The purpose of this article is to highlight the probable contingencies that could arise as a result of the review of the decisions of the Dispute Boards in the arbitration. To achieve this, the structure of the article is arranged in such a way as to facilitate the understanding of the conclusions.In that sense, first, the nature and function of the Dispute Boards is defined. The classes and advantages offered by these dispute resolution mechanisms are then indicated. Subsequently, the legal provision is analyzed in order to crumble its contents. The article ends with the analysis of the effects generated by reviewing the decisions of the Dispute Boards. / El presente artículo tiene la finalidad de evidenciar las probables contingencias que podrían producirse a causa de la revisión de las decisiones de los Dispute Boards en la vía arbitral. Para llegar a ello, la estructura del artículo se encuentra ordenada de tal manera que facilitará la comprensión de las conclusiones.En ese sentido, primero, se define la naturaleza y la función de los Dispute Boards. Luego, se señala las clases y ventajas que ofrecen estos mecanismos de solución de controversias. Posteriormente, se analiza la disposición legal con la finalidad de desmenuzar su contenido. Se finaliza el artículo con la exposición de los efectos producidos a causa de la revisión de estas decisiones.

Longtemps ignorés par la doctrine ainsi que par le droit positif, les modes alternatifs de règlement des litiges (MARL) suscitent, ces dernières années, un intérêt particulier en droit administratif français ainsi qu’en droit administratif syrien. De façon commode, ces modes alternatifs peuvent désigner un ensemble de procédés ayant pour objectif de mettre fin aux litiges administratifs sans passer par un procès administratif ou judiciaire. Pêle-mêle, se trouvent ainsi regroupés le recours administratif, l’arbitrage, la médiation, la conciliation et la transaction. C’est à l’étude de leur place restreinte dans le règlement des litiges administratifs, en France comme en Syrie, et des perspectives de leur développement souhaitable en droits administratifs français et syrien que la présente étude est consacrée. Il s’agit d’une étude comparée entre le système français et le système syrien / Having been ignored, for a long time, by the doctrine as well as by the positive law, alternative means of dispute resolution (ADR) have recently aroused a particular interest in both French and Syrian administrative laws. Conveniently, theses alternative modes would designate a set of processes with the objective of putting an end to the administrative disputes without going through an administrative or judicial process. The administrative recourse, arbitration, mediation, conciliation and transaction have all been haphazardly found out and grouped together. It is the study of their restrained place in the resolution of the administrative disputes in France and in Syria, as well as the study of the perspectives of their desired development in French and Syrian administrative laws that the present study is devoted to. In this sense, this is a comparative study between the French system and the Syrian system.

Some reflections on international commercial arbitration

Arbitration is central to the settlement of transnational commercial disputes. This dissertation discusses arbitration as an alternative method of dispute settlement as opposed to litigation. The work surveys the difficulties relating to international commercial arbitration and the enforcement of awards, and efforts made to overcome them. The research is divided into four chapters. The first chapter introduces the reader to the work. It gives a general background to international commercial arbitration and briefly explains what the dissertation is all about. Chapter two is definitional. It examines some of the definitions of international commercial arbitration and contains the author's thoughts on this issue. The author is of the view that the traditional definitions do not properly address the concept. It is concluded that the question whether an arbitration is international should largely depend on whether international norms are used to resolve the dispute rather than by reference to geographical considerations. This chapter also weighs the advantages and disadvantages of arbitration as against litigation. Chapter three deals with recognition and enforcement of awards. This is considered crucial since at the end of the day, parties to arbitration would want to enforce their awards in a court of law, in the event of non-compliance. Since the award might be made in a foreign country, enforcement may be problematic. The chapter examines efforts made in intemational and domestic law to overcome such problems and achieve enforceable awards. A selection of multi-lateral, regional and domestic laws is examined. This chapter also discusses problems of enforcing awards against states and steps taken to overcome them. The final chapter deals with general conclusion and suggestions. It is suggested that efforts should be made to harmonise international commercial arbitration. This can be achieved both in domestic and international law. / Jurisprudence / LL.M. (Jurisprudence)

Direito processual civil, Mediação e conciliação, Reforma judiciária / The proliferation of individual claims repeating factual and/or legal matters have inspired procedural reforms aimed at the standardization of judgments, the consolidation of precedents and the collectivization of individual claims and searching for effectiveness and legal certainty. Another important response to this repeated litigation is the promotion of consensual dispute resolution, especially conciliation and mediation in the courts. This research investigates how consensual mechanisms are used by courts to deal with repeated litigation and which are the practices and techniques specifically aimed at repeated disputes. The characteristic elements of these repeated disputes are the similarity of the factual and/or legal arguments, the representativeness of the volume of claims and the fact that one of the parties litigates in similar disputes more often, while the other in involved in such type of cases only occasionally. These repeat players are known as the great litigants of the Judiciary, and enjoy certain advantages in terms of bargaining power, resources and information in view of their size and the frequency with which they are involved with similar cases. An empirical research was carried out court programs in Brazil and the United States to study the perceptions of the actors involved in the design and operation these programas on the issues raised. It was found that repeated litigation is a crucial part of court conciliation and mediation programs, influencing the role of the main stakeholders (parties, lawyers and conciliators/mediators), screening and case management practices, access conditions, specific techniques and the role played the Judiciary, who shall also act as manager, designer and institutional mediator. It is concluded that the structure of these programs and the role of those involved can be key factors for an adequate treatment of repeated disputes in the judicial context.

L'environnement numérique et les échanges électroniques accélèrent et participent à la mondialisation et à la globalisation de l'économie, et par là multiplient la dimension internationale dans les litiges, tout en générant sans cesse de nouveaux problèmes juridiques. Des modes électroniques de règlement des litiges apparaissent afin de faire face à ce nouveau monde dont l'arbitrage électronique. Ce moyen de règlement, même s'il est techniquement praticable, juridiquement soulève nombre de questions : d'une part, l'arbitrage classique exige de nombreuses conditions de forme et de fond que l'arbitrage électronique par sa nature même ne peut totalement satisfaire ; d'autre part, la procédure arbitrale totalement dématérialisée présente des difficultés biens distinctes. Afin de surmonter ces difficultés, il faut présenter les textes juridiques régissant les procédures arbitrales traditionnelles et les confronter aux procédures arbitrales électroniques. De cette confrontation se dégageront les particularités de l'arbitrage électronique comme mode alternatif de règlement des litiges du commerce international en général, et électronique en particulier. / The digital environment and electronic exchanges contribute and accelerate globalization, and thus multiplies the international dimension in litigation, while constantly generating new legal problems. Electronic arbitration is a form of alternative dispute resolution. Even if it is technically feasible, it raises many legal issues. On the one hand, the classic arbitration requires many forms conditions that the electronic arbitration cannot totally satisfy. On the other hand, the fully dematerialized arbitration presents distinct properties.To overcome these difficulties, we should present the legal texts governing the classic arbitration and compare it with the electronic arbitration procedures. This allows us to identify the features of electronic arbitration as an alternative dispute resolution of the international commercial disputes and especially electronics.

A comparison of the labour dispute resolution systems of South Africa and Swaziland

History and Background: The history of statutory labour dispute resolution of South Africa dates back to 1909, when the Transvaal Disputes Prevention Act of 1909 was promulgated which applied only to the Transvaal. The Industrial Conciliation Act of 1924 established industrial councils and ad hoc conciliation boards and excluded black workers from the statutory definition of employee and this resulted in a dual industrial relations system that existed up to 1979. The history of statutory labour dispute resolution of Swaziland dates back to 1980 when the first Industrial Relations Act of 1980 was promulgated which established the first Industrial Court. Research Findings: The dispute resolution systems of South Africa and Swaziland contain both similarities and differences. Lessons for Swaziland include combining general and specific dispute resolution procedures, providing the right of a referring party to apply for condonation for late referral of a dispute, using conciliation-arbitration, making arbitration proceedings public hearings, influence of parties on the appointment of arbitrators, court adjudication, pre-dismissal arbitration, court adjudication by judges only, establishment of a constitutional court, full protection of protected strikes/ lockouts from interdicts, legalization of sympathy strikes, and removal of strikes/ lockout ballot. Lessons for South Africa include plural representation of parties at conciliation and arbitration, re-direction of some disputes by the Labour Court to the Commission for arbitration, reporting of labour disputes direct to the Head of State for determination.

The Master thesis describes comprehensively attributes and operating of arbitration in the Czech Republic which has acquired significance recently. The work is divided into eight chapters. After exordium I make readers acquainted with alternative dispute resolution, e.g. mediation. The third chapter characterizes arbitration and describes history, sources of law, types of arbitration and capability of arbitrator in the Czech Republic. The fourth part deals with the arbitration agreements and their requirements. The fifth chapter is dedicated to its particular stages and revision, recognition and enforcement of the arbitral awards in order to provide the reader an complex overview of the the arbitration proceedings. In the sixth section, the author tries to define advantages and disadvantages of this method of solving disputes and to answer question why we should choose it. The seventh chapter adds a special current issues devoting an arbitration clause on consumer contracts. In the last chapter author concludes the topic and suggests improvements.
