<p> </p><p>I det föreliggande arbetet undersöks dels huruvida verkställigheten av domstolsbeslut gällande utvisning med återreseförbud omgärdas av några implementeringsproblem, dels av vilken karaktär dessa är och ur vad de är sprungna. Undersökningen, som är inom ramarna för det som brukar kallas policyanalys, sker med utgångspunkt i en teoretisk modell som tar hänsyn till tre olika typer av generella villkor som måste vara uppfyllda för att en lyckad implementering av ett överordnat beslut skall kunna sägas vara för handen. Studien bygger på en numerär genomgång av alla utvisningsärenden  som handlagts av Polismyndigheten i Västernorrlands län under en femårsperiod, samt på intervjuer med tillämpare på olika nivåer. Syftet med arbetet är att svara på frågorna: finns implementeringsproblem i den studerade kontexten? Om så är fallet, vilken karaktär har problemen och vad är det som gör att de uppstår?</p><p> </p>

Syftet med denna studie är att undersöka på vilket sätt migrationsrättens uppdrag att reglera invandring genom dombeslut förhåller sig till barnets bästa/barns mänskliga rättigheter. Därtill har barnets psykologiska påverkan av migrationsprocessen även undersökts. Detta genom en dokumentanalys i form av en kvalitativ innehållsanalys av domar och två reportageböcker. En rättssociologisk utgångspunkt har använts i studien och har innefattat både en innehållsanalys av materialet samt tolkning av lagtext. De teoretiska utgångspunkterna i arbetet har varit Cullbergs kristeori och medborgarskapsteorier. I resultatet presenteras de koder och teman som identifierats i innehållsanalysen av materialet. Koderna tid och kultur tematiseras som anpassning, rädsla tematiseras som skyddsskäl och vårdbehov tematiseras som exkludering. I analysen kopplas sedan resultatet samman från både domarna samt reportagen och det analyseras vidare. Det förs även en diskussion om metoden och teorierna i koppling till resultatet. Avslutningsvis poängteras studiens värde och implikationer för vidare forskning samt praktik. Studien visar på att barnets bästa i många fall blir sekundärt och att barn far illa i migrationsprocessen. Dessutom visar resultatet på vilka konsekvenser detta kan ha för barnet. Diskrepansen i Migrationsdomstolens uppdrag, barnets sårbarhet samt de negativa konsekvenserna av migrationsprocessen har synliggjorts i denna studie.

<p>The means that the Swedish State has to legitimize and standardize different perspectives of women and their sexuality is significant. Persecution of gender and sexuality is today something that can grant refugee status according to the Swedish Aliens Act. By studying the documents that forestall the amendment of the laws is it possible to unveil the concept and ideas about women sexuality that the state manifests and reproduces through these laws and official documents.</p><p>The aim of this essay is to look upon the sexual policy as it occurs in official the documents that deal with lesbian refugees. The study cover and maps present research on this group of women and gives an answer to how norms about women sexuality are expressed in these documents.</p><p>Throughout the survey of the research field not much previous research was found, therefore even research that only partly covers the field is included and reviewed.</p><p>As method a detailed reading of the official documents and a discourse analysis with it’s emphasize on theoretical themes like gender and sexuality, lesbianism and state feminism, was made. Lesbians are missing in the official state documents and the one time the Migration Board’s documents refer to lesbians they are ascribed to as gender and not as sexuality.</p><p>The essay concludes that the confusion about the category gender and the category sexuality has the result that the lesbians become invisible. Lesbians tend throughout the material to be ascribed to the category gender and gay men to the category sexuality.</p><p>The standardized perspective and normative discourse that has been found in the official documents has the effect that women is looked a pound as gender and therefore, by the same logic loose their sexuality. In this way the Swedish State discriminates lesbian.</p><p>Another conclusion is that the Swedish State has a somewhat ambivalence perspective on their own work on promoting gender equality.</p>
