This study is an endeavour to demonstrate the applicability of constructivist epistemology in different contexts. The black family is presented as one of such contexts. The study is further a demonstration of the role of a symptom as part of a recursive process of interaction in the context of a black family. It reflects an orientation rooted in cybernetics, ecology and systems theory. Therapy is presented as a context through which the therapist becomes incorporated and, therefore, adopting and speaking the language of the family's particular form of symptomatic communication in order to engender change.
A literature study presenting a conceptual framework is presented. A case study presenting the research data is presented. Transcripts from video-taped sessions with the family are presented in the addendum.

The theoretical and methodological assumptions of this
research imply a move away from a positivist empiricist
approach with its reliance on the real, the measurable and the
predictable towards an interactive and collaborative
methodology situated in a constructivist and social
epistemology.
This thesis comprises a recursive intervention in the
researching therapist's life. The author sets out on a voyage
of self-research to investigate her "choreography of coexistence"
(Maturana & Varela, 1987, p.248), due to curiosity about personal and professional impact. The purpose is to
create a map of relational modes that in itself creates shifts:
in the therapist.
This invention-orientated research creates the context of
the researcher and moves through processes: the writing of
autobiography, detailed contextual description, the
interpreting of feedback, and deconstruction. The contents
that pour forth are many different narratives tracking the
evolvement of the self in the original family, through further
definition in new relationships and the expansion of roles in
many professional systems both with clients and colleagues.
" Extracts from conversations provide new perspectives and
feedback about impact. Thus a continual 'provoking of voices'
becomes a thesis theme that highlights the researcher's
structure, organisation and interpersonal processes.
An emancipatory and developmental process is documented
through the researching therapist's positioning as actor,
observer and then critic in relationship to the data.
Patterns and themes emerge that facilitate both self-
differentiation and connectedness and many new head-heart
connections. This new knowledge could enable the
professional's skilful and intuitive use of self.
The self comes into being as it reflects itself, ·so a
recursive process evolves where looking at the self operates
on the products of its own operations. This is an active
process, where the researching therapist constructs an
experiential reality. Given the accountability that accrues
from constructing such a reality, a focus on pragmatic,
aesthetic and ethical criteria is incorporated.
This research, like the practice of therapy, is a
departure from attempts to demonstrate what is already known

Princip komplementarity ve fyzice a jeho role při přípravě odborníků v oblasti ochrany obyvatelstva / Complementarity principle in Physics and its role at experts preparation in the area of population protectionČECH, František January 2018 (has links)
This diploma thesis on the application of logical, empirical and statistical methods defined the role of the complementarity principle in the preparation of experts in the field of the protection of population in the framework of a quantitative research. The complementarity principle is characterized in the thesis in general (working with two expressions, both of them are necessary to explain the nature of the problem but cannot be used simultaneously, e.g. expressions "analysis" and "synthesis"). The diploma thesis then defined the physical aspect of the complementarity principle the wave-corpuscular dualism, the position and the momentum, the energy and the time. The comparison of the basics of the protection of population with the structure of the physical aspect of the complementarity principle followed. The performed comparison was adjusted to the needs and possibilities of future experts in the field of the protection of population on the basis of the theory of the curriculum process. The steps are clear from the set of objectives which were fulfilled gradually in the thesis: 1) To systematically describe the general form of the complementarity principle and its physical application from the point of view of the theory of the curriculum process. 2) To create a structure of the system of emergencies from the point of view of a scientific field of the protection of population and to focus on its educational aspect for the preparation of experts. 3) To perform the comparison of the physical aspect and emergencies with the general form of the complementarity principle. To transfer the findings, a theory of curriculum process was used. The link between a more generally approached complementarity principle and the protection of population was explained in the framework of a conceptual curriculum. The theory connecting these two different fields is the more generally approached complementarity principle and especially Bohr's complementarity principle linking not only the wave-corpuscular dualism but also Heisenberg's uncertainty principle. The physical aspect of emergencies was adjusted to the possibilities and needs of students (the intended curriculum) and written down in an educational text which was provided to students (the project curriculum). The practicality of the educational test was verified by an educational test the results of which were statistically processed (implemented curriculum). The statistical analysis of the test results confirmed the second hypothesis of this work. "The knowledge of future experts in the field of the protection of population will have, from the point of view of the role of the complementarity principle in their preparation, a theoretical division which will be close to the normal division." By confirming this hypothesis, the correctness and applicability of the curriculum process were confirmed as it was assumed by the first hypothesis: "Using the stages of a curriculum process, an educational basis of the role of the complementarity principle can be created within a quantitative research." The contributions of this work can be summarized by following points: 1) The use of an educational text in the preparation of experts in the field of the protection of population (a practical contribution of this diploma thesis). 2) The improvement of the applicability of the theory of the curriculum process in the field of the protection of population which has not been researched so far (the improvement of the theory of the curriculum process). 3) The definition of the link of the physical aspect of the complementarity principle to the general form of this principle (the theoretical contribution of this diploma thesis).

La recherche d’images par contenu (CBIR) est une discipline de l’informatique qui vise à structurer automatiquement les collections d’images selon des critères visuels. Les fonctionnalités proposées couvrent notamment l’accès efficace aux images dans une grande base de données d’images ou l’identification de leur contenu par des outils de détection et de reconnaissance d’objets. Ils ont un impact sur une large gamme de domaines qui manipulent ce genre de données, telles que le multimedia, la culture, la sécurité, la santé, la recherche scientifique, etc.Indexer une image à partir de son contenu visuel nécessite d’abord de produire un résumé visuel de ce contenu pour un usage donné, qui sera l’index de cette image dans la collection. En matière de descripteurs d’images, la littérature est désormais trés riche: plusieurs familles de descripteurs existent, et dans chaque famille de nombreuses approches cohabitent. Bon nombre de descripteurs ne décrivant pas la même information et n’ayant pas les mêmes propriétés d’invariance, il peut être pertinent de les combiner de manière à mieux décrire le contenu de l’image. Cette combinaison peut être mise en oeuvre de différentes manières, selon les descripteurs considérés et le but recherché. Dans cette thése, nous nous concentrons sur la famille des descripteurs locaux, avec pour application la recherche d’images ou d’objets par l’exemple dans une collection d’images. Leurs bonnes propriétés les rendent très populaires pour la recherche, la reconnaissance et la catégorisation d'objets et de scènes. Deux directions de recherche sont étudiées:Combinaison de caractéristiques pour la recherche d’images par l’exemple: Le coeur de la thèse repose sur la proposition d’un modèle pour combiner des descripteurs de bas niveau et génériques afin d’obtenir un descripteur plus riche et adapté à un cas d’utilisation donné tout en conservant la généricité afin d’indexer différents types de contenus visuels. L’application considérée étant la recherche par l’exemple, une autre difficulté majeure est la complexité de la proposition, qui doit correspondre à des temps de récupération réduits, même avec de grands ensembles de données. Pour atteindre ces objectifs, nous proposons une approche basée sur la fusion d'index inversés, ce qui permet de mieux représenter le contenu tout en étant associé à une méthode d’accès efficace.Complémentarité des descripteurs: Nous nous concentrons sur l’évaluation de la complémentarité des descripteurs locaux existant en proposant des critères statistiques d’analyse de leur répartition spatiale dans l'image. Ce travail permet de mettre en évidence une synergie entre certaines de ces techniques lorsqu’elles sont jugées suffisamment complémentaires. Les critères spatiaux sont exploités dans un modèle de prédiction à base de régression linéaire, qui a l'avantage de permettre la sélection de combinaisons de descripteurs optimale pour la base considérée mais surtout pour chaque image de cette base. L'approche est évaluée avec le moteur de recherche multi-index, où il montre sa pertinence et met aussi en lumière le fait que la combinaison optimale de descripteurs peut varier d'une image à l'autre.En outre, nous exploitons les deux propositions précédentes pour traiter le problème de la recherche d'images inter-domaines, correspondant notamment à des vues multi-source et multi-date. Deux applications sont explorées dans cette thèse. La recherche d’images inter-domaines est appliquée aux collections photographiques culturelles numérisées d’un musée, où elle démontre son efficacité pour l’exploration et la valorisation de ces contenus à différents niveaux, depuis leur archivage jusqu’à leur exposition ou ex situ. Ensuite, nous explorons l’application de la localisation basée image entre domaines, où la pose d’une image est estimée à partir d’images géoréférencées, en retrouvant des images géolocalisées visuellement similaires à la requête / Content-Based Image Retrieval (CBIR) is a discipline of Computer Science which aims at automatically structuring image collections according to some visual criteria. The offered functionalities include the efficient access to images in a large database of images, or the identification of their content through object detection and recognition tools. They impact a large range of fields which manipulate this kind of data, such as multimedia, culture, security, health, scientific research, etc.To index an image from its visual content first requires producing a visual summary of this content for a given use, which will be the index of this image in the database. From now on, the literature on image descriptors is very rich; several families of descriptors exist and in each family, a lot of approaches live together. Many descriptors do not describe the same information and do not have the same properties. Therefore it is relevant to combine some of them to better describe the image content. The combination can be implemented differently according to the involved descriptors and to the application. In this thesis, we focus on the family of local descriptors, with application to image and object retrieval by example in a collection of images. Their nice properties make them very popular for retrieval, recognition and categorization of objects and scenes. Two directions of research are investigated:Feature combination applied to query-by-example image retrieval: the core of the thesis rests on the proposal of a model for combining low-level and generic descriptors in order to obtain a descriptor richer and adapted to a given use case while maintaining genericity in order to be able to index different types of visual contents. The considered application being query-by-example, another major difficulty is the complexity of the proposal, which has to meet with reduced retrieval times, even with large datasets. To meet these goals, we propose an approach based on the fusion of inverted indices, which allows to represent the content better while being associated with an efficient access method.Complementarity of the descriptors: We focus on the evaluation of the complementarity of existing local descriptors by proposing statistical criteria of analysis of their spatial distribution. This work allows highlighting a synergy between some of these techniques when judged sufficiently complementary. The spatial criteria are employed within a regression-based prediction model which has the advantage of selecting the suitable feature combinations globally for a dataset but most importantly for each image. The approach is evaluated within the fusion of inverted indices search engine, where it shows its relevance and also highlights that the optimal combination of features may vary from an image to another.Additionally, we exploit the previous two proposals to address the problem of cross-domain image retrieval, where the images are matched across different domains, including multi-source and multi-date contents. Two applications of cross-domain matching are explored. First, cross-domain image retrieval is applied to the digitized cultural photographic collections of a museum, where it demonstrates its effectiveness for the exploration and promotion of these contents at different levels from their archiving up to their exhibition in or ex-situ. Second, we explore the application of cross-domain image localization, where the pose of a landmark is estimated by retrieving visually similar geo-referenced images to the query images

O mercado de carne de frango brasileiro no contexto dos novos acordos regionais de comércio: Transpacífico e Transatlântico / The brazilian chicken meat market in the context of the new regional trade agreements: Trans-pacific and TransatlanticMedeiros, Angélica Pott 31 January 2017 (has links)
The developed countries, heavily impacted by the economic and financial crisis of 2008, signaled the recovery with negotiations on two major international trade agreements, The Trans-Pacific Partnership and the Transatlantic Trade and Investment Partnership (TPP and TTIP, respectively). The establishment of trade agreements may minimize the effects of protectionist policies of countries/blocks, eliminating or reducing existing barriers, thus stimulating the increase in trade among member countries of such agreements. The TPP and TTIP imply the reduction of tariffs and non-tariff barriers between member countries, the United States case. Thus, competition with Brazil will tend to increase in many products, case of the chicken meat, in which the United States occupies the first position in world production, while Brazil positions itself as the largest exporter of the commodity. From this new trade matrix, the present study aims to examine the possible impacts of the Transpacific and Transatlantic agreements on the Brazilian chicken meat market. The methodology derives from a Spatial Equilibrium Model as a Mixed Complementarity Problem (MCP), based on five alternative scenarios, which aimed to highlight possible changes in the market of chicken meat from the implementation of new trade agreements. The first scenario simulates the formation of the TPP with the reduction of tariff barriers, while the second scenario presupposes the elimination of tariff and non-tariff barriers. Regarding the TTIP, scenarios 3 and 4, it is assumed the reduction of tariff barriers as well as the elimination of tariff barriers and technical constraints; in the fifth scenario was considered the simultaneous occurrence of the two agreements, through the elimination of tariff and non-tariff barriers. The results indicate that, in general, with the implementation of both agreements the Brazilian chicken meat market may invariably bring losses, particularly in relation to production, consequently, affecting producers' prices and surpluses. The most damaging scenarios for Brazil are the formation of the TPP in its broadest form, based on the elimination of tariff and non-tariff barriers, as well as the simultaneous formation of the agreements, in which the country show a net loss in welfare. From this, we emphasize the importance of negotiating trade agreements to ensure the industry conditions of expansion and access to new markets, As well as greater rigor in matters related to animal health, inspection and certification, aspects of a technical nature that have great potential to distort trade flows internationally. / Os países desenvolvidos, fortemente impactados pela crise econômica e financeira de 2008, sinalizaram a recuperação a partir de negociações de dois grandes acordos no comércio internacional, a Parceria Transpacífico e a Parceria Transatlântica de Comércio e Investimento (TPP e TTIP, respectivamente). A constituição de acordos comerciais possivelmente minimizam os efeitos das políticas protecionistas dos países/blocos, eliminando ou reduzindo as barreiras existentes, estimulando assim o aumento do comércio entre os países-membros de tais acordos. O TPP e o TTIP implicarão na redução de tarifas e barreiras não tarifárias entre os países-membros, caso dos Estados Unidos. Assim, a concorrência com o Brasil tenderá a aumentar, em muitos produtos, caso da carne de frango, no qual o país norte-americano ocupa a primeira posição na produção mundial, enquanto que o Brasil posiciona-se como maior exportador da commodity. A partir desta nova matriz de comércio, o presente estudo tem por objetivo examinar os possíveis impactos da implementação dos acordos Transpacífico e Transatlântico sobre o mercado de carne de frango brasileiro. A metodologia deriva de um Modelo de Equilíbrio Espacial na forma de um Problema de Complementaridade Mista (PCM), baseando em cinco cenários alternativos, cujo objetivo foi evidenciar possíveis mudanças no mercado da carne de frango decorrentes da implementação de novos acordos comerciais. O primeiro cenário simula a formação do TPP a partir da redução das barreiras tarifárias, já o segundo cenário pressupõe a eliminação das barreiras tarifarias e não tarifárias. Em relação ao TTIP, cenários 3 e 4, pressupõe-se a redução das barreiras tarifarias como também a eliminação das barreiras tarifárias e restrições técnicas; num quinto cenário considerou-se a ocorrência simultânea dos dois acordos, por meio da eliminação das barreiras tarifárias e não tarifárias. Os resultados indicam que, de maneira geral, com a efetivação de ambos os acordos o setor de carne de frango brasileiro, pode invariavelmente trazer prejuízos, principalmente no que se refere à produção e, em consequência, afetando os preços e os excedentes dos produtores. Os cenários mais prejudiciais ao Brasil consistem na formação do TPP em sua forma mais ampla, baseando-se na eliminação das barreiras tarifárias e não tarifarias, como também na formação simultânea dos acordos, nos quais o país apresenta perda líquida de bem estar. A partir disso, ressalta-se a importância da negociação de acordos comerciais para garantir ao setor condições de expansão e acesso a novos mercados, assim como maior rigor nas questões relacionadas à saúde animal, fiscalização e certificação, aspectos de natureza técnica que tem grande potencial de distorção dos fluxos de comércio internacionalmente.

Introduite dans le Code de procédure pénale par la loi n° 2014-896 du 15 août 2014 relative à l'individualisation des peines et renforçant l'efficacité des sanctions pénales, à l'article 10-1, la justice restaurative rejoint désormais l'ensemble des réponses socio-pénales que le système de justice pénale français peut mobiliser pour répondre aux conséquences et aux répercussions du phénomène criminel. Depuis le 1er octobre 2014, date d'entrée en vigueur de l'article 10-1 du Code de procédure pénale, toute personne victime ou auteur d'une infraction pénale peut se voir proposer une mesure de justice restaurative, dans toute procédure pénale et à tous les stades de la procédure. Insérée dans le titre préliminaire du Code de procédure pénale, dans un sous-titre II "De la justice restaurative", la possibilité d'un tel recours à une mesure de justice restaurative prend place parmi les grands principes qui irriguent la procédure pénale et montre l'ambition du législateur en faveur de la justice restaurative présentée comme une des réponses à la crise que traverse le système de justice pénale actuel. Toutefois, au-delà de cette seule possibilité, se pose la question de la place que la justice restaurative peut occuper au sein de ce système, en particulier en ce qui concerne son institutionnalisation concrète et pratique. La démonstration de la forte complémentarité existant entre justice restaurative et justice pénale, au service d'un système de justice pénale répondant pleinement aux attentes des justiciables, ouvre la voie à une application conjointe de mesures de justice issues spécifiquement des deux modèles de justice. Il peut en résulter un système reposant sur une application conjointe de mesure de justice restaurative et de justice pénale et permettant un traitement différentiel, à la fois du conflit de nature infractionnelle et des attentes criminologiques et juridiques des personnes concernées. Cette approche, mise en perspective avec les initiatives naissantes de programmes en France, présente l'avantage de ne pas nécessiter d'importantes modifications du système de justice pénale. Elle consiste en la construction d'une offre locale de justice restaurative, complète et disponible, structurée par des organismes de coordination du partenariat sur lequel elle repose. Elle se manifeste actuellement, tant à l'échelon local, à travers la création de Services régionaux de justice restaurative (SRJR), qu'à l'échelon national, à travers les actions de l'Institut Français pour la Justice Restaurative (IFJR), aux côtés des principales fédérations et administrations concernées. / The law n° 2014-896 of August 15th 2014 on “Individualization of penalties and for strengthening the effectiveness of criminal sanctions” introduced in the Criminal Procedure Code restorative justice. From now on, it belongs to the socio-criminal responses proposed by the French criminal justice system to respond to the consequences and impact of the criminal phenomenon. Since October 1th 2014, the date of entry into force of the law, a “restorative justice measure” may be proposed to any victim or offender during every criminal procedure and at all stages of the proceedings. Inserted in the preliminary title of the Code of Criminal Procedure, subtitle II, entitled "About restorative justice", the possibility of such recourse to a restorative justice measure takes place among the great principles that define the criminal procedure and shows the French legislator ambition for restorative justice, which is presented as a possible answer to the criminal justice system current crisis. However, it raises the question of the place of restorative justice in this system, especially with regard to its concrete and practical institutionalization. The demonstration of the strong complementarity between restorative justice and criminal justice to create a criminal justice system that fully meets the expectations of victims and offenders pleads in favour of a joint implementation of legal measures from these two models of justice. This can lead to a system, based on a joint application of restorative justice and criminal justice, and permitting differential treatment, both of the criminal conflict and of the criminological and legal needs of individuals. This approach, put into perspective with the emerging program initiatives in France, has the advantage of not requiring major changes to the criminal justice system. It involves the construction of a local offer of restorative justice, complete and fully available, structured by coordinating bodies from the parternership the offer is based on.. This approach is currently visible at the local level, through the creation of Restorative Justice Regional Services (SRJR), as at the national level, through the actions of the French Institute for Restorative Justice (IFJR), with the main federations and administrations.

Financial and banking development : the case of Vietnam / Le développement bancaire et financier : le cas du VietnamThan Nguyen, Vinh Hao 18 January 2017 (has links)
Le développement bancaire et financier au Vietnam fait face à de nouvelles conjonctures économiques. Il serait utile d'analyser ce développement dans de nouvelles conditions d'intégration imposées par les normes internationales. La thèse vise à soutenir deux idées : (1) le développement de la relation entre les banques commerciales et les entreprises non publiques, particulièrement les PME, qui résulte des changements de la structure économique du Vietnam - un pays en transition vers l'économie de marché et (2) la micro-finance qui est une innovation permettant une plus grande performance des institutions bancaires et financières vis-à-vis des imperfections du marché ainsi que la réduction de la pauvreté et la pratique de l'usure, dans les zones rurales en particulier.Les grilles théoriques se réfèrent principalement à la théorie néo-institutionnaliste de D.North, à celle du développement financier de King et Lévine, aussi bien qu'à la théorie des complémentarités institutionnelles de Hall & Soskice, et à celle des conventions de Boyer &Orléan. Parmi les principaux résultats que nous avons obtenus, le premier réside dans le résultat positif de la relation entre banques commerciales et les entreprises non-publiques, les PME en particulier. Les banques commerciales contribuent à dynamiser le secteur privé en allouant des crédits et sélectionnant des projets d'investissement et, par conséquent,deviennent un acteur économique important capable de réduire le chômage, promouvoir les affaires et dans une certaine mesure, orienter le développement industriel. A leur tour, les entreprises non-publiques deviennent des clients cibles des banques commerciales et contribuent à créer une nouvelle forme de demande de crédit, de projets d'investissement, du marché du travail, de changements de stratégies d'entreprise et d'évolution des cadres juridiques allant dans le sens facilitant les activités du secteur privé.Le second résultat confirme la corrélation entre le développement économique et le développement bancaire et financier. Le résultat est soutenu par une recherche empirique basée sur une analyse factorielle à partir des données de CEPII 2012. Nous avons réussi à dessiner une carte globale des systèmes bancaires et financiers et localiser la position du Vietnam. Nous observons que le Vietnam se situe dans la zone des pays en émergence, mais à la périphérie, loin des pays développés. Ceci implique qu'il serait utile de se déplacer vers la zone des pays à développement bancaire et financier avancé. Le troisième se trouve dans le résultat positif du rôle de la micro-finance. Cette pratique s'avère efficace dans la réduction de la pauvreté et l'empêchement de l'usure, en particulier dans les régions rurales. Cependant, l'accès au crédit n'est pas facile pour les populations défavorisées à cause de la communication, des spécificités culturelles, du niveau d'éducation,de l'expansion des réseaux ... La micro-finance constitue une innovation permettant de résoudre les problèmes d'asymétrie d'information et d'aléa moral, grâce au contrôle croisé des informations et à la responsabilité réciproque. Cette pratique apporte des preuves du mécanisme d'auto-renforcement prévu par la théorie des conventions, dans le cas de la micro-finance pour les pauvres. En conclusion, le Vietnam, en transition vers une économie de marché, se caractérise par un double changement institutionnel. D'une part, le changement de relation entre les banques commerciales et les entreprises non-publiques, en particulier les PME. Le pays s'oriente vers un secteur privé dont le rôle devient de plus en plus important pour s'adapter à la nouvelle structure économique. D'autre part, l'invasion de la micro-finance devient une alternative efficace pour répondre aux imperfections du marché du système bancaire et financier formel. / The financial and banking development in Vietnam has recently known new challenging economic circumstances. It is useful to analyze this matter to deal with new conditions imposed by the integration process in international norms. This dissertation is devoted to defend two ideas: (1) the development of the relationship between commercial banks and NSOEs, especially SMEs, is a result of change of economic structure of Vietnam, a country intransition, on its way towards a fully market-based economy and (2) micro-finance is a form of innovation making financial-banking institutions more performing in response to market failures as well as in impeding usury and poverty alleviation, especially in rural areas.With different theoretical frameworks mainly based on new-institutionalist vision of D. North, financial development of King and Levine, institutional complementaries of Hall & Soskice, convention theory of Boyer & Orléan, we have had some key findings as following. The first key finding resides in the positive result of the relationship between commercial banks and NSOEs, especially SMEs, in the way that commercial banks contribute to dynamize the private sector by allocating loans and investment selection. Therefore, commercial banks become an important economic agent being able to reduce unemployment, promote businesses and orientate somehow industry development. In its turns, NSOEs, while become target customers of banks, contribute to shape credit demand, project investment, labor market, business strategy changes and legal evolution in the way of facilitating the privatesector.The second finding confirms that the correlation between economic development and financial-banking development does exist. It was proved by empirical study based on a factor analysis from CEPII 2012 databse. We was successful to draw a map and localize precisely the position of Vietnam in the financial-banking world map. And, we saw that Vietnam was located in areas of emerging countries, but merely in peripheral zone far away from developed countries. This suggests an implication that it would be useful to move closer to highly developed countries in the financial and banking sector.The third key finding resides in the positive result that microfinance is proved efficient in poverty alleviation and impeding usury, especially in rural areas; but the accessibility to credit is not easy for poor people due to communication, cultural characteristics, education level, extension of network ... Microfinance is a form of innovation in the way that information asymmetry and moral hazard are well resolved thanks to cross-screening and joint-liability. Micro-finance in Vietnam shows evidence of the process of self-reinforcing mechanism of the convention theory, for the case of micro-finance for the poor. We conclude that on its way to a fully market-based economy, Vietnam in transition is characterized by a double institutional move: on the one hand, the change in relationship between commercial banks and NSOEs, especially SMEs, is moving towards a more important role of the private sector in response to new economic structure; on the other hand, micro-finance invasion becomes an efficient alternative to remedy to market failures of theformal financial and banking system.

La réparation des dommages environnementaux en droit international concerne le droit international public et le droit international privé. Considérant qu’une réparation efficiente des dommages environnementaux est difficilement réalisable par le seul biais du droit international public, la méthode du droit international privé contribue à une meilleure réparation des dommages. La limite du droit international public est liée à la difficulté d’harmoniser les règles matérielles environnementales dans les cadres nationaux, régionaux et internationaux. Une autre raison est le faible contrôle du déplacement des entreprises ainsi que la difficulté de les rendre responsables pour les dommages environnementaux commis. Le droit international de l’environnement nécessite un ensemble d’outils juridiques, publics et privés, ayant comme objectif la protection de l’environnement. Les outils publics comme les traités et les mécanismes de surveillance institutionnalisés doivent opérer en complémentarité avec les outils privés comme la responsabilité civile et l’arbitrage privé. L’utilisation du droit international privé permet d’organiser un ensemble de normes appartenant à différents espaces juridiques. Cette méthode permet l’utilisation, dans un Etat, de mesures juridiques prévues dans le système juridique d’un autre État sans qu’une uniformité ne soit exigée. Le droit international privé, par le biais d’une fonction environnementale accordée aux règles de conflit de lois et de juridictions, conduit à une meilleure interaction entre les espaces normatifs et entre les différentes branches du droit, ce qui favorise une coopération plus efficace pour la protection de l’environnement. / The reparation of environmental damages in international law concerns public and private international law. Due to the fact that efficient reparation of environmental damages is hardly achieved only by public international law, private international law methods can be used to fill the gaps of the former law field. Public international law limits are related to the difficulty of harmonising substantial environmental rules on national, regional and international context. Another reason is that it is hard to control company’s international movements and to hold them liable for damages committed. International environmental law depends on some public and private legal instruments in order to protect the environment. Public instruments such as treaties and Secretariats' mechanisms of control must work jointly with private instruments such as liability and arbitration. Private international law application is useful to organise rules from different legal orders. This methode enables the use of legal measures of one State in another State without looking for uniformity. Private international law, by the environmental function of conflict of laws and conflict of jurisdictions rules, paves the way towards a better interaction between different normative orders and between different law fields. It leads to a more effective cooperation for environmental protection.

Art in the public realm and the politics of rural leisure : access and environmentMurdin, Alex January 2015 (has links)
Exploring both political aesthetics and the politics of aesthetics to outline an environmental ruralism for art in public spaces, this practice lead research project postulates a “complemental practice”, outlining its methodology and contexts for operation, the rural, spaces of leisure and the public realm. It is a response to threats to spatial and environmental commons from heritage, place-making and nostalgia, psychological inhibition such as a sense of global contingency and widespread economic exploitation. Responses by artists to this situation can be characterised as a binary of dialogism (Kester, 2004) and relational antagonism (Bishop, 2004), i.e. consensual/collaborative or antagonistic/autonomous practices. Informing both is the work of Jacques Rancière who theorises an ethical and social turn in the arts. Through both commissioned and self-initiated projects this thesis offers an interpretation of Jacques Rancière’s conception of dissensus (Rancière, 2010) modulated through an application of the work of philosopher Slajov Žižek on environmental politics and complementarity - the inscription of the universal within the particular (Žižek, 2011). The thesis’ originality lies in this theoretical synthesis which sets out a complemental practice based on dissensus and the undecidability of subject and context, but which dismisses any inflexible schema of either aesthetic autonomy or ethico-political egalitarianism. In addition it suggests an approach to practice in this field and a situation for this - a dissensual infrastructure for the common public realm which is socially relational and evolutionary over time.

Impact of tree species diversity on water and carbon relations in European forests / Impact de la diversité en espèces d'arbres sur les relations hydriques et carbonées dans les forêts européennesGrossiord, Charlotte 02 October 2014 (has links)
La biodiversité favorise un grand nombre de fonctions et services écosystémiques des écosystèmes forestiers tels que la production de bois ou la résistance aux attaques d’insectes et aux maladies. Cependant l’impact de la diversité sur l’acquisition et l’utilisation de l’eau et du carbone reste largement méconnu dans ces écosystèmes. De plus, dans le contexte actuel de changement climatique, l’influence de la diversité sur la réponse des écosystèmes forestiers à des événements climatiques extrêmes tels que la sécheresse reste à étudier. L’objectif de ce travail est donc de déterminer l’impact de la diversité en espèces d’arbre sur d’importantes fonctions du cycle de l’eau et du carbone telles que la transpiration, la composition isotopique du carbone ou la profondeur d’extraction de l’eau à l’échelle de l’arbre et de l’écosystème sous des conditions contrastées dedisponibilité en eau du sol. Ce travail a été réalisé dans le cadre du projet FunDivEUROPE sur un réseau de parcelles forestières ainsi que dans des plantations expérimentales le long d’un gradient Nord-Sud en Europe afin de couvrir une importante gamme de conditions climatiques. Nos travaux ont montré une importante variabilité de la réponse à la diversité à l’échelle de l’arbre et de l’écosystème en termes de relations hydriques et carbonées à travers l’Europe. La diversité en espèces ne semble pas influencer les relations hydriques et carbonées des espèces et des écosystèmes forestiers dans des conditions non limitantes de disponibilité en eau. Cependant, un fort effet de la diversité a été observé en conditions de sécheresse pour certains types forestiers. A partir de ces résultats, je discute des mécanismes d’interaction entre espèces qui peuvent expliquer les effets observés. Nos données ont montré que l’influence de la diversité en espèces est fortement dépendante du contexte et peut êtremodifiée par les conditions environnementales locales et les conditions climatiques. En terme de gestion forestière, je suggère que pour certaines régions en Europe, promouvoir la diversité en espèces ainsi que contrôler la densité des parcelles doit être recommandé afin d’adapter les écosystèmes forestiers aux futures conditions climatiques / Biodiversity is known to support and boost a wide range of forest ecosystem functions and services like productivity and resistance against insect pests and diseases. However, whether tree species diversity also promotes water and carbon acquisition and use in forest ecosystems is still unclear. Furthermore, in the current context of global warming, information on how tree species diversity can influence the response of forest ecosystems to extreme climatic events such as drought are urgently needed. In this framework, the objective of my PhD thesis was to determine how tree species diversity influences important functions of the water and carbon cycle including transpiration, carbon isotope composition and water extraction depth at the tree- and ecosystem-Scale under contrasting soil water conditions. My work was conducted within the FunDivEUROPE project in a network of permanent forest stands and tree plantations across a North-South gradient in Europecovering a wide range of climatic conditions. I found considerable variability among species or forest types in the response of transpiration and carbon isotope composition at the tree- and ecosystem-Scale across Europe. Species diversity did not affect the water and carbon relations of tree species and forest ecosystems under non-Limiting soil water conditions. However, a strong effect of species diversity was observed under drought conditions in some forest types. Based on these data, I discuss the potential mechanisms of species interactions that may explain the observed patterns. I also point out that the influence of species diversity is highly context-Dependent, and changes with local environmental and climatic conditions. In terms of forest management applications, I suggest that, at least in some regions, controlling for tree species diversity along with stand density and total basal area could be recommended to help forests adapt to drier conditions
