Die reg tot 'n vrye en regverdige verhoor is een van die mees gevestigde internasionale fundamentele regte.1 Die reg om verhoor te word deur 'n onafhanklike en onpartydige hof of tribunaal vorm deel van die reg tot 'n vrye en regverdige verhoor. Beide Suid-Afrika en Groot Brittanje erken hierdie reg as 'n fundamentele reg. Alhoewel dit duidelik is dat hierdie reg afdwingbaar is in die gewone howe van state wat die relevante konvensies geratifiseer het, bly die vraag steeds tot watter mate die reg tot 'n onafhanklike en onpartydige tribunaal toepassing vind in internasionale kommersiele arbitrasie verrigtinge. Verder is die vraag hoe die toepassing daarvan vergelyk met die toepassing van die reg in die gewone howe. Is dit dus moontlik om te se dat dieselfde toets wat in die gewone howe gebruik word om die onpartydigheid en onafhanklikheid van 'n voorsittende beampte te bepaal, ook gebruik word om die onpartydigheid en onafhanklikheid van 'n arbiter te bepaal?
In die nasionale sfeer verwys onafhanklikheid na twee onderskeibare konsepte. Eerstens verwys dit na die onafhanklikheid van die regsprekendegesag met betrekking tot die wetgewende- en uitvoeren-degesag soos vervat in die leerstuk van die skeiding van magte. Tweedens verwys dit na die persoonlike onafhanklikheid van 'n voorsittende beampte. In internasionale kommersiele arbitrasie is slegs die tweede konsep van toepassing. Internasionale kommersiele arbitrasie funksioneer normaalweg onafhanklik van enige regerings-instelling. Slegs die persoonlike onafhanklikheid en onpartydigheid van die arbiter is dus van belang.
Wanneer die toetse, om die persoonlike onpartydigheid en onafhanklikheid van regters en arbiters te bepaal, met mekaar vergelyk word, is daar drie verskillende toetse wat van belang is. Sover dit
menseregte op 'n intemasionale vlak betref, pas die Europese Hof vir Menseregte die geregverdigde twyfel (legitimate doubt) toets toe. Die arbitrasie instellings wat ingesluit is in hierdie verhandeling2 pas die regverdigbare twyfel Qustifiable doubt) toets toe. Op nasionale vlak pas beide Suid-Afrika en Groot Brittanje die redelike vrees van vooroordeel (reasonable apprehension of bias) toets toe.
Die gevolgtrekking word gemaak dat die toetse vir onpartydigheid en onanhanklikheid wat toegepas word in die nasionale howe van Suid-Afrika en Groot Brittanje, die toetse wat op intemasionale vlak toegepas word in die Europese Hof vir Menseregte en die toetse wat toegepas word deur die onafhanklike intemasionale arbitrasie instellings wat in die verhandeling bestudeer is, tot dieselfde resultaat lei. Gevolglik sal arbitrasie verrigtinge wat in Suid-Afrika die toets van onafhanklikheid en onpartydigheid slaag in alle waarskynlikheid ook die toets in Engeland slaag. Globally-asynchronous, Locally-synchronous Wrapper Configurations ForRavi, Akarsh 01 January 2004 (has links)
Globally-Asynchronous, Locally-Synchronous (GALS) design techniques employ the finer points of synchronous and asynchronous design methods to eliminate problems arising due to clock distribution, power dissipation, and large area over head. With the recent rise in the demand for System-on-a-Chip (SoC) designs, global clock distribution and power dissipation due to clock distribution are inevitable. In order to reduce/eliminate the effects of the global clock in synchronous designs and large area overhead in asynchronous designs, an alternative approach would be to utilize GALS design techniques. Not only do GALS designs eliminate the issue of using a global clock, they also have smaller area overhead when compared to purely asynchronous designs. Among the various GALS design approaches proposed till date, this thesis focuses on the working and implementation of Asynchronous Wrapper designs proposed by Muttersbach et al., in [1, 2]. This thesis specifically addresses different approaches to incorporate the wrappers in VLSI circuits, rather than discussing the efficiency and viability of GALS design techniques over purely synchronous or asynchronous approaches. It has been proven by researchers [3] that GALS design approaches bring down power consumption due to the elimination of the global clock by small amounts, but there is also a drop in performance. Since the goal of this thesis is to introduce the reader to GALS design techniques and not prove their efficiency, it is out of the scope of this thesis to validate the results shown in [3]. In our aim to introduce the reader to GALS design techniques, we first provide a comparison of synchronous and asynchronous design approaches, and then discuss the need for GALS design approaches. We will then address issues affecting GALS such as metastability, latency, flow control, and local clock alteration. After familiarizing the reader with the issues affecting GALS, we will then discuss various GALS design techniques proposed till date. We show the use of asynchronous FIFOs and asynchronous wrappers to realize GALS modules. Two wrapper design approaches are discussed: one being the asynchronous wrapper design proposed by Carlsson et al., in [4], and the other being the asynchronous wrapper design proposed in [1, 2]. An in-depth discussion and analysis of the wrapper design approach proposed in [1, 2] is provided based on the state transition graphs (STGs) that characterize the port-controller AFSMs. Various data transfer channel configurations that incorporate the wrapper port-controllers are designed and realized through VHDL codes, with their functioning verified through simulation results. Design examples showing the working of asynchronous wrappers to achieve point-to-point, synchronous-synchronous and synchronous-asynchronous data communication are provided. Finally, a design example to achieve multi-point data communication is realized. This example incorporates a previously proposed idea. We provide a modification to this idea by designing an arbiter that arbitrates between two separate requests coming into a multi-input port. Through the above design examples, the functionality and working of GALS asynchronous wrappers are verified, and recommendations for modifications are made to achieve flexible multi-point data communication.

Explaining the success of Roman freedmen : a pseudo-Darwinian approachSibley, Matthew John 05 September 2014 (has links)
In Roman society, freed slaves were elevated to a citizen-like status, yet they never had the full rights of their free-born counterparts. Despite the inequality of the system, many freedmen appear to have found great success in the realm of business. This report endeavors to reveal why it was that this group prospered within the Roman economy using a pseudo-Darwinian perspective. Scholarship has, for the most part, tended to avoid Darwinian lines of thought in sociological studies but this report shows the power of this type of thinking. The first chapter clarifies the nature of slavery in the Roman world and the wide variety of experiences that slaves could have. Chapter two considers the different ways that slaves could be manumitted and how a freedman’s status could differ depending on the formality of his release from servitude. The third chapter examines the literary representations of freedmen in the genre of comedy and Petronius’ Satyricon. Chapter four turns to the archaeological evidence and provides a sense of how freedmen represented themselves to the wider community. Lastly, the fifth chapter, using a pseudo-Darwinian model, will show that the image of the successful freedman is not an anomaly of the archaeological record or a trope of Latin literature but an inevitable outcome of the intense selection that slaves underwent. / text

Legal Status of the Financial Arbiter in Comparison with Selected Regulatory and Control Institutions in the Czech Republic and EU The topic of my thesis is legal status of the Financial arbiter in the Czech Republic. It represent a specific institution for out-of-court settlement of financial disputes between providers of some financial services and their clients. The Financial arbiter does not substitute the role of courts; instead it operates alongside the judicial system and offers to the clients of financial institutions swift and free of charge alternative to the legal proceedings, which emphasizes reconciliation. In the opening chapter of this thesis I looked into the theoretical concept of this institution and characterized it as an administrative authority sui generis. In order to obtain better understanding of the institutional status of the Financial arbiter, I further compared the Financial arbiter with similar institutions in the Czech Republic and the EU. I consider the separation from the Czech National Bank and the creation of the Financial arbiter bureau, which is a government department, as a major change in the legal status of the Financial arbiter. The objective of the thesis is to design and implement in the VHDL language a simple multiprocessor supporting parallel computing. Furthemore, the author has designed and realized universal transparent generic interconnection layer with the objective to connect any given number of processor cores to shared address space using arbitrated bus. Parametrized cache has been allocated to each core in the layer. MSI protocol was used to deal with the issue of memory coherence of the implemented system. Direct and indirect synchornisation support is available to the user. In order to verify the functionality of the system, simple processor core has been designed and implemented, and its copies were connected to the interconnection layer. Various testing programmes have been used to verify the functionality of the system, which also confirmed that the acceleration of computing has been achieved successfully. Virtex6 chip has been used to test the whole system.

Speech Disorders. The Speaking Subject and Language in Neronian Court LiteratureRudoni, Elia January 2020 (has links)
By combining literary criticism, philology, and contemporary psychoanalysis, this dissertation offers an innovative interpretation of Neronian court literature (Seneca, Lucan, and Petronius). I argue that the works of these three authors thematize and embody a problematic relation between the human subject and language. Language is not conceived or represented as an inert tool that can be easily appropriated by the speaking subject, but rather as a powerful entity that may, and often does, take control of the human subject, directing it from without. Besides analyzing how Seneca, Lucan, and Petronius portray the relation between the human subject and language in the internal plots and characters of their works, I also explore the relation between these three authors themselves and language. My conclusion is that this relation is defined by unresolved ambiguities and neurotic tensions, and I suggest that this might be a consequence of the traumatizing circumstances that the three examined authors endured at Nero’s court.

On Statistical Properties of Arbiter Physical Unclonable FunctionsGajland, Phillip January 2018 (has links)
The growing interest in the Internet of Things (IoT) has led to predictions claiming that by 2020 we can expect to be surrounded by 50 billion Internet connected devices. With more entry points to a network, adversaries can potentially use IoT devices as a stepping stone for attacking other devices connected to the network or the network itself. Information security relies on cryptographic primitives that, in turn, depend on secret keys. Furthermore, the issue of Intellectual property (IP) theft in the field of Integrated circuit (IC) design can be tackled with the help of unique device identifiers. Physical unclonable functions (PUFs) provide a tamper-resilient solution for secure key storage and fingerprinting hardware. PUFs use intrinsic manufacturing differences of ICs to assign unique identities to hardware. Arbiter PUFs utilise the differences in delays of identically designed paths, giving rise to an unpredictable response unique to a given IC. This thesis explores the statistical properties of Boolean functions induced by arbiter PUFs. In particular, this empirical study looks into the distribution of induced functions. The data gathered shows that only 3% of all possible 4-variable functions can be induced by a single 4 stage arbiter PUF. Furthermore, some individual functions are more than 5 times more likely than others. Hence, the distribution is non-uniform. We also evaluate alternate PUF designs, improving the coverage vastly, resulting in one particular implementation inducing all 65,536 4-variable functions. We hypothesise the need for n XORed PUFs to induce all 22n possible n-variable Boolean functions.
