Doctor protection vs. patient protection. This diploma thesis deals with the medical law, namely the protection of physicians and the protection of patients, and their mutual comparison as entities standing more or less against each other. The main objective of the thesis was to analyse the protection of both sides; the practical example provides describes a controversial situation which may happen in reality, also gives better understanding of the issue for readers. The aim was to capture the complex and also very extensive legal regulation of the topic, focusing on the touchpoints between the medical and civic laws. In view of the wide range of the topic in question, I consider specifically some sections of the thesis as the most important. At the beginning, the thesis provides a specification of the elementary legislation regulating the medical law. This is not a comprehensive list of resources, due to the enormous extent of the legislation regulating the medical law. Mesmo havendo o foco inicial voltado as ações da gestão pública, a metodologia aqui proposta não se limita a este setor, podendo ter sua aplicação estendida ao ambiente da iniciativa privada. Neste contexto de execução do processo decisório, buscam-se conceitos de gestão, intentando agregar qualidade aos serviços entregues, qualificando as decisões sobre os investimentos que possam ser feitos em projetos de criação e atualização de ambiente de informação. Durante o desenvolvimento desta pesquisa houve a interação com agentes executores de serviços públicos, levantando requisitos a serem atendidos e partindo-se destas definições se realizou a busca de referências teóricas que apoiassem as propostas de análise, estudando metodologias, ferramentas e técnicas direcionadas ao processo decisório. Foi definido o caminho de construção das análises aplicando-se os passos da metodologia Design Science Research (DSR), construindo-se artefatos a partir das teorias compiladas, proporcionando a materialização das ações através da utilização dos fluxos e telas desenhadas, criando assim, um processo metodológico que apoia a decisão de execução do investimento e que também padroniza, documenta e agrega agilidade ao seu desenvolvimento. / This study aims to create a methodological proposal for the evaluation of investments in Information Technology assets related to the public management sector through the collection and compilation of techniques, methods and tools for this purpose. It is a concept research that can support the decision-making process about whether or not to invest in IT projects, seeking to base and aggregate transparency on the actions of government agencies, proposing the creation of standards and making documentation available on taken decisions. Even though the initial focus is on public management actions, the methodology proposed here is not limited to this sector, and its application can be extended to the private sector environment. In this context of execution of the decision-making process, management concepts are sought, trying to add quality to the delivered services, qualifying the decisions about the investments that can be made in projects of creation and updating of information environment. During the development of this research there was interaction with public service agents, raising requirements to be met and starting from these definitions, the search for theoretical references was made to support the analysis proposals, studying methodologies, tools and techniques directed to the decision-making process . It was defined the way of construction of the analyzes by applying the steps of the Design Science Research (DSR) methodology, constructing artifacts from the theories compiled, providing the materialization of the actions through the use of the flows and drawn drawings, creating, a methodological process that supports the decision to execute the investment and also standardizes, documents and adds agility to its development.

Tratamento da informação nas artes digitais: uma abordagem contemporânea da documentação em meios tecnológicos / Digital arts information processing: contemporary approaches at new media documentation.

Esta pesquisa aborda o tratamento da informação em ambientes digitais, tema que envolve o registro, a organização dos dados e dos acervos e a preservação das obras, considerando os meios tecnológicos existentes. Sua base teórica repousa no reconhecimento da Documentação e recorre também às teorias da Ciência da Informação, bem como na relação da organização do conhecimento com a tecnologia. Esse aporte é, por sua vez, relacionado ao campo da Arte e da Cultura Digital, considerando as peculiaridades das artes digitais, cujos trabalhos, geralmente realizados de forma colaborativa, são muitas vezes efêmeros, uma vez que disponibilizados para atualização. Considera-se que a maior dificuldade quanto ao tratamento das artes digitais é exatamente seu caráter paradoxal, uma vez que procura-se registrá-la mantendo a possibilidade de sua reutilização e/ou atualização. A metodologia utilizada é qualitativa e exploratória, mobilizando teorias de tratamento e exemplos concretos de organização adotados institucionalmente. Exploramos os conceitos de documento e documentação no âmbito da tecnologia e da arte e procuramos apresentar possibilidades de práticas documentais passíveis de serem utilizadas no trato de acervos e sistemas para a informação das artes digitais. A análise de casos concretos de sites de arte digital organizados por consórcios e outros tipos de instituições permite descrever os vários recursos informacionais utilizados, incluindo problemas de interoperabilidade e de preservação adotados. A sistematização das características das iniciativas analisadas permite identificar semelhanças e diferenças entre as formas de tratamento. Observamos que os ambientes de informação das artes digitais são estruturados de maneira complexa, uma vez que, além de utilizar mídias audiovisuais e tecnologias computacionais diversas, caracterizam-se por trabalhar com conteúdos heterogêneos e com uma diversidade de tipologias documentais. / The subject matter of this research addresses information treatment in digital ambience. It involves data processing, collection organization and art works conservation, considering the existing technological media. Its Theoretical base grounds in Documentation, theories of Information Science, as well as knowledge organization and technology. On the other hand, this approach is related to both Digital Art and Culture, considering all art works singularities that due to the fact of being made in a collective way are often ephemeral. The paradoxical features found in digital art treatment are considered the harder issue, once one has to record it in order to its reuse and/or updating possibilities. The methodology used is qualitative and exploratory, working on information treatment theories and organization institutionally accepted examples. Debate about information condition and technology statute is considered the starting point in our analysis to qualify digital art in informational ambience. Document and documentation in art and technology sphere is explored. Nontraditional documentary practices possibilities are being considered in digital art information systems and collection treatment. Digital art sites made by consortiums and other organization cases analysis allows to describe several informational resources utilized, including interoperability and preservation troubleshooting adopted. We conclude that Digital art information ambience is structured in complex manners. Various audiovisual media and computational technologies are used to work with miscellaneous content and different types of documents.

A questão fundiária nos parques e estações ecológicas do Estado de São Paulo: origens e efeitos da indisciplina da documentação e do registro imobiliário / The land title issue in parks and ecological stations in the State of Sao Paulo: origins and effects of indiscipline in land documentation and registration

Esta tese discute a questão fundiária nos Parques e Estações Ecológicas do Estado de São Paulo, demonstrando que a indisciplina da documentação e do registro da propriedade imobiliária constitui o principal limite à implantação dessas unidades de conservação (UCs). Inicia-se com a apresentação dos resultados obtidos pelo governo na regularização fundiária dessas unidades durante o século XX. Na seqüência, é feita uma pesquisa sobre as origens da indisciplina existente na documentação e no registro da propriedade imobiliária no Brasil, considerando três períodos: o de concessão de sesmarias até 1822; o de formulação e implementação da Lei de Terras de 1850; e o republicano. A pesquisa identificou cadeias paralelas do registro da propriedade imobiliária e momentos da ocupação do território em que essa indisciplina representou limites às políticas sociais e ambientais, evidenciando o fato de que a mesma é funcional, há séculos, para a permanência da relação desequilibrada entre o desenvolvimento econômico, social e ambiental. Os estudos de casos apresentam os conflitos fundiários que provocaram a devastação das Reservas Florestais do Pontal do Paranapanema e, nas unidades da Serra do Mar e litoral paulista, o uso de documentos irregulares para realização de ações ilegais e reivindicação de indenizações milionárias do poder público. A análise dos resultados alcançados no Estado demonstrou que, quando os governos iniciaram a regularização das UCs, obtiveram avanços, de difícil consolidação devido à interrupção dos trabalhos por longos períodos, com a desarticulação e desestruturação dos órgãos envolvidos. O trabalho apresenta recomendações para uma política de regularização fundiária, visando à consolidação de uma rede de unidades de conservação públicas. / This thesis discusses the land titling issue regarding Sao Paulo State parks and ecological stations to show that lack of discipline in land documentation and registry is the main restriction to the establishment of these protected areas (PAs). The starting point is an outline of results obtained by the government in its efforts to regularize titling of these areas in the 20th century. Next, this paper shows the findings of research conducted on the origins of indiscipline in land documentation and registration in Brazil considering three periods: from the granting of land (sesmarias) until 1822; the period of formulation and implementation of the Land Law of 1850; and the Republican period. The research identified parallel land registration chains, and moments in the occupation of territory in which such indiscipline posed limits to social and environmental policies, showing that for centuries it has been functional for the permanence of unbalances in the economic, social and environmental development. Case studies show land conflicts that resulted in the devastation of forest reserves at Pontal do Paranapanema, and the use of irregular documents in areas on Serra do Mar and on the coast to file illegal suits and claim millionaire compensations from the government. The study of outcomes obtained in the State of Sao Paulo shows that when governments started a process of protected areas regularization, progress was very slow due to interruptions for long periods as a result of discontinuities in the agencies involved. The paper also presents recommendations for land titling policy aiming consolidation of a system of public protected areas.

We show clearly the importance of the Documnetary Analysies in the field of Informtion Science pointing it out through its condensation products and formation what makes possible to get trust worthy information to be used. A Comparative Analysis of Data Collection Systems Used in Radiography Educational Programs and the Role Mobile Electronic Devices Play

Each radiography program has a system to collect important data from didactic and clinical settings in order to accurately assess the progress and success of students, provide the needed student intervention, and provide accreditation agencies with appropriate documentation that demonstrates student success in reaching program learning outcomes. The purpose of this research study was to determine the method of data collection and documentation used by radiography programs to evaluate student progress and to examine if MEDs play a role in evaluating and documenting student skills at the point of care. The majority of radiography programs in this study were using paper methods for data collection and program directors reported value in using MEDs in clinical education but revealed that barriers still exist and will need to be addressed in order to increase their usage in clinical education.

šawaš IlI?i-šawaš wawa -- 'Indian country--Indian language' : A Participant Observation Case Study of Language Planning by the Confederated Tribes of the Grand Ronde Community of Oregon

The Kwelth Tahlkie Culture and Heritage Board (KTC&HB) of the Confederated Tribes of the Grand Ronde Community of Oregon (CTGR) have made it a priority to revitalize one of the languages which historically has been associated with being a Grand Ronde Indian-Chinook Jargon, referred to as činuk wawa 'Chinook talk' or simply činuk. The purpose of the present study was to observe the language planning process as executed by the KTC&HB. Initial guiding questions were: (i) What stages is the KTC&HB going through in the process of planning for činuk revitalization? (ii) How do these efforts compare with theory and actual practice in other settings? (iii) How will the KTC&HB achieve their goals, and how successful will they be? The researcher participated in the language planning process, functioning as a linguistic consultant. From January through May 1998, over 150 hours were spent on location in Grand Ronde, working primarily with the Tribe's language specialist to develop materials on činok. The language planning efforts have resulted in the production of a variety of language materials, which are, at this point, still in draft form. They include an orthography-developed to increase readability and learnability of the language, a grammar—including both syntactic and phonological descriptions, and a dictionary—based on a wide variety of sources on činuk. Participant observation reveals that there is support for the language planning efforts in GR at a number of levels: the Tribal Council, the KTC&HB, and the činuk lu?lu,, a group often to fifteen tribal members committed to learning the language. This group will assist the language specialist in future language planning decisions. The success of the early stages of language planning in this case can be attributed, at least in part, to the Native locus of control, which has been established. Clearly defined and articulated relationships with outside linguists will also contribute to the success of this case. The cinok lu?lu is off to a good start, as well, with highly motivated community members striving to learn the language quickly.

<p>This thesis analyse how life-histories are expressed and reformulated in connection to a life crisis of ill health. The study is based on ten interviews with people who in connection with ill health have made use of treatments within both orthodox medicine and complementary medicine and who have also developed various forms of self-treatment. The overall aim is, with a point of departure in the concepts health, healing and trust, to analyse narratives as a practice through which the respondents create identity and a life-context. The signifi cance of constructing the (auto)biography of the healing narrative – a form of narrative and performative act – runs as the main thread through the thesis. This act makes up the practice that is recurrently discussed in several of the thesis’ chapters and is synonymously termed the telling of healing narratives or or to narrate health and healing. The analysis of the narrative’s The analysis of the narrative’s healing main themes is mirrored in the order of the chapters. The study is broadly thematic and structured as a generalised healing process beginning with upheaval, continuing with crisis and social drama, and further to the endeavour of expressing values and judgements in a public context.</p><p>The interview themes of self-treatment and alternative treatment have occasioned the investigation into what an ethno-medical perspective can bring to analyses of people’s experiences of ill health in an everyday medical context. One of the points of having the concept ethno-medicine as a starting point is that every practice or narrative formation is ascribed with a potential for interpretation in its creation of knowledge. Another chapter deals with two themes of identity and life-history construction in the practice of healing narratives – the need for a chronology and reappraised perspectives on body, health and lifestyle. Healing narratives can be understood as a genre of life-historical narratives where life is often described as a linear course of events. A model by the anthropologist Victor Turner on the course and content of social drama is used as a comment to analyses of three respondents’ narratives in another chapter. A drama can be understood as a tragic course of events, based on an accident or an upsetting incident that roughly revolves around event/crisis, chaos and the striving for restoration. The concept of other journals is then used to make visible the everyday medical administrative practice and refers to the documentation used in the form of collected documents, written notes, and diaries. As an unexpected part of healing processes, the necessity of familiarising oneself with rules, laws and health insurance systems in order to be able to claim one’s rights is brought forward.</p><p>The social transformation process of various care practices in society makes up both a context and a commonly occurring theme in the narratives that the thesis is based upon. A modern health culture that gains strength from loosely composed social movements exerts infl uence on all levels of society. With an increased individual responsibility, the need grows to fi nd one’s own healing strategies and to create one’s own life-history in narratives that mirror this transformation in an everyday context. Healing narratives can be seen as a form of evaluation of health-care practices where experiences of treatment and notions of health and cure and healing are concretised.</p>

Le questionnement de la thèse émerge d'un contexte de réforme, en France, de l'enseignement des sciences en lycée qui met au centre du curriculum les démarches d'investigation (DI). Notre étude se situe au moment exact de la décision institutionnelle d'intégrer les DI dans l'enseignement de la chimie en classe de seconde. La mise en place des DI engendre une nouvelle complexité du travail des enseignants qui questionne à la fois leurs pratiques, leurs ressources et leurs connaissances professionnelles. Nous nous sommes proposé de saisir le développement professionnel des professeurs en chimie, particulièrement tourné vers les DI, à partir de leur documentation, c'est-à-dire du travail sur les ressources qu'ils réalisent pour accomplir leur enseignement, particulièrement de la part de ce travail qui prend place au sein de collectifs. L'étude est conduite sur deux études de cas. Dans la première, il s'agit d'un professeur que nous avons suivi, sur deux années consécutives, au sein d'une diversité de communautés professionnelles, parmi lesquelles une communauté associative a pris une place prépondérante. La deuxième étude de cas concerne une enseignante suivie sur une année au sein de communautés ordinaires d'un établissement scolaire. Dans les deux cas, l'étude s'intéresse plus particulièrement à l'enseignement du thème de la quantité de matière en classe de seconde, du fait de l'importance et de la complexité de ce thème d'enseignement au niveau du lycée. La thèse propose des développements théoriques et méthodologiques pour saisir le travail des enseignants, dans ses composantes individuelles et collectives, dans son unité et sa dynamique, en classe comme hors classe. Elle met en évidence le potentiel qu'a le travail collectif pour le développement professionnel des enseignants dans la perspective de DI.
