Protecting traditional healing practices in Malawi : are there lessons to be learnt from South Africa?

"The aim of this paper is to highlight the human rights dimension in the protection of traditional healing practices (THP) in Malawi. At first glance there might not seem to be considerable human rights issues involved. However, the scourge of the HIV/AIDS pandemic entails that traditional health practitioners have a crucial role to play in ensuring the right to health. Furthermore, THP represent an important component of the cultural tapestry of Malawian life. It is this combined cultural and health import that prompts this study. ... This paper explores the relationship between THP and the progressive realisation of the right to health. An investigation is made of the extent to which suppression of THP impacts the right to health in an attempt to discern whether there is a need to regulate and protect these practices. There is some tension between THP, as a cultural right, and the right to health given that THP have the potential to infringe peoples' right to health. However, there is also an intersection between the two rights since health is integrally related to culture and to cultural practices. A person's place in their culture is an essential part of their self-identity, so that if a culture is at risk, that person's psychological and emotional health is also at risk. Consequently this paper will consider the meaning, content and role of the right to culture (is it a collective or individual right?) and whether THP are part of culture, deserving protection as such. ... This paper is divided into five chapters. The introductory chapter provides an overview of the objectives of the study and a definition of THP. The chapter also discusses the research methodology employed in the paper and reviews the main literary works consulted by the author. To establish that THP form an aspect of culture, it is necessary to examine the qualities of THP and compare those to the qualities of recognised forms of culture. The second chapter comprises of an investigation of the legal provisions relating to culture and the various concepts of culture in human rights law. An attempt is then made to place THP within the context of the right to culture. The relationship between THP and the right to health is discussed in the third chapter. In this study it is suggested that the core minimum content of the right to health includes the right to an accessible and acceptable primary health source, and that this implies a right to access THP. The chapter attempts to show that non-regulation impedes THP thus violating the state's obligation to respect the right to health. In the fourth chapter there is an evaluation of the South African Traditional Health Practitioners Act of 2004 (the TH Act). Essentially, the law in Malawi defines and licenses the 'practice of medicine' in terms that entrench the medical profession and that exclude all other forms of healing as the 'unauthorised' practice of medicine, a crime. This chapter considers whether the South African legislation is a model for the inclusion of THP. More specifically, whether the development of THP as a form of culture is captured by the TH Act and whether Malawi can draw guidance from this legislation. The fifth and final chapter concludes the paper. The chapter reverts to the original research questions, the concepts propounded in the paper and the various conclusions drawn to establish whether the original problems presented have been resolved. The role of Makhadzi in traditional leadership among the Venda

Submitted in fulfilment of the requirements for the degree of Doctor of philosophy in the Faculty of Arts, department of Anthropology and Development Studies at the University Of Zululand, South Africa, 2013. / This contribution considers the role of a father’s senior sister (makhadzi) in traditional leadership among the Venda speaking people in the present South Africa. It also considers their place in the new democratic South Africa against the backdrop that the legislations enacted to give effect to traditional leadership did not recognise them explicitly. While reviewing gender based propositions the study demonstrates that even though in most African societies, women are insubordinate to men there exists a special class of women who play critical role in the public sphere and whom the society highly regards. In the case of Venda people these are the makhadzi. It used a qualitative approach to study the role of makhadzi and how people act towards them despite that they are explicitly recognised in the legislations because as an anthropological study, it examines human behaviour with a view to understanding society. Based on primary data collected using participant observation and interviews, the role of makhadzi in society was unearthed. The study found that among the Venda the makhadzi has different roles which are important in traditional leadership and that such women can be traced in other societies in Africa. It establishes that among others, the makhadzi play critical roles in succession, resolution of disputes, regency, initiation of girls and spiritual roles. While some of the cultural practises are repugnant to the notion of justice and morality and would be of dubious legality given the constitution essentialisation of human rights and dignity, the study has shown that the makhadzi has a place and role in the new democratic society.

Explorations and Collaborations on Two Under-Recognized Native American Food Crops: Southwest Peach (Prunus Persica) and Navajo Spinach (Cleome Serrulata)

Agricultural production among the Native American populations of the Southwest declined significantly during the twentieth century. Corn, beans and squash, the three most recognized traditional food crops, remains widespread, but knowledge regarding the traditional management of these crops was lost. The loss of traditional knowledge for Southwest Indigenous Nations was more pronounced for the Southwest peach (Prunus persica) and Navajo spinach (Cleome serrulata Pursh). The Navajo, Hopi, and Zuni Nations are all seeking to increase the availability of traditional crops for their original uses, such as for food and wool dye. In order to revitalize traditional agriculture for these tribes, information regarding these crops was gathered, including: variety characterization, the horticultural basis for traditional management practices, and cultural uses and significance. Southwest peach orchards were located for seed and plant material collections to characterize their genotype and relate them to modern peach cultivars. Traditional farmers were interviewed on management practices and irrigation strategies to correlate to dendrochronology (tree-ring analysis) techniques. Dendrochronology samples included tree stumps or cores to evaluate ring growth variability, age, and life span of the orchard trees. Navajo spinach seed was collected from Chinle, Arizona for germination studies on overcoming seed dormancy. Information on both Southwest peach and Navajo spinach will be useful to encourage culturally important traditional crop management.

A Descriptive Comparative Study Of Traditional And Non-traditional Master's Of Science In Nursing Degree Programs Offering the Education Track in the State of Florida

The goal of this research was to determine how the nursing faculty shortage in Florida was being addressed. The purpose of this descriptive, comparative study was to explore program length, size, and admission criteria of master's of science in nursing (MSN) degree programs. Characteristics of both traditional and non-traditional programs that offered the education specialty were examined. Non-traditional programs included registered nurse to master's of science in nursing (RN-MSN) degree programs. Characteristics of students enrolled in the education track of these programs were also compared, based on participant's entry level into nursing practice. The three comparison groups included diploma prepared nurses, associate degree prepared nurses, and baccalaureate prepared nurses. Comparative and descriptive statistics with cross tabulations and frequencies, were used to determine comparisons, based on responses to questionnaire items that focused on reasons for entering the program, financial assistance, program satisfaction, goals, future plans, years of experience, nursing specialty, employment status, and demographics. The literature review found very few current studies on non-traditional and traditional MSN degree programs. Results of this study found only nine programs in the state that offered an MSN with a nursing education specialty with participation elicited from five of those nine programs. Findings revealed that within those programs were a variety of both traditional and non-traditional options that were unique in how they were organized and administered. Descriptive, comparative analysis revealed no significant differences in student characteristics of the three identified groups for those enrolled in master's level coursework in the nursing education specialty in spring of 2006. Overall, participants in the MSN programs indicated that they chose the program because they needed it for advancement, they wanted additional knowledge and skills, and the reputation and location were important. Their education was financed with personal earnings or loans. Upon completion of the program they planned to stay in their current positions and continue for a doctoral degree or specialty certification in nursing. Within 10 years they planned to be working as a faculty member in a nursing program. They were Caucasian women, aged 41-55, who lived with a significant other and children, worked more than 33 hours per week in critical care, pediatrics or education, and had more than 20 years of work experience. Findings indicated that the diversity of the MSN programs made no difference in the types of students that were attracted to the programs. These findings may be used to target recruitment efforts toward those interested in becoming nursing faculty in an effort to help alleviate the nursing faculty shortage in Florida.

Toward Preservation of the Traditional Marketplace: A Preference Study of Traditional and Modern Shopping Environments in Bangkok, Thailand

The objectives of this dissertation are to: 1) identify the aspects of shopping environments that are important to people; and 2) identify strategies to maintain the cultural relevance and viability of traditional marketplaces in the new global economy. This dissertation uses a Content Identifying Methodology (CIM) to determine preferences of general Thai shoppers for different shopping environments in Bangkok, Thailand. The procedures include preference rating, scene description, and respondents' background surveys. Data were analyzed using factor analysis, content analysis, Analysis of Variance (ANOVA), canonical correlation analysis, and Multivariate Analysis of Variance (MANOVA). In addition, interviews with designers and developers of shopping environments are used to establish implications for future development, design, and renovation of shopping environments. Three major factors, environmental, shopping, and background, were found to influence preferences for shopping environments. The environmental factors include the perceived environmental types; spacious and well-organized spatial configurations; physical content, such as fresh products, vegetation, and sitting areas; and environmental conditions, such as maintenance level, crowdedness, and cool temperatures. Shopping factors include recreational and value shopping. Respondent's background factors include shopping behaviors and socio-economic backgrounds, such as age and household economic status. Shoppers prefer certain shopping environments based on their shopping purpose: recreational versus value shopping. Recreational shopping appeals to young, single, and big group shoppers at modern malls, which provide the most opportunities for exploring, recreating, and socializing. Value shopping appeals to older, married, and large family shoppers at traditional markets that offer the high quality fresh products at low price. The dissertation's findings are consistent with previous studies and support theoretical explanations in the environmental perception and assessment field. Coherence, complexity, legibility, and mystery, and the concept of affordance influence preference; and are useful in making recommendations. The results indicate that, by identifying the preferences and perceptions of Thai shoppers, it is possible to preserve important aspects of the traditional Thai marketplace. This is achieved by incorporating aspects of traditional Thai markets into new shopping environments; and enhancing existing traditional markets to give them broader appeal and make them more viable in today's economy. / Ph. Changing Mindsets: A Case Study of a Community of Practice between Charter and Traditional Public School Leaders in the School Leaders Network

The purpose of this study was to examine the essential elements of a community of practice intended to increase communication and collaboration between traditional public and charter school leaders. Members of the Los Angeles Cohort of the School Leaders Network participated in this study. This case study triangulated observation, interview, and document review data to identify the factors that were most beneficial to this particular community of practice. Drawing on the research of communities of practice, constructivism, and leadership theory, these factors were articulated into five domains with the hope that, with further research, this framework could influence the creation of additional communities of practice between traditional public and charter school leaders. This framework, including indicators and action steps to aid in creating a community of practice, identified five key factors: knowledge, relationships, authenticity, constructivism, and leadership. The convergence of these five domains pointed to two key take-aways: Communities of practice must create a risk-free environment in which sharing can occur so that participants can use storytelling as a vehicle for the exchange of ideas. Essential in creating this environment is the influence of a skilled facilitator who can drive these conversations. Ultimately, in sharing stories and building community, these communities of practice are meant to further the cause of a socially just education for all students regardless of the type of schools they attend.

Traditional Cultural Artmaking Practices and Their Impact on Wellness

This study explores the impact that traditional artmaking can have on the wellness of individuals who continue to practice their traditional crafts. Limited research has explored how culturally adapted art therapy practices and culturally relevant materials can promote wellness and alleviate emotional and acculturation challenges for multicultural populations. This research included a case study approach that invited five participants who regularly engaged in a traditional artmaking practice to continue their practice for four consecutive weeks and reflect on their sense of wellness after each traditional artmaking engagement. Over the four weeks, participants completed an initial survey to assess their baseline sense of wellness, weekly surveys that included the WHO-5 Well-being Index, and a final interview over Zoom web conferencing. Through a thematic analysis of the qualitative data, the researchers recognized two overarching themes: (1) the sense of wellness through experiencing a connection to culture, and (2) connection to heritage and present-moment awareness. The survey results revealed that environmental stressors often impacted the participant’s ability to rate wellness in connection to their artmaking practice and that their practice was a helpful distraction that positively impacted wellness. This research suggests that engaging in traditional cultural art practices can increase an individual’s sense of wellness through a deeper connection to their culture and their present-moment awareness. Further studies regarding traditional cultural artmaking practices and their impact on wellness may inspire and support art therapists in decolonizing therapeutic approaches and empowering multicultural communities and individuals.

Aim of the study: The main aim of the study is to examine and pursue research regarding the history and role of law in the disintegration of the institutions of traditional leadership in South Africa, Botswana and Lesotho in order to make recommendations regarding the challenges and opportunities facing traditional authorities in these countries. The traditional systems, roles and functions of these institutions are traced from the pre-colonial era up to the period of democratic regimes in these countries. This study is based on the premises that the jurisprudence of the institution of traditional leadership is as old as mankind and that this institution is rooted in the rural soil of African communities. Research Methodology: This study is based on legal comparative research with reference to South Africa, Botswana and Lesotho. A literature survey of the most important sources dealing with history, legislation and policy documents was undertaken. Conclusion and Recommendations: The institution of traditional leadership is one of the oldest traditional institutions of governance in South Africa, Botswana and Lesotho. During the pre-colonial era traditional authorities constituted an important component in the traditional system of the administration of the traditional community. Traditions placed a great amount of responsibility on traditional leaders to look after the best interests of their communities. When the colonial government took over the reigns of these three countries, they changed the pre-colonial form and nature of traditional authorities. These colonial governments exercised control over traditional leaders and allowed minimum independence in their traditional rule. The post-colonial governments of South Africa, Botswana and Lesotho retained the institution of traditional leadership. The Constitutions of these countries provide the legal framework for the recognition and functioning of the office of traditional leaders. However, it has been noted in this study that the relationship between the traditional leaders and the governments of these countries has been a mixture of conflict and cordiality. One of the reasons for this uneasy relationship between the traditional leaders and the central governments of these countries is that the status, authority, power and functions of traditional leaders have been reduced considerably when new institutions such as Local Governments, Land Boards, District Councils and Village District Councils were given powers and functions previously exercised by traditional leaders. The post-colonial transformation of traditional leadership in these three countries has led to a steep decline in the authority of traditional leaders. In order to encourage active participation of the traditional leaders in the new democratic structures and bodies, the institution of traditional leadership must be adapted to the changing political, social and economic environments. Rural local government bodies and the national governments of these countries should not view the institutions of traditional leadership as competitors for political power. The post-colonial governments of South Africa, Botswana and Lesotho should introduce traditional leaders as equal partners in the development and advancement of rural communities. In order to achieve this goal the governments of these countries should empower and capacitate traditional leaders so that they do not become misfits in the new constitutional and democratic settlements. / Thesis (LL.D.
