Les enfants de Caïn : la complexité du meurtre dans l’œuvre d’Honoré de Balzac

Lʼœuvre littéraire dʼHonoré de Balzac témoigne dʼune profonde connaissance du système judiciaire et dʼune grande réflexion à son sujet. La violence et le crime, certainement pas les côtés les plus reluisants de lʼHomme, font tout de même partie intégrante de la société. Puisque Balzac a lʼambition de montrer la nature humaine telle quʼelle est, il consent à peindre le meurtre sans euphémismes. Loin de rejeter entièrement lʼesthétique romantique sanglante, il décrit le crime comme une action fondamentalement ambivalente, cʼest-à-dire, quʼil ne le condamne pas absolument ni ne le défend ouvertement. Nous retrouvons dans Balzac ce dont très peu dʼécrivains, et encore moins de philosophes, savent rendre compte : la complexité même de la vie. Lʼengagement social de Balzac invite à penser sa façon de mettre le meurtre en fiction en rapport au contexte sociologique et historique de ses œuvres. Dans la réflexion balzacienne sur le meurtre, quatre thèmes importants reviennent constamment : lʼargent (aspect économique), la jeunesse, la famille (aspects sociaux) et le remords (aspect moral). La dimension philosophique de La Comédie humaine justifie, quant à elle, le choix dʼune lecture également philosophique de lʼœuvre de Balzac. Les meurtres de quatre nouvelles appartenant aux Études philosophiques (El Verdugo, LʼAuberge rouge, Les Marana et Un drame au bord de la mer), assurent une pensée multiple sur des thèmes tels que la justice, le droit, le nom de famille, lʼhonneur, la culpabilité et le glissement dʼune société ancienne vers une société nouvelle dominée par lʼargent. / The literary work of Honoré de Balzac testifies to a deep knowledge and reflection of the judicial system. Violence and crime, certainly not the brightest sides of humanity, are nevertheless an integral part of society. Since Balzacʼs ambition is to show human nature as it is, he agrees to depict murder without euphemisms. Far from entirely rejecting the bloody romantic aesthetic, he describes crime as a fundamentally ambivalent action, meaning that he neither absolutely condemns it nor openly defends it. We find in Balzac what very few writers, and even fewer philosophers, can account for : the very complexity of life itself. Balzacʼs social commitment invites us to think about his way of putting murder in fiction in relation to the sociological and historical context of his works. In Balzacʼs reflections on murder, four important themes constantly recur : money (economic aspect), youth, family (social aspects) and remorse (moral aspect). The philosophical dimension of La Comédie humaine justifies the choice of an equally philosophical reading of Balzacʼs work. The murders of four short stories belonging to the Études philosophiques (El Verdugo, LʼAuberge rouge, Les Marana and Un drame au bord de la mer), ensure a multiple reflection on themes such as justice, law, family name, honour, guilt and the shift from an old society to a new money-dominated society.

Ce mémoire propose d’élaborer une philosophie du meurtre politique, entendu comme mise-à-mort de l’oppresseur dans un contexte de lutte d’émancipation, à partir de celle que l’on peut trouver dans l’œuvre de Jean-Paul Sartre. Il nous faudra d’abord identifier cette philosophie en commençant par ses prémisses dont il sera suggéré qu’elles se trouvent dans le corpus dramatique de l’auteur puis en examinant les prolongements de celles-ci dans son œuvre philosophique. Après l’exposition de la cohérence de ces deux ensembles, ce mémoire s’intéresse à la réception critique de cet aspect de la philosophie sartrienne, afin d’en relever les limites et apories auxquelles il s’agira de proposer des solutions, en greffant à cette philosophie les apports d’autres perspectives que l’on trouve dans les pensées féministes et décoloniales contemporaines. / This dissertation proposes to develop a philosophy of political murder, understood as the killing of the oppressor in the context of an emancipatory struggle, based on that found in the works of Jean-Paul Sartre. We shall first identify this philosophy, starting with its premises, which we shall suggest are to be found in the author's dramatic corpus, and then examining its extensions in his philosophical work. After demonstrating the coherence of these two bodies of work, this dissertation will turn to the critical reception of this aspect of Sartre's philosophy, in order to identify its limitations and aporias, and propose solutions by grafting onto this philosophy the contributions of other perspectives found in contemporary feminist and decolonial thought.

An Exploration of Trauma Markers in the Artwork of Serial Killers

This research is a qualitative art-based study exploring trauma markers found in the artwork of serial killers through the participation of licensed art therapists trained in the identification and treatment of trauma. The literature review covers a broad range of variables that influence the development of mass murderers, and how art therapy may be useful in working with serial killer populations. The study offers a unique, non-verbal exploration of the trauma experienced by serial killers through the art therapy lens. The three participants provided invaluable data through their responses to a questionnaire and creation of response art that demonstrates evidence of complex trauma, military trauma and traumatic brain injury; all of which were supported by previous research found in the literature. Themes identified through the analysis of the data included: communication, representation, chaos and violence, life and death, and illusion of power. This study demonstrates the importance of understanding serial killers’ psychological makeup, the traumas and other experiences that have profound impacts on them, and the contexts in which they develop. This may lead to a better understanding in how to look for the warning signs in their development and artwork; allowing for the potential to prevent such violent behavior with early intervention.

The research is concerned with how the post-mortem report can be used as a source of information in the investigation of murder cases to identify crime, individual crimes and trace suspects, etc. The understanding of the post-mortem report, and the information which can be obtained from it, will assist the police investigators to handle murder cases in a professional way. The purpose of this research was to evaluate the existing manner in which police investigators use post-mortem reports in their investigations, with the intention of determining its strengths and weaknesses, and considering how the usage can be improved. Secondly, the researcher wanted to explore how investigators use postmortem reports as a source of information in their investigations. To accomplish this, the researcher perused international and national literature in an attempt to explore the field. The researcher wanted to apply the new research knowledge in order to develop good practice in the field. This research focused on the personal experiences of both male and female victims of violent crimes. The aim of this research was to explore how indigenous Black South Africans understand and deal with victimisation. An African epistemology was used to help gain a deeper understanding of the experiences of the participants. Participants were recruited using purposive sampling strategy. Five participants were selected for this study. Data was collected using individual face-to-face semi-structured interviews. Based on the transcribed data, themes were extracted and analysed using content analysis. The results indicate that participants attributed varying meanings to their victimisation. / Psychology / M. The significance of efficient murder crime scene processing

This study sought to explore the significance of efficient murder crime scene processing. Data were collected through semi-structured interviews conducted with investigators who investigate murder cases in the Nyanga South African Police Service (SAPS) cluster in the Western Cape, to stimulate knowledge of the significance of efficient murder scene processing. A literature study relating to aspects of crime scene management and crime scene processing was conducted. From the results of this research, it appears that participants did realise the significance of efficient murder scene processing. It is, however, apparent that they experienced challenges and shortcomings with regard to efficiently processing murder scenes. Reasons for this are inexperienced investigators, overload of murder scenes to investigate, lack of human resources, and lack of cooperation between investigators and crime scene experts. An evaluation of the role of forensic science in crime scene reconstruction

In this research, the role of forensic science with the use of forensic photography in the crime scene reconstruction process was evaluated. The researcher identified how SAPS detectives and Crime Scene Technicians (CST‟S) are currently conducting crime scene reconstructions by adopting forensic photography; furthermore, other methods in which forensic photography could be used to conduct crime scene reconstructions were explored. The researcher made use of an empirical design, as the information available on the research topic was limited. The empirical design, together with a qualitative research approach, allowed for real-life observations. The simple random sampling method was used to select 20:10 partcipants for this research as follows: Ten (10) detectives that investigate murder cases, and another ten (10) CST‟S that conducted crime scene reconstructions in the Durban Policing Area (DPA). Data was obtained using qualitative data collection methods that included a literature study and interviews. The findings of this research provide that the value of forensic science, as well as the use of forensic photography in the crime scene reconstruction process, was established. Evidently, detectives and CST‟S are not doing everything possible to reconstruct murder crime scenes. For recommendation, this research suggests that SAPS detectives and crime scene technicians (CST'S) adopt the fundamentals of forensic science when reconstructing murder crime scenes. / Criminology and Security Science / M.
