Text in German / Die wirtschaftspolitische Konzeption der Bundesrepublik Deutschland wird seit 1948 als „Soziale Marktwirtschaft“ bezeichnet. Es beruht auf den Prinzipien des Leistungswettbewerbs, geregelt durch staatliche Ordnungen und ergänzt durch einen sozialen Ausgleich. Die „Soziale Marktwirtschaft“ geht dabei einen Mittelweg zwischen einer liberalen laissezfaire Wirtschaftsordnung und einer staatlichen Planwirtschaft. Vorliegende Arbeit untersucht zum ersten Mal im Detail ein Vorläuferdokument der Sozialen Marktwirtschaft, die „Freiburger Denkschrift“ aus dem Jahr 1943. In dieser Nachkriegsordnung, eine Auftragsarbeit der „Bekennenden Kirche“, finden sich alle Grundprinzipien der später eingeführten Sozialen Marktwirtschaft, eingebettet in ein umfangreiches christliches Reformprogramm für den Wiederaufbau Deutschlands. Die Arbeit analysiert den Hintergrund der Verfasser und die Inhalte der Denkschrift. Konkret wird gezeigt, welche Überzeugungen der christlichen Ethik sich in den wirtschaftspolitischen Forderungen der Denkschrift niedergeschlagen haben. Außerdem wird die Denkschrift in den biographischen Kontext der Verfasser und die zeitgeschichtlichen theologischen Zusammenhänge eingeordnet, denn viele Thesen des Dokuments reflektieren Diskussionsprozesse der damaligen Zeit. Zudem kann gezeigt werden, dass in die Freiburger Denkschrift sowohl protestantische wie auch römisch-katholische Elemente Eingang gefunden haben. / Since 1948 the economic system of the Federal Republic of Germany is called “Social Market Economy”. It is based on the principles of competitive markets, ensured by governmental competition policy and supplemented by social insurance and public assistance. The “Social Market Economy” takes a middle road between a liberal laissez-faire economy and a a centrally planned economy. The current study examines for the first time in detail the document that preceded the “Social Market Economy,” the 1943 “Freiburg Memorandum”. In this work, commissioned by the Confessing Church of the Third Reich as a post-war system, all fundamental principles of the later “Social Market Economy” can be found embedded in a comprehensive Christian reform program for the reconstruction of Germany. This dissertation analyzes the background of the authors and the contents of the memorandum. We will show specifically which convictions of Christian ethics were incorporated into the economic-political requests of the document. In addition the memorandum will be connected to the biographical context of the authors and the theological context of their time, as many theses put forward in the document reflect discussions that were in progress at that time. 21世紀是中國的世紀。自1978年改革開放以來,以漸進式的經濟改革政策成功發展出「具有中國特色的市場經濟」型態,使得經濟成長迅速。在2010年時,中國已經領先日本躍升為僅次於美國的世界第二大經濟體,累積雄厚經濟實力的中國,綜合國力迅速從亞洲崛起。隨著經濟力量、綜合國力的提升,中國在國際的地位也水漲船高,影響力日益升高,因此,中國在對各國的經濟外交運作上更具有著力度。 中國對非洲的經濟外交已經長達半個多世紀,從改革開放前的經濟無償援助關係,到改革開放後的雙方合資合作關係,再發展到現階段互利的「新型戰略夥伴」關係,中國以本身的經濟發展進程對非洲展開階段不同的經濟外交內容。 進入21世紀,崛起的中國需要更多的原物料、能源來維持經濟成長,而天然資源豐富、石油天然氣能源相繼被發掘的非洲,正是中國所需,加深中非經濟關係為中國本世紀要務之一,「中非合作論壇〈Forum on China – Africa Cooperation—FOCAC〉」基於這種背景下應運而生,透過論壇對話平台,中非關係在政治、能源和經貿關係上快速發展。同時,中國也認真落實歷屆論壇中對非洲所宣布的各项援助措施,因此,中國在非洲的影響大幅增強,中非關係更趨緊密。 另一方面,由於全球能源稀缺,西方大國也急於涉足非洲,密切的中非關係引來「中國威脅論」及「新殖民主義」的負面評論。“新非洲爭奪戰”在遙遠的非洲悄然掀起,也間接對全球國際關係產生了影響。 / The 21st century is the century of the Chinese. Since the reform in 1978, the progressive economic reform policy has successfully facilitated the development of the “Market economy with Chinese characteristics” model, thereby allowing the economy to achieve rapid growth. In 2010, China became the world’s second largest economy, ahead of Japan and second only to the United States. Having accumulated solid economic strength, China has increased its national strength and has soared in Asia. With this new economic power, combined with the increase in national strength, China’s international influence soared and its influence continues to increase. Therefore, China’s economic diplomacy in different countries has become more intense. China’s economic diplomacy in Africa has been progressed for over half a century. From the Aid for Debt Relief before the reform and opening-up, the joint venture partnership after the reform and opening-up, to the current mutually-benefiting development of the “new strategic partnership” relationship, China has launched economic diplomacy, the content of which has been carried out in different stages in connection with China’s own economic development process. In the 21st century, China has been the rise and is in need of more raw materials and energy to sustain its economic growth while Africa with abundant natural resources and natural gas energy being discovered is exactly what China is after. One of China’s priorities in this century is to deepen its economic relations with Africa. This background has led to the establishment of a platform for open talks: Forum on China-Africa Cooperation-FOCAC has undergone political, energy, and economic and trade relations with rapid development. Meanwhile, China has earnestly implemented the various assistance measures for Africa in the previous FOCAC sessions. Thus, China’s influence has intensified and China-Africa relations have become closer. On the other hand, due to the global energy scarcity, countries in power in the west have anxiously set food in Africa. The close relationship between China and Africa has led to negative comments such as the “China Threat Theory” and “New-colonialism. The “new scramble for Africa” has been quietly set off in Africa with an indirect impact on international relations.

1978年中國大陸實行改革開放政策,造就中共30餘年來高度的經濟增長率,中共在1990年代中期確立社會主義市場經濟的發展體制,結合有中國特色的社會主義和西方的市場經濟體制,時至今日中共仍然在調整社會主義(國家)和市場經濟體制之間的權力關係,中共政府雖然接受市場經濟體制在資源配置的作用,但代表社會主義的中共政府,仍牢牢掌握對整體經濟的宏觀調控能力,但對於中共而言,更加複雜多變的政經環境以及融入世界經貿體系的因素,改變社會主義和市場經濟體制對於資源配置的作用程度。 本論文從1997年亞洲金融危機和2008年國際金融危機的爆發,造成中國大陸經濟發展的困境、提出的應對措施和發展目標的轉變,檢視中共使用宏觀經濟調控政策中,財政政策和貨幣政策的差異。另外在金融危機後,中共又是如何在堅持社會主義(國家)的控制能力,以及提昇市場經濟的作用程度之間,做出適當的調整,以配合宏觀經濟調控政策達成經濟增長、調整結構、促進改革等目標的平衡發展。

The impact of economic liberalisation on the spatial patterns of peasant crop farming in Zambia since 1991 : the case of Chibombo District in central Zambia

This is a comparative study of the spatial patterns of peasant crop farming in Chibombo District between the 1980s and the 1990s. The study lists and discusses the agricultural support system, communication infrastructure and the crop production and patterns of the 1980s within the environment of centralised planning and then compares these to the structures and patterns of the 1990s in an atmosphere of economic liberalisation. This comparison in crop production, cropping patterns, institutional support systems and the communication infrastructure in five sampled farming wards of Chibombo District, leads to the conclusion that there is a marked change in the structures and patterns of the 1990s from those of the 1980s. Thus, in Chibombo District, the state of the communication infrastructure in the 1990s is generally poorer than the communication infrastructure of the 1980s, the agricultural support system of the 1990s is largely privately owned and found in fewer farming areas while the agricultural support system of the 1980s was state controlled and more widely spread, and crop patterns in some farming wards are different in the 1990s from those of the 1980s. In the 1990s, crop production in farming wards with a supportive environment has increased than it was in the 1980s but decreased in those where a conducive environment lacks. In this line, the study makes several recommendations for consideration on how to mitigate the problems that the peasant farmers are facing or how to enhance the positive changes that have occurred in Chibombo District. / Geography / M.A. (Geography)

Gestaltet wurde die gegenwärtige Wettbewerbsordnung im deutschsprachigen Raum massgeblich von den neoliberalen Ökonomen Alfred Müller-Armack, Walter Eucken und Friedrich August von Hayek. Diese Literaturstudie untersucht die Wettbewerbsordnung dieser drei Ökonomen, deckt ihre ethischen Prämissen auf und diskutiert diese aus theologisch-ethischer Sicht. Im ersten Teil wird der vielschichtige Begriff Neoliberalismus sowie der Wettbewerb wirtschaftsgeschichtlich eingeordnet und die ausgewählten Texte einer wissenschaftlichen Textanalyse unterzogen. Tabellarisch und nach Themen geordnet werden die Thesen der Einzeluntersuchungen zusammengefasst. In fünf Themenbereichen zeigen sich signifikante Überschneidungen bei allen drei Ökonomen. Diese ausgewählten fünf Themenbereiche werden im zweiten Teil theologisch-ethisch diskutiert. Damit theologische Ethik und Ökonomie zu einem konstruktiven Austauschverhältnis gelangen können, wird vorgängig die Reichweite und Grenze einer biblisch-theologischen Arbeitsethik diskutiert. Zudem wird die biblische Perspektive zur Arbeit und zum Wettbewerb eruiert. Abschliessend werden der Kirche wie auch der Wirtschaft Impulse zur Gestaltung einer menschenwürdigen Arbeitsethik gegeben. / Competition is one of the distinctive forces of the working world. Amongst German speaking scholars, the current Wettbewerbsordnung (Engl.: order of competition) was shaped to a great extent by the neo-liberal economists Alfred Müller-Armack, Walter Eucken und Friedrich August von Hayek. This literature study examines the Wettbewerbsordnung of these three economists, uncovers their ethical premises and discusses these from a theological ethical point of view. The first section puts both the complex term ‘Neoliberalism’ and competition into an economic historical context. It also contains a scientific analysis of the chosen texts. The theses of the individually examined texts are summarised in tabular form and classified by subject area. In five areas, all three economists present significant overlap. In the second section, these chosen five areas are discussed from a theological ethical perspective. In order to enable a constructive exchange between theological ethics and economics, the analysis of the abovementioned five areas is preceded by a discussion of the scope and limits of a biblical theological work ethic. Further, this Master thesis traces the biblical perspective on work and competition. Le droit de l’Union européenne induit de très importantes transformations du concept d’intérêt général dont notamment les deux suivantes Premièrement, dans le cadre du système juridique de l’Union l’intérêt général se décline désormais à deux niveaux, à savoir celui de l’Union et celui de ses Etats membres. Deuxièmement, le caractère principalement économique de l’Union européenne et de son droit, bien que quelque peu atténué, fait de la conception de l’intérêt général retenue au sein de l’ordre juridique européen une approche ancrée dans une perspective économique d’orientation libérale. Cela entraîne des conséquences significatives quant à l’agencement de la puissance publique et du marché dans les processus de définition ainsi que de mise en oeuvre de l’intérêt général, tant au niveau des Etats membres qu’au niveau de l’Union. Il en va d’ailleurs ainsi pour ce qui est des fonctions de l’intérêt général. L’objet de la présente thèse consiste en l’étude de ces transformations. / The legal concept of general interest is significantly transformed under EU law. The most important transformations consist in the double-level (national and European) development of the concept and in the fact that the primarily economic character of EU law as well as its liberal orientation influence at a great extent the relation between public authority and the market as far as both the definition and the realization of the general interest, as well as its functions, are concerned. The object of the present thesis consists in a study of the aforementioned transformations.

L'évolution du régime de la domanialité publique portuaire face au développement de l'économie de marché / Evolution of harbour state ownership system facing market economy growth

L’intérêt public imprime aux ports une organisation juridique et institutionnelle spéciale. Les installations portuaires doivent fonctionner sans désemparer et aucun usager ne doit en être privé au-delà des restrictions nécessaires à la satisfaction de tous. À ce titre, elles sont traditionnellement soumises au régime de la domanialité publique et les activités qui s’y déroulent à celui du service public. Les deux régimes étant, par leur essence même, exorbitants, leur application simultanée génère une surprotection préjudiciable à la compétitivité des ports.L’objet de cette étude est de démontrer l’inadaptation de la domanialité publique portuaire, tant du point de vue de sa cohérence générale, que de du point de vue de son impact sur le développement des sites portuaires. L’adoption du CGPPP et les réformes postérieures n’ont pas permis de résoudre le problème de l’hypertrophie du domaine public portuaire, pas plus qu’elles n’ont consacré un régime domanial véritablement adapté.L’émergence du régime des conventions de terminal constitue une évolution majeure, mais insuffisante. S’il favorise un certain partage des risques entre autorités portuaires et opérateurs privés, il n’a, malheureusement, pas résolu le problème de la précarité des occupations domaniales. L’insécurité juridique demeure ; ce qui n’encourage pas l’investissement privé.Face aux contraintes du droit de la concurrence et à la généralisation de la libre circulation des biens et des personnes au sein de l’UE, les modalités de gestion des installations portuaires doivent s’adapter aux enjeux modernes de l’économie de marché. / Public interest gives harbours a specific legal and institutional framework. Harbour facilities must work continuously and stay available to every user, according to the limitations required to satisfy everybody. As such, they are traditionally subject to the state ownership system and their related activities are subject to the public service one. Both systems are exorbitant by nature. Applying them simultaneously triggers off an overprotection detrimental to harbours competitivity.This study aims at showing the harbour state ownership system is unsuitable, both in terms of overall consistency and its impact on the harbour site growth. Adoption of the general code ruling the public ownership and posterior reforms did not allow to resolve the harbour state ownership hypertrophy issue, nor did they establish an ownership system truly appropriate.Appearing harbour terminals contracts constitute a major but still insufficient evolution. If they do allow to share risks between harbour authorities and private operators to some extent, unfortunately they did not resolve the ownership activities precarity issue. Legal insecurity remains, which does not stimulate private investment.Against competition law obligations and the free movement of goods and people spreading within the EU, harbour facilities management terms need to adapt to today’s market economy challenges.
