A Classifica??o Internacional para a Pr?tica de Enfermagem (CIPE?) representa o marco unificador de todos os sistemas de classifica??o de elementos da pr?tica de enfermagem (diagn?sticos, interven??es e resultados de enfermagem) dispon?veis na ?rea em ?mbito profissional que surge em resposta ?s necessidades reconhecidas pela profiss?o. Nesse sentido, o objetivo do estudo foi implementar as contribui??es da Classifica??o Internacional para a Pr?tica em Enfermagem no processo de trabalho do enfermeiro na Estrat?gia de Sa?de da Fam?lia. Foi realizada uma pesquisa-a??o com os enfermeiros de uma Estrat?gia Sa?de da Fam?lia da zona leste do munic?pio de Natal/RN. Segundo Thiollent a pesquisa-a??o agrega diversas t?cnicas de pesquisa social possibilitando a constru??o coletiva e ativa de todos os sujeitos envolvidos no problema ao oferecer um suporte maior na atividade di?ria do profissional. A princ?pio foi elaborado um diagn?stico situacional da realidade, que contribuiu para implementa??o das a??es, nesta etapa foi evidenciado a falta de conhecimento das enfermeiras acerca da CIPE? e das contribui??es que esta traz para a pr?xis profissional. Deste modo, as a??es planejadas e executadas foram: aproxima??o com a realidade e exposi??o da mesma; rodas de conversas sobre a aplicabilidade e funcionalidade da consulta de enfermagem atrav?s de exposi??o-dialogada; rodas de conversa sobre a import?ncia da utiliza??o da CIPE? durante a consulta de enfermagem por meio de din?mica de grupo e exposi??o-dialogada. Identificou-se detalhes da rela??o pedag?gica na escola prim?ria de infantes maranhenses, registradas sob a forma de mem?ria escrita, importantes para identificar os elementos constitutivos da forma escolar prim?ria. Os resultados das an?lises sobre a forma escolar prim?ria republicana no Estado do Maranh?o no per?odo investigado apontaram que esta constituiu-se sob uma din?mica que requeria altera??es nas rela??es sociais de indiv?duos e grupos das massas populares para organiza??o da sociedade maranhense em cadeias de interdepend?ncias, sob a forma de unidade federativa. Neste contexto, a forma da escola p?blica prim?ria maranhense foi configurada com dispositivos de escolaridade que promoviam ? sistematicamente e simultaneamente, mas em graus distintos dependendo das condi??es socioecon?micas da localidade onde a escola prim?ria estava inserida - a desincorpora??o, desvinculamento e o deslocamento dos usos, costumes e saberes nativos para um saber cultural padronizado, mas imanentes aos sujeitos constitu?dos e ?s situa??es que os produziram, (re)formando o cidad?o maranhense com saberes reincorporados para um destino social espec?fico: as pris?es psicossociais do iletrismo. / This study analyzed the shape of Maranh?o primary school and its components during the period from 1889 to 1912. We tried to understand configuration identification of the provincial primary school organization in Maranh?o last imperial decade to analyze the ruptures and continuities inferred with the new regime political, pointing to the dynamics of the strategies, processes and school devices that formed the Republican primary school form in the state of Maranh?o. With data collected from documental, iconographic and bibliographic sources, printed sources used were documents the legislative process, Regulations and Regiments School, newspapers and magazines in circulation in Maranh?o during the period under study, written record of Public Conferences, textbooks written by teachers normalistas, the annals of Pedagogical I do Maranh?o Congress and results of academic research on the history of Maranh?o education in the First Republic. It was identified pedagogical relationship details in elementary school Maranh?o infants, registered in the form of written memory, important to identify the components of the primary school form. The results of the analysis of Republican primary school form in the State of the investigated period indicated that this consisted in a dynamic requiring changes in social relations of individuals and groups of the masses for the organization of society in Maranh?o interdependencies chains under the form of federal unit. In this context, the shape of Maranh?o public elementary school was set up with educational devices that promoted - systematically and simultaneously but in different degrees depending on the socio-economic conditions of the location where the primary school was inserted - the demerger, disassociation and the displacement of uses, native customs and knowledge to a standardized cultural knowledge, but immanent to become subjects and situations that produced them, (re) forming the Maranh?o citizen with knowledge reintroduced for a specific social destination: the psychosocial illiteracy prisons.

O acompanhamento coletivo pode estar vulner?vel a estes problemas, o que demanda a necessidade de conhecer a sua operacionaliza??o. Objetivou-se analisar a pr?tica e a expans?o do acompanhamento coletivo do CD da crian?a em Estrat?gias de Sa?de da Fam?lia (ESF) do munic?pio de Natal/RN. Trata-se de uma pesquisa qualitativa, tendo como m?todo a pesquisa-a??o. Envolveu onze enfermeiras de quatro ESF do munic?pio de Natal, no per?odo de abril a outubro de 2014. Os dados foram coletados atrav?s de entrevista grupo focal e observa??o participante, e analisados de acordo com o direcionamento da an?lise tem?tica de Paulo Freire. O estudo foi aprovado pelo Comit? de ?tica em Pesquisa da UFRN, parecer n? 562.315, seguindo a Resolu??o N? 466/2012 do Conselho Nacional de Sa?de. Na etapa do diagn?stico situacional, que investigou a operacionaliza??o do acompanhamento coletivo do CD da crian?a pelas enfermeiras, percebeu-se que estas buscam realiz?-lo com base na organiza??o e planejamento pr?vios, de forma a ser o mais qualitativo poss?vel. Compreendem a import?ncia e os benef?cios desta atividade, sobretudo no tocante ao emponderamento dos usu?rios. Entretanto, identificou-se a falta de sistematiza??o deste acompanhamento em virtude dos modos distintos de sua operacionaliza??o por parte das profissionais. Percebeu-se ainda a aus?ncia do apoio da equipe de sa?de, o que gera insatisfa??o nas mesmas. Mediante a necessidade de mudan?a desta realidade, decidiu-se, conjuntamente, a constru??o de um instrumento que sistematizasse as a??es, bem como a realiza??o de capacita??es para sensibilizar o apoio por parte das equipes. Na etapa de implementa??o, as enfermeiras demonstraram grande interesse pelo check-list constru?do atrav?s de roda de conversa, entretanto, em rela??o ?s capacita??es, a pesquisadora n?o conseguiu implement?-las de maneira satisfat?ria, devido a indisponibilidade das equipes e de algumas enfermeiras. Constatou-se que estas avaliaram positivamente sua participa??o na pesquisa, a qual favoreceu a troca de experi?ncias e a mudan?a nos pontos negativos, al?m de ter instigado a parceria entre os cuidadores e os profissionais. Como sugest?es para o futuro, as enfermeiras elencaram o incentivo ? realiza??o de mais pesquisas nesse campo e o constante apoio da UFRN, e reivindicaram uma especializa??o em sa?de da crian?a. Como principais dificuldades, destacam-se o alto ?ndice de enfermeiras faltosas nos grupos focais; a pouca motiva??o de algumas participantes, bem como da diretoria de uma ESF e a falta de participa??o da equipe de sa?de na a??o de capacita??o. Assim, constata-se que diante das expans?es desordenadas desta abordagem grupal, pesquisas nesta ?rea devem ser constantemente incentivadas para o seu maior aperfei?oamento. / The collective monitoring of the child?s growth and development (GD) stands out as redirection of the biomedical health care model and seeks to encourage the use of soft technologies and improve the quality of life of users. This way of care is an action for construction and expansion to other units, which makes it vulnerable to a random practice, since there is no guarantee of systematization to ensure its legitimization. In addition, the group work itself, within the primary network, in general, runs the risk of of focusing its actions on the disease by reflecting the biomedical model still prevailing. The collective monitoring may be vulnerable to these problems, which requires the need to know its operationalization. This study had the objective of analyzing the practice and expansion of the collective monitoring of the GD of children in Family Health Strategies (FHS) from the municipality of Natal/RN. This is a qualitative research that had the research-action as its method. It encompassed eleven nurses of four FHS from the municipality of Natal in the period between April and October 2014. Data were collected through focus group and participant observation, and they were analyzed in accordance with the direction of the thematic analysis of Paulo Freire. The study was approved by the Research Ethics Committee from the UFRN, Opinion n? 562.315, and met the Resolution n? 466/2012 of the National Health Council. At the stage of situational diagnosis, which investigated the operationalization of the collective monitoring of the GD of children by nurses, we realized that they seek to accomplish it with basis on prior planning and organization, in such a way as to make it as qualitative as possible. They understand the importance and benefits of this activity, especially concerning the empowerment of users. Nevertheless, the lack of systematization of this monitoring has been identified because of the different modes of its operationalization on the part of professionals. Furthermore, the lack of support from the health team was realized, which leaves them unsatisfied. Due to the need to change this reality, we have decided to jointly construct an instrument able to systematize the actions, as well as to conduct training courses to sensitize the support on the part of teams. At the stage of the implementation, the nurses showed great interest in the check-list constructed through conversation circles; however, regarding training courses, the researcher has failed to implement them in a satisfactory way because of the unavailability of teams and of some nurses. We have found that they rated their participation in the survey in a positive manner, which fostered the exchange of experiences and the change of negative points, besides having instigated the partnership between caregivers and professionals. As suggestions for future, the nurses have listed the encouragement of further researches in this field and the constant support on the part of the UFRN, and called for a specialization in child?s health. As main difficulties, one should highlight the high rate of faults among nurses belonging to the focus groups; the little motivation of some participants, as well as of the board of directors of a FHS and the lack of participation of the health team in training actions. Accordingly, one can find that, given the disorganized expansion of this group approach, the researches in this area should be constantly encouraged to achieve a greater improvement.

Convergence of Copyright and Trademark Protection Key Words: Copyright, Trademark, Protection, Convergence Abstract: The thesis analyzes the concept of copyright and trademark protection in Czech law and the consequences of their simultaneous operation. The aim is to determine whether the existing legislation responds the current trends and demands in our society, where business and arts are becoming interconnected and where the boundaries between those disciplines are blurred. Both protections are initially assigned to theoretical context of legal branches of intellectual property and intangible property. The author also deals with current conception of ownership in Civil Code. Following chapters are based on the principles of civil (continental) law concepts of copyright law and industrial property law established in this part. Subsequently the regulation of copyright protection and trademark protection is discussed in two separate chapters. Those chapters are divided into identical sub-chapters to highlight similarities and differences of both legal institutes. The focus is on subjects of both protections, their beneficiaries, formation, content, duration, means, limitations, international context and the issues of licensing. The collection of empirical data was carried through, over all, in the Legislative Assembly of Rio Grande do Sul's Memorial and in the Map Collection of the Direction of Public Works/RS; it was carried a qualitative analysis of the reports from the Direction of Public Works/RS, Direction of Public Instruction/RS and of the pictorial files. It proposes to discuss the following question: which relations were established between the first primary school buildings, constructed by the Rio Grande do Sul Government in the first decades of the 20th century, and the historical, educational state patrimony? It carries through a cartography of the first projects, plants and photographs of the school buildings constructed by the state government, analyzing aspects of its trajectories, identifying the changes and the continuities, from a material and symbolic point of view. The temporal scope was established in accordance with the years of construction/completion of the first and the last primary school identified in this research. Therefore, the year of 1907 marks the beginning of the construction of Aula Isolada Campos da Reden??o, located in the city of Porto Alegre. The date of 1928 corresponds to the completion of the elementary schools in the State, one located in the city of Passo Fundo and the other in Cruz Alta, which were constructed on the basis of the same project. During this interval (1907-1928), the study identified 18 school buildings, among reforms, adaptations and constructions carried through by the state government, which enabled a division in two great groups: adapted buildings and constructions. Of the 9 buildings that were constructed, the majority is located in the capital and/or urban zones of different cities. When analyzing the trajectory of these establishments, it was observed that great part of them follow their activities as education institutions, facing serious structural problems and a significant crisis related to its history, memory and valuation as historical and educational patrimonies. It was identified that none of these constructions is protected by the Institute of the Historic and Artistic Patrimony of the State, and it was not found any projects linked to the Secretary of Education or the Historic Patrimony sector of the Direction of Public Works with the purpose of preservation of the buildings and school collections. It was evidenced that the first buildings destined to public primary schools survive a structural, historical and memorialist crisis, as well as the indifference of the responsible agencies for its maintenance and preservation. Thus, this thesis proposes interlocution between the school architecture and the historical educational patrimony, involving the school community, the distinct institutions and public spheres and the university researchers. / A presente pesquisa de tese insere-se no campo da hist?ria da educa??o, na perspectiva te?rica da hist?ria cultural e da cultura escolar, onde procura analisar os primeiros edif?cios destinados para a escola prim?ria p?blica no Estado do Rio Grande do Sul, durante a Primeira Rep?blica Brasileira (1889-1930), relacionando-os com o patrim?nio hist?rico-educativo rio-grandense. The objective of this work was to investigate medical formation and HE practices performed by doctors in Primary Care System (PCS) context. The study was descriptive and interpretative, with a quanti-qualitative approach, based on the interviews of 6 doctors who work in the Brazilian Family-Centered Health Strategy and their 2 coordinators, focusing in their perception about formation in HE and educative practices performed. The interviews were analyzed through Bardin?s Content Analyses. We identified three categories: Formation in HE, with the subcategories Graduation, Post-Graduation and Permanent or Continuous Education; the category Practice in HE, with the subcategories Level of Practice, Multidisciplinary and Issue Selection; and the category Factors that Affect HE Effectiveness, with the subcategories Health Professional, Management and PCS Users. Regarding Formation, curriculum changes showed differences among the participants? speech, as well did Family and Community residency and other specific specializations for PCS practitioners. Regarding Practice, all participants reported HE practices, in both individual and collective levels. HE was a multidisciplinary practice present in all heath units (HU) researched. HE effectiveness was influenced by professionals? formation and profile, public department management, professional valorization, intersectionality, co-responsibility and culture. The results of groups? observation were triangulated with the interviews and professionals? data. Regarding the observed practices, all professionals used the lecture as method, with vertical transmission of information from doctor to patient, aiming individual changes in health behavior. Professionals with specific formation for PCS practice showed no innovative experiences, and neither the youngest did. Long-last acting in the same HU also showed no difference among HE practices. Moreover, the way of selection of the practice-guiding issues were not based in a local community diagnosis. We concluded that HE was present in professionals? speech and practices in different ways. While formation reflected important transformations that took place in graduation and postgraduation, practice demonstrated the constancy of inappropriate and updated performances. Multidisciplinary was a positive aspect found. Professionals? speech demonstrated the complexity of HE effectiveness if it is taken in its entirety. This study pointed out the need of strategies to translate research into practice in PCS, implementing scientific recommendations to heath care, considering that HE effectiveness is related to multiple interventions in multiples levels. / A Educa??o em Sa?de (ES) ? um aspecto de promo??o da sa?de e preven??o de doen?as j? bem estudado e a forma??o e atua??o do m?dico s?o elementos de fundamental import?ncia para sua consolida??o. O objetivo do presente trabalho foi a investiga??o da forma??o e das pr?ticas de ES realizadas por m?dicos no contexto da Aten??o Prim?ria em Sa?de. O estudo qualitativo, de car?ter explorat?rio-descritivo e interpretativo, complementado com elementos quantitativos, baseou-se na entrevista de 6 m?dicos que atuam na Estrat?gia de Sa?de da Fam?lia e seus 2 respectivos coordenadores, com enfoque na percep??o a respeito da forma??o em ES e pr?ticas educativas realizadas. Investigou-se tamb?m a percep??o dos entrevistados sobre a efetividade da ES. Al?m disso, realizou-se a observa??o dos profissionais durante a??es educativas do tipo grupo e sala de espera. As entrevistas foram analisadas atrav?s da An?lise de Conte?do de Bardin. Identificaram-se tr?s categorias: Forma??o em ES, com as subcategorias Gradua??o, P?s-Gradua??o e Educa??o Permanente ou Continuada; categoria Atua??o em ES, com as subcategorias N?vel de Atua??o, Multidisciplinaridade e Sele??o Tem?tica; e a categoria Fatores que Influenciam a Efetividade da ES, com as subcategorias Profissional de Sa?de, Gest?o e Usu?rio. Na primeira, relatos sobre as mudan?as curriculares demonstraram diferen?a nos discursos dos entrevistados, bem como a resid?ncia em MFC e as especializa??es espec?ficas para atua??o em APS. Na segunda, quanto ? Atua??o, todos referiram realizar pr?ticas de ES, tanto no n?vel individual quanto coletivo; e em todas as unidades de sa?de (US) pesquisadas, a ES ocorre como uma pr?tica de car?ter multidisciplinar. Na terceira, a efetividade da ES mostrou-se influenciada pela forma??o e perfil do profissional, a administra??o do setor p?blico, a valoriza??o profissional, a intersetorialidade, a coresponsabiliza??o e a cultura. Os resultados da observa??o dos grupos foram triangulados com os das entrevistas e com os dados dos profissionais: nas pr?ticas educativas observadas, todos os profissionais utilizaram a metodologia da palestra, com a transmiss?o vertical das informa??es do m?dico para os usu?rios, objetivando a mudan?a individual do comportamento em sa?de. Os profissionais com forma??o espec?fica para atua??o em APS n?o mostraram experi?ncias inovadoras, nem tampouco os com forma??o mais recente. O tempo de atua??o na mesma US tamb?m n?o evidenciou diferen?a em rela??o ? pr?tica de ES. Al?m disso, o modo de sele??o dos temas para as a??es em ES n?o se seguiu ? execu??o de um diagn?stico em sa?de da comunidade local. Concluiu-se que a ES esteve presente no discurso e na pr?tica dos profissionais de formas diferentes: enquanto a forma??o refletiu transforma??es importantes ocorridas na gradua??o e na p?s-gradua??o, a atua??o demonstrou a perman?ncia de pr?ticas homogeneamente inadequadas e ultrapassadas. A multidisciplinaridade presente nas pr?ticas educativas foi um aspecto positivo encontrado. Se considerado no seu conjunto, o discurso dos profissionais demonstrou a complexidade que envolve a efetividade da ES. Apontamentos do estudo direcionam para a necessidade da formula??o de estrat?gias para se reduzir a dist?ncia entre pesquisa e pr?tica na APS, com efetiva??o das recomenda??es cient?ficas para o cuidado em sa?de, uma vez que a efetividade da ES est? atrelada ? realiza??o de interven??es m?ltiplas em diferentes n?veis de a??o.

The goal is to understand the operational strategies in the exercise work together with the family health teams in Porto Alegre through the perception of NASF professionals, the Family Health Strategy (ESF) and a health manager. From the invitation in the public policy was proposed a discussion of these aspects and factors reported in the interviews by professional participants in this study. This research was divided into two studies that make up this thesis. The first theorist that assists in understanding the evolution of public policies prior to the NASF, presenting the context in which the NASF emerged and also working with key concepts for further discussion on this device. The second this is an empirical study that addresses the perception of professionals involved in the work of the NASF regarding the implementation of the policy in the city of Porto Alegre, and the identification of positive factors and obstacles for the realization of this work. This study was made through a literature review and interviews with five professionals involved in the work of the NASF. The studies were exploratory and descriptive qualitative study aimed to know some of NASF the reality in the city. / A presente disserta??o de mestrado tem como tema a implementa??o da pol?tica do N?cleo de Apoio ? sa?de da Fam?lia (NASF) e a busca pela identifica??o de potencialidades e dificuldades no exerc?cio desse trabalho. O objetivo ? conhecer as estrat?gias de atua??o no exerc?cio do trabalho junto ?s equipes de sa?de da fam?lia em Porto Alegre atrav?s da percep??o dos profissionais do NASF, da Estrat?gia de Sa?de da Fam?lia (ESF) e de gestor de sa?de. A partir do preconizado nas pol?ticas p?blicas foi proposta uma discuss?o desses aspectos e os fatores relatados nas entrevistas pelos profissionais participantes desse estudo. Essa pesquisa se desdobrou em dois estudos que comp?em essa disserta??o. O primeiro te?rico que auxilia no entendimento da evolu??o das pol?ticas p?blicas que antecedem o NASF, apresentando o contexto no qual o NASF surgiu e tamb?m trabalhando com conceitos fundamentais para o aprofundamento da discuss?o sobre esse dispositivo. O segundo trata-se de um estudo emp?rico que aborda a percep??o dos profissionais envolvidos com o trabalho do NASF em rela??o ? implementa??o da pol?tica no munic?pio de Porto Alegre, bem como a identifica??o de fatores positivos e entraves para a efetiva??o desse trabalho.
