Magister Legum - LLM / The main purpose of this paper was to explore the role economic partnership agreements play in regional integration. The whole paper was premised on identifying the nature of economic partnership agreements that is conceived as a free trade arrangement. Therefore the paper discussed the feasibility of the reciprocal principle between the European Union and ACP countries, and further indicated that there is no need to implement the principle of reciprocity at present. The paper also discovered that, due to the fact that unequal trade relations between the EU and the ACP countries still exist, the implementation of the EPAs is most likely to generate the complementary but non-competitive trade relations between the EU and the ACP countries. Such a situation could result in the ACP countries over-independence on the EU's market. ACP countries are not expecting to such integration. In addition the paper ascertains that the EPAs themselves could contain the intrinsic negative impacts such as discrimination against the third countries on regional integration. / South Africa

A new era for the eu-sadc trade relationship: a critical analysis of the EU-SADC EPA and the impact on regional integration in SADC and South Africa’s role in the negotiations

Magister Legum - LLM / The EPA’s will have an impact on regional integration in Africa, especially in the SADC region. The region has been split between the SADC and ESA EPA configuration therefore impacting on regional integration objectives set out under the SADC Trade Protocol.The EPA’s will be concluded separately with six of the sub groupings under the ACP grouping. With the EU-SADC EPA negotiations has come a problem of overlapping of membership of the different regions which has created confusion and conflicts. Members of Southern African Development Cooperation (SADC) did not all enter into the EU-SADC EPA has one. The EU-SADC EPA configuration consists of Angola, Botswana, Lesotho, Mozambique, Namibia, South Africa, Swaziland and Tanzania. The rest of the SADC member states are negotiating with the EU-ESA configuration. With South Africa having been allowed into the negotiations, its role should be examined and what it can contribute to the negotiations. Another conflict that has been created is the fact that South Africa has its own bilateral agreement with the EU thus putting stain on the trade relationship between South African and the rest of the SADC countries.

L’action extérieure de l’Union européenne en matière de droits de l’homme est singulièrement conduite vers l’Afrique subsaharienne, qui bénéficie d’une position particulière. Il s’agit ici d’analyser les droits de l’homme dans les relations entre l’Union européenne et les États de l’Afrique subsaharienne sous l’angle de la recherche constante de l’équilibre. Il s’agit alors de déterminer si les droits de l’homme sont un facteur de progrès dans ces relations, d’un point de vue internationaliste. Par une méthode critique et pragmatique, la recherche a permis de dégager une définition instrumentale des droits de l’homme et d’examiner les différentes formes d’ingénierie juridique dans ces relations. Dans un premier temps, la thèse met en évidence la spécificité de l’intégration des droits de l’homme, c’est-à-dire le processus de création des droits de l’homme qui est dominé par les institutions européennes, et les instruments de promotion et de protection de ces droits qui s’inspirent du droit de l’Union. Le processus juridique de production et le produit des droits de l’homme dans ces relations pose la question de la cohérence des différentes politiques de l’Union en matière de coopération au développement. Dans un second temps, la recherche se penche sur le degré de réalisation des règles de droit dans les faits, par le seuil d’effectivité et d’ineffectivité. Cette appréciation permet de s’interroger sur les incidences et les causes de l’effectivité et de l’ineffectivité des droits de l’homme dans les relations entre l’Union européenne et les États de l’Afrique subsaharienne. Il en ressort une pratique mitigée du mécanisme de garantie de ces droits au regard d’une application à géométrie variable de ce régime juridique et de la permanence des enjeux extra-juridiques. Des interventions tierces dans ces relations d’organisations internationales (ONU, UA) ou d’États (Chine) tentent de compléter ou de réexaminer la conditionnalité de la coopération au développement au respect des droits de l’homme / The European Union’s external action as far as human rights are concerned is specially geared toward sub-Saharan Africa, which benefits of a particular position. The purpose here is to analyze human rights in relations between the European Union and the sub-Saharan African states in terms of a search of a constant equilibrium. It is actually a matter of determining whether human rights are a factor of progress in these relations from an internationalist point of view. Through a critical and pragmatic approach, the research allowed to deliver an instrumental definition of human rights and examine the different forms of legal work in these relations. First the thesis will highlight the specificity of the integration of human rights, the creative process of human rights that is dominated by the institutions of the European Union and the instruments of promotion and protection of these laws, which are inspired by the law of the Union. The legal process of production and the product of human rights in these relations raise the question of the consistency of the various policies of the European Union in matters of development cooperation. Second, the research looks at the degree of realization of the rules of law in effects through a threshold of effectiveness and ineffectiveness. This assessment will raise the question of the incidences and the causes of effectiveness and ineffectiveness of human rights in the relations between the European Union and the sub-Saharan African states. It appears a moderate practice from the guarnanteeing mechanism of these laws, albeit through an application that varies from country to country of this legal system and of the permanence of extra legal issues. Third-party interventions in these international organizations relations (UN, AU) or of States (China) try to complete or reconsider the conditionality of the development cooperation for human rights

L’appropriation des technologies de l’information et de la communication dans le processus d’autonomisation des jeunes femmes d’Afrique de l’Ouest

Tableau d’honneur de la Faculté des études supérieures et postdoctorales, 2014-2015 / Les femmes ont globalement un tiers de chance en moins que les hommes de bénéficier des avantages de la société de l’information en Afrique de l’Ouest francophone. Pourtant, plusieurs travaux montrent que les progrès réalisés dans les domaines des technologies de l’information et de la communication (TIC) pavent la voie à une plus grande contribution des Africaines, particulièrement pour celles âgées de 18 à 35 ans, aux sphères politiques, économiques et sociales (PNUD, 2012). Notre projet a consisté à étudier les modalités d’appropriation des TIC de jeunes professionnelles de cette tranche d’âge issues de cette région du monde, regroupées au sein de coopératives et utilisant les outils technologiques dans leurs activités quotidiennes. S’appuyant sur 16 entretiens individuels semi-dirigés menés à Cotonou au Bénin de juin à août 2013, les résultats de notre recherche révèlent que les jeunes femmes interrogées se servent des TIC de multiples façons et que les usages développés favorisent leur autonomisation. Si l’appropriation de ces outils leur donne des moyens efficaces d’améliorer leurs conditions de vie, elle ne permet toutefois pas nécessairement de transformer une structure sociale qui les désavantage traditionnellement.

The Economic partnership agreements and Market Power Europe : a case study of the African, Caribbean and Pacific States

There are many ways in which to define the relationship between the European Union (EU) and the African, Caribbean and Pacific (ACP) countries. Using Holsti‟s definitions of role theory, this study distinguishes between the ego (the EU) and the alter (the ACP countries), referring to the differing perceptions that each has regarding the same issue: the Economic Partnership Agreements (EPAs). It is argued that the EU carries out its external policies vis-à-vis the ACP countries, and in particular with the EPAs, in a manner that is perceived very differently by the two parties. The EU perceives its behaviour as that of Normative Power Europe (NPE) whereby actions are identified as altruistic and determined by a number of norms that form the core of the EU. Alternatively, it is suggested that in contrast to NPE, the ACP countries, with specific reference to southern Africa, experience and perceive quite a different version of the EU which is determined by Market Power Europe (MPE). MPE highlights a tangible and self-interested Europe not concerned entirely with altruistic intentions but rather the interests of its Single Market. Les intermédiaires en développement en Afrique subsaharienne : analyse comparative de Cotonou et de Lomé

La présente thèse porte sur les acteurs au sein des organisations non gouvernementales locales (ONG) qui, dans la configuration actuelle de l’aide internationale au développement, jouent un rôle de relais ou d’intermédiaires entre donateurs internationaux et populations bénéficiaires en Afrique subsaharienne. En analysant les trajectoires professionnelles de 32 femmes et hommes « leaders » dans des ONG de Cotonou (Bénin) et de Lomé (Togo), la thèse se propose d’appréhender les processus sociaux à travers lesquels ces individus deviennent intermédiaires dans les activités de développement. La recherche s’inscrit dans une approche théorique construite à la rencontre entre la perspective orientée vers l’acteur en socioanthropologie du développement, la sociologie de l’individuation et le paradigme des parcours de vie. La thèse prend également une posture comparative en contrastant, d’une part, les trajectoires professionnelles des intermédiaires du Bénin et du Togo, deux pays ayant connu entre les années 1990 et début 2000 des « destinées » opposées en ce qui a trait à leurs rapports avec les bailleurs de fonds étrangers. D’autre part, l’analyse compare deux générations d’intermédiaires et contraste l’expérience des intermédiaires féminins et masculins. L’analyse montre qu’en premier lieu, les conférences nationales en 1990 au Bénin et en 1991 au Togo ont constitué un tournant important dans les trajectoires professionnelles des intermédiaires dans les deux pays, créant subséquemment, d’un côté, un contexte favorable aux intermédiaires du Bénin, et de l’autre, un environnement délétère pour ceux du Togo. Toutefois, au cours des dix dernières années, ces différences de conditions de travail se sont beaucoup atténuées et les défis relevés par les intermédiaires dans les deux pays sont à nouveau similaires; les contextes actuels sont caractérisés par un soutien étatique au minima, un champ d’activités très concurrentiel et politisé, une professionnalisation du champ, et une forte dépendance vis-à-vis des bailleurs de fonds extérieurs. En second lieu, l’analyse des récits de vie a permis de ressortir quatre types de profils des intermédiaires au moment où ils intègrent le champ des ONG : les « reconvertis », les « nouveaux diplômés des années 1990 », les « carriéristes », et les « activistes ». La comparaison générationnelle suggère en outre que les deux premiers types décrivent mieux les intermédiaires ayant commencé leurs activités avant les années 2000, alors que les « carriéristes » sont pour l’essentiel des intermédiaires de la jeune génération qui intègre le domaine de l’intermédiation après 2000. Aussi, la recherche montre que pour entrer, mais surtout « durer », dans le champ des ONG ces individus utilisent divers réseaux politiques et associatifs et savent « manœuvrer », notamment en choisissant une « thématique porteuse », en veillant à maintenir une constante « visibilité » ou en ayant recours à des formations continues pour acquérir ou consolider des compétences recherchées par les bailleurs de fonds. Par ailleurs, l’analyse des trajectoires professionnelles féminines a révélé qu’alors que le poids des responsabilités familiales a fait que les « pionnières » de l’intermédiation sont entrées de façon tardive dans une profession dominée par les hommes, et se sont toutes focalisées sur des thématiques liées directement aux droits des femmes, les parcours de leurs cadettes sont bien différents. Ces dernières ne travaillent pas dans le traditionnel domaine du « genre », et même si elles reconnaissent aussi leurs difficultés à concilier responsabilités professionnelles et devoir familial, elles ne sont pas prêtes à mettre de côté leur carrière et ont une perception très différente de leurs aînées des rôles genrés au sein de la famille. / This dissertation focuses on individuals in local non-governmental organizations (NGOs) who, in the current configuration of international development, act as relays or intermediaries between international donors and recipient populations in sub-Saharan Africa. By analyzing the careers of 32 female and male "leaders" in NGOs in Cotonou (Benin) and Lomé (Togo), the dissertation aims to understand the social processes through which these individuals become intermediaries in the development arena. The research mobilizes a theoretical approach that combines the actor-oriented perspective in socio-anthropology of development, the sociology of individuation and the life course paradigm. This thesis also takes a comparative approach, first, by contrasting the careers of development intermediaries from Benin with those from Togo, two countries that experienced in the 1990s and early 2000s opposite fates in terms of their relations with international donors. Also, the analysis compares two generations of intermediaries and contrast the experiences of male and female intermediaries. The analysis shows that, first, the Benin National conference of 1990 and the one in Togo in 1991 were turning points in the careers of intermediaries in both countries, by creating a supportive working environment for intermediaries in Benin, and, on the opposite, a deleterious context for those in Togo. However, over the past decade, these differences in working conditions have dwindled, and the challenges faced by intermediaries in both countries are once again similar; the current contexts are characterized by a limited state support, a very competitive and politicized working environment, a professionalization of the field, and a strong dependence toward external donors. Second, four types of intermediaries’ profiles at the time they enter the NGO sector emerged from the life history analysis: the "converted", the "new graduates of the 1990s," the "careerists" and the "activists". Generational comparison shows that the first two types best describe the intermediaries that started their activities before 2000, while "careerists" are mostly intermediaries from the younger post-2000 generation. The research also shows that in order to enter, and more importantly to "last", in the NGO sector these individuals use various political and associative networks and develop various strategies such as choosing a “fashionable” field of interest, remaining “visible”, and constantly seeking trainings in order to acquire “marketable” expertise. In addition, the analysis of women's professional trajectories revealed that while “pioneers” female intermediaries entered the male dominated NGO sector late in their life due to their familial obligations and all worked in the area of women's rights, the experience of their younger counterparts are quite different. The latter work outside the traditional “gender” arena; and, although they also have difficulties reconciling work and family duties, they are not ready to give up their career, and they have very different perceptions of gender roles within the family than their older counterparts.
