A harmonização do direito penal econômico em face da integração regional na África Austral / Harmonization of economic criminal law in the context of regional integration in Southern Africa

Conselho Nacional de Desenvolvimento Científico e Tecnológico / A dissertação analisa as possibilidades e apresenta os pressupostos para harmonização do Direito Penal Económico na África Austral. Nela trabalha-se com a hipótese de que o referido processo é inexorável no âmbito da integração regional. Para o efeito, são abordadas questões criminologicas, exigências político-criminais bem como dogmáticas que permitam propor a referida harmonização legislativas, na perspectiva do direito a constituir. É destacada a pertinência de se empreenderem reformas nas legislações penais dos Estados-membros, com vista a atender aos ilícitos econômicos, considerando que a acentuada disparidade legislativa é um factor que, de certa forma, pode cercear as acções que têm sido realizadas no âmbito da prevenção e combate a criminalidade econômica na região. Disserta-se sobre as peculiaridades do delinquente e especificidades da delinquência econômica ao nível da SADC e, seguidamente, se descreve a forma de concretização da almejada harmonização, tendo como base dois estudos realizados sobre a matéria e igual número de modelos, os quais priorizam dois eixos, designadamente: o eixo dos delitos e o das penas; sendo que no primeiro descata-se a necessidade de uniformizar não só as condutas delituosas a tipificar, mas, sobretudo a técnica para sua tipificação. Como segundo eixo, aborda-se a pertinência de se aproximar as medidas de reação penal as sanções penais. Por fim, em sede da conclusão realça-se a existência de fundamentos e requisitos dogmáticos, político-criminais e criminológicos que permitem realizar a harmonização do Direito penal econômico na SADC, como medida necessária para a prevenção e represão da criminalidade econômica transnacional, intrínsecamente ligada aos processos da globalização e de integração regional em curso. / The dissertation analyzes the possibilities and presents the conditions to achieve the harmonization of Economic Criminal Law in Southern Africa. In this view, the dissertation deal with criminological, criminal policy as well as dogmatic issues in order to propose such desired legislative harmonization and aiming to address the interrelationship between the various forces that support and those that hinder penal harmonization. As a main hypothesis, the dissertation considers that the criminal legislative harmonization is a necessary process in the context of regional integration, especially for those countries located in regions with close economic and political ties (as it is the case of southern African countries). Its emphasized the relevance of undertaking reforms on the SADCs members-states nationals criminal laws in order to improve prevention and combating economic crimes, as far as the differences on the members-states internal criminal legislations is a concern in the region. Is described the characteristics of the delinquents as well as the economic crimes on the SADC region. In this view, is explained how to undertake the desired harmonization, based on two studies and the same number of models related to the harmonization of economic criminal law. It is proposed that the harmonization process has to be made in two axes, mainly: the axis of the offenses and of the penalties. On the first degree is explained the need to harmonize the actions to be legally qualified as economic crimes as well as the legal mechanism for their legal provision. In the second axis is mentioned the issues regarded to the harmonization of criminal penalties. Finally, in the conclusion is underlined and demonstrated the presence of considerable factors and requirements towards the harmonization of economic criminal law in SADC, as it is a necessary measure to protect intra-state economic and financial interests, the common regional objectives as well as to prevent and combat transnational economic crimes, which is, indeed, strongly linked to the worldwide globalization and to the knit regional integration process.

A Comunidade para o Desenvolvimento da África Austral (SADC) é um dos principais processos de integração regional da África. A criação da Comunidade está fundada no processo de descolonização da África Austral e na mobilização dos Estados da Linha de Frente na contenção das políticas de desestabilização da África do Sul durante o período do apartheid. A concepção de regionalismo desenvolvimentista, na qual os processos de integração regionais têm objetivos mais amplos do que os meramente comerciais, vai ao encontro da realidade da África Austral. O conceito de comunidade de segurança também é útil para compreender as relações regionais que envolvem a criação e o desenvolvimento da SADC ao longo das décadas, tendo em vista a sua atuação também nas questões securitárias. O objetivo desse trabalho é analisar a evolução da SADC, desde a sua criação até os anos 2000, enfatizando os aspectos históricos e políticos desse processo. Devolution and democratisation: policy processes and community-based natural resource management in Southern Africa

Philosophiae Doctor - PhD / By presenting case studies from the village of Mahenye in Zimbabwe and the five villages of the Okavango Community Trust in Botswana, the study looks beyond the objectives, discourse and contests of policy and undertakes an investigation of what actions rural people are undertaking inside the institutions established by policy makers, and of governance outcomes at the local level. These case studies reveal that unfettered devolution can lead to elite capture and the perpetuation of poverty; that rural communities themselves have agency and the ability to exercise it; and that there is limited and shrinking political space in both countries which is reducing opportunities for rural communities to engage with political processes. The Botswana case studies demonstrates that an imported and imposed devolutionary initiative which lacks links to higher levels of governance can reduce political space at local levels. The Zimbabwe case study demonstrates that political space may be more effectively created through decentralisation. The lesson drawn from these case studies is that institutional arrangements and roles should be determined by context specific issues and circumstances and move beyond the structural determinism that has characterized much of the CBNRM debate to date. The study concludes with policy recommendations. These include the need for recognition of the synergy between CBNRM and democratisation as mutually reinforcing processes and the need to be context-specific. / South Africa

The future of national flag carriers in developing countries : air Botswana's privatisation struggle

Magister Economicae - MEcon / The study looked particularly at the operations of national carriers and governments' efforts to sustain the airlines' operations. Evidence has shown that many countries struggle to maintain operations of their flag carriers, but few countries are willing to completely leave the airlines in the hands of the private sector because of national pride. On the other hand, many of those airlines that get into private hands fail and end up being closed down or go back into state hands. These airlines are also perceived to be development tools, in particular for tourism development which is a predominant economic activity in many developing countries. For this reason, many states do not favour privatisation, even though the perception is that the airline industry is better handled by private businesses. The main conclusion of the study for Botswana is therefore that neither full state ownership nor full privatisation is the solution to addressing the problem of ailing flag carriers. There is no single solution, but a combination of several. A broader global view of national airline operations clearly shows that approaches adopted by many successful national airlines, in both developed and developing countries, is some form of partial privatisation. / South Africa

Knowledge, beliefs and practice about sexual concurrent partnering amongst education students at a tertiary institution in rural Namibia

Doctor Educationis / Background: In an attempt to avert the HIV/AIDS epidemic, more research has been conducted to determine why the epidemic is more devastating in Southern African countries than anywhere else in the world. Heterosexual transmission is believed to be driving the epidemic in many sub-Saharan African countries. Recent research has indicated that having concurrent sexual partners is one of the factors contributing to the fast spread of HIV transmission in this region.Aim: This study aimed to describe the level of knowledge about the risk of HIV transmission posed by concurrent sexual partnering as well as beliefs and practices about concurrent partnering among education students at the Rundu College of Education(RCE) in the Kavango region of Namibia. Concurrent partnering was defined as a situation where a person has more than one sexual partner at the same time, during the twelve months preceding the study.Methodology: There were 374 students registered for the 2009 academic year at RCE.All registered students were targeted for the study and 278 completed the questionnaire,yielding a response rate of 73.4%. The survey described prevalence of concurrent partnering, knowledge about risk posed by concurrent partnering as well as beliefs about concurrent partnering.Data collected was analyzed using Statistical Programs for Social Sciences (SPSS).Descriptive statistics were used to describe the prevalence of sexual concurrency,knowledge about risk posed by concurrent partnering and beliefs about concurrent partnering among the study population. Frequency of concurrency was cross tabulated with demographic variables like age group, sex and year of study as well as by knowledge and beliefs about sexual concurrent partnering.Results: The prevalence of concurrency in this sample was 9.4% with significantly higher prevalence (13.0%) among male students compared to females (5.3%). Males reported knowledge levels of 85.7% to 88.4% while females reported knowledge levels of 89.3% and 93.1%. More men (28.8%) than women (10.7%) agreed with the statement that sexual concurrency is a sign of manhood (p=0.00). Further, more male students(27.9%) compared to female students (6.1%) agreed with the statement that sexual concurrency is part of African culture and should continue (p=0.00).Conclusion: The study results show a high knowledge of risk posed by concurrency. It further reveals that a high number of people believe that concurrency is acceptable especially among men.HIV prevention activities promoting partner reduction and mutual fidelity should be implemented. Such activities should focus more on behavior change rather than on information giving. There is a need to create platforms for community members to debate on cultural beliefs about sexual concurrency.

Despite the efforts to dismantle trade restrictions and create a common market, the problem remains that of African disintegrated markets which then lead to poor intra-African trade. There is therefore the need to use intra-African trade as an instrument that effectively serve in the attainment of rapid and sustainable social and economic development. The aim of this study is to therefore determine whether the solution to increasing intra-African trade can be found in the Tripartite FTA.

Managing the trade-off between conservation and exploitation of wetland services for economic well-being : the case of the Limpopo wetland in southern Africa

This study had two main objectives. The first objective was to determine the factors that influence rural households’ labour allocation and supply decisions for competing livelihood activities, including wetland activities. The second objective was to: develop an ecological-economic model establishing the linkages between the economic and ecological components in a wetland system and apply the model to evaluate the impacts of alternative wetland management and policy regimes on wetland functioning; and supply ecosystem services and economic well-being. To achieve the first objective an agricultural household framework was used. The reduced form labour use and supply equations for wetland products and agricultural grain, derived from optimising the agricultural household model, were estimated jointly using a seemingly unrelated regression model. The model was fitted to data collected from a survey of 143 households in a wetland system in the Limpopo basin of South Africa. Results showed that poor households, most of whom are female-headed households, have less capacity to participate in off-farm employment and rely heavily on farm and wetland activities for their livelihood. This implies that environmental protection policies that limit access to the wetland resources will deepen poverty as the poor will suffer more from deprivation of resources, which play a key role as a livelihoods safety net for the poor. This suggests that in order to enhance the sustainable management of wetlands there is need to identify and promote local level wetland management practices that allow the poor to use wetlands to enhance their economic well-being with minimum adverse effects on wetland ecological conditions instead of adopting strict wetland protection measures. In addition, there is also a need to broaden the opportunities for the poor to diversify into off-farm livelihood activities. This minimises the risks of income fluctuations associated with farm and natural resource-base livelihood sources and therefore provides the necessary positive incentives for wetland conservation and sustainable use. Better access to education is an important instrument for enhancing the poor’s ability to diversify into off-farm livelihood options. These results suggest that wetland conservation and sustainable use has to be integrated with the broader rural poverty reduction initiatives such as: improved access to education; investment in irrigation infrastructure; and improving access to markets. Results also indicate that a household’s exogenous income and wealth status (asset endowment) enhance farm production whilst reducing dependence on wetland products for livelihood. The government should pursue policy measures that reduce rural household liquidity constraints and enhance investment in productive assets (e.g. improving rural household access to credit and off-farm income opportunities) to boost farm production and enhance wetland conservation and sustainable use. To achieve the second objective the study developed a dynamic ecological-economic model. The model is based on the system dynamics framework to capture the multiple interactions and feedback effects between ecological and economic systems. The application of the model in simulating policy scenarios suggests that wetland ecosystem services (crop production and natural resource harvesting) are interlinked with trade-offs involved through their competition for labour, water and land resources. Policy scenario simulation results showed that diversifying livelihoods out of agriculture simultaneously improves economic well-being and enhances wetland conservation. Pure conservation strategies impose significant losses in the economic welfare of the local population unless supported by diversification of livelihood sources. The simulation results also show that the development of a competitive marketing system for harvested biomass products increases returns to wetland biomass products relative to that of wetland grain and it reduces conversion of wetlands to agriculture. Simulation of the predicted reduction in annual precipitation due to climate change in southern Africa showed that climate change is likely to accelerate the conversion of wetlands to agriculture, confirming the important role wetlands play in managing climate variability in smallholder agricultural systems. The sensitivity of NPV to sampling and estimation decisions of a marine diamond mining project

Marine diamond mining as practiced on the west coast of southern Africa is considered to be a high-risk venture. Investment decisions can be eased by using simulations to model likely outcomes. This study utilised Net Present Value (NPV) to measure the impact of sampling and grade estimation decisions on a marine diamond mining project. It focused on aspects such as the accurate determination of geological conditions, the influence of the degree of error in the geostatistical estimation process, sample density and sample support size. A simulated deposit was constructed that could be sampled using various parameters to measure the sensitivity of NPV. Various scenarios and their related NPV's showed that exploration costs have a small impact on a project in comparison with other cost aspects. However, the decisions made in the exploration process do have a significant impact on the NPV of a project. Inaccuracy in recovery efficiency and mining rate prediction, lead to a decline in NPV. Misfitting the semi-variogram model had a smaller impact on the NPV than the other scenarios investigated, but the importance of reflecting the true variance of the deposit in financial terms was evident. Finding the optimal sampling density and support size do have a positive effect on NPV. It is believed that the method demonstrated in this study can be used as a guide to add value in the selection of optimal parameters when planning exploration campaigns in marine mining projects. In teenstelling hiermee is die impak van besluite wat geneem word in die eksplorasie fase groot. Onakkurate herwinnings effektiwiteit en ontginningstempo skattings lei tot 'n afname in NHW. Swak modelering van die semi-variogram het 'n kleiner invloed op NHW, maar die belangrikeid daarvan om die ware variansie van die afsetting te reflekteer, was duidelik in finansieele terme.
