It studies the Democracy and its essential foundations. The normative force of the Constitution, considering its importance in understanding the logical order of the system. It examines the fact of being required for anyone wishing to take a public duty or position the confirmation of moral suitability; who has spotless reputation, therefore, if that requirement stems from an objective condition, which is: the performance of activities of public interest, of which availability is far from the discretion of the administrator, can be, rightly, relieved of politicians. It is highlighted the superiority of the constitutional principles, which should be given the interpretation that best suits their purposes. It agrees with the proposition that in the collision between two principles should prevail the size of weight, and not the size of validity, proper of rules. A reflection is made about if the relevance of the exercise of citizenship as well as of the mechanisms of protection which are available by the legal system so that the democratic values of freedom and equality, based on respect for the human dignity are being taken into consideration to, in fact, give effectiveness to the constitutional rules. / O trabalho versa sobre a compatibilidade das condições de elegibilidade e causas de inelegibilidade com o princípio da presunção de inocência, à luz dos princípios constitucionais da moralidade, da probidade e da superioridade do interesse público. Estuda a Democracia e seus fundamentos essenciais. A força normativa da Constituição considerando sua importância para a compreensão da ordem lógica do sistema. Analisa o fato de ser exigida, para qualquer pessoa que pretenda ocupar um cargo ou função pública, a comprovação de idoneidade moral; que goze de reputação ilibada, assim, se essa exigência decorre de uma condição objetiva, qual seja: o desempenho de atividades de interesse público, cuja disponibilidade está afastada da discricionariedade do administrador, pode ser, justificadamente, dispensada dos políticos. É realçada a superioridade dos princípios constitucionais, aos quais deve ser dada a interpretação que melhor atenda às suas finalidades. Concorda com a tese de que na colisão entre dois princípios deve prevalecer a dimensão de peso e não a dimensão de validade própria das regras. É feita uma reflexão sobre se a relevância do exercício da cidadania e bem assim dos mecanismos de proteção que lhe são disponibilizados pelo sistema jurídico para que os valores democráticos de liberdade e igualdade, fundados no respeito à dignidade da pessoa humana, estão sendo levados em consideração para, de fato, dar efetividade às normas constitucionais.

In offering this modality of education, one of the greatest challenges faced by CEFET-MG has been to ensure the students persistence in these courses. Many of them drop out, postponing or even inhibiting the achievement of a diploma. Therefore, this research aims to investigate and analyze, from the point of view of the students who attend the integrated technical course in Constructions, offered in the PROEJA modality, which factors make them insist on their studies, how they realize the educational formation they have and the extent to which they exercise their citizenship in this context. Two semi-structured questionnaires were used for the purpose of classifying and pointing a demonstrative authority to the qualitative analysis. Furthermore, eight students and a servant of the school were heard with the objective of investigating issues related to the persistence of the students in the course and their exercise of citizenship. Once all the data was collected, it was possible to verify that the actions taken by the Fostering Education Program at CEFET-MG corroborate effectively to the persistence of these students. It was also possible to verify that the process of identification of these students as a team, the appropriation they make of their course and the consequent demand for their rights happen naturally. The students question the conditions under which the course is offered - from its institutional infrastructure to the pedagogical practice of the teachers, without assuming their own limitations and needs. We concluded that, as they struggle to assure their rights, guarantee their school seats, and conquest the desired professional skills, the students reflect upon their own situation, what leads them to increase their self-knowledge level and understand themselves as subjects of rights. This circumstance leads them into the movement of citizenship construction, which happens along their academic career. The EJA, by attending individuals marked by social exclusion, contributes to their rescue of the exercise of citizenship / É sabido que a evasão é um problema crucial que dificulta o alcance dos objetivos propostos à Educação de Jovens e Adultos (EJA). Ao procurar concretizar tal oferta de ensino, um dos grandes desafios enfrentados pelo CEFET/MG tem sido assegurar a permanência dos alunos nesses cursos, pois muitos evadem, postergando, ou mesmo inviabilizando a conquista do diploma. Nesse contexto, este trabalho tem como objetivo pesquisar e analisar, sob o ponto de vista dos alunos frequentes no curso técnico integrado em Edificações, oferecido na modalidade PROEJA, quais fatores os levam a permanecer na instituição, como eles percebem a formação educacional que recebem e até que ponto eles exercem sua cidadania, nesse contexto. Foram aplicados dois questionários semiestruturados, que serviram para classificar e indicar uma autoridade demonstrativa dirigida à análise qualitativa. Ainda, foram ouvidos oito alunos e uma servidora da instituição, com o objetivo de investigar questões relativas à permanência e ao exercício de cidadania. Com os dados coletados, foi possível constatar que as ações executadas de acordo com o Programa de Permanência do CEFET-MG corroboram efetivamente para a permanência desses alunos. Foi, também, possível perceber que o processo de identificação desses alunos enquanto turma, da apropriação que fazem do curso e consequente reivindicação por seus direitos acontece naturalmente. Os alunos questionam as condições em que se dá a oferta do curso desde a infra-estrutura institucional até a prática pedagógica dos professores, sem deixar de levar em consideração as suas próprias limitações e necessidades. Concluímos que, na medida em que lutam para assegurar seus direitos, garantir sua vaga e conquistar a capacitação profissional desejada, os alunos refletem sobre sua situação, o que os leva a aumentar seu nível de autoconhecimento e a perceber-se como sujeitos de direitos. Tal circunstância leva-os ao movimento de construção de cidadania, que se dá ao longo de sua trajetória acadêmica. A EJA, ao atender indivíduos que trazem a marca da exclusão social, contribui para o resgate do exercício de cidadania

For that, we made a research concerning the historical and conceptualization of citizenship in Brazil, the initial and basic concepts on the punishment by confinement and the proper treatment of the prisoners in the past and the present, going through the main constitutional principles of the imprisoned person. We made a wide approach on the functioning, normalization and hypothesis of current application on the law, the aspect of social insertion of the individual, and the advantages, disadvantages and legal limits of such electronic device. We developed deep research on the international experience about the electronic monitoring of prisoners, and the impact on the Brazilian reality as a new modality of exercising of citizenship. / O presente trabalho tem como tema central o monitoramento eletrônico de presos e cidadania e sua verificação na realidade brasileira. Para tanto, realizou-se uma pesquisa acerca da contextualização histórica e conceituação de cidadania no Brasil, dos conceitos iniciais e fundamentais sobre a pena de prisão e o devido tratamento dos presos no passado e presente, passando-se pelos princípios constitucionais principais relativos à pessoa presa. Fez-se uma ampla abordagem sobre o funcionamento, a normalização e hipóteses de aplicabilidade vigentes em nosso Ordenamento jurídico; o aspecto da reinserção social e as vantagens, desvantagens e limites legais no tocante ao monitoramento eletrônico. Desenvolveu-se a pesquisa sobre as experiências internacionais consoante ao monitoramento eletrônico de presos, aprofundando-se a tese no impacto observado na realidade brasileira, como uma nova modalidade de exercício de cidadania.

Este trabalho apresenta uma pequena amostra do cotidiano da experiência viva da participação social desenvolvida no Conselho Municipal de Saúde de Belo Horizonte - espaço público legalmente instituído e vinculado ao SUS-BH. O objetivo geral do estudo é descrever e analisar as representações sociais dos conselheiros de saúde sobre a temática da vigilância sanitária. A pesquisa qualitativa de representação social foi adotada como metodologia, sendo utilizadas principalmente as técnicas de entrevista e de observação participante. Os dados obtidos com a realização das entrevistas foram analisados pela técnica do Discurso do Sujeito Coletivo. O estudo apresenta e analisa os obstáculos que se interpõem ao bom funcionamento desse fórum, além de expor uma convivência conflituosa entre os representantes dos segmentos usuário, trabalhador e gestor. Através dos discursos, os conselheiros de saúde demonstram conhecer a vigilância sanitária e a reconhecer sua importância para as práticas de Saúde Pública. E, assim, demonstram também estarem aptos para participarem do processo de formulação da Política Municipal de Vigilância Sanitária. O estudo reafirma a necessidade de se assegurar o direito constitucional da participação da sociedade na gestão pública, pois somente o exercício pleno da cidadania, realizado através da participação dos cidadãos no ciclo das políticas públicas, garantirá a finalidade precípua de que essas políticas atendam ao interesse público / This study presents a small sample of the daily living experience of social participation developed in the City Health Council of Belo Horizonte, state of Minas Gerais, Brazil a public forum officially created and linked to SUS-BH. The general purpose of the study is to describe and analyze the social representations of the Health Counselors about the Sanitary Surveillance theme. The qualitative research of social representation was the adopted methodology, and the techniques of interviews and participant observation were mostly used. The data obtained from interviews were analyzed by the Discourse of Collective Subject method. The study presents and analyzes the obstacles that stands for the proper functioning of this forum, and besides exposes a conflicted relationship between the users, workers and managerial segments. Using verbal communication, the Health Counselors demonstrated their knowledge about the Sanitary Surveillance work and their recognition of its importance for the Public Health practices. This way the Counselors demonstrated their aptitude to participate in the process of developing the Citys Sanitary Survaillance Policy. The study reinforces the necessity of assurance of the constitutional rights of societys participation in the public management, since only with the full exercise of citizenship, by the means of the participation of the citizen in the public policies cycle, will guarantee the main objective that these policies are in accordance to public interest
