A model of performance management for the parole boards in South Africa : a penological perspective

One of the fundamental objectives of the criminal justice system in any country is to punish, rehabilitate, deter, incapacitate and reintegrate offenders into communities. The main motive of punishment therefore is to transform criminals into responsible and law-abiding citizens. Parole is acknowledged as an internationally accepted mechanism that allows for the conditional release of offenders from correctional centres into the community and forms one of the most important components of the criminal justice system value chain. The release of the offenders on parole therefore, does not negate the objectives of punishment but entrenches them through setting conditions by which all parolees must abide by. In other words, all offenders released on parole are supervised at all times by parole officials within their communities to ensure that they comply with their conditions. It is for this function- to grant parole to offenders, that the parole boards have been established in different countries. The Department of Correctional Services in South Africa has adopted the independent model of parole which provides for the parole boards that are headed by independent members from the public appointed by the Minister of Correctional Services. Parole is administered by the parole boards and has, as one of its main functions the release of offenders based on their eligibility. The absence of the performance management system for the parole board makes parole board decision making less transparent and government accountability difficult to establish. Performance management systems have been used to strengthen good governance. The purpose of this study is to contribute to the design of a model of performance management of the parole boards in the Department of Correctional Services in South Africa. / Penology / D.Litt. et Phil. A survey on the extent and nature of poly-victimization of adolescents in Heideveld

The goal of the study was to conduct a survey on the extent and nature of poly-victimization of adolescents in Heideveld. This researcher used a quantitative approach, administering an altered form of the Juvenile Victimization Questionnaire to achieve the goal. This questionnaire had 34 screener items exploring victimization events across a broad range of possible victimization types. Convenience sampling of grade 8-10 learners was used from a school in Heideveld. Ninety-one respondents completed the questionnaire, the age range spread from 13 – 18 years of age. Descriptive statistics were used to analyse the results. Responses of respondents to victimization (directed either at themselves or a peer) were explored through open-ended questions. Content analysis was performed to describe the data collected. The results showed that the extent of poly-victimization of adolescents in Heideveld is high. The role of the department of correctional services in the rehabilitation of child molesters

This report is the result of a literature study and questionnaire which gave insight on the role of Department of Correctional Services in the rehabilitation of child molesters. Correctional Services has adopted a new approach, where offenders need to change their negative behavior and be rehabilitated. Corrections have a societal responsibility towards the community to guide the offender on his rehabilitation path. This study was conducted to give a better understanding of rehabilitation to child molesters. It seems that child molesters will re-offend if they are not included in a thorough treatment programme. The purpose of this research is to determine if the Department of Correctional Services delivers on its legal and social responsibility towards the rehabilitation of child molesters. It is evaluated against international benchmarks. In this study the researcher gathered information on the profile of a child molester, the programmes currently available in Correctional Services, and also the involvement of the community in this process. Corrections cannot work alone, and needs the help of the community and leaders in the community to assist it in this process. Correctional Services faces many challenges in order to succeed in the rehabilitation of offenders. Currently there is a shortage of social workers and psychologists in the Department of Correctional Services, and the Department cannot, therefore, fully succeed in its rehabilitative role. Another aspect is that treatment is voluntary, and offenders can decide if they want to become involved or not. Reflections on the legal and psychological constructions of women's resistance to sexual harassment

Despite the extensive research conducted on sexual harassment, very little work has focused on the legal and psychological constructions of women's resistance to sexual harassment. In exploring the legal and psychological constructions of women's resistance to sexual harassment, we are confronted with salient issues pertaining to the determination of the welcomeness requirement which call for a reflection. A key characteristic of sexual harassment is that it is unwanted by the recipient. It is for each person to decide what behaviour is acceptable to them and what they regard as offensive. Thus, although there is general agreement about what can constitute sexual harassment, the experience of sexual harassment is subjective in nature and the precise quantification of workplace sexual harassment is problematic. The present study aims to: (a) identify the reasoning/history behind the "unwelcomeness/unwanted" requirement, (b) assess the reasonableness of· the requirement of "unwelcomeness/unwanted" conduct, taking into account the various pieces of legislation and case law, (c) determine how the courts have interpreted this requirement and what factors are looked at, (d) determine whether the test is subjective or objective, (e) identify the struggle and debilitating effects sexual harassment has on women in the workplace. The results of this study will assist in gaining knowledge and understanding of the concept of "unwelcomeness/unwanted" conduct in sexual harassment cases and the effects it has on the victim which will go a long way in assisting management in any business to effectively implement strategies and disciplines to manage the problem of sexual harassment in the workplace. / Private Law / LLM (Labour Law)

My thesis deals with the problems of sexual abuse of children. It is divided into nine chapters, each of which has a subhead. In the first part, I focused on the term of child sexual abuse. In the second part, I focused on the problem of sexual abuse of children by family members. In the third part, I explained the term of commercial sexual violence committed against children. In the fourth part, I focused on the victims of sexual abuse and in the following part, I focused on the perpetrators. In the sixth part, I described the consequences of the abuse and in the seventh part, I described the therapy. I put a stress on the eighth part which deals with the sexual abuse prevention. The thesis ends with the ninth chapter where I described the moral crimes.

Příčinná souvislost v občanském právu / Causal nexus in civil law

The aim of this thesis is to provide an insight into the topic of causation in law and to acquaint its reader with the common methods of proving the causation before courts. Among the most used methods such as the 'but for' test, this paper focuses on specific aspects of this topic which were introduced to the Czech legal system together with the adoption of the Civil Code 2014. The thesis also includes description and analysis of alternatively used methods of proving 'multiple causation' cases such as the theory of 'loss of chance' and 'pure economic loss'. Among this analysis the comparison between Czech and British legal system is used extensively. The core of this thesis is the effort to confirm or to refute the hypothesis that despite the Czech legal system does not officially recognize distinction between 'factual causation' and 'legal causation' as it is done in the British legal system, methods from both categories are actively used by Czech courts. This paper also aims to analyze whether, due to the fact that recognition between 'factual causation' and 'legal causation' is not explicitly expressed in the Czech legal system, does exist any negative or positive impact on judicial decisions. L’attribution de la responsabilité d’un acte sexuel coercitif basée sur la présence de facteurs situationnels et la propension à indiquer qu’il devrait être divulgué à police selon un échantillon étudiant

Les mythes liés au viol sont des croyances et des perceptions erronées entourant le viol et ceux-ci peuvent avoir une influence sur l’attribution de la responsabilité à l’instigateur ou à la victime de l’acte sexuel coercitif. Des études dénotent des différences entre les hommes et les femmes quant à la présence de ces croyances et l’attribution de la responsabilité de l’acte sexuel et la divulgation policière. De plus, des études montrent que la consommation d’alcool, la consommation de drogue, le visionnement de pornographie et la verbalisation du non-consentement sont des facteurs situationnels qui ont un impact sur l’attribution de la responsabilité. L’objectif principal de cette étude est d’identifier s’il existe des différences au sein d’un échantillon d’étudiants masculins et féminins de l’Université de Montréal quant à leur attribution de la responsabilité d’une agression sexuelle et leur recours à la divulgation policière dans un contexte donné. Plus précisément, est-ce qu’ils interprètent différemment un scénario dans lequel il y a un acte sexuel non-consentant en présence de facteurs situationnels : consommation d’alcool, consommation de drogue, visionnement de pornographie et non-consentement verbal et non-verbal. Les résultats montrent qu’en général, les participants masculins attribuent plus souvent que les femmes une part de responsabilité de l’acte sexuel à la victime, tandis que les femmes attribuent plus de responsabilité à l’instigateur du comportement sexuel. La présence de croyances erronées liées au viol chez les participants est la caractéristique personnelle du participant qui aurait le plus d’influence sur l’attribution de la responsabilité de l’acte sexuel et qui prédirait le recourt ou non à la divulgation policière. / Rape myths are beliefs and misconceptions regarding rape that can have an influence on one’s attribution of responsibility towards the instigator or victim of a non-consenting sexual act. Some research has shown difference between men and women concerning their beliefs and attitudes towards rape and as well as their attribution of blame and tendency of reporting a rape case to police. Research has also shown that alcohol consumption, drug use, pornography consumption and non-consent are situational factors that influence attribution of responsibility in a rape case. The objective of this study is to examine differences in a group of male and female students from the University of Montréal in their attribution of responsibility and their propensity to report rape cases to police authorities in a given context. Specifically, this research will identify if the students interpret the rape scenarios differently when it involves alcohol or drug use, pornography consumption and non-consent. The results show that in general, the male participants attributed more often a part of the blame to the victim whereas the female participants attributed more blame towards the instigator of the sexual act. The presence of rape myths among the students is the factor that influences the most their attribution of responsibility of a sexual coercive behavior and their propensity or refusal to denunciate the situation to the police.

Analyse des liens entre l'action civile et l'action publique en droit iranien à la lumière de l'expérience française / Study of all legal manifestations of the links between public action and civil action as they exist in the iranian criminal law regarding to the french experience

L’action civile peut être exercée, au choix de la victime, soit devant les juridictions civiles soit devant les juridictions répressives (art. 15 et 16 CPPI). Quelle que soit la voie choisie, il existe d’importants liens entre l’action civile et l’action publique qui reflète une certaine dépendance de l’action civile à l’action publique. L’action civile exercée devant les juridictions répressives, principalement justifiée par le souci de simplifier et faciliter la procédure, est l’accessoire de l’action publique dans son existence, son exercice et son jugement. Lorsque l’action civile est exercée devant les juridictions civiles, les rapports entre ces deux actions se manifestent par deux règles complémentaires : le sursis à statuer et l’autorité de la chose jugée au pénal sur le civil (art. 227 CPCI et 18 CPPI). Principalement justifiées par le souci d’éviter des décisions contradictoires, ces règles obligent le juge civil à attendre la décision du juge pénal, et, ensuite, se conformer à cette décision. Cette recherche a étudiée toutes les manifestations juridiques des liens entre l’action publique et l’action civile telles qu’elles existent dans le droit positif iranien afin d’établir les conditions de la rationalisation de leur exercice à la lumière de l’expérience française. Cette étude propose donc des solutions afin de mettre fin aux effets indésirables de ces liens, surtout quant au principe d’autorité de la chose jugée au pénal sur le civil prévue expressément par l’article 18 du nouveau code de procédure pénale iranien 2015 / Civil action may be brought, by the option of the victim, to the civil courts or to the criminal courts (art. 15 and 16 CPPI). Regardless of the victim’choice, important links are created between the civil action and the public action. these links reflect a certain dependence of the civil action for public one. The civil action brought to the criminal courts is mainly justified by the need to simplify and facilitate the procedure. This action is such an incident to the public action in its existence, its practice and its judgment.When the civil action is brought to the civil courts, links between these two actions are manifested in two complementary rules : the stay of proceedings and the authority of res judicata on the civil criminal (art. 227 CPCI and 18 CPPI). These complementary rules are justified by the need to avoid conflicting decision. Therefore, they force the civil court to await the decision of the criminal court, and then comply with this decision. This thesis is a study of all legal manifestations of the links between public action and civil action as they exist in the Iranian criminal law regarding to the French experience in the matter. This study proposes solutios to end the negative effects of these links, especially on the principle of authority of res judicata on criminal civil expressly provide by the article 18 of the new Iranian criminal proceeding law

Réticences des Etats et érosion de la compétence de la Cour pénale internationale / Reluctances of states and erosion of the competence of the International Criminal Court

L’échec de l’impérativité du droit international pénal et la fragilité de la justice pénale internationale qui en résulte ne dépendent pas du choix normatif d’un modèle de juridiction, ad hoc ou conventionnel, mais simplement des défaillances et des réticences des États à l’égard de la norme choisie. Ce constat d’évidence trouve sa confirmation dans le processus de mise en place et de fonctionnement de la Cour pénale internationale, fâcheusement contournée à faire prévaloir sur la lutte contre l’impunité une lutte pour la « justiciabilité » des auteurs des crimes les plus graves qui heurtent la conscience de l’Humanité : crimes contre l’humanité, crime de génocide, crimes de guerre, crime d’agression. L’obstacle qu’elle doit essentiellement surmonter est en effet que sa compétence peut être délibérément mise en échec à tout moment, directement ou indirectement, par tout État avant tout soucieux de sa propre souveraineté, qu’il soit ou non partie au Statut de Rome. L’observation des stratégies étatiques montre d’une part que la faculté de renoncer à l’exercice de sa propre compétence répressive se traduit par une négation de l’impérativité des engagements souscrits auparavant, certains Etats se désolidarisent de la répression dont ils se sont désistés. D’autre part, et à l’inverse, l’exercice légitime de sa compétence répressive par un Etat peut très facilement lui permettre de glisser vers une obstruction chronique de la juridiction internationale, voire ou déni du droit impératif qui la régit. En l’absence d’une réelle reconnaissance de la juridiction internationale, les conséquences de telles attitudes sont d’une ampleur qui dépasse l’imagination. Seul un comportement coopératif et constructif, affranchi des compromis égoïstes et opportunistes des États, pourrait parer au risque actuel d’une érosion progressive de l’architecture punitive partagée mise en place par les États eux-mêmes lors de la création de la Cour pénale internationale et ainsi de garantir que soient punis à coup sûr les auteurs de crimes insupportables. / The failure to make international criminal law imperative and the resulting fragility of international criminal justice should not be understood as the consequence of a normative choice toward a jurisdictional model, be it ad hoc or conventional. Rather, it derives from the State's weaknesses and reluctance to abide by the chosen norm. This is clearly confirmed by the very way the International Criminal Court was implemented, functions and is being sadly circumvented. Instead of bolstering the fight against impunity, it focuses on the fight for the “justiciability” of the perpetrators of the most serious crimes, resulting in subsequent negative effects on Humanity’s consciousness: crimes against humanity, crime of genocide, war crimes and crime of aggression. Owing to the fact that a State's primary concern is its own sovereignty, the biggest obstacle the Court has to overcome remains that at any moment, directly or indirectly, its competence can be intentionally overruled by any State, signatory or not of the Treaty of Rome. Observing State strategies shows that relinquishing one’s repressive authority is generally seen through a negation of formerly made commitments: some States dissociate from the repression monopoly they disclaim. Conversely, the legitimate exercise of a State’s repressive authority can easily result in regular obstruction of international jurisdiction, and even the refusal of the imperative law that governs it. Without any genuine recognition of international jurisdiction, such attitudes have undeniable serious consequences that far outreach the imagination. The only solution is cooperative and constructive behavior, free of opportunistic and selfish compromises of States. This behavior could protect against the current risk of the progressive erosion regarding shared punitive organization which States themselves implemented through the creation of the International Criminal Court. The result would guarantee the punishment of perpetrators of unbearable crimes.
