The diploma thesis depicts the mode and course of collectivization of the rural areas in the district of Kutná Hora in years 1948-1960. It is based on the analysis of five villages - Bahno, Opatovice I, Petrovice I, Mitrov a Vranice (the little town of Kácov is also included for comparison reasons). The thesis describes how the unified binding principles of the state- controlled agricultural politics of KSČ reflected into the socialization of concrete villages and how they influenced the daily life and destinies of their inhabitants. The thesis also concentrates on the individual reactions towards the collectivization, especially those of local functionaries, focusing on which means and strategies these used against the ruling power. The central question is whether, and to what extent, the functionaries could influence and shape the village life and how they influenced the local form of socialization. The objective of this thesis is to show a more vivid picture of the agricultural collectivization and, at the same time, to offer a certain typology of its participants. Apart from the comparison of the mode of collectivization in concrete villages, their example also shows the differences between the first and second (final) phase of the collectivization of the rural areas. Kolektivizace ve Středočeském kraji / Collectivization in the Central Bohemian Region

This thesis focuses on the collectivization of Czechoslovakian countryside from 1949-1960. The current knowledge of agricultural policy of the Communist Party of Czechoslovakia has been extended with the findings from a former Prague Region, present-day Central-bohemian Region. The first part consists of the analysis of the term collectivization in the international context, where a particular attention is paid to the process of collectivization in the Soviet Union. The author follows two main lines of the collectivization in the Czech environment. The former is the establishment of collective farms which formed the main pillar of the countryside socialization, the latter concentrates on the persecution of those who resisted the socialization, i.e. private landowners, known as kulaks. Part of the thesis deals with the agitation which accompanied the creation and running of the collective farms. Last but not least, the thesis includes the reflection of the fight against the kulaks on the pages of the then agricultural press - regional as well as nationwide.

Anotation The thesis concentrates on a description of the action Kulak, focusing on the region Louny with an explanation of the general trends of the collectivization of agriculture. The goal of this work is to show different problems of the action Kulak by thorough analysis of whole course of events. These problems appeared as far as in final period between 1949-1953. Last chapter sketches the diversity of forced resettlement with describing life stories of the individual farmers. The work is micro-probe in proces of forcible resettlement of farmer's families from year 1951 to 1953. The thesis covers historical circumstances of the action Kulak and gains primarily from archive files.

1 Abstract The subject of this work is to monitor a certain section changes the rule of law, regulating the organization and functioning of agriculture in the transition from one mode to another mode and period of stabilization. The work deals with the normative regulation of the Czechoslovak and Czech agriculture in the period of collectivized application form and the second part of the transition period in Czechoslovak and Czech agriculture on the market form. Collectivization and the actual development of the Czechoslovak socialized agriculture is defined as the years 1949-1990, transformation, or rather de- collectivization and the further development of the market, first Czechoslovak and later Czech agriculture, is dated from 1990 almost until today, and this work deals with the investigation of the legislation referred to by 2004, until the accession of the Czech Republic into the European Union. Since 2004 legislation has already ceased to be exclusively a matter of the state and must be adapted to European Union law, as well as the functioning of the market economic conditions of agriculture are modified implementation of the Common Agricultural Policy of the European Union. Perspectivas da tutela jurisdicional dos interesses metaindividuais trabalhistas no Tocantins

O presente estudo tem como objeto as demandas distribuídas para as Varas do Trabalho do Tocantins no ano de 2016, com o enfoque diagnóstico da tutela jurisdicional dos interesses metaindividuais trabalhistas nesse Estado. Nortearam a pesquisa os objetivos de categorizar tais demandas, sabendo quais e quantos são os processos de jurisdição coletiva, analisar o quantitativo de processos coletivos em cotejo com o número total de demandas, e verificar, nas Varas Trabalhistas do interior, quais as lides individuais apresentam potencialidade coletiva. A pesquisa qualiquantitativa descritiva foi orientada pelo método dedutivo e consistiu num estudo de caso, com fundamentação teórica baseada em incursões do materialismo histórico. A investigação permitiu identificar uma preponderância absoluta de processos individuais, em detrimento da coletivização processual. Foi possível constatar um maior número de demandas coletivas nas Varas da capital em comparação com as unidades judiciárias do interior do Estado, bem como, em tais unidades, a existência de um grande percentual de demandas individuais que, pela similitude de objetos e identidade de réus, poderia ter sido objeto de uma demanda coletiva. Também foi possível atestar a ocorrência de um fenômeno de geração de demandas individuais, a partir de sentenças coletivas das Varas Trabalhistas de Palmas, aumentando o quantitativo processual dessas unidades. Concluiu-se que o percentual de demandas coletivas, por si só, não permite aferir a efetividade da tutela jurisdicional dos interesses metaindividuais trabalhistas, diante do expressivo número de processos individuais decorrentes de decisões proferidas em demandas coletivas, sendo percebida a impossibilidade de adequado cumprimento da meta estabelecida pelo CNJ para a priorização das ações coletivas, dada a ausência de correto enquadramento das demandas de natureza coletiva, tendo sido averiguado que diversas ações, embora tenham tramitado como individuais, tinham por objeto a tutela de interesses difusos, coletivos e/ou individuais homogêneos. / The object of the present study are the demands distributed to the Labor Courts in Tocantins in 2016, with diagnostic focus of the judicial protection of metaindividual labor interests in this State. The purpose of the study was to categorize these demands, knowing what and how many are the processes of collective jurisdiction, analyzing the quantitative of collective processes in comparison with the total number of demands, and verifying, in the Internal Labor Courts, which individual cases present collective potentiality. Qualitative-quantitative descriptive research was guided by deductive method and consisted of a case study, with a theoretical basis based on incursions of historical materialism. The investigation allowed to identify an absolute preponderance of individual processes, to the detriment of procedural collectivization. It was possible to verify a greater number of collective demands in Courts at State’s capital in comparison to judicial units located at inland, as well as, in such units, the existence of a large percentage of individual demands that, due to the similarity of objects and identity of defendants, could constituent a class action suit. It was also possible to attest to the occurrence of a phenomenon of generation of individual demands, based on collective judgments of Labor Courts at Palmas, increasing the procedural quantitative of these Courts. It was concluded that the percentage of collective demands, by itself, does not allow to assess the effectiveness of judicial protection of metaindividual labor interests, considering the expressive number of individual cases resulting from decisions rendered in collective demands, being perceived the impossibility to properly comply the goals established by CNJ for the prioritization of collective actions, in view of the absence of correct framing of collective nature demands, and it was ascertained that several actions, although they proceeded as individuals, had as their objects the protection of diffuse, collective and/or individual homogeneous interests.

Trata-se o presente de estudo analítico e propositivo que circunda em torno do tema do controle jurisdicional de políticas públicas, com destacado vigor no que toca às prestações e ações de saúde a cargo do Poder Público. Analisando o fenômeno da assunção do Judiciário como arena de debate político e atribuição de direitos, ver-se-á que há virtudes e vicissitudes nesse que é caminho irreversível da sociedade moderna. No campo da intervenção judicial na saúde, serão demonstrados os grandes transtornos gerados por uma atividade pouco cautelosa e ainda predominantemente fundada nas premissas processuais do Século XIX, o que gera um desarranjo de contas e estratégias e deflagra uma clara crise entre os Poderes instituídos. Ademais, do modo como sucede hoje, a intervenção judicial em políticas de saúde acaba privilegiando poucos à custa de muitos, quando a saúde é taxativamente direito que deve ser atribuído pelo Estado de maneira isonômica e universal. A partir do diagnóstico das patologias causadas pela desmedida intervenção judicial na saúde, realizada a partir de pesquisa empírica e revisão bibliográfica, esta tese estabelecerá limites que deverão ser observados pelo magistrado, verdadeiras fronteiras que, caso ultrapassadas, agravarão e perpetuarão o problema. Ato contínuo, serão propostas medidas que se prestam a tornar o exercício da judicatura nessa seara mais harmônico com a própria gênese do direito à saúde. A ideia, assim, é auxiliar magistrados e operadores a tornar a tarefa de sindicar ações e prestações estatais de saúde mais racional, equilibrada, justa e universal, mediante propositura de limites e adoção de instrumentos apropriados, processuais e não processuais. / This work derives from a research upon Brazilian judicial intervention in public policies, focusing in how this intervention works regarding the constitutional duty, drove to the State, of providing health to people. Analyzing the political phenomena of Judiciary as one of the most relevant public discussions arena, this thesis will show that virtues and inconveniences arise from this Brazilian modern society reality. Considering judicial intervention upon public health, the work will explore the great problems issued by a less cautious activity founded in relevant part on classic procedural premises of the 19th Century, which causes public accountancy disruption and overwhelms administrative strategies, generating a clear crisis amid instituted Powers. Moreover, as it flows nowadays, judicial intervention upon health public politics privileges few against interests of many, as health is a right of everyone and as indeclinable duty of State under the expression rule of Brazilian Constitution. After diagnose the pathologies caused by immeasurable judicial intervention upon public health, featured both by empirical research and bibliographic revision, this thesis will establish boundaries that might be observed by judges when accomplishing their honorable task, limits that, once overtook, make the problem worst and permanent. Afterwards, some measures will be proposed in order to turn judicial activity in this specific field more harmonic with proper nature of right to health. Hence, the main idea is to help judges and other agents to turn the judicial task of intervention in public health more rational, balanced, fair and universal by proposing limits and adopting appropriated procedural and no procedural instruments.

Colectividades agrarias en la región de Girona, 1936-1939

En el contexto de la revolución y la Guerra civil española se desarrolló en las comarcas de Girona un proceso colectivista agrario protagonizado principalmente por jornaleros, payeses sin tierra suficiente (en propiedad o arrendada) para vivir de ella y algunos pequeños y medianos propietarios o arrendatarios. La colectivización agraria en la región, cobijada bajo las siglas de la Confederación Nacional del Trabajo (CNT), afecto principalmente a las grandes fincas o mansos y, en función de factores locales, económicos, sociales y políticos, tuvo una tipología diferenciada y un desarrollo desigual. Los sucesos de mayo de 1937 marcaron el punto de inflexión de la acción colectivista y desencadenaron su progresiva decadencia. Claramente minoritaria frente al reparto de la tierra y la explotación familar de la misma, la opción colectivista, básicamente voluntaria, aunque fracasó como alternativa al modelo de producción y distribución capitalista, intentó establecer unas relaciones sociales basadas en la igualdad económica y en la libertad individual, y fue el referente claro del proceso revolucionario en el campo. FASES: -Julio-octubre 1936: incautación de los medios de producción agraria y constitución de las colectividades. -octubre 1936-abril 1937:participación gubernamental de la CNT, paulatina recomposición del estado y progresivo aislamiento de las colectividades. -Mayo 1937 en adelante fase de decadencia caracterIzada por el ataque legal y político contra las colectividades. -En las comarcas de L'Alt Emporda, el Baix Emporda, La Garrotxa, el Gironès y la Selva (región de Girona) no hubo ningún ataque armado explicito contra las colectividades agrarias.

This thesis focuses on the plans of the Regional National Committee in České Budějovice regarding planning for agriculture in the South Bohemian Region between the years 1949 and 1958. It was the collection named Krajský národní výbor České Budějovice 1949 - 1958, stored in the State Regional Archive in Třeboň, which set the title and time frame for the presented thesis. The circumstances that led to violent collectivization and to establishing of collective farms after the communist takeover in 1949 are no less important. This is why the thesis covers also some events of the Second World War and after it. Violent collectivization fundamentally affected the existing way of farming, caused enormous material damage, destroyed the relationship between farmers and soil that had been built for centuries, eliminated peasantry and fatally affected many human lives. The thesis is based not only on archival materials but also on academic literature concerning farming and political situation. The aim of the thesis is to outline the contemporary idea of planning for agriculture in this agricultural region held by regional representation, the vision for regional development and also to attempt to confront it with contemporary reality. The thesis is divided into five chapters. The most important one is the last one which contains the plans and results of agriculture in South Bohemia during the examined period.

The aim of this thesis is to analyze the impact of agricultural policies applied in Czechoslovakia in the structure of agricultural land use and economic Fund from 1945 to 1959, with particular emphasis on selected areas around Vlasim. Attention is paid to the consequences of a national agricultural policy on agriculture. This thesis also shows the influence of the Communist Party, the circumstances leading to its rise to power, explains specific steps and their impacts. By the time the policy framework was set Vlasim, agricultural and economic situation in the region. The local situation is clearly illustrated by several case studies processed, of which the first, very clearly shows the complete process and the impact of changes in agricultural policy Vlasim since 1945.
