Viv?ncia de mulheres em situa??o de c?rcere penitenci?rio durante o per?odo gestacional / The experience of women in prison during pregnancy

The participation of women in crime and responsibilities within her family makes this phenomenon a growing social problem. Women prisoners are mostly young, in reproductive age, making pregnancy a recurrent situation while they are serving a sentence. The studies about female criminality are poor and not helpful about its real dimension, especially when targeted to women who experienced pregnancy in this environment. Given these considerations, this research had as its object of study the experience of women in prison during pregnancy: analyze the experience of women in prison during the gestational period. This is a descriptive and qualitative study. The data were sourced through a semi-structured interview with nine incarcerated women, between August and September 2011, who met the inclusion criteria previously established, and organized according to the precepts of content analysis according to Bardin. Through this coding and classification process became a central thematic: the experience of women in prison during pregnancy, resulting in three categories: category 1 interpersonal relationships; category 2 - feelings that permeate the pregnant woman in prison; and category 3 absence of health care to incarcerated pregnant. The data were analyzed according to the available literature and the study revealed that interpersonal relationships, maintained by these women in prison, were marked by distance from family members, primarily due to socioeconomic factors, being a challenge for addressing of pregnancy in prison and reports of abuse of power by employees working in the institution. The women, who experience pregnancy in prison are more likely to experience feelings of worry, doubts, sadness and fear for baby s health due to lack of antenatal care and about the prison environment structure to meet your needs. The health care aimed at these women is poor and often does not occur, endangering the baby s life and his own mother, this is being a troubling reality in public health system. Finally, it is expected that this study can give visibility to an issue rarely discussed in the literature and contribute to the construction of specific public policies for this reality, in order to minimize the effects of incarceration during pregnancy / O aumento gradativo da viol?ncia na sociedade brasileira vem resultando no crescimento da popula??o carcer?ria ao longo dos ?ltimos anos, bem como a propor??o de mulheres em rela??o aos homens. A participa??o da mulher no crime e o papel que esta assume no seio familiar fazem com que esse fen?meno represente um crescente problema social. Na maioria, as apenadas s?o jovens, em idade reprodutiva, tornando a gravidez uma situa??o recorrente no per?odo em que est?o cumprindo pena. Os estudos que tratam a criminalidade feminina s?o escassos e pouco esclarecedores quanto ? sua real dimens?o, especialmente se direcionados ?s mulheres que vivenciaram a gesta??o nesse ambiente. Diante dessas considera??es, esta pesquisa teve como objetivo: analisar a viv?ncia de mulheres encarceradas durante o per?odo gestacional. Trata-se de uma pesquisa descritiva de natureza qualitativa. Os dados foram obtidos por meio de entrevista semiestruturada junto a nove mulheres presas, durante os meses de agosto e setembro de 2011, que atenderam aos crit?rios de inclus?o estabelecidos previamente, e organizados conforme os preceitos de an?lise de tem?tica segundo Bardin. Do processo de codifica??o e categoriza??o emergiu uma tem?tica central: viv?ncia de mulheres em situa??o de c?rcere penitenci?rio durante o per?odo gestacional, originando tr?s categorias: categoria 1- relacionamento interpessoal; categoria 2- sentimentos que permeiam a mulher gr?vida presa; e categoria 3- aus?ncia de assist?ncia ? sa?de da gestante encarcerada. Os dados foram analisados de acordo com a literatura dispon?vel e o estudo revelou que as rela??es interpessoais que essas mulheres mantinham dentro do pres?dio foram marcadas pelo distanciamento dos familiares, principalmente devido ao fator socioecon?mico, sendo uma dificuldade para o enfrentamento da gesta??o no pres?dio, e o registro de abuso de poder por parte de profissionais que trabalham na institui??o. As mulheres, ao vivenciarem a gravidez dentro do pres?dio, est?o mais propensas a experimentarem sentimentos de preocupa??o, d?vidas, tristeza e medo quanto ? sa?de do beb?, pela falta de assist?ncia pr?-natal, e quanto ao ambiente prisional, devido ? estrutura para atender suas necessidades. A assist?ncia ? sa?de destinada a essas mulheres ? deficit?ria e muitas vezes n?o ocorre, colocando em risco a vida do beb? e da pr?pria m?e, sendo esta uma realidade preocupante na sa?de p?blica. Este trabalho avaliou a IC e fatores associados ? distor??o e ? insatisfa??o da IC em mulheres encarceradas em regime fechado de Natal, Rio Grande do Norte, Brasil. Trata-se de um estudo observacional transversal, desenvolvido com detentas entre 18 e 57 anos de idade. Foram coletadas informa??es pessoais sociodemogr?ficas (idade, escolaridade, renda familiar, estado civil, tempo de reclus?o, frequ?ncia de visitas e n?mero de filhos) por meio de entrevista, e mensurados o peso e a estatura para obten??o do ?ndice de Massa Corporal (IMC). A avalia??o da IC se deu por meio da Escala de Figuras de Silhuetas para adultos brasileiros (EFS). Utilizou-se a Raz?o de Preval?ncia e seu respectivo Intervalo de Confian?a de 95% para avaliar a for?a da associa??o entre as vari?veis dependentes (distor??o e insatisfa??o da IC) e as vari?veis independentes. A concord?ncia entre o IMC obtido por antropometria (IMC-A) e o IMC estimado pela EFS (IMC-E) foi verificada pelo m?todo Bland-Altman. As participantes tinham idade m?dia de 31,7 anos (8,48), e a m?dia de IMC-A foi de 27,67Kg/m?. Cerca de 65% encontrava-se acima do peso e 27,8% apresentava obesidade. Houve distor??o da IC em 83,3% das participantes. Destas, 82,7% superestimaram o tamanho do seu corpo, imputando em m?dia, 5,59 (2,73) Kg/m2 a mais ao seu corpo real. A maioria das mulheres (91,6%) se demonstrou insatisfeita com o corpo. Embora boa parte (58,9%) tenha desejado ter um IMC, em m?dia, 9,01 Kg/m2 (+ 5,25) menor, cerca de um ter?o desejou aumentar o tamanho do corpo, em m?dia, 6,43 Kg/m? (+ 4,34). As caracter?sticas sociodemogr?ficas, o estado nutricional (RP = 0,99 IC95% 0,89-1,11) e o tempo de reclus?o (RP = 1,06 IC95% 0,94-1,19) n?o estiveram associados ? insatisfa??o com a IC. N?o foram verificadas associa??es entre a distor??o da IC e o tempo de encarceramento (RP=1,17 IC95% 0,96-1,42) ou estado nutricional (RP=1,10 IC95% 0,89-1,36). Conclui-se que a maioria das mulheres em reclus?o ? insatisfeita com seus corpos e distorce sua IC, revelando a necessidade de que esses aspectos sejam contemplados nas a??es de promo??o da sa?de no sistema prisional. / The construction of subjectivity in relation to the body occurs throughout live, and in incarcerated women, life conditions imposed by the imprisonment can strengthen or influence body image (BI) perception. This study analyzed the BI distortion and dissatisfaction and its associated factors in incarcerated women in closed regime of Natal, Rio Grande do Norte, Brazil. A observational cross-sectional study was conducted with the 18 to 57 year-old imprisoned women. An interview was conducted regarding personal sociodemographic information (age, education, family income, marital status, time of confinement, visitation frequency and number of children), and measured their weight and height in order to calculate Body Mass Index. BI was evaluated by using a Figure Rating Scale for Brazilian adults (FRS). Prevalence Ratio and its respective Confidence Interval of 95% were taken into consideration to investigate the strength of the association between the dependent (distortion and dissatisfaction of BI) and independent variables. The concordance between BMI-A and BMI-E was verified by the Bland-Altman method. Participants presented, in average, 31.7 (? 8.48) years old, 27.67 Kg/m? of BMI-A. Approximately 65% had excessive weight, of which 27.8% were obese. BI distortion was present in 83.3% of the participants. Amongst these women, 82.7% overestimated their body size, adding in average 5.59 Kg/m? (? 2.73) to their real body. Most of the participants (91.6%) expressed dissatisfaction with their own body. Although the majority expressed the desire to have a BMI 9.01 Kg/m? (? 5.25) lower, one third of them aspired to enlarge their body in 6.43 Kg/m? (+ 4.34). Sociodemographic characteristics, nutritional status (PR = 0.99 95%CI 0.89-1.11) and time of confinement (PR = 1.06 95% CI 0.94-1.19) were independently associated with their BI dissatisfaction. No associations were found between BI distortion and incarceration time (PR = 1.17 95% CI 0.96-1.42), or nutritional status (PR = 1.10 and 95% CI 0.89-1.36). We conclude that the majority of the incarcerated women are dissatisfied with their BI and present distorted BI, revealing the need for such aspects to be included in health promotion activities in the prison system.

Amor e maternidade no c?rcere : mulheres que t?m filhos com homens encarcerados

We carried out semi-structured interviews at the prison called Pres?dio Central de Porto Alegre (PCPA) with women who have children with incarcerated partners in that prison. To analyze the data we used Critical Discourse Analysis (CDA). This kind of discursive investigation focuses especially on social problems, explaining them by means of structure and social interaction. The dissertation is composed of two articles, both arising from empirical studies. In the first study, based on interviews with three women whose partners are serving time at PCPA, we sought to understand their motivations for maintaining this relationship, as well as to know the roles played and the violence they notice in prison. The analyzed data confirm the social expectation that women care for their partners. The sacrifice arising from the non-abandonment is followed by the desire to be rewarded by their partners after the latter's serving time. The submission of these women, who perceive themselves obliged to maintain their relationships, to visit, to provide their partners materially and emotionally and to endure the violence imposed by the prison is resignified from the leadership they assume. This role is expressed through their power of decision to go to the prison, take their children to the visits and provide inputs to their partners. The second article consists of interviews with two women whose lives are marked by great familiarity with prison and who became pregnant at PCPA when visiting their partners. In this study we sought to understand what meanings they attribute to conceiving their children in prison. Therefore, we investigated the participants' conceptions of maternity, paternity and family. In the analyzed data we see the appropriation of hegemonic models of maternity and paternity based on the ideal of a nuclear family. On the other hand, the non-normative character of their life stories marked by familiarity with the prison outlines other possible discourses that question this hegemonic model. Thus, we can see in the discourse of the participants several and contradictory references in their attempts to build places of mothers and fathers. Such a contradiction resulting from simultaneous movements of appropriation and resistance to normative discourses draws our attention to the dialectical process of subjective construction. In other words, these women signify parental roles from family/community and social/cultural references. / A presente disserta??o tem como objetivo geral compreender, do ponto de vista das mulheres, os significados de ter um relacionamento afetivo e de conceber um filho com um homem encarcerado. Foram realizadas entrevistas semiestruturadas no Pres?dio Central de Porto Alegre (PCPA) com mulheres que t?m filhos com parceiros encarcerados nesta pris?o. Para a an?lise dos dados coletados foi usada a abordagem da An?lise Cr?tica do Discurso (ACD). Este tipo de investiga??o discursiva concentra-se, em especial, nos problemas sociais, explicando-os por meio da estrutura e intera??o social. A disserta??o ? composta por dois artigos, ambos resultantes de estudos emp?ricos. No primeiro estudo, a partir de entrevistas com tr?s mulheres cujos companheiros cumprem pena no PCPA, buscamos compreender as suas motiva??es para manter este relacionamento, bem como conhecer os pap?is desempenhados e as viol?ncias percebidas por elas na pris?o. Os dados analisados atestam a expectativa social de que as mulheres exer?am o cuidado de seus parceiros. O sacrif?cio advindo do n?o-abandono ? acompanhado pelo desejo de serem recompensadas pelos companheiros ap?s o per?odo de cumprimento de suas penas. A submiss?o destas mulheres, que se percebem obrigadas a manter seus relacionamentos, a visitar, a prover seus companheiros material e emocionalmente e a suportar as viol?ncias impostas pela pris?o, ? ressignificada a partir do protagonismo expresso por elas. Tal protagonismo se expressa atrav?s do poder de decis?o das entrevistadas de ir ? pris?o, de levar seus filhos ?s visitas e de fornecer insumos aos seus companheiros. O segundo artigo ? composto por entrevistas com duas mulheres que possuem trajet?rias marcadas pela grande familiaridade com a pris?o e que engravidaram no PCPA em dias de visita a seus parceiros. Neste estudo procuramos compreender quais s?o os significados atribu?dos por elas ? concep??o de um filho dentro do c?rcere. Neste sentido, investigamos as concep??es de maternidade, de paternidade e de fam?lia das participantes. Na an?lise dos dados vemos a apropria??o de modelos hegem?nicos de maternidade e paternidade, fundamentados no ideal da fam?lia nuclear. Por outro lado, a n?o normatividade de suas hist?rias de vida marcadas pela familiaridade com a pris?o delineia outras possibilidades de discurso que colocam em xeque este modelo hegem?nico. Desse modo, convivem no discurso das participantes refer?ncias diversas e contradit?rias em suas tentativas de construir os lugares de pais e m?es. Tal contradi??o, resultante de simult?neos movimentos de apropria??o e resist?ncia a discursos normativos, nos chama a aten??o para o processo dial?tico de constru??o subjetiva. Em outras palavras, ? a partir de referenciais familiares/comunit?rios e sociais/culturais que estas mulheres significam as fun??es paternas e maternas.

Do passado ao presente do PCPA : as viola??es de direitos humanos na execu??o penal e o papel da OEA

Thus, at first we demonstrate how it originated the PCPA, which were their purposes, the intended recipient, and stood structured, even before the lack of jobs versus prison population, until we get to your current situation. Subsequently, we discus about the problems generated in the criminal enforcement on the repeated violation of Human Rights. Therefore, it proved necessary to address the state of the art Human Rights in Constitutional sphere. Traced, then the conceptualization between Human Rights and Fundamental Rights, entering itself in some constitutional principles applicable to criminal enforcement, which proved to be of paramount importance, because while the object contrast, allowed to verify in a timely species of human rights violations originated, such as overcrowding, loss of internal control and dominion of PCPA factions; precariousness of health care, material assistance withheld; absence of conditions of work , study, and other instruments of rehabilitation; supply conditions; magazine and conjugal visits, in addition to the damage to so-called benefits enforceable. We conclude, at this point, the confirmation of human rights violations, as well as the ineffectiveness of the law as a response. Thus, we then develop some considerations about the representation sent to the CIHR: If PCPA and structuring of the Inter-American Human Rights System, in order to raise the possible routes to be followed by representation through the analysis of the ACHR, in its role assertion of rights as well as on its incorporation into domestic constitutionalism. Still, we see the process, the roles and responsibilities of the Commission and the Court, the alleged representation, even bringing into play specific jurisprudence on the matter. Finally, we present the advances possible even if not accepted the representation in terms of visibility of a reality so important, considering, at this point, the need for a flexible concept of sovereignty, as well as posture and will state when it comes to compliance with decisions issued by International Systems of Human Rights Protection. Finally, we conclude that given the existence of a substantial body of legislation on the matter, based on the national or international law, as well as confirmed the human rights violations based on criminal enforcement, and even considering the lack of coercion by higher part of the Inter-American System of Human Rights Protection, regarding the compliance with its decisions, urges a shift in the construction of the mindset of the actors and operators of the penal system, given that it is only through them that the system operates, and which may pursue a criminal enforcement fairer and more human. / A presente disserta??o, vinculada ? ?rea de concentra??o Sistema Penal e Viol?ncia, linha de pesquisa Sistemas Jur?dico-Penais Contempor?neos, teve por intuito abordar a estrutura??o do PCPA, do seu passado ao seu presente, a fim de atentar para as viola??es de Direitos Humanos que da? adv?m ? execu??o penal, bem como, buscando apontar qual ? o papel da OEA, nesse contexto, haja vista Representa??o, no que diz especificamente com o PCPA, endere?ada ao Sistema Interamericano de Prote??o de Direitos Humanos. Dessa forma, num primeiro momento demonstramos como se originou o PCPA, quais eram os seus fins, a quem se destinava, como se encontrava estruturado, inclusive diante a aus?ncia de vagas versus popula??o carcer?ria, at? chegarmos a sua situa??o atual. Posteriormente, discorremos acerca dos problemas gerados na execu??o penal diante a reiterada viola??o de Direitos Humanos. Para tanto, revelou-se necess?rio abordar o estado da arte dos Direitos Humanos na esfera Constitucional. Tra?amos, ent?o, a conceitua??o entre Direitos Humanos e Direitos Fundamentais, ingressando propriamente em alguns princ?pios constitucionais aplic?veis ? execu??o penal, os quais se revelaram de suma import?ncia, porque enquanto objeto de contraste, permitiram verificar de forma pontual as esp?cies de viola??es de Direitos Humanos originadas, tais como: superpopula??o carcer?ria; perda do controle interno e do dom?nio do PCPA pelas fac??es; precariedade da assist?ncia ? sa?de; assist?ncia material sonegada; aus?ncia de condi??es de trabalho, estudo e outros instrumentos de reabilita??o; as condi??es de alimenta??o; a revista e visitas ?ntimas; para al?m dos preju?zos aos chamados benef?cios execut?rios. Conclu?mos, nesse ponto, pela confirma??o das viola??es de Direitos Humanos, bem como da inefic?cia do direito interno como resposta. Travestis e pris?es : a experi?ncia social e a materialidade do sexo e do g?nero sob o lusco-fusco do c?rcere

This analysis used the fundamentals of the dialectical materialism and feminist grounds (especially the intersectional one), queer theory and critical criminology, toward a marxist queer perspective. Studying the social experiences of the travesti population in prison implies to recognize the presence of denied rights and non-responded needs, since it is known that the gender identities, which are different from the ones recognized as consistent with a sex/gender binary system, are historically repressed and scrutinized by the ideological apparatuses of the Estate, especially the ones attached to the criminal justice system. It was used, ass a qualitative nature methodology, the bibliographic and document research used to accomplish the theoretical study of the theme, the non-structured interviews through oral history technique applied to subjects and participant observation using a field diary. The interviews were performed with a focal group of twelve prisoner travestis and two male partners of theirs; individual interviews with one prisoner homosexual man, three travestis who have experienced prison and four prison employees, totalizing 22 investigation subjects. The oral history appears as technique in the non-structured interviews and focal group through a script of guided topics. As for the participant observation, the script developed embodied the field diary. The interpretation of the data was attained by discursive textual analysis. It was possible to consider that the arrest of the travestis give the prison distinct patterns of control over bodies, not experienced so far, which the prison experience become an instrument for deepening of the violence suffered in daily life. It occurs due to the criminal justice selective system consider as social markers race/ethnicity and social class, or in other words, determinations that put them previously socially vulnerable. The creation of a specific room, thus, is a way of confronting collectively organized by the travestis according to their interests for more institutional protection. On the other hand, this same kind of protection also oppresses the travestis in the most perverse ways, such as the non-access to education and work inside the prison system; their relationships with other prisoners and the institutional transphobia; the determined behavior patterns; the poor access to health; the family abandonment; the criminal control. / O presente texto versa sobre as experi?ncias sociais de travestis com o c?rcere, tendo como cen?rio o Pres?dio Central de Porto Alegre (PCPA). A an?lise presente se utilizou dos fundamentos do materialista-hist?rico e dial?tico e dos fundamentos feministas (especialmente do feminismo intersecional), da teoria queer e da criminologia cr?tica, em dire??o a uma perspectiva queer marxista. Estudar as experi?ncias sociais da popula??o de travestis na pris?o implica reconhecer a presen?a de direitos negados e de necessidades n?o respondidas, pois ? sabido que as identidades de g?nero diferentes das reconhecidas como coerentes de acordo com um sistema bin?rio de sexo/g?nero s?o historicamente reprimidas e perscrutadas pelos aparelhos ideol?gicos do Estado, especialmente os ligados ao sistema penal. Como metodologia de natureza qualitativa, se utilizou de pesquisa bibliogr?fica e documental para realiza??o do estudo te?rico sobre o tema, de entrevistas n?o estruturadas atrav?s da t?cnica de hist?ria oral com os sujeitos e observa??o participante com recurso ao di?rio de campo. Foram entrevistadas em grupo focal doze travestis presas e dois homens companheiros de travestis; individualmente foram entrevistados um homem homossexual preso, tr?s travestis que j? passaram pela experi?ncia social da pris?o e quatro t?cnicos, totalizando 22 sujeitos da pesquisa. A hist?ria oral aparece como t?cnica nas entrevistas individuais n?o estruturadas e grupo focal atrav?s de um roteiro de t?picos guia. J? para a observa??o participante, foi elaborado um roteiro que consubstanciou em di?rio de campo. A interpreta??o dos dados foi realizada por meio da an?lise textual discursiva. Foi poss?vel considerar que a captura das travestis pela pris?o lhes confere padr?es distintos de controle sobre os corpos, at? ent?o n?o experimentados, nos quais a experi?ncia prisional se torna instrumento de aprofundamento da viol?ncia sofrida no cotidiano. Isso acontece porque suas pr?prias sele??es ao sistema penal consideram marcadores sociais de ra?a/etnia e classe social, quer dizer, determina??es que j? as colocam anteriormente vulner?veis socialmente. A cria??o de uma ala espec?fica, assim, ? um modo de enfrentamento organizado coletivamente por elas de acordo com os seus interesses de maior prote??o institucional. Por outro lado, esse mesmo modo de funcionamento que protege tamb?m oprime de formas mais perversas as travestis atrav?s do n?o acesso ? educa??o e ao trabalho dentro do c?rcere; na rela??o com os outros presos e na transfobia institucional; nos modelos de comportamento ditados; no acesso prec?rio ? sa?de; no abandono familiar; no aumento de controle penal.

We seek to understand the adhesion between the national guidelines postulated for the Program, established in PPC and mediations with the process conceived in the run of the course. Guiding by the socio-critical approach and the dialogical paradigm, the theoretical-epistemological mark is especially buoyed by the theoretical contributions of Ciavatta (2005) , Rock (2011) , Haddad and Di Pierro (2000), Freire (2005), Marx (1982), Ramos (2005), Frigotto; Ciavatta; Ramos (2005), Moura (2012), and also on education in prisons by Onofre (2007, 2011), Bueno (2007), Juli?o (2011) and Foucault (2001). We assume that an action that enables professional qualification as FIC courses articulated to the EJA in the context of education in prisons have conceptual, methodological, political and pedagogical implications for it focuses challenges, weaknesses and opportunities on the same area of education., We have developed four techniques of data collection based on procedures and tools of qualitative research, such as document analysis, a student survey, the conduction of focus groups with teachers and administrators of the course and on-site observation. Mediated by the investigated context, results showed that the consolidation of PROEJA FIC / AT ELEMENTARY SCHOOL LEVEL goes beyond the intentions officially declared. It is inferred that after seven years of its creation, even though it keeps some potential, this program is not being satisfactorily developed and it shows weaknesses national and locally, it is set at low capillarity, it has a limited scope, and dissolved essential public commitments to the course development. The effectiveness of PROEJA FIC / AT ELEMENTARY SCHOOL LEVEL as part of an emancipatory inclusion social policy, according to official statement, entails approximating the legal logic with social logic, so as not only to propagate discourses and enforce worship to specific and successful experiences that reach only a minority, but to provide actual and necessary conditions to promote the breadth and social quality of the offered deals in this program format / A presente pesquisa objetiva analisar o Curso FIC de Auxiliar T?cnico em Gest?o e Qualidade em Servi?os, na forma integrada ao ensino fundamental/EJA, desenvolvido pelo IFRN-MO entre 2011 e 2013 no ?mbito do PROEJA FIC/FUNDAMENTAL. Busca-se perceber a ader?ncia entre as diretrizes nacionais postuladas para o Programa, o institu?do no PPC e as media??es com o processo gestado no funcionamento do curso. EJA no contexto da educa??o em pris?es traz implica??es de natureza conceitual, metodol?gica, pol?tica e pedag?gica, por concentrar, no mesmo campo formativo, desafios, fragilidades e possibilidades. Apoiando-se nos procedimentos e instrumentos da pesquisa qualitativa, foram desenvolvidas quatro t?cnicas de coletas de dados: a an?lise documental, a aplica??o de question?rio junto aos estudantes, a realiza??o de grupo focal junto aos docentes e gestores do curso e a observa??o in loco. Mediatizados pelas interfaces do contexto investigado, os resultados mostraram que a consolida??o do PROEJA FIC FUNDAMENTAL vai al?m das inten??es declaradas oficialmente. Infere-se que ap?s sete anos de cria??o, ainda que guarde potencialidades, esse Programa n?o est? sendo desenvolvido a contento, em raz?o de apresentar fragilidades em n?vel nacional e local, configuradas na baixa capilaridade, pouca abrang?ncia e desonera??o dos compromissos p?blicos essenciais ao desenvolvimento dos cursos.
