Soudnost a jednání. Studie k problému souzení u Arendtové a Gadamera / Judgment and Action. On the Concept of Judging in Arendt and Gadamer

The dissertation focuses on the theme of practical judgment (i.e. judgment related to human action) in Hannah Arendt and Hans-Georg Gadamer. Despite substantial differences in philosophical approaches, perspectives and motivation, I show that there are important areas of overlapping. I approach the problem of judgment in a systematic way, being fully aware that especially Hannah Arendt does not treat judgment systematically; what is more, a book she meant to dedicate to the problem of judging remained unwritten. The dissertation is divided into three parts. I start with the relation between judgment and rules. The second theme is judgments' validity, especially the specific kind of validity of political and moral judgments, while the third part concentrates on how judgment is related to other people and the world. I also try to evaluate the way Arendt interprets Kant's theory of aesthetic judgment as well as Gadamer's criticism of Kant. In the third part I investigate not so well known areas of Gadamer's and Arendt's philosophy such as their notion of solidarity and the way how they grasp the relation between judgment and responsibility (or responsibility of judgment, both towards one's own self and towards the world).

Lek för lekens skull : En fältstudie av meningsskapande i barnens fria lek på förskolan

Lek som en spontan aktivitet fritt vald av barnen, utan aktiv vuxen-styrning eller lärandemål (s.k. ”fri” lek), är enligt många väldigt viktig för barn. Det är därför nödvändigt att bejaka den fria lekens egenvärde och utrymme i praktiken som en egen och separat typ av lek, vilket kan underlättas genom mer förståelse av vad som sker i fri lek. Syftet med studien är att med hjälp av Gadamers begrepp horisont och horisontsammansmältning analysera barnens meningsskapande i fri lek, där frågeställningarna har handlat om hur detta yttrade sig i barnens fria lek. För att besvara syftet gjordes fältstudier vid en förskola, där jag som passivt deltagande observatör kunde studera en grupp barn, 5 år gamla, i deras fria lekar. Dessa utspelade sig i olika miljöer, inomhus och utomhus på förskolan, samt i skogen, och varje leksituation omfattade 1-1,5 timmar. Tre utvalda leksituationer visade på betydande meningsskapande, vilket framkom efter en tolkningsanalys av vad barnen både sa, gjorde och lekarnas tema/handling. Meningsskapandet var mångsidigt, eftersom det inbegrep kroppslig (och viss verbal) härming/imitation, dialoger, användandet av föremål samt andra kroppsliga/sinnliga erfarenheter, vilket knöts an till olika teman/handlingar under den fria lekens gång. Barnens korta/sporadiska dialoger, hur de ändrade på vad de gjorde samt förändringar i lekens teman/handlingar bidrog till fria lekens spontanitet. Barnen eftersträvade aktivt att dela sina förståelser och tolkningar med varandra, med målet att hitta gemensamma tolkningar av omvärlden i enlighet med horisontsammansmältning. Detta uppstod först efter en viss tid av oavbruten fri lek, och kunde observeras i varierande lekmiljöer. Slutsatserna blev att barnens meningskapande i den fria leken var mångfacetterad, hade inslag av spontanitet och blev tydligare ju längre leken pågick, samt att dessa aspekter inte var beroende av en viss sorts lekmiljö.

It results from a study aimed at approximating Hans-Georg Gadamer’s philosophical hermeneutics and legal hermeneutics, and was focused on presenting some of the main concepts of Gadamerian hermeneutics and on discussing their possible application to interpreting the legal sphere. The theoretical approach, besides the very core philosophical perspective of Gadamer, involved a survey on authors that have developed analyses of Gadamerian assumptions. Additionally, the study sought to exemplify the application, showing a possible broadened reading of the concept of hermeneutic circle proposed by the author. It was verified that some of the core concepts in Gadamer’s philosophy – such as hermeneutic circle, tradition, temporal distance, historically effected consciousness and application, as a way of understanding – are applicable to legal hermeneutics, allowing a deeper and dialectic reflection on the area. Thus, it is a qualitative study of exploratory character whose methodological procedures started from a bibliographic survey including an effort to translate original texts. / O presente trabalho transita entre duas áreas do conhecimento: a Filosofia e o Direito. É resultado de um estudo que visa à aproximação da hermenêutica filosófica de Hans- Georg Gadamer com a hermenêutica jurídica, tendo como objetivo apresentar alguns dos principais conceitos tratados pelo autor e discutir a possibilidade de sua aplicação à interpretação na esfera do Direito. A abordagem teórica envolveu, além da própria perspectiva filosófica central de Gadamer, a pesquisa de autores que fazem uma análise dos seus pressupostos. Buscou-se exemplificar, ainda, tal aplicação, por meio de uma possível leitura ampliada do conceito de círculo hermenêutico proposto pelo autor. Verificou-se, afinal, que determinados conceitos fundamentais da filosofia de Gadamer – tais como o círculo hermenêutico, a tradição, a distância temporal, a “consciência da história dos efeitos” e a aplicação como forma de compreensão – são aplicáveis à hermenêutica jurídica, possibilitando uma reflexão mais aprofundada e dialética dessa área. Trata-se, portanto, de um estudo qualitativo, de cunho exploratório, cujos procedimentos metodológicos partiram de levantamento bibliográfico, com esforço de tradução dos textos originais.
