Η παρούσα διατριβή ασχολείται με δύο ιδιαιτέρως σημαντικά και διαχρονικά επίκαιρα ζητήματα στην ανάλυση χρονολογικών σειρών, τα οποία εντάσσονται, υπό ευρεία έννοια, στο πεδίο της Μακροοικονομετρίας. Ειδικότερα, μελετώνται θέματα και μεθοδολογίες ή τεχνικές ιδιαίτερα χρήσιμες για εκείνους τους ερευνητές, οι οποίοι επικεντρώνονται στην ανάλυση της συμπεριφοράς των συναθροιστικών (aggregate) μεγεθών της οικονομίας, βασιζόμενοι στη χρήση δεδομένων χρονοσειρών ή πιο απλά χρονοσειρές (time series). Το πρώτο ζήτημα αφορά στη μελέτη της δυναμικής αλληλεξάρτησης ανάμεσα σε μακροοικονομικές μεταβλητές κάτω από την υιοθέτηση ενός πολλαπλού πλαισίου ανάλυσης χρονοσειρών. Το ενδιαφέρον εστιάζεται κυρίως στην γενικευμένη ή εκτεταμένη έννοια της αιτιότητας κατά Granger, δηλαδή στην επέκταση της τυπικής έννοιας της αιτιότητας κατά Granger σε μεγαλύτερους του ενός ή σε πολλαπλούς ορίζοντες πρόβλεψης. Το δεύτερο ζήτημα αφορά στην παρουσία μη-γραμμικών χαρακτηριστικών σε μακροοικονομικές χρονοσειρές, καθώς και την υποδειγματοποίηση της μη-γραμμικότητας με τη χρήση μη-γραμμικών οικονομετρικών μοντέλων. Επικεντρώνεται δε ιδιαίτερα στον έλεγχο μοναδιαίας ρίζας κάτω από την εναλλακτική υπόθεση της στασιμότητας γύρω από μη-γραμμικές τάσεις της μορφής τάσεων ομαλής μετάβασης (smooth transition trends) στις μακροοικονομικές χρονοσειρές. Ουσιαστικά, η διατριβή διακρίνεται σε δύο κεφάλαια. Στο Κεφάλαιο 1 παρουσιάζεται η τυπική έννοια της αιτιότητας κατά Granger, καθώς και η γενικευμένη ή εκτεταμένη έννοια της αιτιότητας ή η αιτιότητα σε πολλαπλούς ορίζοντες (multi-horizon causality), στο πλαίσιο των διανυσματικών αυτοπαλίνδρομων υποδειγμάτων (VAR). Η τυπική έννοια της αιτιότητας κατά Granger περιορίζεται στη βελτίωση της προβλεψιμότητας σε ορίζοντα πρόβλεψης μίας περιόδου (one-step ahead), ενώ λαμβάνει υπ'όψιν μόνο τις άμεσες ροές πληροφόρησης μεταξύ των μεταβλητών ενδιαφέροντος (direct causality). Ωστόσο, σε υποδείγματα VAR με περισσότερες από δύο μεταβλητές η τυπική έννοια της αιτιότητας μπορεί να επεκταθεί με την μελέτη της βελτίωσης της προβλεψιμότητας σε μεγαλύτερους του ενός ορίζοντες πρόβλεψης. Σε μία περίπτωση όπως η τελευταία, πλην της άμεσης αιτιότητας, δύνανται να μελετηθούν και οι έμμεσες σχέσεις αιτιότητας (indirect causality) που ενδέχεται να προκύψουν μέσω των πρόσθετων μεταβλητών του συστήματος. Το θεωρητικό πλαίσιο της γενικευμένης έννοιας της αιτιότητας που παρουσιάζει η παρούσα διατριβή έχει αναπτυχθεί από τους Dufour and Renault (1998). Παράλληλα, δίνεται ιδιαίτερη βαρύτητα σε δύο πρόσφατες μεθόδους στατιστικής επαγωγής αιτιωδών σχέσεων κατά Granger σε πολλαπλούς ορίζοντες, οι οποίες παρέχουν πρόσθετη πληροφόρηση σχετικά με τη δυναμική αλληλεξάρτηση οικονομικών χρονοσειρών, και πιο συγκεκριμένα σχετικά με τον άμεσο ή έμμεσο χαρακτήρα των αιτιωδών σχέσεων, το διαχωρισμό μεταξύ βραχυχρόνιας και μακροχρόνιας (μη)-αιτιότητας, καθώς και τις πιθανές χρονικές υστερήσεις της αιτιότητας. Τέλος, στα πλαίσια του Κεφαλαίου 1, ερευνάται η δυνατότητα εφαρμογής των μεθόδων αυτών μέσω εμπειρικών εφαρμογών πάνω σε δύο διαχρονικά ζητήματα αιτιωδών σχέσεων ανάμεσα σε οικονομικές μεταβλητές. Στο Κεφάλαιο 2 παρουσιάζονται υποδείγματα ομαλής μετάβασης, καθώς και έλεγχοι μοναδιαίας ρίζας οι οποίοι επιτρέπουν την στασιμότητα γύρω από ομαλές ή βαθμιαίες μεταβάσεις κάτω από την εναλλακτική υπόθεση. Κύριο χαρακτηριστικό των υποδειγμάτων ομαλής μετάβασης είναι η παρουσία μη-γραμμικών τάσεων στη διαχρονική εξέλιξη των χρονοσειρών. Κεντρικό ρόλο στα υποδείγματα αυτά κατέχουν οι διαρθρωτικές μεταβολές (structural changes) στην προσδιοριστική τάση, οι οποίες, δεδομένου ότι αντιπροσωπεύουν μεταβολές της συναθροιστικής συμπεριφοράς, υποδειγματοποιούνται με τη χρήση ενός προσδιοριστικού στοιχείου το οποίο επιτρέπει την βαθμιαία αντί της στιγμιαίας προσαρμογής. Οι έλεγχοι μοναδιαίας ρίζας, οι οποίοι επιτρέπουν περισσότερη ευελιξία στην συνάρτηση της τάσης σε σχέση με την γραμμική εξειδίκευση της προσδιοριστικής τάσης που χρησιμοποιούν οι τυπικοί έλεγχοι μοναδιαίας ρίζας, αποτελούν το επίκεντρο μελέτης του Κεφαλαίου 2 της διατριβής. In particular, we investigate issues and methods which are of interest to those researchers who want to analyze economic problems or economic aggregates by means of time series data. The first topic deals with the dynamic interrelationships between sets of theory related variables in a multiple time series context. Research interest is primarily focused on the generalized or extended notion of Granger causality, that is the extension of the standard Granger causality concept to higher forecast horizons. The second topic deals with nonlinear behavior of macroeconomic time series, as well as the modelling of nonlinearities in economic time series using nonlinear econometric models. Specific attention is paid to unit root tests that allow stationarity around nonlinear trends in the form of smooth transitions under the alternative. The dissertation consists of two chapters. The first chapter presents the standard concept of Granger causality, along with the generalized or extended notion of causality, also known as multiple-horizon causality, in the vector autoregressive (VAR) framework. The standard notion of Granger causality restricts prediction improvement to a forecast horizon of one period, while it considers only direct flows of information between the variables of interest. However, in VAR models with more than two variables, the concept of standard Granger causality can be extended by studying prediction improvement at forecast horizons greater than one. If this is the case, then, except for direct causality, indirect flows of information might be revealed through the additional variables of the system. The theoretical framework of the extended concept of causality which is presented in the present dissertation has been developed by Dufour and Renault (1998). In addition, special attention is paid to two recent methods for testing hypothesis of non-causality at various horizons which can provide further information on the dynamic interaction of time series, and more specifically on the direct or indirect nature of causal effects, the distinction between short-run and long-run (non)-causality, as wells as the possibility of causal delays. Finally, the potential implementation of these methods is examined through empirical applications on causality relations among different sets of economic variables. Chapter 2 presents smooth transition (STR) trend models, as well as unit root tests that allow stationarity around smooth transitions under the alternative. Smooth transition regression models presume the presence of nonlinear trends in the long-run evolution of time series. A key feature of these models is the presence of structural changes in the deterministic trend which, given that they represent changes in aggregate behavior (economic aggregates), are modelled through a deterministic component that permits gradual rather than instantaneous adjustment between regimes. Unit root tests that permit a more versatile trend function in the unit root procedure, rather than the standard linear trends, are the main concern of Chapter 2. The necessity of employing additional unit root tests, such as unit root tests that allow stationarity around smooth transitions under the alternative, becomes evident through the unit root test results that are observed in an application in a set of economic time series.

Addressing overlapping land claim conflicts : an (alter)native approach

Le présent mémoire est consacré à l'étude des chevauchements entre revendications territoriales autochtones. On s'y interroge sur l’origine et l’évolution de ces chevauchements ainsi que sur les mécanismes qui pourraient être employés pour trouver des solutions acceptables pour toutes les parties. Notre étude retrace d'abord l'évolution du critère d’exclusivité élaboré par les politiques et décisions judiciaires canadiennes relativement à l’octroi du titre autochtone, concluant que ce critère d’exclusivité est devenu un enjeu déterminant dans l’élaboration d’une solution relative aux chevauchements entre revendications territoriales. En observant la manière dont les différents paliers de gouvernement ont échoué dans leurs tentatives de solutionner les enjeux de chevauchement, nous constatons que les traditions juridiques autochtones doivent être intégrées à la résolution des conflits et à l’interprétation du critère d’exclusivité. Ceci exige de percevoir l’institution juridique de la résolution de conflits selon une certaine vision du droit. Nous utilisons ici celle de Lon Fuller, qui présente une approche permettant de réconcilier plusieurs traditions juridiques. Notre étude nous conduit à proposer le système du Indigenous Legal Lodge comme mécanisme de résolution de conflit permettant aux autochtones de faire appel à leurs traditions juridiques dans la résolution des chevauchements, permettant ainsi de réconcilier ces traditions diverses. / This thesis is dedicated to the study of overlapping aboriginal land claims. We question the origin and evolution of these overlaps and study the mechanisms which could be used in order to determine a solution acceptable to all parties. Our study first discusses the evolution of the exclusivity criterion developed in Canadian policy and case law relating to the granting of an aboriginal title, concluding that the criterion of exclusivity has become a defining issue in the development of a solution to overlaps between land claims. By observing the failures of the various levels of government in their attempts to develop solutions to overlapping claims, we find that Aboriginal legal traditions must be integrated into conflict resolution and be used when interpreting the exclusivity criterion. This requires us to perceive conflict resolution, as a legal institution, according to a certain understanding of the law. We use Lon Fuller’s vision, who presents an approach for reconciling various legal traditions. Our study brings us to propose the Indigenous Legal Lodge as a conflict resolution mechanism enabling Aboriginal groups to call upon their own legal traditions in resolving overlaps and to reconcile their differing traditions.

Lithium-ion Battery Modeling and Simulation for Aging Analysis using PyBaMM / Modellering och Simulering av Litiumjonbatterier för Åldringsanalys med hjälp av PyBaMM

The rate of degradation of a lithium-ion battery depends on its use i.e. how it is charged and discharged. Physics-based models are used to represent the processes inside a cell as well as the degradation mechanisms. This thesis aimed to compare how the battery lifetime is affected when charging with different charging protocols using different battery models and degradation mechanisms. The investigated models are the Single Particle Model (SPM), the Single Particle Model with electrolyte (SPMe), and the Doyle-Fuller Newman model (DFN). The degradation mechanisms are solid electrolyte interphase (SEI), and lithium plating (LP). The used charging protocols are constant-current constant voltage(CCCV), positive pulsed current (PPC), and constant current (CC). Pulsed charging was included to investigate if the battery lifetime can be improved as in an experiment by Huang where pulsed charging increased the battery lifetime by 60%. To perform the simulations using the physics-based models, PyBaMM (PythonBattery Mathematical Modeling) was used. The simulations were performed for a lithium cobalt oxide (LCO) cell. Two types of SEI were implemented, solvent-diffusion limited and reaction limited. For the LP only irreversible LP was used.1200 cycles were simulated. Comparing the PPC and CC protocols, there were no significant changes between the degradation mechanisms for the different protocols. The results were the same for all the models, except for the results of the internal resistance. The conclusion is that for the PPC and CC protocols, the cell degrades the same although the PPC protocol used twice the C-rate. The PPC charging did not increase the battery lifetime. For the CCCV and CC protocols, there were some bigger differences between the protocols, but between the different models, there weren’t any significant differences. The CCCV degrades the cell faster for all degradation mechanisms and all models. Simulating one degradation submodel at a time resulted in a very small capacity fade for some submodels. Therefore, for future work, it is suggested to use several degradation submodels at the same time but also to try other degradation mechanisms or try PPC protocols with different frequencies and duty cycles. / Hur snabbt litiumjonbatterier degraderas beror på hur de används, laddas och laddas ur. Denna studie har genomförts för att undersöka hur batteriets livslängd påverkas av olika laddningsprotokoll genom att använda olika batterimodeller och degraderingsmekanismer. Modellerna som användes är Singel-partikelmodellen (SPM), Singel-partikelmodellen med elektrolyt (SPMe) och Doyle-Fuller Newman-modellen (DFN). Degraderingsmekanismerna är fast elektrolytinterfas (SEI) och litiumplätering (LP). Laddningsprotokollen som användes är konstant ström konstant spänning (CCCV), positiv pulserande ström (PPC) och konstant ström konstant (CC). Protokollet för pulsad laddning inkluderades för att undersöka om batteriets livslängd kan förbättras som i ett experiment av Huang, där pulsad laddning ökade batteriets livslängdmed 60%. Slutsatsen är att för både PPC- och CC-protokollen så degraderades cellen på samma sätt, trots att PPC-protokollet använde dubbelt så hög C-faktor. PPC-protokollet ökade inte batteriets livslängd. För CCCV- och CC-protokollen fanns det några större skillnader mellan protokollen, men mellan de olika modellerna fanns det inga signifikanta skillnader. CCCV-protokollet försämrade cellen snabbare för alla degraderingsmekanismer och alla modeller. Att simulera en degraderingsmodell i taget resulterade i mycket små kapacitetsförluster. Därmed föreslås det att i framtida arbete använda flera degraderingsmodeller samtidigt men även testa andra degraderingsmekanismer eller PPC-protokoll med olika frekvenser och arbetscykler

De la consultation des peuples autochtones : structure institutionnelle d'un dialogue appelé à renouveler la notion des droits ancestraux : essai fondé sur la jurisprudence de la Cour suprême du Canada (1984-2004) et la théorie du droit

Le présent mémoire est consacré à l'étude de l'obligation faite à l'État canadien de consulter les autochtones lorsqu'il envisage de prendre des mesures portant atteinte à leurs droits et intérêts. On s'y interroge sur le sens que peut avoir cette obligation, si elle n'inclut pas celle de s'entendre avec les autochtones. Notre étude retrace d'abord l'évolution de l'obligation de consulter dans la jurisprudence de la Cour suprême du Canada, pour se pencher ensuite sur l'élaboration d'un modèle théorique du processus consultatif. En observant la manière dont la jurisprudence relative aux droits ancestraux a donné naissance à l'obligation de consulter, on constate que c'est en s'approchant au plus près de l'idée d'autonomie gouvernementale autochtone - soit en définissant le titre ancestral, droit autochtone à la terre elle-même - que la Cour a senti le besoin de développer la consultation en tant que véritable outil de dialogue entre l'État et les Premières nations. Or, pour assurer la participation réelle des parties au processus de consultation, la Cour a ensuite dû balancer leur rapport de forces, ce qu'elle a fait en admettant le manque de légitimité du pouvoir étatique sur les autochtones. C'est ainsi qu'après avoir donné naissance au processus de consultation, la jurisprudence relative aux droits ancestraux pourrait à son tour être modifiée substantiellement par son entremise. En effet, l'égalité qu'il commande remet en question l'approche culturaliste de la Cour aux droits ancestraux, et pourrait l'amener à refonder ces droits dans le principe plus égalitaire de continuité des ordres juridiques autochtones. Contrairement à l'approche culturaliste actuelle, ce principe fait place à la reconnaissance juridique de l'autonomie gouvernementale autochtone. La logique interne égalitaire du processus de consultation ayant ainsi été exposée, elle fait ensuite l'objet d'une plus ample analyse. On se demande d'abord comment concevoir cette logique sur le plan théorique. Ceci exige d'ancrer la consultation, en tant qu'institution juridique, dans une certaine vision du droit. Nous adoptons ici celle de Lon Fuller, riche de sens pour nos fins. Puis, nous explicitons les principes structurants du processus consultatif. Il appert de cette réflexion que l'effectivité de la consultation dépend de la qualité du dialogue qu'elle engendre entre les parties. Si elle respecte sa morale inhérente, la consultation peut générer une relation morale unique entre les autochtones et l'État canadien. Cette relation de reconnaissance mutuelle est une relation de don. / In this essay, we study the Canadian State's duty to consult Aboriginal peoples when it purports to infringe on their rights and interests. We start with the following question: What meaning, if any, does the duty to consult have, if it does not include a duty to reach a consensus ? Our study is divided in two parts. First, we trace the evolution of the duty to consult in the decisions of the Supreme Court of Canada. Secondly, we discuss a theoretical model for the consultation process. Our study of the genesis and subsequent evolution of the duty to consult reveals that this duty gains some ambit when the Court is called upon to define the notion of aboriginal title - the type of aboriginal right that cornes closest to full aboriginal self-government on a piece of land. In its effort to construct the consultation process, the Court soon realizes that if it wants both parties to really engage in it, it has to balance their relationship, something the Court does by admitting the State's lack of legitimate authority over the Aboriginals. But affirming the equal status of both parties in the consultation process leads to further consequences than the mere effectiveness of that process. Aboriginal equality does not fit weIl within the Court's cultural approach to aboriginal rights. The common law doctrine of continuity of the aboriginal legal orders is more congenial to that equality, as it leads naturally to the legal recognition of a measure of aboriginal autonomy within Canada. Thus, after giving birth to the consultation process, the law of aboriginal rights could itself be substantially modified through the logical implications of its own offspring. Having exposed the egalitarian logic inherent to the consultation process, we proceed to study that logic in further detail. We ground our quest for the inherent structure of consultation in a larger understanding of the law itself, which proceeds from Lon Fuller' s view of law as facilitating human interaction. We then discuss the principles that give content to a consultation process directed to achieve reconciliation. Effective consultation depends on the quality of the dialogue that it generates. Appropriately conceived and implemented, the consultation process between Aboriginal peoples and the State embodies a unique moral relationship, one of mutual recognition, capturing the' spirit of giving'.

Active Enchantments: Form, Nature, and Politics in American Literature

Situated at the crossroads of literary studies, ecocriticism and political theory, Active Enchantments explores a strain of thought within American literature that understands life in all of its forms to be generated not by self determined identities, but by interconnectedness and self abandonment. I argue that this interest led American writers across the nineteenth century to develop theories of subjectivity and of politics that not only emphasize the entanglement of the self with its environment, but also view this relationship as structured by self overcoming. Thus, when Emerson calls such interconnectedness "active enchantment," he means to signal life's inherent ability to constantly surpass itself, to never fully be identical with itself. My dissertation brings to the fore the political and ecological stakes of this paradox: if our selves and communities are molded by self abandonment, then the standard scholarly account of how nineteenth century American literature conceptualized politics must be revised. Far from understanding community as an organic production, founded on a teleological and harmonizing principle, the writers I study reconceive it around a sense of a commonality irreducible to fixed identity. The politics emerging out of such redefinition disposes with the primacy of individual or human agency, and becomes ecological in that it renders inoperative the difference between the social and the natural, the human and the non human, ourselves and what comprises us. It is the ecological dimension of what seems like a properly political question that brings together writers as diverse as Emerson and Sarah Orne Jewett, Margaret Fuller and Henry and William James. I argue, for example, that in Jewett's The Country of the Pointed Firs, racial minorities emerge from geological strata as a kind of natural archive that complicates the nation's understanding of its communal origin. When she sets her romances on Native American shell mounds in Maine, or makes the health of a New England community depend on colonial pharmacopoeia and herbalist healing practices of the West Indies, Jewett excavates from history its silent associations and attunes us not only to the violent foundation of every communal identity, but to this identity's entanglement in a number of unacknowledged relations. Her work thus ultimately challenges the procedures of democratic inclusiveness that, however non violent, are nevertheless always organized around a particular notion of identity. The question of the self's constitutive interconnectedness with the world is as central to Margaret Fuller's work. Active Enchantments documents how Fuller's harrowing migraines enabled her to generate a peculiar conception of the "earthly mind," according to which the mind is material and decomposable, rather than spiritual, incorruptible or ideal. This notion eventually led her to devise a theory of the self that absolves persons from self possession and challenges the distinctiveness of personal identity. My concluding chapter argues that Henry James's transnational aesthetics was progressively politicized in the 1880s, and that what scholarship celebrates as the peak of his novelistic method develops, in fact, out of a network of surprising and heretofore unexplored influences, William James's concurrent theories of corporeal emotion, Mikhail Bakunin's anarchism, and Henry James's friendship with Ivan Turgenev, which inflamed James's interest in British politics, the Russo Turkish War, and the Balkan revolutions.

Comparing South African financial markets behaviour to the geometric Brownian Motion Process

<p>This study examines the behaviour of the South African financial markets with regards to the Geometric Brownian motion process. It uses the daily, weekly, and monthly stock returns time series of some major securities trading in the South African financial market, more specifically the US dollar/Euro, JSE ALSI Total Returns Index, South African All Bond Index, Anglo American Corporation, Standard Bank, Sasol, US dollar Gold Price , Brent spot oil price, and South African white maize near future. The assumptions underlying the&nbsp / Geometric Brownian motion in finance, namely the stationarity, the normality and the independence of stock returns, are tested using both graphical (histograms and normal plots)&nbsp / and statistical test (Kolmogorov-Simirnov test, Box-Ljung statistic and Augmented Dickey-Fuller test) methods to check whether or not the Brownian motion as a model for South&nbsp / African financial markets holds. The Hurst exponent or independence index is also applied to support the results from the previous test. Theoretically, the independent or Geometric&nbsp / Brownian motion time series should be characterised by the Hurst exponent of &frac12 / . God and Slavery in America: Francis Wayland and the Evangelical Conscience

The work examines the antislavery writings of Francis Wayland (1796-1865). Wayland pastored churches in Boston and Providence, but he left his indelible mark as the fourth and twenty-eight year president of Brown University (1827-1855). The author of numerous works on moral science, economics, philosophy, education, and the Baptist denomination, his administration marked a transitional stage in the emergence of American colleges from a classically oriented curriculum to an educational philosophy based on science and modern languages. Wayland left an enduring legacy at Brown, but it was his antislavery writings that brought him the most notoriety and controversy. Developed throughout his writings, rather than systematically in a major work, his antislavery views were shaped and tested in the political and intellectual climate of the antebellum world in which he lived. First developed in The Elements of Moral Science (1835), he tested the boundaries of activism in The Limitations of Human Responsibility (1838), and publicly debated antislavery in Domestic Slavery Considered as a Scriptural Institution (1845). The political crisis from the Mexican-American War through the Kansas-Nebraska Act heightened Wayland’s activism as delineated in The Duty of Obedience to the Civil Magistrate (1847), his noncompliance with the Fugitive Slave Law, and his public address on the Kansas-Nebraska Bill (1854). In 1861 he became a committed Unionist. I argue that Francis Wayland was a mediating figure in the controversy between abolitionists and proslavery apologists and that his life was a microcosm of the transition that many individuals made from moderate antislavery to abolitionism. Wayland proved unique in that he was heavily coveted by Northern abolitionists who sought his unconditional support and yet he was respected by Southerners who appreciated his uncondemning attitude toward slaveholders even while he opposed slavery. I argue that Wayland’s transition from reluctant critic to public activist was not solely due to the political sweep of events, but that his latter activism was already marked in his earlier work. Most importantly, his life demonstrated both the limits and possibilities in the history of American antislavery.

De la consultation des peuples autochtones : structure institutionnelle d'un dialogue appelé à renouveler la notion des droits ancestraux : essai fondé sur la jurisprudence de la Cour suprême du Canada (1984-2004) et la théorie du droit

Le présent mémoire est consacré à l'étude de l'obligation faite à l'État canadien de consulter les autochtones lorsqu'il envisage de prendre des mesures portant atteinte à leurs droits et intérêts. On s'y interroge sur le sens que peut avoir cette obligation, si elle n'inclut pas celle de s'entendre avec les autochtones. Notre étude retrace d'abord l'évolution de l'obligation de consulter dans la jurisprudence de la Cour suprême du Canada, pour se pencher ensuite sur l'élaboration d'un modèle théorique du processus consultatif. En observant la manière dont la jurisprudence relative aux droits ancestraux a donné naissance à l'obligation de consulter, on constate que c'est en s'approchant au plus près de l'idée d'autonomie gouvernementale autochtone - soit en définissant le titre ancestral, droit autochtone à la terre elle-même - que la Cour a senti le besoin de développer la consultation en tant que véritable outil de dialogue entre l'État et les Premières nations. Or, pour assurer la participation réelle des parties au processus de consultation, la Cour a ensuite dû balancer leur rapport de forces, ce qu'elle a fait en admettant le manque de légitimité du pouvoir étatique sur les autochtones. C'est ainsi qu'après avoir donné naissance au processus de consultation, la jurisprudence relative aux droits ancestraux pourrait à son tour être modifiée substantiellement par son entremise. En effet, l'égalité qu'il commande remet en question l'approche culturaliste de la Cour aux droits ancestraux, et pourrait l'amener à refonder ces droits dans le principe plus égalitaire de continuité des ordres juridiques autochtones. Contrairement à l'approche culturaliste actuelle, ce principe fait place à la reconnaissance juridique de l'autonomie gouvernementale autochtone. La logique interne égalitaire du processus de consultation ayant ainsi été exposée, elle fait ensuite l'objet d'une plus ample analyse. On se demande d'abord comment concevoir cette logique sur le plan théorique. Ceci exige d'ancrer la consultation, en tant qu'institution juridique, dans une certaine vision du droit. Nous adoptons ici celle de Lon Fuller, riche de sens pour nos fins. Puis, nous explicitons les principes structurants du processus consultatif. Il appert de cette réflexion que l'effectivité de la consultation dépend de la qualité du dialogue qu'elle engendre entre les parties. Si elle respecte sa morale inhérente, la consultation peut générer une relation morale unique entre les autochtones et l'État canadien. Cette relation de reconnaissance mutuelle est une relation de don. / In this essay, we study the Canadian State's duty to consult Aboriginal peoples when it purports to infringe on their rights and interests. We start with the following question: What meaning, if any, does the duty to consult have, if it does not include a duty to reach a consensus ? Our study is divided in two parts. First, we trace the evolution of the duty to consult in the decisions of the Supreme Court of Canada. Secondly, we discuss a theoretical model for the consultation process. Our study of the genesis and subsequent evolution of the duty to consult reveals that this duty gains some ambit when the Court is called upon to define the notion of aboriginal title - the type of aboriginal right that cornes closest to full aboriginal self-government on a piece of land. In its effort to construct the consultation process, the Court soon realizes that if it wants both parties to really engage in it, it has to balance their relationship, something the Court does by admitting the State's lack of legitimate authority over the Aboriginals. But affirming the equal status of both parties in the consultation process leads to further consequences than the mere effectiveness of that process. Aboriginal equality does not fit weIl within the Court's cultural approach to aboriginal rights. The common law doctrine of continuity of the aboriginal legal orders is more congenial to that equality, as it leads naturally to the legal recognition of a measure of aboriginal autonomy within Canada. Thus, after giving birth to the consultation process, the law of aboriginal rights could itself be substantially modified through the logical implications of its own offspring. Having exposed the egalitarian logic inherent to the consultation process, we proceed to study that logic in further detail. We ground our quest for the inherent structure of consultation in a larger understanding of the law itself, which proceeds from Lon Fuller' s view of law as facilitating human interaction. We then discuss the principles that give content to a consultation process directed to achieve reconciliation. Effective consultation depends on the quality of the dialogue that it generates. Comparing South African financial markets behaviour to the geometric Brownian Motion Process

<p>This study examines the behaviour of the South African financial markets with regards to the Geometric Brownian motion process. It uses the daily, weekly, and monthly stock returns time series of some major securities trading in the South African financial market, more specifically the US dollar/Euro, JSE ALSI Total Returns Index, South African All Bond Index, Anglo American Corporation, Standard Bank, Sasol, US dollar Gold Price , Brent spot oil price, and South African white maize near future. The assumptions underlying the&nbsp / Geometric Brownian motion in finance, namely the stationarity, the normality and the independence of stock returns, are tested using both graphical (histograms and normal plots)&nbsp / and statistical test (Kolmogorov-Simirnov test, Box-Ljung statistic and Augmented Dickey-Fuller test) methods to check whether or not the Brownian motion as a model for South&nbsp / African financial markets holds. The Hurst exponent or independence index is also applied to support the results from the previous test. Theoretically, the independent or Geometric&nbsp / Brownian motion time series should be characterised by the Hurst exponent of &frac12 / . Para llegar hasta allí comenzaremos por esbozar lo que entenderemos por Positivismo Jurídico, mostrando sus cimientos y analizando a sus principales exponentes para posteriormente explicar la existencia de una moral interna en el derecho y como puede ser ésta el camino para conectarse con la justicia apreciando la relación de alteridad que debe haber entre ambos conceptos si se quiere hacer frente a la urgente amenaza que significa la irrupción del estado de excepción.
