In hierdie skripsie is op die belangrike kwessie van onafhanklike waarborge of
waarborge betaalbaar op eerste aanvraag (‘demand guarantees’) gefokus.
Onafhanklike waarborge speel ’n groot rol in internasionale handel en word dikwels
as die ‘lewensbloed van handel’ beskou. ’n Onafhanklike waarborg kan beskryf word
as ’n persoonlike sekuriteitsonderneming waaronder ’n bank die betaling van die
onafhanklike waarborg aan ’n begunstigde belowe, indien die prinsipaal nie sy
verpligtinge ingevolge die onderliggende kontrak nakom nie.
’n Fundamentele beginsel van onafhanklike waarborge is die
onafhanklikheidsbeginsel
(die ‘autonomy principle’ of ‘independence principle’). ’n Probleem wat dikwels in
regspraak voorkom ten opsigte van onafhanklike waarborge, is die vraag oor
wanneer ’n finansiële instelling aanspreeklikheid mag vermy, met ander woorde op
watter uitsonderings tot die onafhanklikheidsbeginsel die bank aanspraak kan maak.
Suid-Afrikaanse howe aanvaar dat die onafhanklikheidsbeginsel van onafhanklike
waarborge in sekere gevalle deur die bank (die borg) geïgnoreer mag word. Bedrog
is een so ‘n uitsondering en die uitsondering van onregmatigheid begin ook
aansienlik meer aandag geniet in die howe.
As navorsingsontwerp is die leerstukgebonde metodologie gebruik ten einde die
kwessies wat in die mini-verhandeling aan bod kom te ondersoek. Akademiese
artikels, wetgewing en regspraak is geraadpleeg en bespreek Daar is verder ook
vergelykend te werk gegaan deur die Engelse regspraak te betrek..
Gebaseer op die geraadpleegde bronne word daar tot die gevolgtrekking gekom dat
Suid-Afrika die streng benadering tot die bedroguitsondering tot die
onafhanklikheidsbeginsel volg. Die kwessie van die onregmatigheid van die
onderliggende kontrak moet egter nog baie aandag kry. Onregmatigheid as
uitsondering is nog in sy kinderskoene en daar is steeds baie onsekerheide ten
opsigte van die presiese toepassing daarvan, die tipes onregmatigheid en die
bewyslas wat vereis word. Tot dusver is daar geen regspraak in die Suid-Afrikaanse

Faktore wat die effektiewe bestuur en kontrole van skoolfinansies in openbare skole beïnvloedJordaan, Johannes Cornelius 27 June 2009 (has links)
AFRIKAANS : Voor 1994 was die skoolhoof aanspreeklik vir die beheer van die finansies van die skool. Met die instelling van die Suid-Afrikaanse Skolewet no. 84 van 1996 het die aanspreeklikheid ten opsigte van finansies drasties verander deurdat selfbestuur by skole geïmplementeer is. Daar bestaan groot onduidelikhede by departementele amptenare sowel as by skoolhoofde en beheerliggaamlede oor wie aanspreeklik vir die finansies van die skool is. Skole se begrotings het sedert 1994 van `n paar honderd duisend rand na `n paar miljoen rand toegeneem; meer personeel word aangestel wat deur die skoolbeheerliggaam vergoed word en dit alles plaas ekstra belading op die skoolhoof. Dikwels is die skoolhoofde en skoolbeheerliggaamlede nie opgelei om hierdie ekstra finansiële lading te hanteer nie. Daar word van die skoolbestuurspan verwag om kennis van finansiële bestuur te hê om hulle taak effektief te kan uitvoer, nie alleenlik vir hulle eie oorlewing nie maar ook tot die voordeel van die skool en die gemeenskap. Die doel van hierdie studie is om te bepaal watter faktore die beheer en bestuur van skoolfinansies in `n openbare skool beïnvloed en om `n model daar te stel wat die beheer en bestuur van skoolfinansies in `n openbare skool sal rig. ENGLISH : Before 1994 the principal of a school was accountable for the control of the school`s finances. Since the introduction of the South African Schools Act no. 84 of 1996 and the implementation of self management of schools, the accountability regarding finances has changed dramatically. Schools’ budgets have increased from thousands of rand to millions of rand since 1994; more teachers are being appointed and paid by the school governing body. Departmental officials, principals and school governing body members have no experience to handle the extra financial burden. Principals and school governing body members have no experience of carrying this extra financial burden. It is expected of school managers to have knowledge of financial management to enable them to execute tasks effectively, not only for their own survival but also in the best interest of the school and the community. The purpose of this study is to determine factors that influence the control and management of public schools’ finances and to present a model that will guide the control and management of a public school’s finances. The use of temporary employment services as a means to achieve flexibility in die labour market led to various complications due to a lack of proper regulation. The atypical formation of the triangular employment relationship, limited rights and less favourable employment conditions of the temporary employees, multiple authority figures and their liabilities under various circumstances and the impact thereof on such employee’ collective bargaining rights caused legal uncertainty in the absence of sufficient legislation to govern it. Temporary employment agencies developed certain methods in order to evade the restrictive labour legislation and employer duties imposed on them, namely by making use of automatic termination clauses (resolutive conditions) and by categorising the temporary employee as an independent contractor. Last mentioned would effectively exclude the temporary employee from labour legislation and the protection it provides.
In reaction to abovementioned problems, trade unions have been objecting to the use of temporary employment agencies and went as far as demanding the total ban thereof. This raised the question in the South African Government whether said agencies should indeed be banned. The other option is a less restrictive approach and entails the attempt to regulate these agencies by amending the current labour legislation in order to accommodate temporary employment services. In light of the fact that various proposals to amend the current South African labour legislation (especially with regard to temporary employment services) have been published in the Government Gazette, it can be deduced that the social partners ultimately chose to regulate temporary employment agencies rather than ban them altogether.
From an early stage the International Labour Organisation (ILO) provided rules and regulations for the management of employment agencies in general by way of conventions and recommendations. In 1997, in order to give effect to the labour standards identified by it, the ILO brought the Private Employment Agencies Convention into existence. This document could be applied to all temporary employment agencies on an international level. This document provides for administrative regulations, the duties of the agency and the client as well as the rights of the temporary employees concerned. The ILO recommends that all of its member states incorporate the principles contained within this document in their own legislation.
Temporary employment services are also used in other legal systems. For purposes of this study, the English law (United Kingdom (UK)) and the Namibian law will be scrutinised. Similar issues to those recognised in the South African law have been identified in these countries. However, each has approached said problems in different ways. The Namibian Government banned the conducting and provision of these services by way of legislation in 2007. The constitutionality of the ban has however been questioned by the Supreme Court of Namibia, after which it had been found to infringe upon the fundamental freedom to carry on any business, trade or occupation. The ban was struck down as unconstitutional. The Namibian Government has since promulgated new legislation in which it removed the ban and replaced it with numerous amendments providing for the regulation of temporary employment services.
Since 1973 the UK has been promulgating various instruments for the thorough regulation of temporary employment agencies. These instruments provide for the management of temporary employment agencies and the rights of the employees involved. The relevant legislative instruments have been updated regularly with the purpose of ensuring that the needs of all the parties concerned are met. The UK, as a member state of the European Union (EU), (which has also been providing for the regulation of temporary employment services in various directives), promulgated legislation specifically with the aim to give effect to the principles in the mentioned directives. By way of doctrines and the creation of a third category ―worker‖ the UK has been attempting to prevent any loopholes in their legal system with regard to temporary employment services and the rights of the employees involved.
The aim of this study is to investigate all the important complications experienced with temporary employment agencies in order to indicate the impact the atypical circumstances have on the rights of the temporary employees. The degree to which, if at all, the South African law complies with the preferred labour standards identified by the ILO will be pointed out. A comparative study will be conducted, first by ascertaining in detail how the comparable issues in the UK and Namibian law are dealt with, and second by identifying which aspects in these legal systems could be of value to the South African law. Finally the potential effectiveness of the proposed amendments to the South African labour legislation will be analysed, during which recommendations for the unresolved issues will be provided. Investigating the importance of co-expressed rotavirus proteins in the development of a selection-free rotavirus reverse genetics system / Johannes Frederik WentzelWentzel, Johannes Frederik January 2014 (has links)
Reverse genetics is an innovative molecular biology tool that enables the manipulation of
viral genomes at the cDNA level in order to generate particular mutants or artificial viruses.
The reverse genetics system for the influenza virus is arguably one of the best illustrations of
the potential power of this technology. This reverse genetics system is the basis for the
ability to regularly adapt influenza vaccines strains. Today, reverse genetic systems have
been developed for many animal RNA viruses. Selection-free reverse genetics systems have
been developed for the members of the Reoviridae family including, African horsesickness
virus, bluetongue virus and orthoreovirus. This ground-breaking technology has led to the
generation of valuable evidence regarding the replication and pathogenesis of these viruses.
Unfortunately, extrapolating either the plasmid-based or transcript-based reverse genetics
systems to rotavirus has not yet been successful. The development of a selection-free
rotavirus reverse genetics system will enable the systematic investigation of poorly
understood aspects of the rotavirus replication cycle and aid the development of more
effective vaccines, amongst other research avenues.
This study investigated the importance of co-expressed rotavirus proteins in the
development of a selection-free rotavirus reverse genetics system. The consensus
sequences of the rotavirus strains Wa (RVA/Human-tc/USA/WaCS/1974/G1P[8]) and SA11
(RVA/Simian-tc/ZAF/SA11/1958/G3P[2]) where used to design rotavirus expression
plasmids. The consensus nucleotide sequence of a human rotavirus Wa strain was
determined by sequence-independent cDNA synthesis and amplification combined with
next-generation 454® pyrosequencing. A total of 4 novel nucleotide changes, which also
resulted in amino acid changes, were detected in genome segment 7 (NSP3), genome
segment 9 (VP7) and genome segment 10 (NSP4). In silico analysis indicated that none of
the detected nucleotide changes, and consequent amino acid variations, had any significant
effect on viral structure. Evolutionary analysis indicated that the sequenced rotavirus WaCS
was closely related to the ParWa and VirWa variants, which were derived from the original
1974 Wa isolate. Despite serial passaging in animals, as well as cell cultures, the Wa genome
seems to be stable. Considering that the current reference sequence for the Wa strain is a
composite sequence of various Wa variants, the rotavirus WaCS may be a more appropriate
reference sequence.
The rotavirus Wa and SA11 strains were selected for plasmid-based expression of rotavirus
proteins, under control of a T7 promoter sequence, due to the fact that they propagate well
in MA104 cells and the availability of their consensus sequences. The T7 RNA polymerase
was provided by a recombinant fowlpox virus. After extensive transfection optimisation on a
variety of mammalian cell lines, MA104 cells proved to be the best suited for the expression
rotavirus proteins from plasmids. The expression of rotavirus Wa and SA11 VP1, VP6, NSP2
and NSP5 could be confirmed with immunostaining in MA104 and HEK 293H cells. Another
approach involved the codon-optimised expression of the rotavirus replication complex
scaffold in MA104 cells under the control of a CMV promoter sequence. This system was
independent from the recombinant fowlpox virus. All three plasmid expression sets were
designed to be used in combination with the transcript-based reverse genetics system in
order to improve the odds of developing a successful rotavirus reverse genetics system. Rotavirus transcripts were generated using transcriptively active rotavirus SA11 double
layered particles (DLPs). MA104 and HEK293H cells proved to be the best suited for the
expression of rotavirus transcripts although expression of rotavirus VP6 could be
demonstrated in all cell cultures examined (MA104, HEK 293H, BSR and COS-7) using
immunostaining. In addition, the expression of transcript derived rotavirus VP1, NSP2 and
NSP5 could be confirmed with immunofluorescence in MA104 and HEK 293H cells. This is
the first report of rotavirus transcripts being translated in cultured cells. A peculiar cell
death pattern was observed within 24 hours in response to transfection of rotavirus
transcripts. This observed cell death, however does not seem to be related to normal viral
cytopathic effect as no viable rotavirus could be recovered. In an effort to combine the
transcript- and plasmid systems, a dual transfection strategy was followed where plasmids
encoding rotavirus proteins were transfected first followed, 12 hours later, by the
transfection of rotavirus SA11 transcripts. The codon- optimised plasmid system was
designed as it was postulated that expression of the DLP-complex (VP1, VP2, VP3 and VP6),
the rotavirus replication complex would form and assist with replication and/or packaging.
Transfecting codon- optimized plasmids first noticeably delayed the mass cell death
observed when transfecting rotavirus transcripts on their own. None of the examined coexpression
systems were able to produce a viable rotavirus.
Finally, the innate immune responses elicited by rotavirus transcripts and plasmid-derived
rotavirus Wa and SA11 proteins were investigated. Quantitative RT-PCR (qRT-PCR)
experiments indicated that rotavirus transcripts induced high levels of the expression of the
cytokines IFN- α1, IFN-1β, IFN-λ1 and CXCL10. The expression of certain viral proteins from
plasmids (VP3, VP7 and NSP5/6) was more likely to stimulate specific interferon responses,
while other viral proteins (VP1, VP2, VP4 and NSP1) seem to be able to actively suppress the
expression of certain cytokines. In the light of these suppression results, specific rotavirus
proteins were expressed from transfected plasmids to investigate their potential in
supressing the interferon responses provoked by rotavirus transcripts. qRT-PCR results
indicated that cells transfected with the plasmids encoding NSP1, NSP2 or a combination of
NSP2 and NSP5 significantly reduced the expression of specific cytokines induced by
rotavirus transcripts. These findings point to other possible viral innate suppression
mechanisms in addition to the degradation of interferon regulatory factors by NSP1. The
suppression of the strong innate immune response elicited by rotavirus transcripts might
well prove to be vital in the quest to better understand the replication cycle of this virus and

Since they contribute to or deter from the achievement of business objectives, it is essential that they be identified and investigated. The aim of this study was to determine the environmental forces which affect the operations of small, medium and micro independent caterers in Cape Town. In this context, the micro, market and macro-environments were examined. It is hoped that the results of the study will assist these caterers in their awareness of pertinent factors in their business environment, as well as the strengths, weaknesses, opportunities and threats arising therein. Primary data was collected from the business owners or managers through an online survey. The survey covered firmographic business details, as well as demographic details of the owners/managers. Thereafter, their opinions were elicited regarding the impact of various factors in their business environment. The main findings are the following: The greatest positive impacts on the small, medium and micro independent caterers are the abilities of the owners/managers, relationships with suppliers, the internet, and the control of materials and production processes. The greatest challenges faced are financial resources, marketing strategies, online services, competitors, customer demands, the current state of the economy and legal regulations. / Die omgewing waarin 'n onderneming werksaam is, bestaan uit verskeie magte wat die onderneming positief of negatief kan beïnvloed. Aangesien dit tot die onderneming se doelstellings kan bydra of keer dat die onderneming dit bereik, is dit noodsaaklik dat dit geïdentifiseer en ondersoek word. Die doel van hierdie studie was om die omgewingsmagte te bepaal wat die werksaamhede van klein, medium en mikro-onafhanklike spyseniers in Kaapstad beïnvloed. Abstracts in English, Afrikaans and Zulu / In this study, social exclusion in an independent, faith-based girl’s school in South Africa was investigated. Bullying is widely recognised as being unacceptable and is addressed by many schools in the form of anti-bullying policies. However, on ongoing basis, girls are being socially excluded from relationships and because this behaviour is often so subtle, it is neither recognised as a form of bullying nor is it being addressed within schools. Theologians argue that educational institutions ought to evaluate the ethical dimension of knowledge construction and that a focus on moral norms, values and virtues need to be a fundamental part of such communities, so that the well-being of its members is fostered. Unless problems such as social exclusion are understood from a theological-ethical perspective, it is unlikely that there will be a permanent change in girls’ behaviour. Changing societies that accommodate bullying requires changes in perspectives, attitudes and behaviour, and schools can make a significant contribution in providing a community in which every child feels accepted and is afforded dignity.
This study offers a theoretical-ethical perspective of social exclusion and draws on insights from the fields of theological ethics, sociology, psychology and anthropology. The reasons why girls are socially excluded, the girls’ and the school’s systemic patterns of behaviour and what educators can do to develop an inclusive community are identified. To determine to what extent the theory was supported, alumnae were asked to complete the questionnaires and be interviewed. Some staff members also completed questionnaires and agreed to be interviewed.
The findings of the empirical research indicated that the theoretical research was largely supported. Some interesting observations emerged from the questionnaires and interviews that expanded the understanding of social exclusion. One important finding was that the girls who are being excluded from social relationships feel that they are to blame and that they somehow deserve to be excluded. They experience strong feelings of shame as well as loss of self-esteem. This prevents them from discussing or reporting the problem and therefore the structures that are in place for such reporting are not effective. Another important finding was that there is a disconnection between the girls and the staff regarding the effectiveness of current interventions. Therefore, based on the theoretical research and the findings of the empirical data, this dissertation makes recommendations for establishing a community that promotes the well-being and dignity of all. / In hierdie studie is ondersoek ingestel na sosiale uitsluiting in ’n onafhanklike, geloofsgebaseerde meisieskool in Suid-Afrika. Treitering word wyd as onaanvaarbaar erken en word deur baie skole in die vorm van anti-treiterbeleide aangeroer. Dit is egter so dat baie meisies voortdurend op sosiale vlak uit verhoudings gesluit word en omdat hierdie gedrag so subtiel is, word dit nie as ’n vorm van treitering erken nie en dit word ook nie in skole aangespreek nie. Tensy probleme soos sosiale uitsluiting vanuit ’n teologies-etiese perspektief hanteer gaan word, is dit onwaarskynlik dat daar enige permanente verandering in die meisies se gedrag sal wees. Om samelewings wat treitering akkommodeer te verander, vereis verandering in perspektiewe, houdings en gedrag en skole kan ’n aansienlike bydrae lewer om ’n gemeenskap te vestig waarin elke kind aanvaarding en waardigheid ervaar.
Hierdie studie bied ’n teoreties-etiese perspektief ten opsigte van sosiale uitsluiting en steun op insigte uit velde soos sosiologie, sielkunde en antropologie. Die studie identifiseer redes waarom meisies sosiaal uitgesluit word, die meisies sowel as die skool se sistemiese gedragspatrone, en wat opvoeders kan doen om ’n inklusiewe gemeenskap te ontwikkel.
