Capacity-building of school governing bodies in area of policy interpretation and implementationMakhuvele, Sevha Thomas 05 1900 (has links)
MEd (Educational Management) / Department of Educational Management / The aim of the study was to investigate the capacity-building of School Governing Bodies (SGBs) in the area of policy interpretation and implementation. The research was carried out in schools under Klein Letaba Circuit in the Mopani Education District, in the Limpopo Province. This was a qualitative study where the researcher used purposive sampling to select schools and participants and interviews and document analysis to collect requisite data. In analysing data collected, content analysis was used. On the basis of data analysed and interpreted, the research findings revealed that SGBs do not have the necessary capacity to interpret and implement policies in schools. This is as a result of the inadequate training that they receive during their term of office, high level of illiteracy among them and lack of monitoring and support by the Department of Basic Education (DBE). The study therefore recommends that SGBs be adequately trained in their home languages and encouraged to form cluster committees to share experiences to develop their capacity. The DBE should continuously monitor and support SGBs in the execution of their duties.

A Legal Analysis of Litigation against Louisiana Educators and School Districts, Before and After the Louisiana Governmental Claims ActPrice, Charie Wesley 05 1900 (has links)
This dissertation analyzed court decisions in injuries on school grounds cases under the Louisiana Governmental Claims Act. The question addressed was: How have the Louisiana courts interpreted the Louisiana Governmental Claims Act in litigation against Louisiana school districts and their employees? The intent of this study was to show how Louisiana's legal system has evolved, and how that evolution affected tort cases involving school boards and school board employees. Doctrinal legal research was the methodology used to answer the research question. To limit the number of cases analyzed, this study only focused on tort claims involving injury on school property. In order to gain a broad perspective, tort claims cases filed prior to the 1974 Louisiana Constitution, cases filed after the 1974 Louisiana Constitution, and cases filed after the 1995 Louisiana Liability Limits Amendment, and the Louisiana Governmental Claims Act of 1996 were analyzed. By analyzing the tort claims brought against Louisiana school districts and employees during the various time-periods, it was clear to see how the case rulings reflected the frequent changes of the Louisiana Constitution and its' laws. In the end, the state continued to control who could sue them and how much they would pay in damages.

State Created Danger and Chronic Traumatic Encephalopathy in Texas Schools: A Legal ExaminationSwitzer, Aaron Gray 05 1900 (has links)
The recent breakthroughs in the research of brain trauma as it relates to athletics has revealed never before seen damage linked with football participation. Known as chronic traumatic encephalopathy (CTE), it is caused by activities inherent to the sport of football. School sponsored football has been granted immunity through case law and legislation in Texas. Recent research however indicates a different type of injury than those that school districts have been protected of liability from. This will provide a challenge to the immunity school districts have enjoyed regarding football. One route to abrogation of immunity is the state created danger provision established by the Supreme Court. The Fifth Circuit Court whose jurisdiction includes Texas has yet to officially adopt the state created danger theory. This research examined legal precedent to determine the challenge CTE may present the various layers of immunity surrounding school sponsored football in Texas.

* wetgewing met betrekking tot dissipline in skole;
* soorte van probleme;
* faktore wat aanleiding gee tot probleme;
* maatreëls wat gebruik word om dissiplinêre probleme te hanteer en te voorkom.
Deur literatuurstudie word begrip en kennis verkry wat as agtergrond dien vir die kwalitatiewe ondersoek waardeur `n kontekstuele begrip verkry word van die ervaring van dissipline en probleme deur `n geselekteerde groep skoolhoofde van Intermediêre Skole in die Namakwa Distrik van die Noord-Kaapprovinsie. Ten slotte word voorstelle gemaak met die oog op die verbetering van `n komplekse situasie. / The aim of this study on a small scale is to gather information about the problem of discipline as manifested in Intermediate Schools in the Namaqua District of the Northern Cape Province. The attention is focused on:
* legislation in connection with discipline in schools;
* types of problems;
* factors that cause problems;
* measures to cope and prevent disciplinary problems. The study of literature provides understanding and knowledge that serves as background to the qualitative study by way of which a contextual understanding is developed of the experience of discipline and specific problems by a selected group of principals of Intermediate Schools in the Namaqua District of the Northern Cape Province. Developing a law and policy framework to regulate cyber bullying in South African schoolsHills, Cathrine Anna 01 1900 (has links)
Cyber bullying is a growing phenomenon in schools all over the world, and it is evident that cyber bullying presents certain unique problems for schools in the regulation thereof. From the number of different definitions of cyber bullying, it is also evident that there is no clear concept of the exact nature of cyber bullying, and how it should be addressed in schools. The existing legal framework in South Africa can be used to address cyber bullying in schools, but there is no legislation or policy that is directly aimed at the regulation of cyber bullying at school level.
The purpose of this research is to develop a law and policy framework for the effective regulation of cyber bullying in schools. Firstly, a literature review was conducted to determine the nature of cyber bullying and to examine how cyber bullying in American schools is regulated by law. Secondly, a literature study determined the human rights obligations with regard to protecting learners against cyber bullying, and reviewed how current South African law and policy speaks to addressing cyber bullying in schools. In order to investigate the occurrence of cyber bullying in South African schools practically, a case study was conducted at a South African school. All the resources mentioned above were used to develop an education-specific law and policy framework to address cyber bullying in South African schools effectively. This framework includes a suggested insertion in the South African Schools Act, draft Guidelines for the regulation of cyber bullying in schools, draft provisions for schools’ Codes of conduct for learners and an information brochure on cyber bullying. / Public, Constitutional and International Law / LL.
