras. Oriktig uppgift föreligger i dagsläget aldrig formellt, dels beroende på att dokumentationskravet är osanktionerat dels beroende på att innebörden av kravet inte är specificerat. Oriktig uppgift kan således endast föreligga materiellt. Om det finns en bra och väl underbyggd dokumentation har Skatteverket svårt att visa att en prissättning materiellt är felaktig, även om den vid en första anblick synes vara det. Är dokumentationen bristfällig finns enligt min mening två aspekter, antingen är det till skattebetalarens fördel eftersom Skatteverket i dessa fall inte har något material att utgå från vid sin bedömning och därav får svårare att uppfylla sin bevisbörda, eller så är det till skattebetalarens nackdel eftersom det kan väcka misstanke om felprissättning hos Skatteverket, varför en revision troligen inleds. De nya dokumentationsreglerna medför enligt min mening ingen förändring av denna slutsats.

Multinational enterprises (MNEs) engage in tax-planning strategies between their related parties that affect their profit and consequently their tax liability. Transfer pricing (TP) legislation addresses these tax planning strategies of MNEs resulting in increased tax revenues. Despite the updated 2006 TP legislation, shifting of profit and taxes is still occurring by MNEs; therefore, the implications of this legislation need to be examined. The purpose of this study was to compare the reporting of profit, before and after change in legislation, as well as to examine the cost of services mediation of the relationship between the status of the legislation and profit reported. The study's theoretical framework was a combination of economic and strategic management theories. This ex-post facto quantitative study addressed two research questions with the first examining the difference in the reporting of operating profit before and after the updated TP legislation. The second assessed how the cost of services mediates the relationship between the status of the TP legislation and the reporting of operating profits. Data collected on a sample of tax returns, representing 32 industry sectors for each of 14 years, from the Internal Revenue Service were used in applying statistical tests for answering these research questions. The results indicated that the updated TP regulations influenced MNEs for reporting greater profit than before the update as well as possibly inconsistent mediation with the proposed mediator of cost of services. These results support having TP legislation since it would increase tax revenues resulting in positive economic and social changes as well as contributing to achieving sustainable development.

aktiviteter som i grunden handlar om att uppnå ekonomiska mål. Internprissättning är ett av dessa. När ett företag växer i storlek uppkommer ofta en diskussion om hur organisationen ska decentraliseras och vem som ska fatta beslut. Vanligt idag är att företagen decentraliseras och fler och fler beslut fattas lokalt. 1967 gjordes en enkätundersökning som innefattade totalt 235 svenska företag varav bland annat alla börsnoterade. Man ville undersöka vad man i svenska företag vill åstadkomma med sin internavräkning. Det finns många olika anledningar till varför ett företag använder internprissättning. Vissa menar att internprissättning hjälper ett företag att koordinera de olika enheterna så att de kan jobba effektivare. Andra författare och forskare går ett steg längre och hävdar att internprissättning är en förutsättning för att uppdelningen i självständiga enheter ska fungera. Vår ambition var att komma fram till hur internprissättningen ser ut i svenska företag idag och att jämföra resultatet med hur det sett ut tidigare. Därför utgick författarna från tidigare forskning; främst Göran Arvidssons publikation från 1972 samt en rapport om internprissättning utgiven av Lantz et al 2002. Även doktorsavhandlingar och uppsatser på kandidat- och magisternivå har använts för att kartlägga tidigare forskning inom ämnet. Syftet med denna uppsats är att undersöka av vilken anledning svenska företag använder internprissättning och vilken prissättningsmetod som förekommer mest frekvent samt att se om detta har förändrats över tiden. För att ge svar på forskningsfrågorna har en enkät skapas för att samla in kvantitativ information. Enkäten skapades genom att använda gratistjänsten MySurvs på Internet där användaren kan göra enkäter och sedan på ett enkelt sätt göra dem tillgängliga för respondenterna. Vi har besvarat vårt syfte som utvecklades ur problemformuleringen. Vi kan konstatera att vår undersökning går i linje med Arvidssons från 1972, fråntaget syftet skatteskäl. En bidragande orsak till detta är lagen om dokumentationsskyldighet som bör ha haft stor inverkan på vårt resultat. activities that basically are about achieving organisational goals. Transfer pricing is one of these. When a company grows in size, it has to decide how to decentralize its organisation and at what level decisions should be made. Over the last decades there has been a trend to decentralize the firms and make more decisions locally. A survey was conducted in 1967 that included 235 Swedish firms, in order to investigate what Swedish companies wanted to accomplish with its transfer pricing system. There are many reasons why firms use transfer pricing. Some authors and researchers in the subject argue that transfer pricing helps a firm to coordinate its divisions in order to make them work more effective. Other researchers imply that transfer pricing is a requisite when decentralizing the organisation. Our ambition was to find out how firms use transfer pricing today and to compare that to the 1970’s. We started out by analysing other researchers’ work, of which Arvidsson’s publication from 1972 and a business report by Lantz from 2002 were most significant. Doctoral-, bachelor- and master theses have also been used in order to gain an understanding of the field. The purpose of this thesis is to investigate why Swedish firms use transfer pricing and which method is most common when setting transfer prices and if this has changed over time. In order to answer the research questions, a survey was conducted to gather quantitative information. It was created using MySurvs, an internet survey provider, where the user can create surveys and easily send them to respondents. We have served our purpose which was created from the research questions. Our investigation is similar to what Arvidsson concluded in 1972, except from the purpose “tax reasons”. This can, at least partly, be explained by the implementation of a new law about transfer pricing documentation. Cost based methods are still the most common method when setting transfer prices.

The aim of the paper is to discuss how the enterprise chooses its optimal location of the affiliate when its exports to the foreign market are subject to a high tariff rate. We want to know whether the enterprise chooses a third country, which is subject to a lower tariff, and sets an affiliate in there. Because the model contains the multinational enterprise, we take the transfer pricing into consideration. Assume that the factory will not be established on the foreign market, we show that the enterprise would like to move the factory to the third country then export to the market. Furthermore, when the headquarter moves to the third country, it will induce the decrease of the tax revenue of the host country. Then, we try to discuss how the governments¡¦ tax policy affects the tax revenue. Assume the enterprise moves its factory to the third country where selects the double taxation. We show that when the government chooses a looser tax policy, then it will have more opportunity to receive more tax revenue.
