Mapa argumentativo do caso Araguaia em protocolo de disputas / Argumentative map of Araguaia case in dispute protocol

O presente trabalho tem duplo objetivo, prático e teórico. Em termos práticos, busca sistematizar as discussões sobre a responsabilização dos militares e do Estado por acontecimentos do regime militar, bem como sobre a busca da verdade e a preservação da memória. Destacam-se nas discussões os acontecimentos da Guerrilha do Araguaia. Em termos teóricos, tem a intenção de apresentar uma exposição compreensiva da Teoria da Argumentação, tentando adaptá-la, na medida do possível, às necessidades da Argumentação Jurídica. Para cumprir esse duplo objetivo, o trabalho aplica a Teoria da Argumentação às discussões sobre o regime militar almejando benefícios para a teoria e para a prática. Desse modo, o trabalho inicia apresentando os principais conceitos e ferramentas da Teoria da Argumentação. Em seguida, realiza algumas adaptações das ferramentas para que sejam utilizadas na argumentação jurídica. Por fim, utilizando os conceitos e ferramentas expostos e adaptados, apresenta o Mapa Argumentativo dos debates sobre o regime militar, com destaque para as discussões sobre a possibilidade de responsabilizar criminalmente os militares por torturas, execuções e desaparecimentos forçados. São levados em consideração especialmente os aspectos fáticos do caso da Guerrilha do Araguaia e argumentos levantados pelo STF no julgamento da ADPF 153 e pela Corte Interamericana de Direitos Humanos no Caso Gomes Lund (Guerrilha do Araguaia) v. Brasil. A dissertação conclui que os militares não foram beneficiados pela Lei de Anistia e aponta para a continuidade dos debates tanto sobre o aspecto criminal quanto outros problemas identificados no Mapa. Na parte teórica, chama-se atenção para a necessidade de continuar o estudo da Teoria da Argumentação e de adaptá-la às necessidades da Argumentação Jurídica. / This dissertation has two objectives: a practical and a theoretical one. The practical objective is to organize discussions concerning the responsibility of the State and the Military due to events occurred in the Brazilian Military Government, as well as discussions about the search for the historical truth and preservation of its memory. Special attention is draw upon the Araguaias Guerilla. Theoretically, the work intends to present the main aspects of Argumentation Theory trying to adapt it - as long as possible - to be used in Legal Argumentation. To fulfill this double objective, one applies Argumentation Theory to the Military Government events discussions aiming for benefits both for theory and practice. Hence, it begins presenting the essential concepts and tools of Argumentation Theory. It follows with the tools adaptations to Legal Argumentation. Finally, the Argumentation Map of the discussions is presented. The problem whether the most severe crimes of the military personnel (tortures and executions for instance) were amnestied is dealt with in greater detail. The events of Araguaias Guerrilla, the arguments of Brazilian Supreme Court in ADPF 153 and the arguments of the Inter-American Court of Human Rights in Gomes Lund v Brazil Case are all given special attention. The dissertation concludes that the military (States agents) were not amnestied. It also points out the next steps in the discussions. As for the theoretical concerns, the conclusion draws attention to the importance of studying and developing Argumentation Theory in connection with Legal Argumentation.

<p>Uppsatsen är inriktad på den militära delen i upprorsbekämpning och tar sin utgångspunkt i två stycken militärteoretikers teorier inom ämnet. Teoretikerna är John Mackinlay och David Kilcullen, som under 2009 utkom med varsin ny bok inom området, The Insurgent Archipelago samt The Accidental Guerilla. Den metod som arbetet vilar på är kvalitativ textanalys. Syftet med uppsatsen är att undersöka i vilken utsträckning som teorin och doktrinerna stämmer överrens. Därför har först teoretikernas syn på hur en utifrån kommande intervenerande styrka påverkar lokalbefolkningen analyserats. Det som framkommit av detta är dels Mackinlays uppfattning att samtliga styrkor av denna karaktär kommer att betraktas som ockupanter av lokalbefolkningen. Dels Kilcullens uppfattning att styrkan påverkar lokalbefolkningen till att gripa vapen mot dem. Detta trots att även de har en avig inställning mot upprorsrörelsen. Som lösning på problemet för Kilcullen fram bildandet av en strategisk tjänst i likhet med Office of Strategic Services. Från dessa teorier har ett antal kriterier valts ut vilka sedan använts som analysverktyg för att undersöka doktrinernas syn på områdena. De doktriner som har analyserats är Storbritanniens Joint Doctrine Publication 3-40, USA:s Joint Publication 3-24, samt NATO:s i nuläget gällande styrdokument BI-SC Cointerinsurgency Joint Operational Guidelines. Av analysen har framkommit att en viss överrensstämmelse mellan teori och konceptuell verklighet förekommer. Dock att teorin snarare rör sig inom en eventuell framtid emedan doktrinerna är fast inom nulägets ramar.</p> / <p>The essay focuses on the military part of counter-insurgency and is based on two theories by the military theorists John Mackinlay and David Kilcullen. Who both in 2009 published a new book on the subject, The Insurgent Archipelago and The Accidental Guerrilla. The method used in the essay is qualitative text-analysis. The purpose of this essay is to examine whether resemblance between theory and doctrine exists. Therefore first of the theorists view in how an exogenous intervening force affects the local population has been analyzed. What emerged from this is partly Mackinlay's view that all forces of this nature will be seen as occupiers by the local people. Partly Kilcullen's view that the force affects the local population to resort to arms against them. This despite the fact that they’re original attitude towards the insurgent movement, which is the reason for the intervening forces presence, is of negative. As a solution to the problem Kilcullen brings forward the constitution of a strategic service, like the Office of Strategic Services. From these theories, a number of criteria have been selected which are then used as analytical tools to examine the doctrines. The doctrines which have been analyzed is the UK's Joint Doctrine Publication 3-40, U.S. Joint Publication 3-24 and the currently governing NATO document BI-SC Counterinsurgency Joint Operational Guidelines. The analysis has shown that some resemblance between theory and conceptual reality exist. However that theory, rather involved in a possible future while the doctrines are restrained by the framework of the present day.</p>

Guerrilleros de papel : La representación del guerrillero en seis novelas centroamericanas de los años setenta y ochenta / Paper guerrillas : The representation of the guerrilla soldier in six Central American novels from the seventies and eighties

The aim of the present study is to analyze and compare the representation of the guerrilla soldier in six contemporary Central American novels. According to Claudio Guillén, the comparison is a dialogue between unity and diversity. It can be defined with the help of two coordinates: a spatial and a temporal. In this study the spatial coordinate includes Nicaragua, Guatemala and El Salvador, and the temporal extends from the mid-seventies to the eighties. The novels written in the seventies are Los compañeros (1976) by Marco Antonio Flores, ¿Te dio miedo la sangre? (1977) by Sergio Ramírez and Caperucita en la zona roja (1977) by Manlio Argueta. The ones written in the eighties are La mujer habitada (1988) by Gioconda Belli, La diáspora (1989) by Horacio Castellanos Moya and El hombre de Montserrat (1994) by Dante Liano. The novels are analyzed from a postcolonial perspective following the ideas of Alfonso de Toro and Santiago Castro-Gómez particularly. The method used is the phenomenological hermeneutics, as proposed by Mario J. Valdés. This implies an analysis performed on four levels: historical, formal, phenomenological and hermeneutic. Two of the key aspects in the analysis are the reader's aesthetic identification with the hero and the postcolonial concept subaltern. The main conclusion is that the representation of the guerrilla soldier in the corpus is very heterogeneous and that almost no protagonist can be considered a subaltern. The reader's identification with the guerrilla soldier ranges from admirative to ironic, though the main type is sympathetic. Hence, the representation may be considered a hybrid, using a term borrowed from anthropologist Néstor García Canclini that opposes binary schemes and essentialist thinking. The guerrilla soldier is regarded as an individual and not as an abstract idea, which indicates that the civil wars in Central America were not just a conflict between two ideologies, but above all a human experience.

Purpose: The purpose of this study is to analyse how consumers perceive guerrilla marketing in contrast to traditional marketing, looking at a gender perspective. This to be able to determine whether it is more beneficial for a company to invest in extra energy and time with less money spent and choose guerrilla marketing over traditional marketing. Methodology: A quantitative study, with a deductive approach and extensive structure Theoretical framework: The theoretical framework includes theories concerning the twomethods and gender marketing. A communication stream model has furthermore been developed and modified from existing theories within the concept of marketing and communication. The AIDA model has been used to determine the buying behaviour. Empirical framework: The empirical framework presents the outcome of the primary research such as findings and statistics. Conclusion: Guerrilla marketing shows a clear advantage in most cases except when it comes to credibility. If companies can over win the issue with trust, guerrilla marketing is to prefer over traditional marketing, based on consumer perception. Major gender differences were none to be found.

The corporeal activism of Nahui Olin and Nidia Díaz: a feminist performance of social defiance

This dissertation analyzes the performance praxis of the Mexican poet Nahui Olin (1893-1978) and the Salvadoran guerrilla leader and author Nidia Díaz (1952-). Through their self-representation in images and texts, these two women subverted the discourse of power characteristic of their respective cultural and historical contexts. Whereas Olin carried out her “corporeal activism” through defiant eroticism; Díaz did so through her stoic stance in the face of incarceration and torture. The dissertation carries out visual analyses enriched by attention to literature, and literary analyses informed by visual culture. In their respective approaches to performance these two figures engage with their sociopolitical contexts as they relate to women’s condition and the quest for spiritual liberation. The first chapter presents the dissertation’s theoretical framework. Michel Foucault, Judith Butler and Elaine Scarry’s theories are crucial to understanding the concepts of body, discourse of power, performance, and pain; Gillian Rose’s approach is essential to analyzing images; Lucia Guerra-Cunningham and Rita Felski are fundamental for addressing women’s writing. The second chapter focuses on Olin’s activism, evident in her role as a “flapper,” her transgressive nude photographs and her poems written during the Mexican post-revolutionary period and which were influenced by avant-garde movements. My analysis links the key photograph I call “Nahui Olin Andrógina” with her poetry, centering on the trope of androgyny as a mystic state. The third chapter examines the naïf self-portraits and testimonio found in Díaz’s Nunca estuve sola (in 1988), which she narrates her imprisonment during El Salvador’s civil war of the 1980’s. My analysis centers on the trope of stoicism manifested in her drawing I call “Una ‘mesías’ que deviene en la madre del pueblo” as well as in the prose of her testimonio. Olin’s erotic activism and Díaz’s armed rebellion both represent attempts to achieve human liberation, including their own as oppressed women, and suggested emancipatory paths that may serve as models for others.
