Thesis (MPhil (Political Science))--Stellenbosch University, 2008. / This study undertakes to look at the relationship between peace agreements and the violence that follows these agreements. Throughout modern history, there are examples of peace agreements between two warring internal factions that ended in post-conflict violence and in extreme cases, to the end of the peace agreement. It does not necessarily lead to full out war, but can manifest in riots, like Malaysia and criminal violence in South Africa. This study attempts to compare both South Africa and Malaysia by looking specifically at the reasons for post conflict violence. South Africa has faced a growing problem with violent crime after the negotiations of the early 1990’s and its result, the new constitution of 1993, that functioned as the peace agreement. Malaysia moved through several constitutions to arrive at their constitution of 1957 that which viewed as their constitutional agreement. This constitutional agreement went to great lengths to protect the sons of the soil, the bumiputra. The uneasy peace only lasted until 1969, when race riots followed the general elections and left hundreds dead or injured. By studying South Africa and Malaysia and looking at the underlying factors of violence, with special focus on ethnic factors and especially poverty, can we move closer to the underlying causes of post conflict violence. Malaysia tried to address these problems by making constitutional amendments, following the 1969 riots. These amendments were implemented in 1972. Since then the problem of post conflict violence has been addressed to some extent. There are however, still factors of violence that have not been completely eradicated, that might lead to a flaring of violence again one day. The question that this thesis tries to address in the end is, if we need to consider and implement constitutional amendments, like Malaysia, to address our growing problem of post conflict violence. I attempt here to answer this question, comparing the histories of South Africa and Malaysia and the underlying factors of violence to see exactly how similar these states are and if the same solution can work for both.

The secondary purpose of this dissertation is to demonstrate that the alterations imposed to Social Security by the Constitutional Amendments 20/98 and 41/2003 should respect the acquired rights of insured and servants, who, at the time of edition of said amendments, complied with the requirements necessary for retirement. The justification for the choice of the theme of this work is developed by reason of the serious doctrinaire and jurisprudential dissents on the extent and limits of Constitutional Amendments 20 and 41, the stone clauses, unfolded into acquired right and juridical safety of the public insured and servants. This work investigates, too, the constitutionality of said Constitutional Amendments in accordance with the fundamental principles inserted by the constituent assembly. Constitutional Amendments 20/1998 and 41/2003 modified the security concept itself, redefining untouchable juridical paradigms, such as, for instance, the juridical safety and acquired right statutes. The hypothese raised is the following: the rules that provide on the social security rights and guarantees are social to attain the nuclear problem of this dissertation, one started from analysis of the process of constitutionalization of Constitutional Amendments 20/1998 and 41/2003, in order to check whether such amendments are consistent with the will of the constituent assembly / O objetivo central desta dissertação é investigar a relação entre as Emendas Constitucionais n. 20/1998 e n. 41/2003 e o equilíbrio financeiro e atuarial nos regimes de previdência social. O objetivo secundário é demonstrar que as alterações impostas pelas Emendas Constitucionais n. 20/98 e n. 41/2003 à previdência social deveriam respeitar os direitos adquiridos dos segurados e servidores que, à época da edição das referidas emendas, preenchiam os requisitos necessários para requerer a aposentadoria. A justificativa para a eleição do tema deste trabalho se dá em razão das sérias divergências doutrinárias e jurisprudências acerca do alcance e dos limites da referidas emendas em relação às cláusulas pétreas, desdobradas no direito adquirido e na segurança jurídica dos segurados e servidores públicos. Lança-se a hipótese de que as alterações oriundas das Emendas Constitucionais n. 20/1998 e n. 41/2003 visaram estabelecer o equilíbrio financeiro e atuarial para a previdenciária social, com a mudança no financiamento dos regimes de previdência social. A metodologia adotada seguiu o método dedutivo. A presente dissertação focaliza a utilização do precatório judicial como meio de extinção do crédito tributário. Parte-se da seguinte hipótese: é possível a utilização de precatórios como forma de extinção do crédito tributário? Em quais situações? Para que se possa responder com segurança às indagações acima, são analisadas as modalidades de extinção do crédito tributário previstas no Código Tributário Nacional, especificamente o pagamento e a compensação, apontando-se os seus requisitos essenciais e as limitações impostas pelo ordenamento jurídico para a realização de ambos. Com suporte nessas considerações são fixadas as premissas que servirão para o enfrentamento das teses envolvendo a extinção dos créditos tributários por meio de precatórios. A partir disso, adentra-se ao estudo dos precatórios, desde a sua origem no Direito Constitucional Brasileiro, até o seu atual regramento na Constituição da República. São também estudadas as mudanças empreendidas após a promulgação da Constituição Federal de 1988, com destaque para as Emendas Constitucionais n° 30 de 2000 e 62 de 2009. Isso porque as referidas emendas instituíram, respectivamente, o parcelamento decenal e o regime especial de pagamento de precatórios vencidos, que ensejaram as grandes questões em matéria tributária que são enfrentadas nesta oportunidade, como a utilização de precatórios em compensações ou como garantia da execução fiscal. Ao final do trabalho são expostas as conclusões obtidas. / This dissertation focuses on the Court-Ordered debt payment to settle taxes. Starts with the following hypothesis: it is possible to use a Court-Ordered debt payment for pay a tax debit? In what situations? To respond this questions safely, was studied the conditions for the payment of tax debit, specifically the payment in the tax law and compensation, pointing to their requirements and limitations imposed by law. This rules will used to be set the possibility to pay a tax debit with the judicial order. After this, will be studied the court ordered in the Brazilian Constitutional Law and the changes performed, especially the Constitutional Amendments No. 30 of 2000 and 62 of 2009. That\'s because those amendments introduced like the special parceling for payment the public debt are the focus of the the major questions concerning tax matters that were worked at this opportunity. At the end of this work will be exposed the conclusions.

A teoria do Poder Constituinte Derivado de Equivalência às Emendas Constitucionais busca abarcar por completo o fenômeno jurídico da aprovação de tratados e convenções internacionais sobre direitos humanos como equivalentes às emendas constitucionais, nos termos do §3º do art. 5º da Constituição, inserido pela Emenda Constitucional nº 45/04. Após a descrição crítica do panorama constitucional, doutrinário e jurisprudencial em que foi engendrado este novo dispositivo do art. 5º e o procedimento pelo qual foi aprovada a incorporação da Convenção sobre os Direitos das Pessoas com Deficiência e de seu Protocolo Facultativo como equivalentes às Emendas, seguem as três partes essenciais e imprescindíveis que compõem a abordagem do tema. A primeira está voltada à caracterização da presença de uma nova manifestação de Poder Constituinte, com o objetivo de oferecer soluções coerentes e consistentemente respaldadas em um arcabouço teórico comum para toda a problemática envolvida, que será especificamente examinada a partir das questões enfrentadas na Parte II. The first is directed to describe the presence of a new manifestation of constituent power, with the goal of providing solutions coherent and consistently backed into a theoretical framework common to all the problems involved, which will be examined specifically from the issues faced in Part II. A movement of one's own?: American social movements and constitutional development in the twentieth century / American social movements and constitutional development in the twentieth century

This dissertation examines the interaction between American social movements as they pursue their constitutional rights. The public law literature is dominated by a topdown approach to the study of constitutional politics, frequently focusing on the impact of Supreme Court decision-making. Instead, I explore constitutional politics from the bottom-up, analyzing constraints on social movement organizations as they formulate their constitutional strategies. Social movements must always be keenly aware of the actions of their peers who also seek to exploit the Constitution for their own benefit. My findings indicated that social movements recognize this competitive relationship with other social movements and treat their fellow constitutional claimants accordingly, acting to contest claims unfavorable to their cause, co-opt claims of other groups that have shown promise, and even form coalitions with their peers where an adjustment of their own claims to accommodate their coalition partners will likely net a greater return than going it alone. These negotiated constitutional claims have resulted in significant, durable and often ironic or unexpected shifts in constitutional development. / text

UN, AU and SADC approaches to unconstitutional changes of government : the case of Madagascar

Thesis (MA)--Stellenbosch University, 2012. / Includes bibliography / ENGLISH ABSTRACT: The resurgence of unconstitutional changes of government in Africa is regarded not only as a threat to democratisation processes but also to peace, security and stability on the continent. The United Nations (UN), the African Union (AU) and various regional economic communities (RECs) have all sought to address this challenge, in what may be described as a trilateral linkage between the international, regional and sub-regional organisations. The unconstitutional change of government in Madagascar in 2009 led to the involvement of the UN, AU and the Southern African Development Community (SADC). Although these organisations all responded to the case of Madagascar, it cannot be assumed that they all share a common understanding of and approach to unconstitutional changes of government. This study builds upon a constructivist approach to norm development, with a particular focus upon the norm life cycle. The thesis seeks to assess if a normative approach to dealing with unconstitutional changes of government has developed within the UN, AU and SADC respectively, and if so, how? Furthermore, how have these organisations responded to such a case, with a specific focus on Madagascar? Building upon these findings, the thesis aims to assess if and how a norm condemning unconstitutional changes of government has emerged, spread and become internalised within the UN, AU and SADC. The study illustrates that the norm condemning unconstitutional changes of government is particularly salient within the AU. Furthermore, and unlike many other peace and security norms, the norm condemning unconstitutional changes of government seems to have emerged from the level of the AU and impacts upwards on the UN as well as downwards on SADC. These findings imply that the AU will have a prominent role in informing the approach and response to such cases on the African continent in the future. Furthermore, the normative frameworks of the UN and SADC may be developed largely as a result of and on the basis of the principles and policies of the AU. / AFRIKAANSE OPSOMMING: Die herlewing van ongrondwetlike regeringsverandering in Afrika word nie net as 'n bedreiging vir die demokratiseringsprosesse beskou nie, maar ook vir vrede, veiligheid en stabiliteit op die kontinent. Die Verenigde Nasies (VN), die Afrika-Unie (AU) en verskeie streeks-ekonomiese gemeenskappe (REC's) het gepoog om hierdie uitdaging, wat beskryf kan word as ‘n driehoekskakeling tussen die internasionale, streeks- en substreek-organisasies, aan te spreek. Die ongrondwetlike regeringsverandering in Madagaskar in 2009 het gelei tot die betrokkenheid van die VN, AU en die Suider-Afrikaanse Ontwikkelings gemeenskap (SAOG).
