The economics of commodity promotion in the hazelnut industry

The objective of this study was to evaluate the effect of commodity promotion activities on the United States' hazelnut farmer's economic welfare. Commodity promotion activities, such as generic advertising and research, are the responsibilities of government mandated commodity commissions, such as the Hazelnut Marketing Board (HMB). The HMB is a state mandated cartel, organized under the Agricultural Marketing Agreement Act of 1937 (i.e. the Marketing Order) and amended in 1981, 1986, and 1989 (7 CFR Part 982, FR Doc. 81-14045 FR Doc. 86-18438, FR Doc. 89-26187). HMB promotion activities are funded by taxes levied on U.S. hazelnut farmers. To ensure that promotion provides a net benefit to these farmers this research uses Cost-Benefit Analysis (CBA) of the assessments under various assumptions about the market's conditions. A non-linear system of equations (SEM) with Monte Carlo simulation was utilized to produce these estimates. / Graduation date: 2013

Investigation Of Ramp/Cowl Shock Interaction Processes Near A Generic Scramjet Inlet At Hypersonic Mach Number

One of the major technological innovations that are necessary for faster and cheaper access-to-space will be the commercial realization of supersonic combustion jet engines (SCRAMJET). The establishment of the flow through the inlet is one the prime requirement for the success of a SCRAMJET engine. The flow through a SCRAMJET inlet is dominated by inviscid /viscous coupling, transition, shock-shock interaction, shock boundary layer interaction, blunt leading edge effects and flow profile effects. Although the literature is exhaustive on various aspects of flow features associated with SCRAMJET engines, very little is known on the fundamental gasdynamic features dictating the flow establishment in the SCRAMJET inlet. On one hand we need the reduction of flight Mach number to manageable supersonic values inside the SCRAMJET combustor, but on the other hand we have to achieve this with minimum total pressure loss. Hence the dynamics of ramp/cowl shock interaction process ahead of the inlet has a direct bearing on the quality and type of flow inside the SCRAMJET engine. There is virtually no data base in the open literature focusing specifically on the cowl/ramp shock interactions at hypersonic Mach numbers. Hence in this backdrop, the main aim of the present investigation is to systematically understand the ramp/cowl shock interaction processes in front of a generic inlet model. Since we are primarily concerned with the shock interaction process ahead of the cowl all the investigations are carried out without any fuel injection. Variable geometry is necessary if we want to operate the inlet for a wide range of Mach numbers in actual flight. The investigation mainly comprises of three variable geometry configurations; namely, variation of contraction ratios at 00 cowl (CR 8.4, 5.0 and 4.3), variation of cowl length for a given chamber height (four lengths of cowls at 10 mm chamber height) and variation of cowl angle (three angles cowl each for two chamber heights). The change in cowl configuration results in different ramp/cowl shock interaction processes affecting the performance of the inlet. Experiments are performed in IISc hypersonic shock tunnel HST 2 (test time ~ 1 ms) at two nominal Mach numbers 8.0 and 5.74 for design and off-design testing conditions. Exhaustive numerical simulations are also performed to compliment the experiments. Further the effect of concentrated energy deposition on forebody /cowl shock interactions has also been investigated. A 2D, planar, single ramp scramjet inlet model has been designed and fabricated along with various cowl geometries and tested in a hypersonic shock tunnel to characterize the forebody/cowl shock interaction process for different inlet configurations. Further a DC plasma power unit and a plasma torch have been designed, developed and fabricated to serve as energy source for conducting flow-alteration experiments in the inlet model. The V-I characteristics of the plasma torch is studied and an estimation of plasma temperature is also performed as a part of characterizing the plasma flame. Initial standardization experiments of blunt body flow field alteration using the plasma torch and hence its drag reduction, are performed to check the torch’s suitability to be used as a flow-altering device in a shock tunnel. The plasma torch is integrated successfully with the inlet model in a shock tunnel to perform experiments with plasma jet as the energy source. The above experiments are first of its kind to be conducted in a shock tunnel. They are performed at various pressure ratios and supply currents. Time resolved schlieren flow visualization using Phantom 7.1 (Ms Vision Research USA) high speed camera, surface static pressure measurements inside a generic inlet using miniature kulite transducer and surface convective heat transfer rate measurements inside a generic inlet using platinum thin film sensors deposited on Macor substrate are some of the shock tunnel flow diagnostics that have been used in this study. Some of the important conclusions from the study are: • Experiments performed at different contraction ratios show different shock patterns. At CR 8.4, the SOL condition is satisfied, but the flow gets choked due to over contraction and flow through inlet is not established. For CR 5.0, formation of a small Mach stem before the chamber is observed with the reflection point on the cowl and the weak reflected shock entering inside the chamber. The Mach stem grows with time. For CR 4.3, the forebody/cowl shock interference created an Edney’s Type II shock interaction pattern. However, at off-design conditions, for CR 5 the shock reflection is regular and at CR 4.3, the Edney’s Type II pattern lasts for a short time. • For all lengths of cowl tested, 131mm and 141mm showed Edney’s Type II shock interference where as 151mm showed Edney’s Type I pattern at design condition. In all cases the flow is choked for high contraction ratio. At off-design condition these shock patterns do not last for the entire test time but rather it becomes a lambda pattern with the normal shock before the inlet. • For inlet configurations with cowl angle other than 00, the flow is found to be established for all cases at designed condition and except for 100 cowl at off-design condition. • For CR 8.4 the peak value of pressure (~1.7x104 Pa) occurs at a location of 151mm, where as for CR 5.0 and 4.3 they occur at 188mm and 206mm having values ~1.6x104 Pa and ~1.4x104 Pa respectively. These locations indicate the likely locations of shock impingements inside the chamber. • For cowl angle of 00 for a 10 mm chamber the maximum pressure value recorded is ~1.7x104 Pa whereas for 100 and 200 cowl it is ~1.1x104 Pa and 1.2 x104 Pa respectively. This is because in the first case the inlet is choked because of over contraction whereas in the other two cases the CR is less and flow is established inside the inlet. • The average heat transfer rates of last four heat transfer gauges (180 mm, 190 mm, 200 mm and 210 mm from the forebody tip) for all lengths of cowls tested are found to be almost same (~ 20 W/cm2). This is because the flow is choked in all these cases. The numerical simulation also shows uniform distribution here, consistent with the experimental findings. • The locations of heat transfer peaks for 100 cowl at design condition can be observed to be occurring at 170 mm and 200 mm from the forebody tip having values ~44 W/cm2 and ~39 W/cm2 respectively. For a 200 cowl they seem to be occurring at 170 mm and 180 mm from the forebody tip having values ~50 W/cm2 and ~30 W/cm2. These locations indicate the likely locations of shock impingements inside the chamber. With the evolution of concept of upstream fuel injection in recent times these may the most appropriate locations for fuel injection. • At higher jet pressure ratios the plasma jet/ramp shock interaction results in a lambda shock pattern with the triple point forming vertically above the cowl level. This means the normal shock stands in front of the inlet making a part of the flow entering the inlet subsonic. The reflected shock from the triple point also separates the ramp boundary layer. • At lower jet pressure ratios the triple point is formed below the cowl level and the flow entering inside the inlet is supersonic. The reflected shock interacts with the cowl shock and a weak separation shock is seen. • Experiments are performed with concentrated DC electric discharge as energy source. Even though the amount of energy dumped here is less than 0.25% of the total energy it creates a perceptible disturbance in the flow. • Experiments are also performed to see the effect of electric discharge as energy source on height of Mach stem for a given inlet configuration. Deposition of energy in the present location does not seem to alter the Mach stem height. However more experiments need to be performed by varying the energy location to see its effect. Non-intrusive energy sources like microwave and lasers can be thought of as options for depositing energy to study its effect on Mach stem height. Since they provide more flexibility on varying the location of energy the optimum location of energy can be found out for highest reduction of Mach stem height.

Alternative leistungselektronische Schaltungskonzepte im PKW-Innenraum / Entwurf, Optimierung und Bewertung

Elektronische und elektrische Systeme stellen seit einigen Jahren einen zunehmenden Anteil an den Gesamtproduktionskosten von Personenkraftfahrzeugen. Laut Prognosen wird sich diese Entwicklung zwar abschwächen, jedoch wird der Wertschöpfungsanteil der Elektronik am Fahrzeug weiter zunehmen. Die hier vorliegende Arbeit beschäftigt sich mit leistungselektronischen Subsystemen in PKW, die aufgrund der benötigten Chipfläche der Halbleiter kostenintensiv sind. Ziel der Arbeit ist es, Strukturen zu entwickeln und zu untersuchen, die es ermöglichen, mehrere Verbraucher in einer solchen Struktur zu betreiben und dadurch Leistungshalbleiter einzusparen. In einer Analyse werden die derzeitige Struktur der Verbraucher im Fahrzeug, die dazugehö-rige Elektronik und die zeitlichen Abhängigkeiten der Verbraucher untereinander dargestellt. Die Analyse kommt zu dem Schluss, dass die Verbraucher im Fahrzeug auf den jeweiligen Einsatzzweck hin optimiert sind. Dadurch sind sie kostengünstig und einfach aufgebaut. Ge-meinsamkeiten, die für eine Vereinheitlichung der Leistungselektronik genutzt werden kön-nen, können unter Beachtung der betrachteten Systeme gefunden werden. Daraus werden Anforderungen an alternative leistungselektronische Strukturen formuliert. In der Arbeit werden zwei leistungselektronische Schaltungen untersucht, die den Forderun-gen nach einer Einsparung von Leistungshalbleitern gerecht werden. Bei der matrixförmigen Vernetzungsschaltung sind die Versorgungsleitungen in Zeilen und Spalten angeordnet, zwi-schen denen die Verbraucher angeschlossen sind. Bei der linearen Vernetzungsschaltung be-nutzen alle an einer Struktur angeschlossenen Verbraucher teilweise eine gemeinsame und eine individuelle Leistungselektronik. Dabei wird ein geringerer Vernetzungsgrad erreicht. Bei der matrixförmigen Vernetzungsschaltung wird ein hoher Vernetzungsgrad erzielt. Hier-bei kann eine Vielzahl von Verbrauchern mit vergleichsweise wenig Leistungselektronik be-trieben werden. Der hohe Vernetzungsgrad hat Bedingungen an die Anordnung der in der Struktur befindlichen Verbraucher zur Folge, die es nur bei kleinen Strukturen ermöglichen ohne Hilfsmittel eine optimale Struktur zu entwerfen. Für größere Strukturen werden Me-thoden benötigt, um die Anordnung der Verbraucher so zu gestalten, dass die Bedingungen an den gleichzeitigen Betrieb in der Applikation erfüllt werden können. Diese Aufgabe entspricht dem mathematischen Problemkreis der kombinatorischen Optimierung. Als Lösungsmethoden werden die Ganzzahlige Lineare Programmierung, die in jedem Fall ein exaktes Ergebnis er-reicht, und Genetische Algorithmen verwendet, die auch bei sehr großen Strukturen ein opti-miertes Ergebnis erzielen können. Die Genetischen Algorithmen werden in dieser Arbeit auf das Problem und dessen Darstellung angepasst, und die Ergebnisse der Optimierung mit de-nen der exakten Verfahren verglichen. Ergebnisse zeigen, dass die auf die Problemstellung angepassten Genetischen Algorithmen mit hoher Sicherheit das globale Optimum finden. Es werden matrixförmige und lineare Strukturen für eine Sitzsteuerung und eine Klappen-verstellung einer Klimaanlage entworfen, mit den beschriebenen Methoden optimiert und nachfolgend bewertet. In der Bewertung wird gezeigt, dass die entworfenen alternativen Strukturen den konventionellen teilweise überlegen sind und je nach elektronischem System zu einer deutlichen Kosteneinsparung führen können. In den untersuchten Systemen hat sich die lineare Struktur als besonders vorteilhaft herausgestellt.

Generic Quality-Aware Refactoring and Co-Refactoring in Heterogeneous Model Environments

Software has been subject to change, at all times, in order to make parts of it, for instance, more reusable, better to understand by humans, or to increase efficiency under a certain point of view. Restructurings of existing software can be complex. To prevent developers from doing this manually, they got tools at hand being able to apply such restructurings automatically. These automatic changes of existing software to improve quality while preserving its behaviour is called refactoring. Refactoring is well investigated for programming languages and mature tools exist for executing refactorings in integrated development environments (IDEs). In recent years, the development paradigm of Model-Driven Software Development (MDSD) became more and more popular and we experience a shift in the sense that development artefacts are considered as models which conform metamodels. This can be understood as abstraction, which resulted in the trend that a plethora of new so-called model-based Domain-Specific Languages (DSLs) arose. DSLs have become an integral part in the MDSD and it is obvious that models are subject to change, as well. Thus, refactoring support is required for DSLs in order to prevent users from doing it manually. The problem is that the amount of DSLs is huge and refactorings should not be implemented for new for each of them, since they are quite similar from an abstract viewing. Existing approaches abstract from the target language, which is not flexible enough because some assumptions about the languages have to be made and arbitrary DSLs are not supported. Furthermore, the relation between a strategy which finds model deficiencies that should be improved, a resolving refactoring, and the improved quality is only implicit. Focussing on a particular quality and only detecting those deficiencies deteriorating this quality is difficult, and elements of detected deficient structures cannot be referred to in the resolving refactoring. In addition, heterogeneous models in an IDE might be connected physically or logically, thus, they are dependent. Finding such connections is difficult and can hardly be achieved manually. Applying a restructuring in a model implied by a refactoring in a dependent model must also be a refactoring, in order to preserve the meaning. Thus, this kind of dependent refactorings require an appropriate abstraction mechanism, since they must be specified for dependent models of different DSLs. The first contribution, Role-Based Generic Model Refactoring, uses role models to abstract from refactorings instead of the target languages. Thus, participating structures in a refactoring can be specified generically by means of role models. As a consequence, arbitrary model-based DSLs are supported, since this approach does not make any assumptions regarding the target languages. Our second contribution, Role-Based Quality Smells, is a conceptual framework and correlates deficiencies, their deteriorated qualities, and resolving refactorings. Roles are used to abstract from the causing structures of a deficiency, which then are subject to resolving refactorings. The third contribution, Role-Based Co-Refactoring, employs the graph-logic isomorphism to detect dependencies between models. Dependent refactorings, which we call co-refactorings, are specified on the basis of roles for being independent from particular target DSLs. All introduced concepts are implemented in our tool Refactory. An evaluation in different scenarios complements the thesis. It shows that role models emerged as very powerful regarding the reuse of generic refactorings in arbitrary languages. Role models are suited as an interface for certain structures which are to be refactored, scanned for deficiencies, or co-refactored. All of the presented approaches benefit from it.

Application of a non-linear thermodynamic master equation to three-level quantum systems / Εφαρμογή μιας μη-γραμμικής θερμοδυναμικής εξίσωσης master σε κβαντικά συστήματα τριών καταστάσεων

In this Master’s thesis, we have focused on the description of three-level quantum systems through master equations for their density matrix, involving a recently proposed non-linear thermodynamic one. The first part is focused on a three-level system interacting with two heat baths, a hot and a cold one. We investigated the rate of heat flow from the hot to the cold bath through the quantum system, and how the steady-state is approached. Additional calculations here refer to the rate of entropy production and the evolution of all elements of the density matrix of the system from an arbitrary initial state to their equilibrium or steady-state value. The results are compared against those of a linear, Lindblad-type master equation designed so that for a quantum system interacting with only one heat bath, the same final Gibbs steady state is attained. In the second part of this thesis, we focus on the electromagnetically induced transparency (EIT), a phenomenon typically achievable only in atoms with specific energy structures. For a three level system (to which the present study has focused), for example, EIT requires two dipole allowed transitions (the 1-3 and the 2-3) and one forbidden (the 1-2). The phenomenon is observed when a strong laser (termed the control laser) is tuned to the resonant frequency of the upper two levels. Then, as a weak probe laser is scanned in frequency across the other transition, the medium is observed to exhibit both: a) transparency at what was the maximal absorption in the absence of the coupling field, and b) large dispersion effects at the atomic resonance. We discuss the Hamiltonian describing the phenomenon and we present results from two types of master equations: a) an empirically modified Von-Neumann one allowing for decays from each energy state, and b) a typical Lindblad one, with time-dependent operators. In the first case, an analytical solution is possible, which has been confirmed through a direct solution of the full master equation. In the second case, only numerical results can be obtained. We present and compare results from the two master equations for the susceptibility of the system with respect to the probe field, and we discuss them in light also of available experimental data for this very important phenomenon. / Η παρούσα εργασία επικεντρώνεται στην περιγραφή των κβαντικών συστημάτων τριών καταστάσεων μέσω εξισώσεων master για την μήτρα πυκνότητας πιθανότητάς τους (density matrix), συμπεριλαμβάνοντας μία πρόσφατα προτεινόμενη μη-γραμμική θερμοδυναμική εξίσωση. Το πρώτο μέρος εστιάζει σε ένα σύστημα τριών καταστάσεων το οποίο βρίσκεται σε αλληλεπίδραση με δύο λουτρά θερμότητας, ένα θερμό και ένα ψυχρό. Εξετάζεται ο ρυθμός ροής θερμότητας από το θερμό προς το ψυχρό λουτρό μέσω του κβαντικού συστήματος, και με ποιον τρόπο επιτυγχάνεται η μόνιμη κατάσταση. Επιπλέον υπολογισμοί αναφέρονται στον ρυθμό παραγωγής της εντροπίας και στην εξέλιξη όλων των στοιχείων της μήτρας πυκνότητας πιθανότητας από μία τυχαία αρχική κατάσταση προς την ισορροπία ή τη μόνιμη κατάσταση. Το φαινόμενο παρατηρείται όταν ένα ισχυρό laser (το αποκαλούμενο ως control laser) συντονίζεται στη συχνότητα των δύο άνω ενεργειακών σταθμών. Τότε, καθώς ένα ασθενές probe laser ανιχνεύεται με συχνότητα όμοια με της άλλης επιτρεπόμενης μετάβασης, το μέσο παρατηρείται να εμφανίζει τα εξής: α) διαφάνεια στο σημείο μέγιστης απορρόφησης απουσία του control πεδίου, και β) έντονα φαινόμενα διασποράς στον ατομικό συντονισμό. Θα συζητήσουμε τη Χαμιλτονιανή που περιγράφει το φαινόμενο και θα παρουσιάσουμε αποτελέσματα από δύο εξισώσεις master: α) μία εμπειρική τροποποιημένη Von-Neumann εξίσωση επιτρέποντας τις απώλειες από κάθε ενεργειακή κατάσταση, και β) μία τυπική Lindblad εξίσωση, με χρόνο-εξαρτώμενους τελεστές. Στην πρώτη περίπτωση, είναι πιθανή η εύρεση μιας αναλυτικής λύσης, η οποία έχει επιβεβαιωθεί μέσω μιας άμεσης (direct) λύσης της πλήρους εξίσωσης master. Στη δεύτερη περίπτωση, μπορούν να ληφθούν μόνο αριθμητικά αποτελέσματα. Παρουσιάζονται και συγκρίνονται τα αποτελέσματα που ελήφθησαν από τις δύο master εξισώσεις και αφορούν την επιδεκτικότητα (susceptibility) του συστήματος σε σχέση με το probe πεδίο, και τέλος συζητιούνται σε σχέση με διαθέσιμα πειραματικά δεδομένα γι’ αυτό το πολύ σημαντικό φαινόμενο.

Τα ασύρματα δίκτυα αισθητήρων αποτελούν μια νέα κατηγορία δικτύων υπολογιστών. Αποτελούνται από ένα μεγάλο πλήθος υπολογιστικών κόμβων μικροσκοπικού μεγέθους, εφοδιασμένων με πλήθος αισθητήρων και μονάδων ελέγχου. Σκοπός τους είναι η επίτευξη μιας δύσκολης, για τα δεδομένα του κάθε κόμβου, αποστολής μέσω της συνεργασίας μεταξύ όλων των κόμβων του δικτύου. Τα δίκτυα αυτά αντιμετωπίζονται με μεγάλο ενδιαφέρον από την ερευνητική κοινότητα τα τελευταία χρόνια. Έτσι, έχει προταθεί πλήθος από πρωτόκολλα διάδοσης πληροφορίας, πιθανές εφαρμογές, έχει υλοποιηθεί πλήθος λογισμικού, κτλ. Υπάρχει όμως περιορισμός στα διαθέσιμα εργαλεία για την ανάπτυξη εφαρμογών σε τέτοια δίκτυα, το οποίο σημαίνει από τη μια περιορισμό των διαθέσιμων δυνατοτήτων στους χρήστες και από την άλλη αυξημένη δυσκολία υλοποίησης κάποιας εφαρμογής. Σκοπός της εργασίας αυτής είναι ο σχεδιασμός και η ανάπτυξη ενός γενικού περιβάλλοντος, το οποίο θα προσφέρει στους χρήστες τη δυνατότητα να υλοποιούν σε μικρό χρονικό διάστημα μια εφαρμογή σε ασύρματα δίκτυα αισθητήρων. Το περιβάλλον αυτό, το οποίο ονομάζουμε jWebDust , εκτείνεται σε όλα τα επίπεδα που μπορεί να περιλαμβάνει μια τέτοια εφαρμογή, και επιτρέπει στο χρήστη να αναπτύξει μια εφαρμογή χωρίς ο χρήστης να χρειάζεται να υλοποιήσει ο ίδιος τα επίπεδα αυτά. Η συνεισφορά της παρούσας εργασίας συνοψίζεται σε δύο συνιστώσες: · Το πρωτόκολλο VTRP, το οποίο προσπαθεί να αντιμετωπίσει το πρόβλημα του εντοπισμού και διάδοσης πολλαπλών γεγονότων στα ασύρματα δίκτυα αισθητήρων. Το πρόβλημα αυτό συνίσταται στον εντοπισμό μέσα στο δίκτυο ενός πλήθους από γεγονότα και της διάδοσης των αντίστοιχων αναφορών σε ένα κέντρο ελέγχου, με έναν αποδοτικό τρόπο όσον αφορά την κατανάλωση ενέργειας και την ανοχή σε σφάλματα μετάδοσης. · Το περιβάλλον jWebDust, το οποίο αποσκοπεί στο να βοηθήσει το χρήστη να υλοποιήσει μια εφαρμογή σε ένα ασύρματο δίκτυο αισθητήρων εύκολα και γρήγορα. In the proceedings of DCOSS ’05 (International Conference on Distributed Computing in Sensor Systems), Marina Del Rey, June 30 – July 1, 2005 . / Wireless sensor networks are comprised of a vast number of ultra-small fully autonomous computing, communication and sensing devices, with very restricted energy supplies and computing capabilities, which co-operate to accomplish a large sensing task. Such networks can be very useful in practice, i.e. in the local detection of remote crucial events and the propagation of data reporting their realization to a control center. It is expected that, in the future, the wide range of applications of sensor networks will make them an integral part of our lives. The interest of the research community in these networks has grown steadily in the recent years and a plethora of data propagation protocols and possible applications has been proposed, along with a growing number of software applications and real network deployments. There is, though, a lack of available tools for developing applications in sensor networks, which means that there is a lack of available options for the final users and also an increased difficulty in implementing an application for such a network. The aim of this dissertation is the design and development of a generic environment, which will offer the possibility of implementing quick and easy an application for wireless sensor networks. This environment is called jWebDust, and its implementation is based on existing technologies, like the TinyOS operating system for sensor networks, and is targeted towards hardware platforms that are supported by TinyOS. The contribution of this dissertation can be summarized as follows: 1. The VTRP protocol [2], designed to face the (multiple event detection and propagation) problem in wireless sensor networks, which is defined as follows: how can each node in the network via cooperation with the rest of the nodes propagate the information regarding some event to the control center of the network in an efficient and fault-tolerant way. What differentiates VTRP to the other existing protocols is the change of the transmission range of each node, when this is necessitated by the conditions inside the network field. 2. The jWebDust environment [3], which aims at providing a simple interface for creating quick and easy an application for wireless sensor networks. jWebDust provides a simple interface to the final user, through which a variety of actions for administering a wireless sensor network can be performed, and also collection of data from the network nodes can be automated. This dissertation is comprised of the following parts: 1. Current research in wireless sensor networks (chapter 1 - 3): In the first part of this thesis we provide an introduction to the basic concepts in wireless sensor networks and a short overview of their history so far. A presentation of the current research regarding the most important hardware platforms and software applications presented so far concludes this part. 2. The VTRP protocol (chapter 4): a detailed description of the protocol is provided in this chapter, along with results from extensive simulation experiments conducted with the simDust network simulator [1]. 3. The right to health, the TRIPS agreement and the public health safeguards to encourage the universal access to essential medicines

The privileges arising from patent protection on pharmaceutical products often prevent the full realization of the right to health, especially in developing countries with scarce resources. This thesis first identifies the international agreements that have established the right to health in international law, obligations and violations associated with it, the problems encountered in the implementation of human rights on the field, compared with the implementation and sanctions associated with economic rights from the World Trade Organization regulatory framework. A comparative study of the legislative frameworks of both developed and developing countries will reveal to what extent Canada, the United States, the European Union, Brazil, India, and South Africa conformed with patent protection exceptions arising from international patent law to protect public health. Finally, the author identifies the crucial indicators that need to be considered in order to assess the conformity of a given approach with the right to health, before he underscores the temporary character of the relevant WTO measures, and the future stakes concerning an increased access to essential medicines. / Les droits issus des brevets d'invention sur les produits pharmaceutiques empêchent souvent la réalisation pleine et entière du droit à la santé, plus spécialement dans les pays en voie de développement ayant des ressources plus limitées. Ce mémoire de recherche retrace d'abord les accords internationaux ayant établi le droit à la santé en droit international, les obligations et les violations qui en découlent, la problématique quant à la mise en oeuvre des droits de l'homme sur le terrain, en comparaison avec la mise en oeuvre et les sanctions pour le non-respect de droits économiques dans le cadre réglementaire de l'Organisation Mondiale du Commerce (OMC). Ensuite, une étude comparative des cadres législatifs de pays développés et de pays en développement révèlera dans quelle mesure le Canada, les États-Unis, l'Union Européenne, le Brésil, l'Inde, et l'Afrique du Sud se sont conformés aux exceptions aux règles de protection issues du droit international des brevets pour cause de santé publique. Policy agenda-setting and the use of analytical agenda-setting models for school sport and physical education in South Africa

This study focused on policy agenda-setting models for school sport and physical education in South Africa. The primary objective was to assess and propose options for improved agenda-setting by focussing on the use of agenda-setting models and by applying it to physical education and school sport and the policy agenda of the national government. The study has shown that pertinent school sport and physical education policy issues, as supported by key role-players and principal actors, were initially not placed on the formal policy agenda of government during the research investigation period (2005-2009). However, during 2010 and 2011 the issue of school sport and physical education received prominent attention by authorities and these developments were subsequently included in the study. The study aimed at contributing to existing policy agenda-setting models and by recommending changes to the Generic Process Model.The study also made a contribution by informing various role-players and stakeholders in education and school sport on the opportunities in policy agenda-setting. The study showed that policy agenda-setting is a vital step in the Generic Policy Process Model. Policy agendasetting in South Africa is critical, as it is important to place new and emerging policy issues on the policy agenda and as a participative public policy process is relatively new in this young democracy. The reader should not confuse the study as one dealing with school sport and physical education primarily, but rather as a research investigation dealing with policy agenda-setting models as applied to school sport and physical education.The secondary objectives of the study included the development of a historical perspective on trends and tendencies in education and sport in South Africa. A second objective was to provide theoretical perspectives on public policy and specifically on policy agenda-setting. From these theoretical perspectives, the Generic Policy Process Model was selected to use as a model that provided guidance on the overall policy process normally followed in South Africa. The Issue Attention Cycle and Principal Actor Models on Agenda-Setting were selected to apply to the case study to specifically ascertain important factors related to policy agenda-setting such as the identification of key role players as well as key policy issues. The Generic Policy Process Model provided for both a comprehensive set of phases as well as specific requirements and key issues to be addressed during each phase of the policy process.In terms of findings the study found that a number of specific agenda-setting elements or phases needed to be added to the Generic Policy Process Model, which includes a problem stage, triggers, initiator, issue creation and actors or policy stakeholders.The Principal Actor Model to agenda-setting was selected for application to the case as different actors have different levels of success at each policy stage. In the South African experience it is important to look at who sets the policy agenda and why, who can initiate agenda-setting and the role played by these principal actors in the agenda-setting process.Issue emergence often places policy issues on the policy agenda. The public is initially involved in issues, but in the long term public interest declines. The government realizes the significant costs involved in placing policy issues back on the agenda. This leads to a decline in issue attention by policy-makers and the public. The Issue Attention Cycle Model of agenda setting was used to analyse this phenomenon in South African Education policy.The study provides a case assessment of the South African experience. From the research findings, a set of conclusions and recommendations were developed for improved policy agenda-setting models and implications for school sport and physical education, as well as tools to place it on the national policy agenda were identified. The research findings suggest that pertinent school sport and physical education policy issues, as supported by key roleplayers,stakeholders and principal actors were not placed on the formal policy agenda of the government as a vital step in the policy process between 2005 and 2009. Ever since, principal policy actors, civil society NGOs, and government officials placed sufficient pressure on the Minister of Basic Education to place Physical Education on the agenda. Subsequently,Minister Angie Motshega has placed physical education in the school Curriculum under the subject Life Orientation and Lifeskills. It has become evident from the research that agendasetting is both necessary to, and a complex phase in, the policy-making process.This study has shown that major policy issues such as physical education and school sport were neglected during the period 2005 and 2009 despite reformed and advanced policy cycles in government. It has also shown that the role of policy agenda-setting in the overall policymaking process was revisited by government in the subsequent period 2010/2011 and placed on the policy agenda. Specific lessons of experience emanated from this process.The study recommends that the triggers of the agenda-setting phases be added to the Generic Policy Process Model, which should include the problem stage, triggers, initiators, issue creation, actors and policy stakeholders. Principal actors in the agenda-setting model in South Africa want the issue of physical education and school sport to be part of the school curriculum, and therefore be placed back on the policy agenda by the Government on its institutional agenda. Furthermore, the study showed that actors wanted it to be compulsory in all phases of the school (Foundation, Intermediate, Senior, GET, FET) and that it should have the same legal status as other subjects.The important findings include that: Comprehensive policy process models such as that of Dunn, Wissink and the Generic Process model may need to be reviewed to incorporate more fully the policy-agenda setting stages of the overall process; Current policy agenda setting models in use are relevant and valuable in identifying key role players as well as key issues and considerations regarding the policy process; Institutional arrangements to strengthen the role of NGOs and lower level institutions,such as schools to participate in policy agenda setting are important; and the study has shown that a number of key factors have been identified that had a key influence on policy agenda-setting in the case of physical education and school sport in South Africa. These included the influence of changing political leadership, the competency of policy capacities in government, the profile of issues in the media etc. The key findings of the study have shown that further potential exists to improve monitoring and evaluation and policy analysis.The study made a set of recommendations to principal actors such as the Minister of Education, Minister of Sport and Recreation, non-governmental organisations, interest groups,department officials and pressure groups. The objectives of this study were to evaluate the viability and sustainability of preferential procurement in the metals and engineering sector. Preferential procurement is one of the seven elements of Broad–Based–Black Economic Empowerment (BBBEE) and seeks to encourage companies to procure goods and services from black empowered suppliers. The Broad–Based–Black Economic Empowerment Act was legislated in 2004 as an improvement on the previous Black Economic Empowerment (BEE). The objective of these legislations was to increase participation of previously disadvantaged groups in the mainstream economy. BEE was deemed to be narrow because it focused exclusively on ownership and management control. BBBEE was enacted to broaden the number of beneficiaries and included five other elements, namely: Employment Equity, Skills Development, Preferential Procurement, Enterprise Development and Socio–economic Development. The two companies that engage in preferential procurement should benefit from the relationship and value should be created in the process. Companies should not procure from black suppliers for accumulating points on the generic scorecard. Black–owned suppliers should provide service and products of the highest quality standards that meet customer requirements. The questionnaire that reflects on the objectives of this study was drafted and circulated to black–owned suppliers for completion. The suppliers were asked to comment on statements that reflect on capacity, profitability, working relationship and continuity. The results show that the SMMEs have capacity to perform according to specification of customers. The area of concern was the difficulty for SMMEs to maintain the current preferential status.
