Contribuições para uma teoria da discriminação nas relações de trabalho / Contributions to a theory on discrimination in work relationships

O principal objetivo da pesquisa é revelar e examinar os principais elementos encontrados nas condutas discriminatórias nas relações de trabalho, como alicerce de uma teoria da discriminação nas relações de trabalho. A tese extraiu conceitos e princípios antidiscriminatórios mediante a identificação e estudo dos componentes das práticas discriminatórias. As conclusões da investigação foram baseadas no direito antidiscriminatório geral, bem como no direito antidiscriminatório laboral. A pesquisa tem início na busca das origens da expressão discriminação, dentro de seu sentido pejorativo, como tratamento diferenciado ilícito. Posteriormente, faz uma avaliação do significado e do alcance do dever de tratamento igualitário, bem como demonstra a natureza destacada das normas antidiscriminatórias. É procedida a identificação dos componentes de uma prática discriminatória através do exame detalhado de suas principais características. Igualmente são apresentados os mais interessantes conceitos doutrinários, normativos e jurisprudenciais sobre a discriminação laboral, bem como as modalidades discriminatórias mais comuns. Dos componentes apresentados são colhidos alguns princípios antidiscriminatórios laborais envolvidos, tanto materiais como processuais. Por fim, é abordada a complexa e preocupante situação da discriminação praticada contra trabalhadores migrantes, em face de ser uma modalidade que tem vislumbrado crescentes dificuldades no seu combate. Como conclusão da pesquisa, é proposto um conceito de prática discriminatória nas relações do trabalho. / The main objective of the study is to uncover and examine the principal elements found in discriminatory conduct in work relationships, as a foundation of a theory of work relation discrimination. This thesis extracted concepts and antidiscrimination principles by identifying and studying the components of discriminatory practices. The investigations conclusions were based on both general and labor antidiscrimination law. The study begins with a search for the origins of the expression discrimination, in its pejorative sense, as illicit differentiated treatment. Later, it evaluates the meaning and scope of the duty of equal treatment, as well as it demonstrates the outstanding nature of the antidiscrimination norms. Next, in the study, the identification of components of discriminatory practices is done through a detailed examination of their main characteristics. The most interesting, doctrinaire, normative and jurisprudential concepts are presented in the same manner, which are related to work discrimination as well as to the most common discriminatory modalities. Some labor antidiscrimination principles, both material and procedural, result from the concepts here presented. Finally, the complex and preoccupying situation of the discrimination practiced against migrating workers is addressed, in light of the fact that this is a modality of discrimination which has become ever more difficult to combat. As a final conclusion of this study, a concept of discriminatory practice is proposed in work relations.

This study results of an empirical research which analyzes the life trajectories and work of a garbage selectors group in Maceió-Al, nowadays inserted directly in the productive chain of recycling. The objective of this work was to analyze the trash recycling process, as an environmental policy that reorients the production of new materials usinor those dismissable ones, detaching the role of the selectors, their insertion in the productive process, their work relationship and their life conditions. The research involved referring methodological procedures to the bibliographical research, the documentary one and the empirical research, being used the techniques of the participant observation to analysis of the daily one, and of the interview half-structuralized for the reconstruction of their histories of life. The development of the research made in possible for us to understand that the reality of the selecting in Maceió had not been modified. These selectors are the same abandoned of long ago that feed the production chain of the recycles. We conclude that the field work here realized in corroborate, in the theory of Gonçalves, who the perverse cycle is much more observed them the virtuous cycle and, still with more reason, than the anatomical cycle of recycling. In short, the activity of selecting doesn t foresee the social fairness and, therefore, don t foresee the sustainable development. / Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / Este estudo resulta de uma pesquisa empírica que analisa as trajetórias de vida e trabalho de um grupo de catadores de lixo de Maceió-Al, hoje inseridos diretamente na cadeia produtiva da reciclagem, atividade considerada como meio para a preservação ambiental. O objetivo deste trabalho foi analisar o processo de reciclagem de lixo, enquanto política ambiental que reorienta a produção de novos materiais a partir da reutilização dos descartáveis, destacando o papel dos catadores, sua inserção no processo produtivo, suas relações de trabalho e suas condições de vida. A investigação envolveu procedimentos metodológicos concernentes à pesquisa bibliográfica, à documental e à pesquisa empírica, sendo que nela foram utilizadas as técnicas da observação participante para análise do cotidiano, e da entrevista semi-estruturada para a re-construção de suas histórias de vida. O desenvolvimento da investigação possibilitou-nos compreender que a realidade dos catadores de lixo em Maceió não foi alterada. Esses catadores são os mesmos desvalidos de outrora que alimentam a cadeia de produção dos recicláveis. Conclui-se que o trabalho de campo aqui realizado corrobora, à luz da teoria de Gonçalves, que o ciclo perverso é muito mais observado do que o ciclo virtuoso e, ainda com mais razão, que o ciclo atômico da reciclagem. Em suma, a atividade de catação não provê a eqüidade social e, portanto, não provê o Desenvolvimento Sustentável.

Nurse Education and Communities of Practice

No / The processes whereby nurses develop the skills and knowledge required to deliver individualized and holistic care were examined in a 2-year study of nurses in a range of clinical settings and a university department of nursing in England. Members of two research teams of qualified nurses joined various communities of nursing practice as participating members and simultaneously "shadowed" designated nurses. At day's end, shadowers and shadowees reviewed the day's practice in critical incident interviews. The powerful processes of nurse socialization that create a strong core identity of the "good nurse" proved central to understanding the acquisition, use, and protection of nursing skills. Learning to become a nurse was always situated within particular communities of practice. Learning in such contexts, both in clinical and educational settings, entailed not just mastering a range of intellectual concepts but also learning through embodied performances involving engagement and interaction with the community of practice. The following were among the study recommendations: (1) link educational and clinical settings by helping clinical staff understand their collective role in the educational experience; (2) enhance the mentor and assessor functions; and (3) enable, support, and resource time in education for clinicians and time in practice for educators.

This thesis deals with the subjectively perceived problematical relationship between the employees of a day care centre (who are either professional caregivers or teachers) and clients or pupils with severe multiple disabilities. Examining this relationship and other selected problematical situations took place as part of short-term group work project using psychotherapeutic techniques. The group work facilitated a change in the relationship of the day care centre's employees with the clients. The research was conducted with a small group of probands from the Zahrada Integration Centre and from the Zahrádka Elementary School in Prague 3. The following professional methods have been used in the preparation of this thesis: an analysis of the relevant scientific literature, group work with a small group of probands using some elements of psychotherapy, a questionnaire survey, an analysis of records concerning the progression of problematical situations and data analysis of case studies. The findings of this thesis are that group sessions comprising elements of psychotherapy represented a supportive factor in regard to the perception of the problematical relationships of individual probands with their clients. Relation au travail et identité professionnelle dans le monde technique chez France Télécom / Work relationship and professional identity of the technicians at France Télécom / Orange

Cette thèse CIFRE a pour objectif d'étudier les effets d'un changement organisationnel sur la relation qu'entretient le technicien à son travail ainsi que sur les éléments qui sous tendent son identité professionnelle. Cette recherche explore les représentations des techniciens, construites et partagées en fonction du contexte social d'appartenance, ainsi que les différentes stratégies d'adaptation mises en place au niveau du groupe de techniciens.Méthodologie : Des entretiens libres ont été réalisés auprès de 54 techniciens des Unités d'Intervention de Paris, du Pays de Loire et d'Ile-de-France Sud. Les données d'entretiens ont ensuite été analysées à partir de l'Analyse Phénoménologique Interprétative (API ; Smith et al. 1995) et d'analyses de contenu thématiques. Des observations ont également été effectuées sur le terrain en situation d'intervention technique.Résultats : les principaux résultats indiquent une relation au travail basée pour une grande partie de l'échantillon sur une croyance propre aux organisations du travail précédente l'actuelle. Les éléments constitutifs de l'identité professionnelle mettent en valeur le rapport au client, aux collègues, à la technicité ainsi qu'un rapport particulier à la hiérarchie et la direction de l'entreprise. / This thesis aims to study effects of organizational changes on work relationship of technicians and their professional identity. This research explores technicians' representations as built and shared according to the social context, as well as adjustment strategies of groups of technicians. Methodology: interviews with 54 technicians were conducted in Technical Units of Paris, Pays de Loire and Ile-de-France Sud. Data were analyzed with Interpretative Phenomenological Analysis (IPA ; Smith et al. 1995) and thematic analysis. Observations were also conducted in situ during technical interventions Results: Results show that work relationship is based for a large part on belief of previous work organization of the company. As for professional identity, results show an important part for the client, colleagues, technicality and a singular relationship to the hierarchy and the management of company.

Over the past two decades, work relations have changed dramatically. New phenomena like “gig-economy” or “crowd work” not only constitute precarious working conditions but also contradict with our social esteem of work resulting from the social theories of the classical economy of the eighteenth and nineteenth centuries. The central focus of classical economists on building an educated and disciplined workforce provided not only the base for the upcoming industrial society but also resulted in a work-based society where “being employed” became the precondition for social security and social participation. It is the aim of this contribution to show how our positive attitudes towards work, established by the political economic theories of the eighteenth and nineteenth centuries, are jeopardized by the social changes in post-industrialized societies, due to the effects of globalized economies, digitalization and changed industrial relations. This has also far-reaching consequences for managerial theories based on conceptions like meaningful work or discussions about social responsibilities vis-à-vis employees as primary stakeholder groups.

The diploma thesis The quality of supporting relationship and aim directivity as a successful factor in social work was written by Šicnerová Věra, Faculty of Theology of the University of South Bohemia. The supervisor of the thesis is Lhotová Marie, PhDr. Ing. Ph.D. Key words: aim, emotions, client, indirect approach, Rogers, empathy, interaction, communication, conflict, social work, social worker, relationship. The diploma thesis describes the development of a social therapeutic relationship between a client and a social worker which is based on non - evaluating approach of the social worker and in the connection with a suitable follow-up aim. The information about the conditions of a quality relationship which is needed for communication between the client and the social worker in a social therapeutic relationship is included in the thesis. Dangers and inappropriate approaches which can ruin suitable selection and the realization of aim are mentioned too. The thesis defines vocational qualities of social workers which can make the relationship development easier. It also presents attributes of social workers and clients, which can on the contrary disrupt or thwart this development. The diploma thesis illustrates that the relationship between social workers and clients is a determinative factor for a successful definition and realization of the social therapeutic process aim.
