The Mental Capacity Act 2005 and the institutional domination of people with learning disabilities

People with learning disabilities are subject to a wide range of potential interferences with their choices and freedoms when they are 'placed' in institutional care services. The cumulative and pervasive impact of these regimes can be monumentally detrimental to self and wellbeing. Some have suggested that a new law, the Mental Capacity Act 2005, may limit the interferences that people with disabilities are subject to in care services. In this thesis, I subject the Mental Capacity Act to a critique drawn from new republican political theory. I argue that far from limiting the interferences that people with disabilities are subject to, the Act creates a mechanism which permits a proliferation of arbitrary interferences in people's everyday lives, with little recourse for people to 'invigilate' such interferences. I base this argument on a critical analysis of case law connected to the Mental Capacity Act, and by critically examining four key mechanisms of enforcement: Independent Mental Capacity Advocates, the Court of Protection, complaints procedures and regulation by the Care Quality Commission. I argue that, paradoxically, a framework for detention introduced by the Act - the deprivation of liberty safeguards - in fact contains more ingredients for ameliorating states of domination in these services than the Mental Capacity Act itself. However, the safeguards also suffer from serious defects. I conclude by discussing what lessons may be drawn from the problems with the Mental Capacity Act and the safeguards for wider reform efforts connected with the UN Convention on the Rights of Persons with Disabilities.

Em diálogo com um debate que questiona a fortaleza do Estado de direito e o lugar da ordem legal na construção de um regime democrático, esta pesquisa analisa o fundamento e o funcionamento da Lei de Cultura Cívica da Cidade do México. A Lei de Cultura Cívica é uma lei que, desde 2004, regula o uso do espaço público (práticas, atividades, comportamentos) na capital mexicana, enquanto o juzgado cívico é a instituição na qual se processam e se determinam as conciliações, responsabilidades, infrações e punições dos infratores dessa lei. Com base em um trabalho de campo em um juzgado cívico do Centro Histórico da Cidade do México, exploram-se as configurações históricas e políticas que têm feito desse espaço uma zona entre fronteiras de legalidade entre o legal, o ilegal e o informal, em um denso entramado de relacionamentos sociais e circuitos de mercadorias. Assim, a partir de práticas e contextos situados, em uma perspectiva de antropologia do Estado, estuda-se o uso cotidiano que, nos juzgados cívicos, se faz da Lei de Cultura Cívica. Nesses usos, analisam-se particularmente os circuitos, as práticas e os mecanismos pelos quais é possível produzir uma verdade jurídica que diverge do registro empírico. Para analisar essas práticas e produções dentro do campo jurídico, propõe-se o conceito de legalismo. Finalmente, considera-se o espaço do arbítrio e da discrição na Lei de Cultura Cívica, como parte de um direito administrativo que espalha, pelas ruas da cidade, um particular poder de polícia, um poder que, em nome da lei, suspende, com suma frequência, os próprios princípios legais. / In dialogue with a debate that questions the strength of the rule of law and the place of legal order in the construction of a democratic regime, this research analyzes the foundation and operation of the Civic Culture Law of Mexico City. The Civic Culture Law is a law that, since 2004, regulates the use of public space (practices, activities, behaviors) in Mexico City, while the juzgado cívico is the institution in which the reconciliations, responsibilities, infractions and punishments of the offenders of this law are processed and determined. Based on fieldwork in a juzgado cívico in Mexico City\'s Historic Center, I explore the historical and political configurations that have made of this space a zone between boundaries of legality between the legal, the illegal and the informal in a dense web of social relationships and commercial circuits. Therefore, based on practices and situated contexts, in a perspective of anthropology of the State, I study the everyday use of the Civic Culture Law in the juzgados cívicos. Regarding these uses, I analyze with particular attention the circuits, practices and mechanisms that enable the production of a legal truth that differs from the empirical record. To analyze these practices and productions within the legal field, I propose the concept of legalism. Finally, I consider the place of arbitrariness and discretion in the Civic Culture Law as part of an administrative law that spreads, throughout the city streets, a particular police power, a power that, in the name of the law, often suspends the laws legal principles.

Nėra abejonių, kad Kinijos Liaudies Respublika šiuo metu atlieka svarbų vaidmenį pasaulio politikoje, didelės įtakos turi ir tai, kas vyksta šalies viduje: jos politiniai, ekonominiai bei socialiniai pokyčiai. Paskutinius dešimt metų Kinija perėjo nuo planinės ekonomikos prie rinkos ekonomikos. Kinija susiduria su daugybę iššūkių ir problemų, kurios susijusios tiek su vidaus problemomis, tiek su spaudimu iš išorės. Kinija teigia, kad ji nesiekia dominuoti pasaulio arenoje, o tik siekia „taikiai vystytis“, t. y. pasisako prieš perdėtą kišimąsi į kitų valstybių reikalus. Darbo problematika susijusi su vienu pagrindinių dabartinės Kinijos Liaudies Respublikos politikos devizu: „harmoninga visuomenė“ (hexie shehui) ir jos atsiradimo prielaidomis. Darbo tikslas išanalizuot socialines, politines visuomenėje, kylančio nepasitenkinimo priežastis, kokių priemonių imasi KLR valdžia. Dauguma Kinijos intelektualų sutinka, kad vienas esminių valstybės politikos tikslų yra sukurti stabilią – „harmoningą visuomenę“, jis būtinas sėkmingam tolesniam šalies vystymuisi. Aptariamos istorinis politinės minties raidos kontekstas, turėjęs įtakos „harmoningos visuomenės“ idėjos susiformavimui. Šalies modernizacijos laikotarpis nuo 1979 m., kuris turėjo didelės įtakos dabartinei situacijai: socialinė politinė įtampa visuomenėje tapo sunkiai suvaldomi, vis didėja skirtumai tarp miesto ir kaimo, tarp turtingųjų ir vargšų. [toliau žr. visą tekstą] / There is no doubt that the People's Republic of China policy now plays an important role in the world stage, and has a significant impact on what is happening in the country: the political, economic and social change. In the past ten years, China has experienced a rapid period of transition from a planned to a market economy. China is facing a number of crucial challenges and problems. Problems are related to internal as well as external pressures and processes. The task of study is to analyze the potential economic, social and political causes of the growing public discontent, and the measures taken by the government of PRC. The idea of „harmonious society“ – is the socio-political goal, which is transforming into an ideology, for the successful development of the country. China claims that it does not seek to dominate the world stage but only seeks to „peaceful development“, maintains stable relationship, not only domestically, but also with its neighbours. Current party leaders have a high attention to the new political challenges and strategies for development. „Harmonious society“ idea of an attempt to justify the need to implement the fairer social policies, the harmonization of central and local government relations, to resolve conflicts arising among the various interest groups, not only for the fair distribution of material but also for the spiritual values.

Intelektuální dějiny českého reformního komunismu 1968 - 1990 / Intellectual History of Czech Reform Communism 1968 - 1990

The main topic of the dissertation is the development and changes in the political thinking of Czech reform communism from 1968. While in the 1960s reform communism represented the dominant intellectual and political current, after the military invasion in August 1968 it gradually disappeared from the public discourse and was later completely suppressed by normalization propaganda and labeled as "counter- revolutionary" and "right-wing opportunist" ideology. The central questions of the thesis explore the changes that the political project of reform communism underwent during the twenty-one-year normalization period and the shifts that took place in the "horizon of expectation" of the Czechoslovak socialist opposition in the context of the intellectual and political changes of the 1970s and 1980s. The aim of the thesis is to explain the political perspectives of reform-communist intellectuals in the Czechoslovak opposition after 1968. They represented an important part of both domestic and especially exile opposition, which formed around the journal Listy. Some of them also played an important role in the creation of Charter 77 and its legalistic criticism. Nevertheless, their story does not fully fit into the traditional narrative of Czechoslovak dissent, as they never completely parted ways with...

Le contentieux précontractuel des marchés publics en France et en Roumanie est une étude comparative qui a comme objet l’analyse synthétique et pragmatique des mécanismes nationaux français et roumains destinés à assurer la protection des opérateurs économiques contre les éventuels manquements aux principes de transparence et de mise en concurrence. La comparaison des deux ordres juridiques est initiée à partir de la présentation du droit européen du contentieux des marchés publics qui a influencé de manière substantielle les systèmes juridiques nationaux. Cette influence sera le point central de l’étude et elle facilitera une comparaison indirecte entre le droit français et le droit roumain qui ont réagi de façon similaire et différente à la fois face à la primauté du droit européen. Ainsi, forte de sa tradition historique en matière de contentieux administratif, la France a été plus réticente à intégrer les règles européennes et a dû accepter quelques compromis qui ont sensiblement bouleversé ses coutumes, notamment en ce qui concerne les pouvoirs du juge. Le système juridique roumain, plus jeune et moins encré dans des règles traditionnelles, a été plus ouvert aux attraits du droit européen à tel point qu’il a innové en créant un organisme administratif-juridictionnel spécialisé, plus adapté aux exigences de rapidité et d’efficacité imposées par les directives européennes. L’évolution de sa jurisprudence riche mais changeante et sa comparaison avec la jurisprudence du juge administratif français nous permettra de nous interroger sur le compromis nécessaire entre la légalité et la sécurité juridique dans la passation des marchés publics. / The precontractual disputes within the public procurement procedures in France and Romania represents a comparative study whose object is to synthetically and pragmatically analyse the national French and Romanian mechanisms aimed to ensure the protection of the economic operators against the eventual infringements of the transparency and competition principles. The comparison between the two legislative frameworks is initiated by the presentation of the European law of the disputes within the public procurement procedures, which significantly influenced the national legal systems. This influence shall be the study’s central point, which shall facilitate an indirect comparison between the French and Romanian law that have both similarly and differently reacted to the priority of the European law.Thus, based on its powerful historical tradition in the field of the disputes of the public procurement law, France was more reluctant to integrate the European rules and had to admit some compromise which had sensibly disturbed its tradition, especially with respect to the powers of the judge.The Romanian legal system, younger and less pegged in the traditional rules, was more opened to the attractions of the European law to such a point that it innovated by creating a specialised administrative-jurisdictional organism, more adapted to the celerity and efficiency exigencies imposed by the European Directives. The evolution of its jurisprudence, rich but inconstant and its comparison to the jurisprudence of the French administrative judge will allow an interrogation of the necessary compromise between the legalism and the legal security in the awarding of the public contracts procedures.

Disenchanting political theology in post-revolutionary Iran : reform, religious intellectualism and the death of utopia

This thesis delineates the transformation of Iran’s so-called post-revolutionary ‘religious intellectuals’ (rowshanfekran-e dini) from ideological legitimators within the political class of the newly-established theocratic-populist regime to internal critics whose revised vision for the politico-religious order coalesced and converged with the growing disillusionment and frustration of the ‘Islamic left’, a constellation of political forces within the governing elite of the Islamic Republic, that following the death of Ayatollah Khomeini increasingly felt itself marginalised and on the outskirts of power. The historical evolution of this complex, quasi-institutionalised and routinized network, encompassing theologians, jurists, political strategists and journalists, which rose to prominence in the course of the 1990s, and its critical engagement with the ruling political theology of the ‘guardianship of the jurist’, the supremacy of Islamic jurisprudence, political Islamism and all forms of ‘revolutionary’ and ‘utopian’ political and social transformation, are scrutinised in detail. In this vein, the thesis examines the various issues provoked by the rowshanfekran-e dini’s strategic deployment and translation of the concepts and ideas of a number of Western thinkers, several of which played a pivotal role in the assault on the ideological foundations of Soviet-style communism in the 1950s and 1960s. It then moves to show how this network of intellectuals and politicos following the election of Mohammad Khatami to the presidency in May 1997 sought to disseminate their ideas at the popular level by means of the press and numerous party and political periodicals, and thereby achieve ideological and political hegemony. The thesis proceeds to demonstrate the intimate connection between the project of ‘religious intellectualism’ and elite-defined notions of ‘democracy’, ‘electoral participation’, ‘reform’ and ‘political development’ as part of an effort to accumulate symbolic capital and assert their intellectual and moral leadership of the polity.

Ao longo do trabalho, examina-se a influência do direito, da ideologia, das normas que regem o Judiciário, das regras que regem as decisões colegiadas, do Poder Executivo, do Poder Legislativo, da opinião pública e da imprensa no processo decisório do Supremo Tribunal Federal. / This work aims at identifying legal and non-legal factors that interfere with Brazilian Supreme Court decisions. The analysis is developed with basis on the legal model, on the attitudinal model, on the institutional model and on the strategic model of judicial decision-making. It examines the influence of constitutional law, ideology, collegial process, Executive Power, Legislative Power, public opinion and of the media on Brazilian Supreme Court attitudes.
