This doctorate thesis The Politics of Iwi Voice focuses on the struggle of a modern, urban iwi authority to secure political recognition from other iwi and the Crown as it attempts to assert an independent iwi voice, and exercise mana and tino rangatiratanga. The responses of the local iwi/Maori community, the Crown, and others to the re-emergence of the new iwi entity are critically examined. The thesis demonstrates how a small iwi group resists attempts to assimilate into a broader coalition of iwi, hapu, whanau and marae interests, preferring instead to maintain and develop its own distinctive identity. It uses the iwi Ngati Tama to exemplify the diaspora of an iwi, and shows how iwi identity and fortunes are buffeted by both iwi and urban contestations as well as changing political directions. The study suggests that a Ngati Tama future away from its homeland will depend primarily on the development of pragmatic adaptive and innovative strategies, and a fervent resolve to retain a distinctive identity, while participating in a dynamic and often oppressive environment. This thesis concludes that to maintain a distinctive iwi presence its members should have the right to decide who best represents them. An iwi is considered an appropriate vehicle to represent its members and manage its interests. In order to survive in a constantly changing environment, an iwi must be dynamic, flexible, relevant, and meet the needs of its membership. Further, its leadership should be focused on negotiating relationships in good faith - including third party interventions - and seeking pathways that will advance its interests into the future.

Conflict resolution and reconciliation in Sudan : inter-tribal reconciliation conferences in South Darfur State up to 2009

This study explores and critically examines the role of indigenous mechanisms (the Inter-Tribal Reconciliation Conferences-ITRCs) in resolving tribal conflicts in South Darfur State of Western Sudan. The fundamental question raised by this study is: have these reconciliation conferences- 1989-2009- been able to address the root causes of the tribal conflicts and are they capable of serving the same role that they once did? Tribal leadership structures, such as Native Administration (NA) and their mechanisms of conflict resolution/management in Darfur, have been subjected to highly significant changes over time. The question is to what extent these changes further fuelled tribal conflicts and/or have negatively affected the capability of the NA and the ITRCs to deal with these conflicts? This thesis relies on archive records and reports of the ITRCs and data generated through interviews conducted with key informants. Through a detailed analysis the study: 1) presents a detailed account of the major conflicts and their causes in South Darfur; 2) identifies the changing identities of the protagonists and of the perceived causes; 3) assesses the effectiveness of the agreements reached by these conferences when considered alongside the causes identified. Analysis of the ITRCs shows that tribal conflicts in Darfur (from1980s), and South Darfur in particular, were connected to the wider political conflict in the Sudan and the region respectively. The analysis suggests that the history of neglect/marginalisation of the region by successive governments, and the political manipulation of the NA and local government, have negatively affected the performance of these institutions. The experience of the ITRCs indicates that they were unable to address the underlying causes of the tribal conflicts, such as land disputes, the manipulation of the NA and local government, rape and mass killings.

This dissertation investigates the social and cultural contours of citizenship and nationhood of Kahnawake Mohawks. The central question that I seek to answer is "What other narratives of nationhood and citizenship are there than those of membership in the American or Canadian states?" Mohawks and other Iroquois nations have long asserted their ideological, and in the case of some, economic independence from the governments of Canada and the United States. My multi-sited research illustrates that this historical assertion is more than rhetoric; it is also a practice or " praxis," as Mohawks configure citizenship across the imposed borders that separate their reserves from cities and states from states. This dissertation engages contemporary theories of nationhood, historical and contemporary ethnographic literature on the Iroquois, as well as contemporary literature in political theory and policy to examine the gendered and sometimes racialized contours of Indigenous nationhood and citizenship across borders. Kahnawake Mohawk narratives and the choices that they entail have implications for the way that all "post-colonial" nationals attempt to imagine and construct their place and their membership within and beyond the boundaries of their communities and that of the state.

Aboriginal forest tenure and governance in British Columbia : exploring alternatives from a Stellat'en First Nation community perspective

The purpose of this research is to contribute to the identification of appropriate forest tenure and governance designs that are in congruence with Aboriginal values, interests and rights. The research is highly relevant to current societal deliberations on sustainable forest management as well as to the future of the forest sector in Canada. First Nations culture and ways of life are intimately and inextricably tied to the land. Some eighty percent of Canada’s First Nations communities are situated in productive forest regions (NAFA 2003). Even so, First Nations have been largely excluded from forest development and planning activities. Furthermore, the provincial policy emphasis on industrial timber production may not be consistent with Aboriginal forest values. This community-based research takes a participatory approach to forest policy analysis. The work is conducted in partnership with the Stellat’en First Nation and Carrier Sekani Tribal Council in central British Columbia. Stellat’en criteria for forest tenure and governance are identified in a series of workshops and interviews. These criteria are then applied in the analysis of four alternative models: the Community Ecosystem Trust, the Gitanyow joint land use planning model, BC Community Forest Agreements and Aboriginal reservations in the United States. The results indicated that Stellat’en have three main goals regarding forest tenure and governance: protect the traditional territory for future generations, protect Stellat’en culture and support Stellat’en economic self-determination. Implementation of the Stellat’en vision calls for a greater emphasis on ecological and cultural values in forest management, devolution of decision making authority to First Nations, reallocation of harvesting rights and redistribution of wealth generated by forest activities. The Stellat’en perspective emphasizes co-existence and stewardship. Evaluation of the four alternative models provided useful insights for progressive tenure and governance design. All four models had positive aspects to contribute, as well as shortcomings. The models are not mutually exclusive. Since each model addresses different management and institutional functions, they could be combined into a new system for the future.

The role of traditional leaders in rural local government : a case of Vulindlela and Impendle traditional areas.

Approximately three-quarters of the population in South Africa live in rural areas and are under the governance of traditional leadership, whose practice has been the source of controversy in the post-apartheid era. The institution of traditional leadership has been historically regarded as the main ruling system closest to and accepted by the people at grassroots level. The aim of this research is to investigate the role of traditional leaders in local government in the Vulindlela and Impendle areas, Pietermaritzburg. The objective is to present a historical overview of the role of traditional leaders and to analyse the role traditional leaders have to play in development. The research examines whether the tension between traditional leaders and municipal councillors hinder development to the masses in Vulindlela and Impendle areas. The methodology adopted for this study was a qualitative research approach, which was used to analyse the roles played by traditional leaders in rural local government development. The main findings of the study reveal that traditional leaders and authorities are essential political, social and economic structures for maintaining the socio-political order that is a prerequisite for rural development. Any endeavor to create a full democratic society in South Africa must utilize the intrinsic strengths of traditional leaders. The institution of traditional leaders should be transformed to move with the times. Many traditional leaders accept the role they have to play as part of the new order as well as the resulting challenge associated with the process of transformation. In principle, traditional authorities should not be drawn into party politics and their role should remain one of neutral leadership. Traditional leadership in local economic development : a case study of the uMgungundlovu District.

Inequality in South Africa in terms of access to education, finance, food security, and public amenities is worse in rural areas under traditional leadership than in urban areas not under the control of traditional leaders. In most of these areas, people live in abject poverty and underdevelopment is rife with no access to economic opportunities, basic services and economic and social infrastructure. This study attempts to ascertain the involvement of traditional leadership in the Local Economic Development (LED) of these areas. It also explores the mandate given to traditional leadership through government legislation, policies and programmes in LED. The study further seeks to suggest through a model how traditional leadership could be involved in LED. This study focuses on the following questions:  What are the fundamental causes of the exclusion of traditional leadership in LED?  What government policies and programmes are in places that explicitly spell out the role of traditional leadership in LED? and  What are the perceptions of traditional leadership implicit in the government’s LED initiatives? The scope of the study covers the uMgungundlovu District which has 24 traditional councils that form the local House of Traditional Leaders. These traditional councils spread across the seven local municipalities that form part of the District. The data was collected using a qualitative research methodology which focused on interviews with government officials and traditional leaders, to get their perceptions on the role of traditional leadership in LED. Government legislation, policies and programmes have also been reviewed to check the official government position on the role of traditional leadership in LED. Engagement with government officials, traditional leaders and government publications reveals that traditional leadership is not playing a role in LED. There are no LED programmes directed to traditional communities that are led by traditional leaders. There is then a justifiable perception that traditional leaders are being deliberately excluded from government LED initiatives. A review of the government legislation, policies and programmes indicates that they do not bar the traditional leaders from playing a role in LED. The constitution of the Republic of South Africa provides a broad framework with regard to the role of traditional leaders by stating that the national government may provide for a role of traditional leadership in matters affecting their communities. The White Paper on Traditional Leadership and Governance recognizes traditional leadership as an institution located in rural areas that has a role to play in the fight against poverty. The Traditional Leadership Governance and Framework Act states that government may provide a role for traditional leaders in respect of economic development. This study provides a model through which traditional leadership could be involved in LED. The model provides for a role to be played by the provincial House of Traditional Leaders, as part of LED policy formulation; a role for the local House of Traditional Leaders as part of LED strategy development; and for a Traditional Council, as part of LED implementation monitoring. Traditional ward’s headmen are envisaged as assisting in coordination and a ward committee, in which traditional leadership is represented, is envisaged as contributing towards evaluation. The study finally recommends that the Provincial Department of Economic Development and Tourism in collaboration with the Department of Cooperative Governance and Traditional Affairs should establish a fund for a LED programme for traditional communities. The study further recommends that the conceptualization of LED programmes should be done in consultation with traditional leadership, and that traditional leadership should lead the implementation of the programme in their respective areas. / Thesis (M.Com.)-University of KwaZulu-Natal, Westville, 2012.

The aim of this thesis is to undertake a theoretical analysis of the dynamics of change in pre-Ngāi Tahu and Ngāti Māmoe oral traditions of Te Waipounamu to gain a deeper understanding of their nature, function, evolution and meaning. For the purposes of this thesis a framework will be established to classify changes to encompass different types of alterations made pre-contact and post-contact to authentic and un-authentic oral traditions. This model will analyse the continuum of change and will be applied in later chapters to pre-Ngāi Tahu and Ngāti Māmoe traditions to gain an understanding of the dynamics, evolution and construction of the oral traditions of Te Waipounamu. This study of the morphology of tradition will demonstrate they were never fixed but evolved alongside their communities as they adapted to ensure tribal identity and mana was firmly entrenched in their local landscape. A major component of this thesis will be analysis of Waitaha traditions centring upon three key questions; firstly who were Waitaha peoples, secondly, where were they from, and thirdly, were they, and do they continue to be separate social units? This thesis will contribute to this discussion by analysing literature concerning pre-Ngāi Tahu and Ngāti Māmoe tribal identities to ascertain not just who they were and where they were from but how their identities have been constructed and modified over time. Analysis will examine the role of oral tradition in establishing tribal identity and how Waitaha traditions were changed both pre and post-contact to suit the cultural, political and ideological imperatives of the time, providing an insight into how our ancestors perceived, recollected and constructed the past to suit the needs of the present.
