M.A. (Philosophy) / Usually when we think of law, we think of rationality and outcomes that are not swayed by emotion. Modern Western society tends to think of emotion and rationality as incompatible. It is a widely-held belief that it is more morally desirable for people to make ‘rational’ decisions rather than ‘emotional’ decisions in life in general. Perhaps in no other area is this distinction between the two more pronounced as in criminal law, where judges who society considers to be making ‘rational’ judicial decisions are revered, and those who society at large considers to be making ‘emotional’ judicial decisions are distrusted. As Terry Maroney (2006: 120) says, “[a] core presumption underlying modern legality is that reason and emotion are different beasts entirely…the sphere of law admits only of reason; and vigilant policing is required to keep emotion from creeping in where it does not belong”. In this dissertation, I propose to look at the virtue of mercy, where mercy is understood to have a significant emotional component, and to answer the question: Should a judge in a criminal trial employ mercy? If so, under what conditions? The importance of the question of whether a judge should employ mercy in a criminal case is that it addresses one part of the larger enquiry into how the state should respond to offenders. As moral beings, our emotional responses to criminals and their crimes are varied. Sometimes we feel anger, at other times disgust, and at other times mercy, grief and sadness.

From spaces of mercy to sites of sanctuary: a historical survey of Canada’s federal prison libraries

Since the inception of the first modern Canadian carceral structure in 1835, the prison library has existed. The condition of the prison libraries in Canadian federal institutions, as well as the diversity and quantity of their content has changed dramatically over the course of the nineteenth and twentieth centuries. The modern-day federal prison library mirrors, in many ways, its “outside” Canadian public library counterpart. This thesis does not attempt to dispute or affirm the likeness between the Canadian prison and public library. Instead, in this thesis, I examine the evolution of the library from a space that reinforced hegemonic carceral control to a space where inmates could seek refuge and sanctuary. The first half of the thesis charts the emergence of the library as a, what I have termed, space mercy. This conceptualization of the library is inspired by Douglas Hay’s concept of mercy, in criminal law, as an ideological tool to reinforce hegemony. In the second half of the thesis I present a case study of the William Head Institution on Vancouver Island. Through the consulting of inmate publications, interviews, questionnaires, and other primary source material I posit that the prison library has evolved into a site of sanctuary. This term is taken from Laura Madokoro’s public history project Sites of Sanctuary. The site of sanctuary differs from the space of mercy in a number of ways and marked a distinct shift in the function and use of the prison library, by inmates, in Canada’s federal carceral institutions. / Graduate / 2021-07-20

Juntamente com o estudo de Kasper, a dissertação procura verificar o ensinamento do Papa Francisco no ano do Jubileu Extraordinário da Misericórdia. A dissertação destaca elementos do livro de Kasper e ênfases do ensinamento do Papa Francisco, em principais documentos pontífícios no ano jubilar, como a Bula Misericordiae Vultus que abre o ano da misericórdia e a carta apostólica Mirecordie et Misera fechando o ano e em audiências. Em Kasper e em Francisco apresentam-se questões importantes para o agir do cristão no mundo. A Escritura mostra a misericórdia de Deus. A misericórdia está na obra salvífica de Deus. A misericórdia deve estar na fé e na vida dos cristãos. O diálogo da misericórdia será necessário para levar a ação da misericórdia de Deus para uma cultura da misericórdia e para a evangelização do mundo. Together with Kasper s study, the thesis seeks to verify the teaching of Pope Francis by year during Jubilee extraordinary of Mercy. See the deepening of mercy in the main section of the Pope s hearings in this jubilee. The dissertation highlights elements of Kasper s book and emphases of the teaching of Pope Francis with pontifical texts in the jubilee year, as in the Bull Misericordiae Vultus that the year of mercy was opened and the apostolic letter Misericordia and Misera closing the jubilee year. In Kasper and Francis are presented important questions for the action of the Christian in the world. Scripture shows the mercy of God. Mercy is in the saving work of God. Mercy must be in the faith and life of Christians. The dialogue of mercy will be necessary to bring the action of God s mercy to a culture of mercy and to the evangelization of the world. The Church must receive the mercy of God and proclaim with words and works of mercy and the sacraments. Within this framework, attention will need to be paid, among other things, the sacrament of reconciliation where one encounters the forgiveness and the mercy of God.

There is a Wideness to God's University: Exploring and Embodying the Deep Stories, Wisdom, and Contributions of Women Religious in Catholic Higher Education

Thesis advisor: Hosffman Opsino / Women Religious founded more than half of the current two hundred and sixty institutions of Catholic higher education in the United States. Rooted in a distinct mission to women’s education in the Catholic Intellectual Tradition, these colleges and universities have demonstrated a strong commitment to educate the politically, economically, educationally, and ecclesially marginalized, with particular emphasis on the empowerment of women. For nearly a century, these colleges and universities have creatively adapted to various changes in the educational and cultural landscape and have navigated and negotiated the complex relationships between the Church, the university, and the larger U.S. society. Ironically, their experiences and stories remain widely unknown compared to those of similar institutions founded by and for men. Using a historical and theological lens, this dissertation demonstrates how the deep stories that sustained the life and identity of many Women Religious in the United States inspired the foundation of colleges and universities that distinctively saw these stories in unique ways. In doing so, they modeled new and creative ways of education women, and others, that remain to be genuinely studied and incorporated into the larger narrative of U.S. Catholic higher education. At a time of major cultural, demographic, and ecclesial transitions, this dissertation proposes ways for those deep stories to continue to give life, even in the absence of the women who embodied them. It does so by focusing primarily on the example of the Sisters of Mercy and one of their universities. A autoria, o local de composição e os destinatários do texto são questões abertas, pois a exegese ainda não chegou a um resultado consensual sobre isso. Hebreus encontrou resistências para ser aceito no cânon sagrado; sua inclusão no cânon só ocorreu definitivamente no quarto século da Era Cristã. Entretanto, esse escrito é considerado um dos melhores textos do NT, por se tratar de uma linguagem muito refinada e com um perfeito domínio do grego. Na perícope de Hb 4,14-16 o autor afirma que temos um sumo sacerdote que penetrou os céus, Jesus o filho de Deus . Essa afirmação constitui objeto da profissão de fé, pois o autor exorta aos(as) destinatários(as) a perseverarem nessa profissão de fé. Nossa tese consiste em afirmar que, nessa exortação feita pelo autor, está implícito, de forma a priori, o pressuposto da ressurreição de Jesus, pois ele só pôde penetrar os céus , uma vez que fora ressuscitado pelo Pai. Dessa maneira, ele foi entronizado à direita de Deus, onde exerce seu ministério sumosacerdotal no santuário celestial em favor de seus irmãos e irmãs, ou seja, de todos(as) que dele se aproximam buscando graça e socorro.

This is due to the fact that the three major monotheistic religions approach it in their religious essence. In judaism, it is related to the acts of piety present in the Old Testament; in christianity, to acts of mercy which involve a compromise of love to God and neighbor and are fundamental for obtaining salvation; and, in Islam, the good or evil that one practices with his brothers are important acts for either gaining paradise or ending in hell. In the first part, the question of text in its context is approached: the social reality of the Roman Empire, of the judeo-christian community, in Antiocus, and the necessity of solidarity that this text expresses. In the second part, there is a complete exegesis in all its steps to the Last Judgment (Matthew 25,31-46), within these, there is the delineation, the structure, the linguistic configuration, the wording, the characteristics of God present in the text and much other exegetical informations. In the third part, the updating of the message of the Last Judgment is presented which has, as its base, three dimensions: the personal, ecclesiastical and social, where, according to Jesus teachings, the acts of mercy, practiced in relation to the least of God s creature, here and now, will be decisive at the Last Judgment, when the Son of Man will judge each according to his acts. / A presente dissertação discorre sobre o Juízo Final que é um tema atual e questionador. Isto se deve ao fato das três grandes religiões monoteístas o abordarem em sua essência religiosa. No judaísmo, está relacionado às obras de piedade presentes no Antigo Testamento; no cristianismo, às obras de misericórdia que envolvem compromisso de amor a Deus e ao próximo e são fundamentais para se obter a salvação; e, no islamismo, o bem ou mal que se pratica com os irmãos são obras importantes para possuir o paraíso ou acabar no inferno.
