Německý hospodářský zázrak / Germany's economic miracle

The topic of thesis is an analysis of the German economy in the years 1948 - 1953, which took place in liberalization of the economy. Liberalization allowed the growth of the economy, which is known as Germany's economic miracle. The work will include an analysis of the benefits Erhard's economic reform, based on the teachings ordoliberalismu. The work includes a theoretical basis for the most important ideas ordoliberalismus. The main part of the thesis, however, focused on the historical context of economic reforms and the economic situation in West Germany. The first part contains a theoretical view of ordoliberalismus. The next chapter deals with the first step in the transition to a market economy and monetary reform. Here is analyzed the cause, course and consequence of monetary reform on the economy situation in the country. There would be followed by an analysis of monetary and banking system development, together with the liberalization of foreign trade.

Social Market Economy: An Inquiry Into The Theoretical Bases Of German Model Of Capitalism

In this study, the concept of &lsquo / Social Market Economy&rsquo / which was the leading idea in the post-Second World War economic order of Germany will be analysed. This analysis will also take into consideration the Economic School of Ordoliberalism which emerged in the inter-war period and greatly influenced the construction of the idea of &lsquo / Social Market Economy&rsquo / with its theoretical principles. Some politicians and theoreticians in the post-war period also contributed to the development of the concept. Within this theoretical framework, the post-war economic policies and developments will be surveyed and the newly established economic order will be compared with the ideals of Social Market Economy theoretical programme. In particular, the impact of the Social Market Economy upon the evolution of German Model of Capitalism will be explored by taking into account the significant changes in the role of the state in the economy and the conduct of relations between the social partners especially since the 1960&rsquo / s.

Es heißt, moderne Marktwirtschaften seien sich selbst regulierende Systeme. Dies gelte auch für die Moral der Akteure. Die Finanzkrisen der letzten Jahre haben die Frage nach der Stärke der Selbstheilungskräfte aufgeworfen. Dies wird im Aufsatz untersucht. Dazu werden zunächst die geisteswissenschaftlichen Konzeptionen des Liberalismus, des Ordoliberalismus und der Zentralverwaltungswirtschaft vorgestellt. Dann wird eine evolutionswissenschaftliche Konzeption dagegengestellt. Es zeigt sich, dass die geisteswissenschaftlichen Konzeptionen das „eigentliche“ Zielsystem der Akteure nur unvollkommen berücksichtigen. Sie über- oder unterschätzen daher das Vermögen der Systeme zur Selbstheilung. Die größte Übereinstimmung finden wir beim Ordoliberalismus, der mit seiner Skepsis in die Selbstheilungskräfte freier Märkte Recht hat: Es muss einen institutionellen Ordnungsrahmen geben, der mit der wünschenswerten gesellschaftlichen Moral besser als bisher zu verknüpfen ist. Für die weitere Forschung sehen wir die wichtige Aufgabe, die Selbstheilungskräfte der Gesellschaft in Bezug auf moralisches Verhalten genauer zu erforschen. / It has been said, modern market economies are self-regulating systems. This would also be true for the moral standards of its actors. The financial crises of recent years have put the strength of self-healing capacities in question. This will be investigated in the following paper. In order to do so, concepts of social sciences such as liberalism, ordoliberalism and central command economy will be presented. Subsequently, evolution theory will oppose these concepts. The analysis shows that social sciences only imperfectly recognize the essential objectives of actors. They over- or underestimate the self-healing capabilities of the economy systems. The largest conformity was found in the ordoliberalism, whose skeptics in self-healing capacities of free markets have been upheld. An institutional framework has to be put in place, which is more strongly linked to the morals of civil society as has been the case so far. In the future, one important task for research will be to further investigate self-healing capacities of societies in light of moral behavior.

After 2 WW was a situation in Germany very difficult. Consequences of a defeat were legible in all spheres. Despite of this situation the German economy was able to recover and in the next two decades showed an economic growth. A significant share on this recovery had representatives of the concept of social market economy and representatives of ordoliberalism Ludwig Erhard, Walter Aucken or Alexander Rustow. In the first chapter I deal with the characteristics and main principles of social market economy. I define main historical milestones of this concept regarding the economic development. With another internal and external changes which inevitably affected German economy, a weaknesses of this system appeared. There were implemented structural reforms, which changed the original concept of social market economy. The second chapter is focused on these structural changes. The last and third chapter deals with current economic situation, which was influenced by the process of globalization and integration of EU. Then in this chapter I describe the current form of social market economy and pros and cons of this concept. The final part deals with future development and sustainability of social market economy.

Construction of legitimacy through contestation of norms and ideas - Legitimacy of the European Central Bank’s crisis governance

The purpose of this thesis is to study the social construction of the legitimacy of the European Central Bank (ECB). This research addresses the research gap in literature on the legitimacy of the ECB. The research conceptualizes a constructivist concept of legitimacy as contestation that is shaped by norms and ideas. The theoretical framework is applied in a case study of the ECB’s policies during the European sovereign debt crisis. The textual data consists of statements by significant political actors in European economic governance. A qualitative content analysis is applied as a method of analysis. The main findings of the research are that the dominant legitimacy discourse during the European sovereign debt crisis was shaped by ordoliberal norms. Those norms were challenged, due to their moral commitments, by a communitarian democratic discourse. The thesis argues that the dominant legitimacy discourse establishes a wider framework of legitimacy for the EMU as a whole and does not only legitimate the policies of the ECB. In addition, the thesis contributes to the understanding of the role of norms and ideas as constitutive of legitimacy. In relation to the field of Global Politics, this study introduces a case of legitimacy in supranational global governance.

Liberal theory and practice of competition law Abstract The presented thesis focuses on the matter of competition law from the point of view of selected schools of economic thought. The goal of the thesis is to provide a comprehensive insight into the content and nature of legal norms in the field of competition law and offer a comparison of views of specific traditions of economic theory on the selected bodies of legislation in force. The wider objective of the thesis is to explore the application possibilities of the findings of various economic theories to legal phenomena, with the thesis exploring both the anglo-american branch of economic analysis of law and heterodox approaches, that originate from the continental economic theory and jurisprudence. To this end, the thesis picks three distinct schools of economic thought, that are commonly labeled as liberal, these being the Austrian, Chicago and Freiburg school of economics, each having different methodology, theoretical and analytical conclusions and prescriptive suggestions. Bodies of legislation in force selected for the purposes of this thesis are competition law statutes of the Czech Republic, the Federal Republic of Germany and the EU. This proposition was designed by the School of Freiburg, in which a scientific committee developed a theory that possess characteristics more liberal and less Keynesian, professing a market economy with state intervention in certain aspects. This theory can be seen in works of political Roberto Campos early in his political career, and certain weightings at the end of it, in which the intellectual undergoes a process of metamorphosis in thinking about Brazil, transferring and adapting theories economic and social well, inspired in Germany and the United States to Brazil, since he was a diplomat. His theories and adaptations can be seen in the JK government and military dictatorship of Castelo Branco, culminating in the Economic Miracle in the Medici government, always thinking in the state as a provider of guarantees and civil liberties, as expressed in the ordoliberalism.

EU Competition Law under Ordoliberalism - A case study of Excessive Pricing in Pharmaceutical Sector

The purpose of this study is to conceptualize the ideational influence of Ordoliberalism on EU Competition Law while addressing a problematic social issue that has been witnessing a surge in the number of cases, which is excessive price abuse under Article 102(a) of the Treaty on the Functioning of the European Union (TFEU) within the spectrum of pharmaceutical sector. By utilizing Nedergaard (2020)’s analytic framework for Ordoliberalism’s operationalization, the study successfully proves the impacts of five characteristics of Ordoliberalism, including Politics by rules, Economic Constitution, Market Construction, Role of Consumers and Role of the states towards consumers, on the practices of EU Competition Law, using the empirical data collected from two excessive pricing examples: Aspen in Italy and Pfizer/Flynn in the United Kingdom. The study also highlights the unique features of the pharmaceutical market due to its significant impacts on public healthcare and medicine assessment. At the end of the study, some recommendations are provided for further investigations.

Cette thèse propose une histoire intellectuelle de l’ordolibéralisme (1932-1950), centrée sur les travaux de Walter Eucken et Wilhelm Röpke, incluant également des références à Franz Böhm, Alexander Rüstow, Leonhard Miksch et Friedrich Lutz. Il s’agit de répondre à la question suivante : comment expliquer que la pensée ordolibérale ait eu les ressources intellectuelles pour peser sur la reconstruction allemande de l’après-guerre Seconde Guerre mondiale ? Répondre à cette interrogation exige, dans un premier temps, de définir clairement ce qu’est l’ordolibéralisme dans son contexte discursif d’apparition. La thèse établit d’abord que l’ordolibéralisme, dans ses composantes épistémologique (Chap. 1), théorique (Chap. 2), idéologique (Chap. 3) ou politique (Chap. 4), peut être défini comme une économie politique du pouvoir : c’est-à-dire une forme de savoir économique, plutôt qu’une sous variété de (néo)libéralisme. L’objectif premier de cette économie politique est de conduire une analyse des sources, des manifestations et des conséquences du pouvoir dans la sphère sociale. Dans un deuxième temps, la thèse montre en quoi cette identité a pu jouer positivement dans la fondation d’une rationalité politique dans les années d’après-guerre en Allemagne de l’Ouest (Chap. 5), et négativement comme rempart aux programmes concurrents, et en particulier face à celui de John Maynard Keynes (Chap. 6). En définitive, la thèse interroge le discours ordolibéral dans sa capacité à servir de référence à des politiques économiques allemandes, puis européennes : une pérennité accompagnée d’une profonde transformation d’une économie politique du pouvoir initial à la forme contemporaine de l’orthodoxie ordolibérale. / This thesis retraces the intellectual history of ordoliberalism, focusing in particular on the works of Walter Eucken and Wilhelm Röpke, with references to the contributions of Franz Böhm, Alexander Rüstow, Leonhard Miksch and Friedrich Lutz. The main question it addresses is the following: how can we explain the fact that ordoliberal thought had the intellectual resources to weight on German post-war reconstruction? In order to answer it, it is necessary to provide a clear definition of ordoliberalism in its discursive context. First the thesis shows that ordoliberalism, in its epistemological (Chap. 1 ), theoretical (Chap. 2), ideological (Chap. 3) and political (Chap. 4) components, can be defined as a political economy of power, i. e. a form of economic knowledge, whose primary objective is to analyse the sources, the action and the impact of power within society; in other words, as a specific doctrine rather than a sub-species of (neo) liberalism. Secondly, the thesis illustrates how this identity played a positive role in promoting a form of political rationality in the post-war years in West Germany (Chap. 5), but also a negative one by excluding rival political programs, such as that of John Maynard Keynes (Chap. 6). Finally, the thesis investigates the ordoliberal discourse as a benchmark for German, and then European, economic policies: a persistence that went together with its radical transformation from the initial political economy of power, to the contemporary form of ordoliberal orthodoxy.
