Mission to the Gentiles in Luke-Acts as fulfilling God's promise to Israel: A critical reading of the Apostolic Decree of the Jerusalem Council in Acts 15:1-29Min, Guofang January 2018 (has links)

Stegman / The overall narrative in the Acts of the Apostles displays a noticeable dual-emphasis of the author: emphasis on the mission to the Gentiles despite the obstructions of the Jews and emphasis on the Jewish roots of the Gentile mission, which results in an ambivalent attitude toward the Jews and Judaism. These seemingly contradictory emphases easily push careless readers to an unbalanced interpretation and reading of Acts, and the Holocaust is the ultimate horrible consequence of the anti-Semitic interpretation of Acts. This thesis argues that the two emphases, rather than being contradictory, are mutually intertwined: Jewish roots help illuminate the origin and meaning of the mission to the Gentiles, and the mission to the Gentiles fulfills the promise God made to Israel. A good example of this is the Apostolic Letter composed at the Jerusalem Council, which was held to address and solve the problem of the conditions by which the Gentiles could be members of the church (cf. Acts 15:2). In this study, I will place the Apostolic Letter (15:23-29) within a larger theological and narrative framework of Luke-Acts—the fulfillment of God’s promise to Israel— and argue that, as Luke’s rhetorical device, the Decree (15:20, 29; 21:25) not only serves to explain some already existing practices among Jewish and Gentile Christians, but more importantly, serves as a guiding principle for concrete table fellowship between Jewish believers and Gentile believers within a community that calls its believers to be of “one heart and soul” (4:32). / Thesis (STL) — Boston College, 2018. / Submitted to: Boston College. The thesis is focused on changes which have been originating in accounting of comunities since 1. 1. 2010, mainly on the decree No. 410/2009 Coll., implementing certain provisions of the act No. 563/1991 Coll. about accounting, as amended, for some selected entities to replace the existing decree No. 505/2002 Coll. The decree 410/2009 Coll. was analyzed in terms of changes in the financial statements and changes in the guiding chart. In short, the paper deals with act No. 304/2008 Coll. which amends act No. 563/1991 Coll. about accounting. Furthermore, the major changes in the accounting practices of the local authorities since 1. 1. 2010 have been described. In this work a bridge for transmission for the village Račice nad Trotinou has been created according to the accounting standard for certain selected entities No. 702 {--} Opening and closing of books of accounts, which defines the advancement of the accounting entity on 1. 1. 2010. As well as the analysis of the structure and of the development of incomes and costs of the village for the period 2006-2009 have been carried out based on the statement for assessment of the performance of municipal budgets and of voluntary associations of municipalities.

A Case Study of the Civil Rights of Institutionalized Persons Act: Reforming the Arizona Department of Juvenile CorrectionsJanuary 2013 (has links)
abstract: Research examining the long-term impacts of federal interventions under the Civil Rights of Institutionalized Persons Act on correctional institutions has been scant. The result has been a failure to understand the sustainability of reforms aimed at protecting the civil rights of confined persons. This dissertation examined the long-term reforms at the Arizona Department of Juvenile Corrections following a consent decree with the U.S. Department of Justice from 2004 to 2007. Interviews were conducted with current and former ADJC employees, juvenile justice advocates across Arizona, and county court representatives to determine how each of these groups perceived the status of the reforms at the ADJC. The findings of the current dissertation suggest that long-term reforms following consent decrees imposed on correctional institutions are possible. At the ADJC, the methods for securing the reform required that the agency reform its culture, implement a Quality Assurance process, revamp the Investigations and Inspections unit at the agency, and consider the perspectives of external agencies. One of the primary reasons why the department has been committed to making these reforms is because of the perceived loss of legitimacy and resources that would occur if they failed to reform. Such a failure for the agency could have potentially resulted in a closure of the agency. However, the increase in punitive and preventive policies used to enforce the reforms may have negative repercussions on the organizational culture in the long term. Policy implications for future CRIPA consent decrees are outlined, limitations are addressed, and suggestions for future research are made. / Dissertation/Thesis / Ph.D. Criminology and Criminal Justice 2013

In this academic article, the author analyzes the administrative simplification mechanisms implemented in the Law of General Administrative Procedure, 27444, as amended by Legislative Decree 1272, and in the recent Law of Prevention and Elimination of Bureaucratic Barriers, Legislative Decree 1256. Thus, it can be seen that both laws have taken into account the recommendations of the Organisation for Economic Co-operation and Development (OECD) in order to (i) alleviate the burdens imposed on the citizens in the development of administrative procedures, (ii) empower the Office of the President of the Council of Ministers in order to implement administrative simplification measures and to monitor compliance by entities, and (iii) eliminate bureaucratic barriers in our legal framework. / En el presente artículo, la autora analiza los mecanismos de simplificación administrativa implementados en la Ley del Procedimiento Administrativo General, Ley 27444, modificada por el Decreto Legislativo 1272, y en la reciente Ley de Prevención y Eliminación de Barreras Burocráticas, Decreto Legislativo 1256. Así, se podrá evidenciar que ambas normas han tomado en consideración las recomendaciones de la Organización para la Cooperación y el Desarrollo Económicos (OCDE) para (i) alivianar las cargas impuestas a los administrados en el desarrollo de los procedimientos administrativos, (ii) empoderar a la Presidencia del Consejo de Ministros para que implemente medidas adicionales de simplificación administrativa y supervise el cumplimiento por parte de las entidades, y (iii) eliminar las barreras burocráticas en nuestro ordenamiento.

Résumé The outrageous crimes committed by the Nazis and their treacherous accomplices in Czechoslovakia demanded strict justice. These were the first words of the Decree No. 16/1945 concerning the punishment of Nazi criminals, traitors and their accomplices and concerning the Extraordinary People's Courts (so called the Great Decree). This decree was used to punish Nazi criminals, traitors and their accomplices who stood trial before the Extraordinary People's Courts. The biggest extraordinary people's court resided in Prague, it carried out its activity from 5th September 1945 to 4th July 1947 and it had to deal with eleven thousand cases. During its existence this court had to solve a lot of issues: such as missing professional judges and public prosecutors, problematic cooperation with the District National Committees, and finally the interpretation of problematic provisions. A lot of important Nazis had to stand trial before this court, such as the prosecutor of the Special court Kurt Blaschtowitschka, the politician of the First Republic and the Minister of State for Bohemia and Moravia Karl Hermann Frank, the Deputy Protector of Bohemia and Moravia Kurt Daluege, the gestapo leader in Kladno Harald Wiesmann with another fifteen gestapo members and at last the parachutist and later paid confident, the...

O estudo trata dos termos de compromisso, mecanismo de solução consensual aos processos administrativos sancionadores cuja utilização foi facultada à Comissão de Valores Mobiliários por inserção de norma legal específica na Lei 6.385/76, em 1997. A parte inicial trata da natureza dessa ferramenta, relata os argumentos favoráveis e contrários à sua utilização no âmbito do mercado de valores mobiliários brasileiro; analisa a disciplina e as balizas legais aplicáveis, com referência ao processo legislativo e ao contexto regulatório em que foi criado; bem como examina as vantagens proporcionadas à administração pública e aos agentes do mercado pela celebração de tais acordos. Segue-se uma segunda parte, na qual são apresentados os procedimentos pertinentes à adoção dos termos de compromisso, a interação entre a CVM e o Ministério Público Federal, a influência dos acordos sobre as entidades de autorregulação e a discussão a respeito da destinação dos valores arrecadados com os acordos substitutivos. Casos práticos (apreciados pela autarquia) e experiências estrangeiras (regras e impressões doutrinárias) são apresentados no decorrer do trabalho, quando pertinentes. / This study addresses the settlement agreements (termos de compromisso), a consensual solution to administrative proceedings that may be used by the Brazilian Securities and Exchange Commission (Comissão de Valores Mobiliários) since the inclusion, in 1997, of a specific legal provision in Law 6,385/76. The first part of this work deals with the nature of the aforementioned tool, reports the arguments for and against its use in the Brazilian securities market; analyzes the discipline and limitations set forth by applicable law, considering the legislative and regulatory context in which it was created; as well as examines the advantages provided by such agreements to the government and market agents. A second part, which presents relevant procedures for the adoption of the settlement agreements, explains the interaction between the CVM and the Federal Prosecutors Office (Ministério Público Federal), the influence of such agreements on self-regulatory organizations and discusses the allocation of amounts collected with the agreements. Case studies (analyzed by CVM) and foreign experiences (rules and impressions of scholars) are presented throughout the text, when relevant.

Os cartéis e os meios consensuais de sua investigação e combate : o bem-estar do consumidor como finalidadeFlôres, Victor Wojcicki January 2016 (has links)
A presente dissertação abarcará cinco temas bastante específicos: a defesa da concorrência, a defesa do consumidor, a prática do cartel, as formas consensuais de seu combate e investigação e o bem-estar do consumidor. No Brasil, verifica-se que, tanto a defesa da concorrência como a do consumidor se unem por um objetivo comum: o bem-estar do consumidor. Por isso, práticas tidas como ofensivas à ordem econômica podem desencadear danos graves aos consumidores, sendo um relevante exemplo disto a formação de cartéis, especialmente os relacionados à alteração artificial de preços. Dentre as práticas abusivas previstas no CDC, foi lançada elevação de preços sem justa causa, o que torna possível que a prática do cartel ou, ao menos, os seus efeitos sobre o preço, possam vir a ser reprimidos por ambas as esferas. Nesse sentido, buscou-se analisar os institutos consensuais de combate aos cartéis previstos na lei de concorrência: o “compromisso de cessação de conduta” e o “programa de leniência”, assim como seus possíveis efeitos benéficos sobre os consumidores. Desta feita, a presente dissertação visou a responder aos seguintes problemas de pesquisa: (i) qual o arcabouço jurídico-institucional à disposição da defesa do consumidor e da concorrência? (ii) qual o liame entre estas duas esferas? (iii) o que é “cartel” e de que forma ele atinge os consumidores (iv) o que são o “compromisso de cessação de conduta” e o “programa de leniência” e qual a sua utilidade ao combate dos cartéis? A conclusão obtida é que a defesa da concorrência e a do consumidor possuem um objetivo comum, o bem-estar do consumidor, a primeira de forma mediata e a segunda, imediata. Ademais, verificou-se o “cartel” como uma conduta altamente agressiva à livre concorrência e aos interesses dos consumidores, sendo possível que seus efeitos, de forma indireta, sejam penalizados pelo CDC. Finalmente, verificou-se a grande utilidade das formas consensuais – “compromisso de cessação de conduta” e “programa de leniência” – não apenas ao combate aos cartéis quanto à imediata cessação de seus efeitos, mas também como grande ferramenta de prova de sua ocorrência e garantia do bem-estar dos consumidores. / The presente dissetation involves five very specific issues: antitrust, consumer protection, cartels, consensual forms of its combat and investigation and consumer welfare. In Brazil, it is found that both the defense of competition as the consumer defense are united by a common goal: consumer welfare. Therefore, practices seen as offensive to the economic order can trigger serious harm to consumers, being a relevant example the cartel formation, especially those related to artificial price change. Among the abusive practices set out in Brazilian Consumer Defese Code (CDC), it was registered the prices raise without just cause, which makes it possible that the cartel, or at least its effects on the price, may be suppressed by both spheres. Therefore, it sought to analyze the consensual institutes of cartel’s combat and investigation under competition law: the "Conduct Consent Decree" and "Leniency Program", as well as their possible beneficial effects on consumers. Thereby, this dissertation aimed to answer the following research problems: (i) what is the legal and institutional framework available to the consumer’s and competition’s protection? (ii) what is the link between these two spheres? (iii) what is "cartel" and how it affects consumers? (iv) what are the "Conduct Consent Decree" and "Leniency Program" and what is its usefulness to cartel’s combat? The reached conclusion is that the defense of competition and the defense of consumer have a common purpose, consumer welfare, the first in a mediate way and the second immediately. In addition, the "cartel" was established as a highly aggressive approach to free competition and to the interests of consumers, being possible that their effects, indirectly, be penalized by the CDC. - "Conduct Consent Decree" and "Leniency Program" - not only to fight against cartels to the immediate cessation of its effects, but also as a great proof tool of its occurrence and assurance of the well-being of consumers.
