Právo na podobu / Right to one's own image

The aim of this thesis is to describe the conditions of capturing someone's image and of further portrait use under the law of the Czech Republic. Its content reflects recent fundamental changes in Czech civil law through the new Civil Code, effective since 1 January 2014. This thesis begins with an explanation of the constitutional fundamentals of personality protection, followed by a description of personality protection itself. The major part of the thesis focuses on the right to one's own image and to right to portrait. Generally, capturing one's appearance is possible only upon one's prior consent but there exist several exceptions: interest license, official license, scientific license, artistic license and newspaper license. The situation is different with public figures as the level of their privacy protection is lower than the level of privacy protection of "ordinary" people. The judgment of the European Court of Human Rights in the case of von Hannover v. Germany in 2004 was ground-breaking, saying that the public has the right to be informed about facts which intrude into the privacy of public figures, as long as these facts are capable of contributing to a debate on matters of public interest in a democratic society. Women Creators: Artistry and Sacrifice in the Novels of Virginia Woolf

This thesis examines different facets of feminine artistry in Virginia Woolf's novels with the purpose of defining her conception of women artists and the role sacrifice plays in it. The project follows characters in "Mrs. Dalloway," "To the Lighthouse," and "Between the Acts" as they attempt to create art despite society's restrictions; it studies the suffering these women experience under regimented institutions and arbitrary gender roles. From Woolf’s earlier texts to her last, she embraces the uncertainty of identity, even as she portrays the artist’s sacrifice in the early-to-mid twentieth century, specifically as the creative female identity fights to adapt to male-dominated spaces. Through a close-reading approach coupled with biographical and historical research, this thesis concludes that although the narratives of Woolf's novels demand the woman artist sacrifice for the sake of pursuing creation, Woolf praises the attempt and considers it a crueler fate to live with unfulfilled potential.

Kvalita života člověka se sluchovým postižením / Quality of life people with hearing impairments

The thesis concerns with the quality of life of the individuals with hearing impairment. The thesis is divided into four major parts consisting of subchapters. First major part focuses on general description of the sense of hearing, auditory analyser and difference between these two terms as well as on the classification of the individual auditory impairment types. The next part provides general description of life quality according to various criteria. The last theoretic part focuses on everyday life of aurally impaired individuals. This chapter specifically refers to education and employment of individuals with hearing impairment. A chapter relating to social environment and leisure time is also included. Theoretic part of my thesis is followed by the results of my survey. Two different questionnaires were used aiming at two different groups of survey respondents. Partial conclusions were drawn from each questionnaire survey. The questionnaires mentioned were elaborated in accordance with interdisciplinary division of life quality as well as with subjective perception of quality of life. The diploma thesis focuses on special activities used with visually impaired individuals such as spatial orientation and independent movement activities. The thesis is based both on literature and questionnaires filled in by parents and interviews with children who take spatial orientation and independent movement courses. The first part of this thesis is characteristics of children with severe visual impairment. Next chapter is dedicated to visual defects and injuries of children, including special pedagogy diagnostics. The third chapter deals with special activities used with visual impaired individuals, specifically self-service, training of signing one's self, spatial orientation and independent movement. The final part consists of research - questionnaires and interviews with children who attend spatial orientation and independent movement courses. This thesis deals with the topic of the Socratic question as a basis of the care for one's soul in Patocka's texts within the period from 30th to 50th years of the 20th century. This topic is here divided into three larger coherent units. The first part deals with the Patocka's understanding of Socratic care for one's soul as a historical moral self-creation of man having a character of negatively oriented transcension, which is not determined by ideas, but associated in its way of distance from objectivity with motive of knowing unknowing about the last good. The second part of this thesis deals with Patocka's comprehending of Plato as a creator of metaphysical thinking, in which core stands this negatively oriented experience of Socratic moral reversal. Plato, however, this experience of originally unobjectivated horizon according to Patocka's interpretation objectivates as the world of eternal ideas. Patocka as a central interpretative motive of this experience inserts in his own interpretation of Plato the term of Being inspired by Heidegger, which is very close to Plato's Idea of Good laying beyond all divides of essence (ἐπέκεινα τῆς οὐσίας). Šiandien gausu technologijų, kurios suteikia galimybę paprasčiau bendrauti, dalintis informacija bei įspūdžiais, kitos, tikėtina, atlieka prevencinę funkciją prieš nusikaltimus, apsaugant mus ir mūsų nuosavybę. Tačiau tokia technologijų plėtra iškėlė grėsmę pačiam asmeniui, sumažindama teisę išlaikyti savo privatumą. Konkrečiau kalbant, turima omenyje tik tas technologijas, kurios susijusios su asmens atvaizdu ir jo paviešinimu. Viena iš tokių technologijų yra 2007 metų gegužę Jungtinėse Amerikos Valstijose pristatyta Google Street View paslauga – jos pagalba galima virtualiai keliauti po pasaulį ir matyti aplinką 360 laipsnių kampu. Pasirodžius minėtai paslaugai kilo didžiulis sąmyšis dėl intervencijos į asmens privatumą, nes įgyvendinant užmanytą šio projekto tikslą, kartu su gatvių ir pastatų vaizdais buvo užfiksuoti ir žmonės. Todėl šiame darbe pateikiama minėtos paslaugos ir jos poveikio asmens privatumui analizė. Pagrindinis darbo tikslas – išsiaiškinti, ar Google Street View pažeidžia teisę į privatų gyvenimą. Siekiant minėto tikslo pirmoje darbo dalyje analizuojama teisės į privatų gyvenimą samprata pagal tarptautinę ir nacionalinę teisę, toliau analizuojamas minėtos paslaugos įgyvendinimo atitikimas valstybių iškeltiems reikalavimams. The advancement of new technologies is changing the world, however, it raises the threat to the person by reducing his right to maintain his privacy at the same time. More specifically are meant only technologies that deal with person’s image and its disclosure. One of such technologies is Street View project of Google, which was introduced in May 2007 in United States of America. Street View makes possible to take a virtual travel around the world and viewing and navigating within 360 degree scenes of street-level imagery. Its realization caused huge commotion because of intervention to privacy – the cameras of Google vehicles captured images not only of buildings, automobiles but even passersby. The aim of this thesis is to ascertain whether Google Street View violates the right to the private life. The work is devided into three chapters. Nowadays, anonymous sperm donation is indeed a globally discussed topic: the popularity of the use of assisted reproduction technology for the purpose of conception is directly proportional to increasing infertility and technological progress. Also, the duration of its use already started to show, with the first generation of opinionated anonymous donor children growing up. The aim of my work is to analyze what are the today's Western society's current ethical and legal views on the anonymous sperm donation and its alternatives, as well as what they should be, and to demonstrate these on the example of Canada, United Kingdom and Australia. In the first two chapters, I outline the context of ethical and legal thinking about anonymous sperm donation: I analyze the concept and implications of the infertility, as well as the development and types of methods of assisted reproduction. Further, I proceed from the basis of ethical reasoning and the determination whether the right to know one's origins, implying the right to know the circumstances of one's conception, exist, and its competition with the rights of parents and donors in the third chapter, to its legal grounds.
