L'intégration des immigrées marocaines vieillissant seules en France et en Belgique. : Quelle perception ont-elles de leur vie et de leur avenir, au regard des politiques publiques mises en œuvre dans les deux pays d'accueil ?

La France et la Belgique sont deux pays qui ont attiré massivement l'immigration marocaine dans les années soixante/soixante-dix. Beaucoup de ces immigrés ont vieilli dans les pays d’accueil. Parmi eux, des femmes, qui sont venues seules ou ont rejoint leurs maris du fait du regroupement familial. Nous nous sommes intéressée à une catégorie de femmes particulièrement vulnérables, les femmes de 50/60 ans vivant seules et arrivant à l’âge de la retraite. Elles sont veuves, célibataires, divorcées ou abandonnées par leur mari et ont de petits revenus. Notre étude qualitative de terrain a porté sur leur histoire de vie et la perception qu’elles ont de leur vie et de leur avenir. Ces femmes enquêtées vivent dans deux lieux géographiques différents, la région parisienne et la région bruxelloise. Ce choix a été dicté par des contextes d’intégration différents, en France et en Belgique, du point de vue institutionnel et de celui des politiques migratoires. En effet, ces deux pays ont des approches de l’intégration comportant certaines divergences historiques et idéologiques qui peuvent influer sur le mode de vie et les perceptions des immigrés. Citons un point particulièrement sensible : la France prône l’intégration républicaine alors que la Belgique reconnait les communautés culturelles.Cependant, quelque soit leur lieu de vie, ces femmes subissent la « triple peine » d'immigrée, de personne âgée et de femme. Elles n'ont pas pu, au cours de leur trajectoire de vie, accéder à l'ensemble des dispositifs du droit commun auxquels elles auraient pu prétendre. / France and Belgium have both massively attracted Moroccan immigration in the nineteen sixties and seventies. Many among those immigrants got old in their new country. Among them were women who had come on their own or to join their husbands for family gathering and settlement.We have directed our research onto a category of particularly vulnerable women in their fifties and sixties who live on their own and are approaching the age of retirement. Widowed, single, divorced or abandoned by their husbands, they live on low income. Our qualitative field study focused on their story and their own perceptions of their past life and future.The women we've interviewed live in two different locations—Paris and its suburbs, and the Brussels area. This choice was imposed on us because the two contexts of immigration are different in France and in Belgium, as far as institutions and immigration policies are concerned. Here is a very sensitive related issue—Republican integration is advocated in France while cultural communities are recognized in Blegium.Whatever their social standards, however, those women undergo the triple penalty of being immigrants, elderly and women. They were not able, during their lifetime, to get an access to all the legal devices they could have claimed for.

R I G H T T O R E S P E C T F O R P R I V A T E A N D F A M I L Y L I F E I N T H E C A S E - L A W O F T H E E U R O P E A N C O U R T O F H U M A N R I G H T S Abstract The aim of the thesis is to explain wording and application of the Article 8 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (the Convention) from the perspective of the European Court of Human Rights (the ECHR). The scope of Article 8, which guarantees the right to respect for private and family life, is very broad. For this reason the thesis especially deals with the issue of the right of the child to know his/her origin and information about his/her early childhood. In particular it attempts to outline the way how the ECHR deals with the conflict of the right to know one's origin with the right of the parent to stay anonymous. The thesis is divided into five chapters which illustrate the particular aspects of the application of Article 8. These chapters are linked through the judgements Gaskin, Mikulić, Odiévre, Jäggi and Phinirikadou which are related to the right of the child to know his/her origin. Determination of Parenthood - Alexandra Hrušáková Abstract In my thesis "Determination of Parenthood", I focused on the largest area of family law. Everyone's life is influenced by his family the whole life. And there are many consequences connected to the relation between a child and his parents. My topic responds lively to the changes brought by current scientific and technical progress and dynamic development and metamorphoses in our society. I tried to describe it in a complex way, but in order to put accent on the most important segments of this problem. From the times of ancient Rome there exists the principle "mater semper certa est, pater incertus", which means that the identity of the mother is always certain, but the father isn't. However there exist some situations in which the principle could not be so clear. These situations created objective of this thesis. This thesis is divided into ten chapters. Cette étude analyse les modalités de l’inhabitable dans un monde hostile et instable, ainsi que les stratégies élaborées afin de contrecarrer les effets pervers de l’instabilité. La violence des affects en jeu est à l’image de la cruauté des relations sociales, et ne laisse que peu d’espace viable même au sein du cercle familial, lui aussi soumis à l’entropie de la méchanceté ontologique. Les héroïnes de Jackson, confrontées de diverses manières aux résurgences d’expériences traumatiques que la traversée du présent, odyssée physique et psychique, transforme en obstacles insurmontables, recherchent la demeure idéale où se réfugier et trouver l’ancrage que leur interdit le monde extérieur. Jackson utilise les tropes de la maison gothique, de la hantise et du surnaturel pour illustrer les rouages trompeurs qui se mettent en place dès lors que ses héroïnes pensent avoir trouvé un tel lieu. Europos Tarybos Žmogaus teisių ir pagrindinių laisvių apsaugos konvencijoje įtvirtintas rinkinys teisių ir laisvių (teisė į gyvybę, kankinimų draudimas, teisė į teisingą teismą, teisė į privataus ir šeimos gyvenimo gerbimą ir kt.), taikomų kiekvienam, esančiam valstybės, ratifikavusios šią Konvenciją, jurisdikcijoje. Tačiau čia nėra išskiriamos vaikų, kaip specifinės socialinės grupės, reikalingos didesnės apsaugos, teisės. Visgi remiantis tuo, kad EŽTK įtvirtintos teisės taikomos „kiekvienam“, teigtina, kad jos taikomos ir vaikams. Šiame darbe autorė siekia atskleisti, kokios teisės yra užtikrinamos vaikams EŽTK 8 straipsnio plotmėje, taip pat tam tikrus, iš šių teisių kylančius, probleminius aspektus. Siekiant šio tikslo, ypač didelis dėmesys skiriamas EŽTT jurisprudencijai, kadangi remiantis šio Teismo praktika ne tik nustatomas tam tikrų teisių turinys ir jo kaita, bet ir atskleidžiama vaiko teisių apsaugai aktuali problematika. [toliau žr. visą tekstą] / The 1950's Convention of European Council on Human Rights and Fundamental Freedoms establishes a set of rights and fundamental freedoms (the right to life, prohibition of torture, the right to a fair trial, the right to respect for private and family life etc.) applicable to everyone within the jurisdiction of the state that ratified the Convention. Children are a very specific social group, which needs greater protection. However their rights are not distinguished in the Convention. On the basis that the rights enshrined in the ECHR are applicable to „everyone“, it may be maintained that those rights can be applicable to children as well. The author of this work aims to reveal the rights that are guaranteed for children in the context of the article 8 of the ECHR. To this end, particular attention is paid to the jurisprudence of the ECtHR. (Abstract) The diploma thesis deals with the reflection of the right to know one's own origin in the Czech legal order. Knowledge of one's own origin and the right to know one's own origin constitute not only a legal but also a moral and ethical question. The right to know one's own origin (i.e. the right to know one's parents, one's biological family and one's ancestors) is one of the subjective human rights, which belongs to every natural person. This right is more or less reflected in majority of institutes of family law. The thesis analyses the most important of them and indicates how the right to know one's own origin is reflected in these institutes or it is not, although it should be. The work seeks to highlight possible shortcomings of the legislation and tries to propose possible solutions de lege ferenda. There are also stated (for the purposes of comparison) some examples of foreign legislation in cases of some legal institutes. Abstract, Keywords The thesis concerns itself with the analysis of Czech legislation currently in effect with respect to the right to know one's origin. Discussed are the contents of this right, the legislation's addressees, Article 7 of the Convention on the Rights of the Child including the reservations to it made by the Czech Republic. The affected Czech regulations and their reforms are also talked about. Attention is also given to the issue of determining one's parentage. The bulk of the thesis is made up of analyzing the issues of assisted reproduction, surrogacy, adoption, anonymized and confidential childbirths, and baby boxes in regard to protecting the right to know one's origin. The thesis aims to critically evaluate current legislation, point out its shortcomings and suggest possible future development as the right to know one's origin isn't currently being given enough attention. Some of the aforementioned institutes aren't set out in law at all, others give preference to the anonymity of the child's biological parents. Adoption has recently seen some positive development with the recodification of the civil law, however even this is an area that leaves a lot to be desired as there still are certain faults and deficiencies of the legislation. Les mutations profondes qui ont eu lieu dans notre manière de vivre : aspiration à l'égalité ; féminisme ; généralisation des familles recomposées ; acceptation sociale de l'homosexualité ; société de consommation ; dématérialisation et réappropriation de l'identité de l'individu sur les réseaux numériques... ont accompagné un changement radical de la manière de penser le rattachement familial de l'enfant. La mention du nom des parents dans l'acte de naissance ou la reconnaissance de l'enfant sont autant de supports dont le potentiel reste à explorer. Pour sa part, l'adoption est désormais fondée sur un lien plus abstrait de volonté qui exige de ne peut-être plus s'intéresser aux circonstances qui l'ont entourée. Enfin, en parallèle de la filiation génétique et de la filiation volontaire se dessine une nouvelle catégorie de filiation : le lien de filiation polygonéique, fondé sur le fait et mu par l'affection que l'on porte à l'enfant auquel il conviendra de donner un contenu juridique dans l'intérêt de l'enfant. The mention of both parents’ names on a birth certificate, or the recognition of a child are two promising medium, yet to be examined. Concerning adoption, it is founded upon a more abstract link based on volition, meaning that it may no longer require to take into account the circumstances surrounding the adoption. Finally, parallel to genetic filiation and voluntary filiation, a new category of filiation is taking shape: polygoneic filiation (multi-parental filiation), which is based on facts and pushed by the affection felt for the child, and which will require a legal content in the best interests of the child. Beyond all these forms of belonging to a family, we can then wonder what will become new rights for children. Will a child have the right to have specific parents? What will be the criteria for equality between children in the future? What benefits will the child attain after these evolutions? What importance should be given to his/her views? More than ever, it will be crucial to re-examine an equable and predictable legal framework for family bonds which would take into consideration the new public order of the family: the rights of the child.

The aim of this diploma thesis is to analyse the conception of marriage in the works of two Indian female authors, namely Chitra Banerjee Divakaruni's novels Sister of My Heart and its sequel The Vine of Desire and Arundhati Roy's The God of Small Things. The thesis consists of two parts. The objective of the theoretical part is to portray the position of marriage within Indian society and to introduce two female authors and their novels where the theme of Indian marriage plays a significant role. The practical part of the work focuses on a thorough analysis of three chosen female characters. Their roles within the marriage and the influence of marriage on their lives will be further discussed. The result of this part will be an overall comparison of how the chosen authors approach the theme of traditional Indian marriage in their works. .
