Horizontal equity in the taxation of the income of individuals in the Republic of South Africa subsequent to the submission of the Margo report

The purpose of this research was to determine whether horizontal equity in the taxation of individuals in South Africa improved after the legislative changes from 1984 to 1995 and the Katz Commission recommendations. After an extensive literature study, horizontal equity in the taxation of individuals in South Africa was defined as the equivalent tax treatment in equivalent economic circumstances for the same economic units. The household as the economic unit, is the unit to be considered when evaluating horizontal equity. The study also reviewed the solutions found in other countries for the dilemma of the one-breadwinner versus the two-breadwinner married couple. It was found that the tax systems of most countries provide relief to the one-breadwinner couple while the working wife was taxed separately from her husband or had the option to be taxed separately. An important part of this study compared the tax of the unmarried taxpayer and the married couple as the units for horizontal equity. It was found that, although two-breadwinner married couples were discriminated against until the separate taxation of married couples was introduced, the one-breadwinner couple and single taxpayers with dependants now suffer more horizontal inequity than was previously the case. The research indicated that to attain greater horizontal equity provision should also be made for families and households with only one breadwinner (breadwinner being defined as the provider in a one-breadwinner couple or a ·taxpayer with dependents). Recommendations made to alleviate this inequity are transferable allowances for spouses, or, without ~ontravening the Constitution's demands for equality, a separate rate schedule for breadwinners, a fixed allowance or rebate for breadwinners, or a proportional allo~ance depending on the breadwinner's income. The study also addressed the financial and administrative implications and political acceptability of these recommendations and concluded that the proportional allowance, although expensive, would come the closest to providing the greatest horizontal equity. The research into the international tax measures to promote equity revealed that horizontal equity could be further promoted by providing tax relief for child-care and day-care facilities. The different forms of the de facto marriage in its wide interpretation are reviewed and the following relationships are discussed: cohabitation relationships; customary marriages; marriages resulting from religious traditions; and homosexual relationships. It is found that the present South African legal position is very unsatisfactory. Several suggestions for amendments are made, and the unique characteristics of the South African situation to be taken into consideration in forming a new approach, are highlighted. It is pleaded that the legal profession accept the challenge to create, with innovation, a new system for South African law which will be flexible, but, will at the same time ensure certainty in law. / Private Law / LL. Les conjoints de fait au Québec : perspectives féministes pour un encadrement légal

(2-325-1-0)" / Le Québec est la seule province canadienne à ne pas imposer d'obligation légale quant aux rapports interpersonnels entre les membres de couples non mariés. Pourtant, leur nombre augmente considérablement et, en 2001, il y avait 1 158 410 couples en union libre au Canada, dont 508 525 vivaient au Québec. Les conjoints de fait des autres provinces canadiennes ont revendiqué un statut juridique d'égalité de droits avec les couples mariés, ce qui a donné lieu à plusieurs décisions de la Cour suprême du Canada et à la mise en vigueur de lois visant l'encadrement juridique de la rupture de ces conjoints de fait. C'est ainsi que toutes les provinces canadiennes, sauf le Québec, imposent une obligation alimentaire entre conjoints de fait à la rupture. La présente étude utilise les méthodologies d'analyse proposées par les théories légales féministes pour aborder la situation juridique de la famille québécoise dans un contexte historique et social afin de suggérer la mise en place d'un cadre légal des rapports interpersonnels des conjoints de fait. Afin de favoriser une plus grande égalité et une solidarité familiale, l'auteur propose l'établissement d'une obligation alimentaire compensatoire entre les membres des couples québécois non-mariés, avec enfants. / Quebec is the only Canadian province that does not impose legal obligations regarding interpersonal relations between the members of unmarried couples. In 2001, there was 1 158 410 unmarried couples in Canada, of which 508 525 were living in the province of Ouebec. Common law spouses from other provinces have claimed equal legal status with married couples, which lead to many decisions from the Supreme Court of Canada and to provincial legislations regarding their separation. Thus, ail Canadian provinces except Ouebec impose alimentary support on common law spouses at separation. This study uses the methodology of feminist legal theories to approach the legal situation of Quebec families in a historical and sociological context to propose a legislation regarding interpersonal relations within unmarried couples. According to the author, there should be a compensatory obligation of support between the members of unmarried couples with children to favor equality and familial solidarity.

Étude exploratoire de la détérioration du lien parent-enfant : contexte d’apparition, caractéristiques et comportements des couples parentaux séparés impliqués dans ces dynamiques

L’objectif principal de cette thèse de doctorat est de déterminer, à l’aide d’une grille d’observation des comportements parentaux après la séparation , si des catégories de la grille permettent de distinguer entre eux les couples parentaux où le risque de Détérioration du Lien Parent-Enfant en contexte de séparation conflictuelle (DLPE) est très élevé des couples parentaux où le risque de DLPE est très faible. De plus, trois objectifs secondaires s’ajoutent à notre objectif principal. Premièrement, nous avons tenté de voir s’il était possible de prédire les cas où les risques de DLPE sont très élevés. Deuxièmement, nous avons exploré comment la DLPE s’inscrit dans les conséquences pouvant découler de la séparation parentale. Et enfin, troisièmement, nous avons brièvement exploré la question des allégations d’agression sexuelle envers l’enfant dans les contextes de DLPE. Cette thèse est composée de deux articles et d’une note de recherche brève. Le premier article s’intitule En quoi et pourquoi les hommes et les femmes sont-ils affectés différemment par la séparation conjugale? Cet article est une recension critique de la littérature traitant des conséquences du divorce chez les adultes ainsi que des conséquences différentielles du divorce pour les hommes et les femmes. Dans cet article, des hypothèses explicatives quant à l’origine de ces diverses conséquences sont discutées et nous proposons de les conceptualiser sous la forme d’un éventail rendant compte des impacts tant positifs que négatifs, notamment à une extrémité du continuum où se retrouvent les dynamiques DLPE. Ce continuum sur lequel s’inscrit la DLPE permet de conceptualiser et de discuter de l’adaptation ou de la mésadaptation des individus face à la séparation. Dans cet article, notre regard sur la DLPE fait ressortir les lacunes de la recherche actuelle sur ce phénomène. Il ressort un manque flagrant de connaissances du contexte d’apparition du phénomène, de connaissances empiriques sur la question des allégations d’abus sexuel se produisant dans le cadre de telles dynamiques ainsi que de connaissances des caractéristiques et des comportements des individus qui y sont impliqués. Conséquemment, notre article met l’emphase sur la nécessité qu’une tradition de recherche se développe dans le domaine de la DLPE afin de clarifier tous ces aspects. Enfin, cet article met en lumière différents facteurs de risque et différents facteurs de protection susceptibles d’expliquer que le divorce ait des conséquences différentes chez les hommes et les femmes. Le deuxième article s’intitule Étude exploratoire des caractéristiques et des comportements de couples parentaux séparés engagés dans une dynamique de Détérioration du Lien Parent-Enfant. Cet article cherchait à déterminer si les couples parentaux séparés hautement à risque d’être engagés dans une dynamique de DLPE se distinguent des couples parentaux séparés dont le risque de DLPE est faible sur certaines variables. Nous avons étudié cette question auprès de notre échantillon de 82 couples parentaux séparés pour lesquels le risque de DLPE est évalué comme étant soit très faible (groupe de comparaison) ou soit très élevé (en tenant compte du fait que la mère ou le père soit le parent dénigrant). À cette fin, nous avons utilisé un instrument de mesure, la Grille d’observation de la Détérioration du Lien Parent-Enfant après la séparation (GODLPE), adapté de celui développé par Johnston, Walters, & Olesen, (2005). Les résultats obtenus à l’aide de tests d’analyse de variance et de khi-deux démontrent que les ex-couples du groupe de comparaison se distinguent des ex-couples du groupe où le risque de DLPE est très élevé par un mariage significativement plus long et un niveau de conflit plus élevé. Également, les résultats démontrent que les parents du groupe de comparaison, les parents dénigrés et les parents dénigrants se distinguent entre eux quant à leurs comportements coparentaux aliénants, à leur relation coparentale supportante, à leur relation coparentale méfiante et à leurs comportements de renversement de rôle. Finalement, notre étude révèle que la durée du mariage et l’intensité des conflits permettent de prédire le risque de DLPE. La note de recherche brève s’intitule Étude exploratoire des allégations d’agression sexuelle envers l’enfant dans un contexte de Détérioration du Lien Parent-Enfant. Cet note de recherche s’intéresse à ce qui a longtemps été considéré comme l’une des caractéristiques déterminantes des dynamiques de DLPE, soit les allégations d’agression sexuelle envers l’enfant professées par un parent à l’endroit de l’autre parent ou d’un membre de son entourage proche. Nous avons étudié cette question chez 82 couples parentaux séparés pour lesquels le risque de DLPE était évalué comme étant très faible ou très élevé. Les résultats indiquent qu’il n’existe aucune différence significative entre les groupes relativement à cette caractéristique. Cependant, les mères auraient davantage tendance à alléguer de tels abus que les pères. Enfin, aucune des allégations professées n’a été jugée suffisamment crédible pour que la Directeur de la protection de la Jeunesse (DPJ) juge nécessaire d’intervenir. Plusieurs hypothèses sont soulevées pour expliquer ces résultats. / The main goal of the present doctoral thesis was to determine whether certain items of an observation grid assessing parental behaviors following separation allow to distinguish parents whose risk of Deterioration of the Parent-Child Relationship (DPCR) is very high from those whose risk of DPCR is very low. This goal led to secondary objectives regarding the prediction of such dynamics, the issue of sexual abuse allegation toward the child in such situations, and the context in which this phenomenon appears in the context of parental separation. This thesis includes two articles and a brief note of research. The first article is entitled: How and Why Are Men and Women Affected Differently by Marital Separation? This article is a critical literature review regarding the consequences of divorce for adults as well as its differential impact on men and women. Explanatory hypotheses regarding the origin of these diverse impacts are discussed. Furthermore, this article offers a conceptualization of such impacts as a continuum, which takes into account the positive and as well as the negative consequences of divorce, such as the dynamics of DPCR following separation. Different risk factors and protective factors are also suggested. The second article is entitled: Exploratory Study of the Characteristics and Behaviors of Separated Couples Engaged in a Dynamic of Deterioration of the Parent-Child Relationship. This article discusses whether it is possible to distinguish, on certain variables, separated couples who are at high risk of being engaged in a dynamic of DPCR from those who are at low risk. This issue was studied among 82 separated couples for which the risk of DPCR was assessed as being very low or very high (in the latter case was distinguished the group where the mother was the denigrating parent from the group where the father was the denigrating parent). An instrument called the Deterioration of the Parent-Child Relationship Observation Grid (DPCROG), adapted from an instrument developed by Johnson, Walters, & Olesen, 2005, was used in the present study. Analyses of variance and chi-squared analyses were carried out and revealed that ex-couples in the group at high risk for DPCR distinguished themselves from ex-couples in the comparison group by a significantly longer marriage and a higher level of conflict. In addition, results of 2 X 2 repeated measures analyses of variance, as well as results of Tukey’s post-hoc tests, revealed that parents in the comparison group, denigrated parents, and denigrating parents differed from one another in terms of their alienating coparenting behaviors, their supportive coparenting relationship, their mistrustful coparenting relationship and their role reversal behaviors. Finally, results of Tukey’s post-hoc analyses and chi-squared analyses indicated that the length of marriage and the intensity of conflict allow to predict the risk of DPCR. The brief note of research is entitled: Exploratory Study of Child Sexual Abuse Allegations in the context of a Deterioration of the Parent-Child Relationship. This note of research is concerned with what has long been considered as one of the characteristics of the dynamics of DPCR: the allegation of child sexual abuse declared by a parent against the other parent or against people close to the other parent. This issue was studied among 82 separated couples for which the risk of DPCR was assessed as being very high or very low. The results indicated that there were no significant differences between groups in regards to these allegations. Furthermore, mothers seemed to have a greater tendency to allege such abuse in comparison to fathers. Finally, whereas none of these allegations were judged as sufficiently credible in order for the Direction de la Protection de la Jeunesse (DPJ) to intervene, several hypotheses were raised to explain this finding.

Développement, mise à l’essai et évaluation qualitative d’une intervention infirmière dyadique auprès de couples âgés vivant avec la maladie de Parkinson au stade modéré

Au Québec, près de 25 000 personnes, principalement des aînés, sont touchées par la maladie de Parkinson (MP), la majorité étant soignée par leur conjoint. Au stade modéré, la MP altère la santé et la qualité de vie de ces couples. Ce stade est propice à la mise en place d’interventions dyadiques, car les couples expérimentent des pertes croissantes, nécessitant plusieurs ajustements. Néanmoins, aucune étude n’avait encore examiné leurs besoins d’intervention lors de cette transition et peu d’interventions pour les soutenir ont fait l’objet d’études évaluatives. Avec comme cadre de référence la théorie de l’expérience de transition de Meleis et al. (2000) et l’approche systémique de Wright et Leahey (2009), cette étude visait à développer, mettre à l’essai et évaluer une intervention auprès de couples âgés vivant avec la MP au stade modéré. À cette fin, un devis qualitatif et une approche participative ont été privilégiés. L’élaboration et l’évaluation de l’intervention s’appuient sur le cadre méthodologique d’Intervention Mapping de Bartholomew et al. (2006) et sur les écrits de Miles et Huberman (2003). L’étude s’est déroulée dans une clinique ambulatoire spécialisée dans la MP. Dix couples et quatre intervenants ont collaboré à la conceptualisation de l’intervention. Trois nouveaux couples en ont fait l’expérimentation et l’évaluation. L’intervention dyadique compte sept rencontres de 90 minutes, aux deux semaines. Les principaux thèmes, les méthodes et les stratégies d’intervention sont basés sur les besoins et les objectifs des dyades ainsi que sur des théories et des écrits empiriques. L’intervention est orientée vers les préoccupations des dyades, la promotion de la santé, la résolution de problèmes, l’accès aux ressources, la communication et l’ajustement des rôles. Les résultats de l’étude ont montré la faisabilité, l’acceptabilité et l’utilité de l’intervention. Les principales améliorations notées par les dyades sont l’adoption de comportements de santé, la recherche de solutions ajustées aux situations rencontrées et profitables aux deux partenaires, la capacité de faire appel à des services et l’accroissement des sentiments de maîtrise, de soutien mutuel, de plaisir et d’espoir. Cette étude fournit des pistes aux infirmières, engagées dans différents champs de pratique, pour développer et évaluer des interventions dyadiques écologiquement et théoriquement fondées. / In Quebec, nearly 25 000 people are affected by Parkinson’s disease (PD). They are, for the most part, elders cared for by their spouse. At the moderate stage, PD alters the couples health and quality of life. This stage of the illness offers opportunities for dyadic interventions, as these couples experiment growing losses requiring numerous adjustments. Nevertheless, no study had yet explored their intervention needs during this transition and few interventions to support them have been the object of evaluative studies. Based on transition theory by Meleis and colleagues (2000) and on family systems approach by Wright and Leahey (2009), the purpose of this study was to develop, implement and evaluate a dyadic intervention oriented towards elderly couples living with PD at the moderate stage. To achieve this goal, a qualitative design and a participative approach were privileged. The Intervention Mapping framework by Bartholomew and colleagues (2006) and the analytic methods developed by Miles and Huberman (2003) were used to conceptualize and evaluate the intervention. The study took place in an ambulatory clinic specialized in PD. Ten couples and four health professionals collaborated to the intervention development. Three new couples tested and evaluated the intervention. The dyadic intervention consists of seven sessions of 90 minutes, held every second week. The themes of the sessions and the intervention methods and strategies are based on the couples needs and goals, as well as on specific theories and empirical findings. The intervention is oriented towards dyads concerns, health promotion, problem solving, access to resources, communication, and role adjustments. The study results showed the feasibility, the acceptability and the utility of the intervention. The main benefits observed by the dyads are the adoption of health behaviors, the finding of solutions adapted to various situations and favorable to both partners, the skills to get help and services, and the increased feelings of mastery, mutual support, pleasure and hope. This study can illuminate nurses involved in different domains of practice and interested in developing and evaluating dyadic interventions that are ecologically and theoretically based.

A mãe que trabalha fora: a criança e a família em relação ao trabalho materno / The working mother: the child and family in relation to maternal employment

Este estudo pretendeu investigar como a variável trabalhar fora interfere na constituição do lugar da mãe para o filho. Utilizamos uma metodologia de pesquisa de campo, de natureza qualitativa a partir do estudo comparativo de seis famílias da classe média paulistana. Foram realizadas entrevistas semi-dirigidas com os casais e com as crianças aplicamos o Procedimento de Desenhos de Família com Estórias, proposto por Walter Trinca (1997). Nosso estudo procurou articular o conhecimento advindo da história da trajetória da família burguesa, com os aportes oferecidos pela análise dos desenhos e entrevistas com as famílias inseridas nesse contexto, contando também com o auxilio do substrato teórico da psicanálise. Nossos dados apontaram que o fato da mãe trabalhar fora, enquanto fator isolado, não parece discriminar entre os dois grupos. Verificamos que os fatores mais importantes têm relação com a constituição da conjugalidade e da parentalização. Outro aspecto identificado esteve associado à possibilidade de um pai participativo, esse aspecto demonstrou ter forte relação com a satisfação conjugal, igualmente influente na percepção da criança sobre seu lugar na família / This study aimed to investigate how the variable \"out-of-home work\" affects the constitution of the place of the mother to the child. We used a methodology of field research, qualitative in nature, from the comparative study of six middle-class families in São Paulo. We executed semi-directed interviews with the couples and applied the Procedure of Family Drawings with Stories, proposed by Walter Trinca (1997), with the children. Our study sought to articulate the knowledge gained from the history of the trajectory of the bourgeois family, with contributions offered by the analysis of drawings and interviews with the families inserted within this context, also counting on the help of the theoretical basis of psychoanalysis. Our data showed that the mothers that work out of home, as an insulated factor, does not seem to discriminate between the two groups. We found that the most important factors are related to the establishment of conjugality and parenthood. Another aspect identified was associated with the possibility of the participation of the father. This aspect has demonstrated a strong relationship with marital satisfaction, equally influential in the child´s perception of his place in the family

Our study was based on the assumption that no marriage can exist without conflicts, and that conflicts occur not only between couples with the opposite typology but also between those with the same typology. Conflicts do not only occur only when casals have the opposite typological functions, but also when they have the same dominant functions. From our review of the literature we only identified one study that focused on the two issues. We identified several studies that considered conjugal conflicts, but very few that related these conflicts to psychological types. Considering that our study examined conjugal conflicts, the typology of couples and the possible relationship between the conflicts and their typology, an iniitial depth interview was considered to be an adequate procedure to approach this question, given that we did not intend to undertake a therapeutic process. We adopted a qualitative approach to this research, which consisted of two moments. During the first moment we identified the typology of the couples and during the second moment, three couples were selected and interviewed in order to investigate the conjugal conflicts they identified, and to relate these conflicts to their typology. The instrument used for this research was QUATI (Questionnaire to Evaluate Typology), which enabled us to select three couples from the twenty four couples who participated during the first stage of the research. Considering the difficult task of reconciling typology and conjugal conflicts, after evaluating the results and the data obtained and performing an intuitive, symbolic, conceptual analysis, we concluded that some conflicts reported by the couples could be related to their typology, but we understand that other studies need be undertaken in order to obtain more conclusive evidence / Esta pesquisa procurou identificar os conflitos em casais que possuem a tipologia Sentimento Extrovertido. Nosso estudo baseou-se na premissa de que não existe um casamento sem conflitos, e que os mesmos ocorrem tanto em casais com tipologias opostas como também nos que possuem a mesma tipologia. Conflitos não se instalam apenas quando os casais têm funções tipológicas opostas, mas também quando apresentam a mesma função dominante. Na revisão de literatura encontramos apenas um estudo que focasse os dois assuntos. Identificamos vários estudos a respeito de conflitos conjugais e poucos relacionados a tipos psicológicos. Considerando que o nosso estudo examinou os conflitos conjugais, a tipologia dos casais e a possível relação entre os conflitos e suas tipologias, a entrevista de profundidade foi considerada um procedimento adequado para abordar essa questão, visto que, a nossa intenção não era realizar um processo terapêutico. O método escolhido para o desenvolvimento da pesquisa foi o qualitativo. Esta constou de dois momentos, no primeiro momento os casais foram selecionados pela tipologia e no segundo, foram realizadas entrevistas com os três casais selecionados, a fim de identificar os conflitos conjugais trazidos por eles, assim como, relacioná-los a tipologia. Esta pesquisa utilizou como instrumento o QUATI (Questionário de Avaliação Tipológica), o qual permitiu selecionar três casais dos vinte e quatro que participaram da primeira fase da pesquisa. Considerando a difícil tarefa de conciliar tipologia e conflito conjugal, após a avaliação dos resultados, discussão dos dados e de uma análise intuitiva, simbólica e conceitual. Concluímos que alguns dos conflitos apresentados pelos casais podem estar ligados a tipologia dos mesmos, mas deixamos uma porta aberta para que novos estudos sejam realizados, com o propósito de aumentar as possibilidades de pesquisa referentes ao tema

O morar dos idosos nas instituições de longa permanência: o caso dos casais residentes na Instituição Nosso Lar em Santo André/SP

Their reflexes had beginning in Brazil starting from the second half of the century XX and it was resulted of the reduction in the fertility/mortality taxes, of the urbanization and of the increase of the life expectancy of the people. In the same way as there is the increase of the number of senior people, there is also a crescent disputes for new manners of living. Such fact lifts inherent questions of social stamp when living of the seniors in the Institutions of Long Permanence (ILPI), fear of this research, that he/she had as objective lifts the residents' of the Instituição Assistencial Nosso Lar, in Santo André-SP and to know the moments for two lived by the couples there residents, contributing to the implementation of public politics of home for senior. For so much he/she was employee the method of qualitative approach, using the interview semi-structured to pick four resident seniors' depositions in the researched Institution. We observed that the relationships to two in the Institution are permeated of prejudices so much on the part of the administration, that is not prepared to welcome seniors' couples, as on the part of the other interns, that you/they act with strangeness due to the rare moments of affectivity of the couples. It was also noticed a retraction on the part of the subjects interviewees in relation to the questions about the sexuality, once they became shy when verbalizing their moments of intimacy. We noticed that this is a theme that it still lacks studies more deepened and of operationalization of Public Politics of house for seniors so that these subjects have his/her respected citizenship when they choose an ILPI as home and place to live to two / O crescimento expressivo da população idosa é um fenômeno mundial. Seus reflexos tiveram início no Brasil a partir da segunda metade do século XX e foi resultado da redução nas taxas de fertilidade/mortalidade, da urbanização e do aumento da expectativa de vida das pessoas. Do mesmo modo como há o aumento do número de pessoas idosas, há também uma crescente demanda por novos modos de morar. Tal fato levanta questionamentos de cunho social inerentes ao morar dos idosos nas Instituições de Longa Permanência (ILPI), tema desta pesquisa, que teve como objetivo levantar o perfil dos residentes da Instituição Assistencial Nosso Lar, em Santo André SP e conhecer os momentos a dois vividos pelos casais ali residentes, contribuindo para a implementação de políticas públicas de moradia para idosos. Para tanto foi empregado o método de abordagem qualitativa, utilizando a entrevista semi-estruturada para colher depoimentos de quatro idosos residentes na Instituição pesquisada. Observamos que os relacionamentos a dois na Instituição são permeados de preconceitos tanto por parte da administração, que não está preparada para acolher casais de idosos, quanto por parte dos outros internos, que agem com estranhamento diante dos raros momentos de afetividade dos casais. Notou-se também uma retração por parte dos sujeitos entrevistados em relação aos questionamentos sobre a sexualidade, uma vez que se acanharam ao verbalizar seus momentos de intimidade. Percebemos que este é um tema que ainda carece de estudos mais aprofundados e de operacionalização de Políticas Públicas de habitação para idosos para que estes sujeitos tenham sua cidadania respeitada no momento em que escolherem uma ILPI como moradia e local para viver a dois
