The aim of this essay is to discuss the problems concerning the right of priority for re-employment in connection to employing temporary agency workers. This will be done with the help of relevant laws, preparatory work and literature that fall within the scope of the legal dogmatic method. Using temporary personnel is becoming considerably more common throughout the Swedish workplace. In recent years there has been a rapid growth of work agencies and a tendency to employ temporary personnel. At the same time employees are made redundant, suffering the consequences that arise from the workplace failing to abide by the rules of re-employment. In order to claim that the employer has failed to follow the right of priority for re-employment, evidence must be sufficient. It must also show that the employers’ actions were unfit in relation to the circumstance. It is difficult to identify whether the employer has failed to follow the right of priority for re-employment. The aim, measures and actions of the right of priority for re-employment must be reassessed in order to apply the law effectively. Unfortunately, in comparison to the labor management rights act, the right of priority for re-employment is easily bypassed.

Redundancy duration and business alteration - Consequences of establishment closures in Sweden

This thesis follows and analyses what happens to individuals who work at establishments that are closed down. I examine if and when the displaced workers are re-employed. Furthermore, I examine to what extent individuals have moved, changed industry of work, have started to commute or have become self-employed. Additionally I examine, if the workers become selfemployed after displacement, how many of them that does so within the same industry of work as they initially got displaced from. A unique longitudinal matched employer-employee data incorporating all firms, establishments and their employees in Sweden between the years 1997-2008 is used. All individuals between 25 and 55 years of age at the time of displacement that were displaced between 2000 and 2003 due to establishment closures are followed over a five-year period of time. Consistent with previous empirical research, it is shown that an absolute majority of the workers that are displaced one given year also recovers within that same year. The results moreover express that the longer the displaced workers are out of employment, the larger is the willingness to change industry of work, change municipality of living or move into self-employment. The willingness to commute is however found to be fairly constant over time. Finally, I find that those who become self-employed to a greater extent start business in other industries than they were displaced from as time passes.

New veterans in Tainan who demobilized in three years take Tainan for example

The study aims to investigate the correlation for new veterans among their personalities, family factors, relevant coping strategies for employments provided by Veteran Affairs Commission in Tainan and re-employment. The research findings will be offered to administrators in Veteran Affairs Commission, as well as future researchers in the field, which would promote the possibility of employment for new veterans. Moreover, individual personalities such as gender, age, marriage, education, military seniority, type of demobilization pension, demobilization rank, situations of family and work, duration of unemployment and so on will be taken into consideration for probing the effect on re-employment. These findings will be reference for government to provide adaptive service for individual difference based on called ¡§Walking around service.¡¨ Finally, the research findings would suggest the administration, i.e. Ministry of National Defense, Council of Veteran Affairs, and Council of Labor Affairs, to cultivate second major training for those active military officials. These plans for their careers after demobilization will help them get used to the society, contribute more effort to the country in the next stage of life. The research subjects include new veterans in Tainan who demobilized in three years. The data was collected by distributing 486 questionnaire and 128 returned, effective returned rate reached 26.83%. The questionnaire was designed based on related references and inventories. The collected data were analyzed with SPSS 12.0 by using Reliability Analysis, Factor Analysis, Descriptive Statistics, t-test, One-Way ANOVA, Regression Analysis as well as Hieraechical Regression Analysis. The research findings concluded as follows: 1. The personality of new veteran has significant effect on his/her re-employment. 2. The personality of new veteran has significant positive effect on his/her work value. 3. The family factor new veteran has interaction between his/her personality and work value. 4. The opinion on re-employment provided by Veteran Affair Commission in Tainan has significant effect on personality, work values, family factors.

From Labor Market Exclusion to Social Exclusion: A Sociological Analysis of Unemployed Workers

This thesis begins with the economic globalization, and uses secondary data analysis to explore the labor structural change and employment conditions in Taiwan under globalization. Then, using the social exclusion theory, through qualitative in-depth interview methods, this study explores the unemployment and re-employment experiences of the long-term unemployed and the marginally employed, as well as the economic, psychological, and social network exclusion in the process of employment to unemployment. This study also discusses the roles of government employment policies, familial and social relationship networks. Finally, policy suggestions are proposed according to related research discoveries. The study finds that: first, in terms of unemployment and re-employment experience, most laborers regard unemployment with a passive and external attribution attitude; this negatively influences emotions, interpersonal relationships, and later re-employment. While unable to return to the original career, unemployed laborers develop different life choices. Those who return to the labor market the earliest return because they succumb to economic pressure, becoming marginal workers who are willing to do any work, and the other kind are those who are continuously accumulate capital and convert it into employment resource; these are the active workers. On the other hand, there are two types of people who remain unemployed. One is the type that becomes waiting unemployed because they are unwilling to budge on employment conditions, and the other is the type that is limited by their own employment abilities and become helplessly unemployed. Additionally, unemployed people with different identities also have different life choices at their inability to return to their original careers. Secondly, from labor market exclusion to social exclusion: 1.Labor market exclusion and economic exclusion: unemployment results in decreased income, which further impairs daily living needs, basic medical care, and educational services, as well as stops one from participating in entertainment and leisure activities; these impact basic life opportunities and makes one feel more and more exclusion. 2. Labor market exclusion and psychological exclusion: emotional changes during unemployment are primarily affected by decreased income, but it is also affected by personal expectations of future re-employment. For the involuntarily unemployed, they feel a greater sense of lack of control and impotence over their lives. 3. Labor market exclusion and social relationship exclusion: as a result of lack of self esteem or economic considerations, the unemployed have significantly less social interaction, in a singularized network structure, which would provide relatively smaller economic or re-employment support. 4. Social networks have a positive influence on alleviating the multifaceted exclusion caused by unemployment, but the majority of unemployment laborers have significantly insufficient social network functions. Those who are unemployed with weak formal and informal social networks would fall into social exclusion, have a bleak outlook on the future and believe that there is no chance to extricate oneself from the various unfavorable situations caused by unemployment. ¡@¡@The end of the thesis also discusses some related issues, such as the unemployment issue (unemployment conceptualization? Who are the unemployed? Work or retire?), social exclusion issues (applicability of social exclusion theories? what is the role of the country in labor market exclusion? Does the employment policy cause social cohesion or social exclusion?), social structures, and individual action interactions. Finally, from labor market intervention, construction to social network, and proposes related policy suggestions to reverse social exclusion.

After establishment closure : Individual characteristics that determine re-employment probabilities of displaced workers in Sweden

This paper studies the relationship between individual characteristics of displaced workers and the probability of re-employment. A competing risks hazard model is used, distinguishing between exits from joblessness to self-employment and to paid-employment. All individuals between 25 and 55 years of age, at the time of displacement, that suffered from at least one year of joblessness after being displaced between 1990 and 1998 due to establishment closures that occurred between 1990 and 2001 are included. This allows for the closure procedure to be between one and three years long. Each individual is followed, from the year of displacement until the year of re-employment or at the latest, ten years after displacement. Semi-parametric estimation techniques for discrete time data are used, and in consistency with previous research the results show that subgroups of the jobless individuals experience different re-employment probabilities. The results suggest that a non-immigrant, high income-earner in the mid-thirties, with short tenure at the closing establishment, and who was not displaced early in the closure process and who has lived in the same city for a long time, faces the greatest probability of becoming re-employed. Furthermore, men and individuals with self-employment experience face lower probabilities of re-employment in paid-employments compared to their counterparts. This relationship is however reversed when studying the probability of leaving joblessness for self-employment. Men, immigrants, high income-earners, displaced from smaller establishments, previously self-employed and those with shorter tenure in previous employment are found to be more likely to enter self-employment than their counterparts. A positive duration dependency is prevalent in re-employment probability, suggesting that search activity is increased over time. The probability of self-employment entry is however decreasing the first years of joblessness following displacement, displaying an initial negative duration dependency.

Flexibilitet kontra anställningstrygghet : En studie av svensk rätt vid inhyrning av personal när återanställningsrätt föreligger

Because of the globalization, the labor market has been thru some changes and the need to be flexible has increased. The need of flexibility can be met by using temporary staff that is rent from a temporary-work agency.   In Sweden the regulation in Section 25 of the Swedish Employment Security Act (LAS) give previous employees priority right to re-employment when the employer is hiring new staff.  If the employer hire staff from a temporary-work agency instead of hiring new staff the priority right to re-employment is not applicable. The Swedish court of labor have judged that it is accepted to hire staff when there are former employees that have priority right to re-employment.   In 2010 this was an issue surrounded by discussions from the trade unions. The result of the discussions in 2010 was regulations in collective agreements. This means that each sector has their own regulation. Because of a segregated labor market, the consequence can be unequal protection in this area.   The purpose of this paper was to see if the protection is unequal and it might be. If you interpret the regulations in the collective agreements by just reading what they say the collective agreement that regulate female dominated sectors have a lower, if any special protection.

En gång officer - alltid officer : En studie om reengagering av yrkesofficerare i Försvarsmakten

Denna studie syftar till att skapa förståelse för hur avgående yrkesofficerares möjligheter till en reengagering i Försvarsmakten kan öka. Arbetsmarknaden präglas i dag av en personell rörlighet mellan företag och organisationer samt de individuella kraven på utvecklingsmöjligheter och meningsfullhet är höga. Om en organisation kan anpassa sig till dessa förhållanden kan en återbetalning i form av ny kompetens och engagemang komma att ske genom reengagering. Med reengagering menar vi en avgående yrkesofficer som åter tjänstgör i Försvarsmakten som tidvis tjänstgörande reservofficer, tjänstgöring i internationell tjänst, eller åter som kontinuerligt tjänstgörande yrkesofficer.Studiens resultat visar att validering av civil kompetens, tillgängliggörande av lediga yrkesofficersbefattningar och ett positivt avslut på en anställning ökar möjligheterna till en reengagering. Att erbjuda reservofficersavtal, tillgång till ett personligt nätverk eller medlemskap i alumninätverk vid avgången ökar möjligheterna ytterligare. Andra faktorer som ökar möjligheterna är personlig och dynamisk arbetsgivarkontakt samt att på ett personligt plan erbjuda anställning. Slutligen, och inte minst, ser vi att individens starka identitetskänsla som yrkesofficer i Försvarsmakten är en central och attraherande faktor: En gång officer - alltid officer!Denna kvalitativa, intervjubaserade och induktiva studie bidrar till ökad förståelse för faktorer som påverkar en återanställning i en försvarsmaktskontext. Studien bidrar vidare till ökad förståelse för de kulturella band som en organisation och dess deltagare kan ha till en individ och hur banden kan få individen att återvända till sin tidigare arbetsgivare. / This study aims to create an understanding of how, military officer´s departing, possibilities for re-engagement could be strengthened. Today’s labor market is incused by high movement of personnel between organizations and by high individual demands on potentiality and meaningfulness with employment. If an organization manages to adapt to these circumstances it could enjoy a refund in new knowledge and dedication that comes with a re-engagement. With a re-engagement we refer to a former military officer who, now working outside the Armed Forces returns to continuous service, international service or occasional service.The results of the study show that validating civil competence, making available jobs visible and searchable, and striving for a positive departure when quitting, increases the possibilities for a re-engagement. When offered an opportunity to serve as an officer in the reserve and given access to an alumni network when quitting, possibilities for a re-engagement increases further. Additional factors that strengthen possibilities are personal and dynamic working relations and personally addressed job offers. Finally, but not least, the strong sense of identity that is inherent with military officers is a fundamental and attractive factor: Once an officer – always an officer!This qualitative, interview based and inductive study contributes to increased knowledge on factors that have an impact on re-engagement in a military context. The study further increases understanding of cultural ties between an organization and individuals and how these ties may affect a person's choice to return to a former employer.

En partant de l’idée que la guerre et les images sont deux notions interdépendantes, la thèse reprend deux concepts clés : visualité et contre-visualité. La visualité, étant une façon de perpétuer la guerre, représente les discours dominants. L’art contemporain serait donc une possibilité de construction de contre-visualités. La « guerre globale » contemporaine - totale et dispersée - aurait une production visuelle qui lui correspondrait : des images d’amateurs, elles aussi dispersées et de grande circulation. Comment ces images, généralement liées à la sphère privée, se sont converties en enregistrements de la guerre contemporaine ? Comment l’art fait face à la guerre et à la visualité dominante par le biais du remploi de ces images ? La recherche essaie de définir cette production d’images « amateur » et de l’encadrer dans le temps conflictuel du présent. Une telle production serait-elle une résistance à la visualité actuelle ou au contraire quelque chose qui la renforce ? Ensuite, à travers un corpus circonscrit de quatre artistes visuels contemporains (Clarisse Hahn, Rabih Mroué, Coco Fusco et Thomas Hirschhorn), nous travaillons l’hypothèse que la réutilisation de ces images peut contribuer à la construction d’une contre-visualité : par le geste artistique, l'enlèvement de ce matériau d'un certain flux provoquerait un arrêt, une déviation vers une reconfiguration du sensible où le facteur conflictuel serait mis en évidence. Dans un troisième moment, la thèse se penche sur l'œuvre des années 1970 de Jean-Luc Godard et Anne-Marie Miéville, quand ils interrogent les forces et les faiblesses du cinéma militant et mettent en question les images et leurs potentialités. Certaines de leurs procédures créatives sont examinées rétrospectivement, car à notre avis, elles sont toujours présentes directement ou indirectement dans la pratique artistique des artistes de notre corpus. / Considering the idea that war and images are two interdependent concepts, the thesis deals with two key concepts: visuality and counter-visuality. Visuality as a way of perpetuating the war represents dominant discourses. Contemporary art would therefore be a possibility of constructing counter-visuality. The contemporary “global war” - total and dispersed - would have a visual production that would correspond to it: the amateur images, also scattered and widely circulated. How are these images - usually related to the private sphere - converted into records of contemporary war? How does art face war and the dominant visuality by utilizing these images?The research attempts to characterize this amateur production of images and to frame it in the conflicting time of the present. Would such a production be a resistance to the current visuality or, on the contrary, something that strengthens it? From then on, by analyzing a circumscribed corpus of four contemporary visual artists (Clarisse Hahn, Rabih Mroué, Coco Fusco and Thomas Hirschhorn), we work on the hypothesis that the reuse of these images can contribute to the construction of a counter-visuality: by the artistic gesture, the removal of this material from a certain flow would cause a stop, a deviation towards a reconfiguration of the sensible where the conflicting factor would be highlighted. In a third moment, the thesis looks at the work of Jean-Luc Godard and Anne-Marie Miéville on the 1970s, when they question the strengths and weaknesses of militant cinema and challenge images and their potentialities. Some of their creative procedures are examined in retrospect because in our opinion they are still directly or indirectly present in the artistic practice of the aforementioned artists.

Cette thèse porte sur l’examen du mode d’opération du remploi photographique en art contemporain, et en spécial celui d’images photographiques post mortem. Avec l’appui de différentes théories qui portent sur la photographie et l’observation de plusieurs oeuvres de remploi photographique, ce travail étudie,d’une part, les problématiques d’ordre génétique et théorique spécifiques à cette pratique contemporaine. De l’autre, ce travail traverse des perspectives historiques et aussi anthropologiques à propos de l’homme face au corps mort pour, en tenant en compte des différents aspects des transformations du rapport de la société occidentale à la mort, observer les effets sur la production de la photographie contemporaine. Dans ce contexte, l’étude identifie les deux types majeurs d’images photographiques post mortem remployées – les deux associé à la violence – et analyse, en suite, les nouveaux rapports symboliques proposés par un nombre d’oeuvres. Cet étude cherche à observer à quoi répond ces oeuvres de remploi d’images photographique post mortem et, en même temps, à observer que l’oeuvre de remploi photographique, en tant que pratique artistique qui vise la révision et la critique des représentations, contribue néanmoins pour la construction d’une représentation de la mort selon les perspectives contemporaines auxquelles elles répondent. / This thesis focuses on the examination of the operation mode of the photographic re-employment incontemporary art, and in special of post mortem photographic images. With the support of various theories that focus on photography and the observation of several photographic re-employment artworks, this study examines, on the one hand, genetic and theoretical problematic that are specific to this contemporary practice. On the other, this work crosses historical and also anthropological perspectives on humans facing the dead body, taking into account different aspects of the transformations in Western society’s relationship to death, in order to observe the effects on contemporary photography production. In this context, this study identifies two major types of postmortem photographic images re-employed – both associated with violence –, and then analyses the newsymbolic relations proposed by a number of artworks. This study seeks to observe to what these artworks that re-employ post mortem photographic images respond to, and at the same time, seeks toobserve that the photographic re-employment, as an artistic practice that aims to review and criticize representations, contributes however, for the construction of a representation of death within the very contemporary perspectives, which they respond to.

Thesis (LLM.) -- University of Limpopo, 2022 / The study will analyse the legal position of the right to strike and the consequences of participating in an unlawful strike. The study will provide a brief practical implication of employees dismissed for participation in an unlawful and/or unprotected strike and the employer’s right to reemploy any employee dismissed for a misconduct relating to unlawful and/or unprotected strike. The study will further make a brief comparison with the labour law position relating to strikes in the United Kingdom (“UK”). At the end provide recommendations on how the law on participation on unlawful and/or unprotected strikes and reemployed of employees dismissed on misconduct relating to participation in an unprotected strike can be developed and improved.
