1 The role of media in criminal proceeding Abstract The thesis deals, as the name implies, with the role of the media in criminal proceedings, both theoretically and practically. The work contains a lot of examples primarily through the case-law presented. Chapter one is titled "Power of Media". It deals with the emergence of this concept and the history of the media in our country. It also focuses on the potential threat to media power, through purchasing of mass media, and murder of journalists and media workers. The second chapter deals first with one of the basic principles of criminal proceedings, namely the principle of the public; the second part deals with the principle of the presumption of innocence. The third chapter briefly focuses on the media's access to proceedings. The conclusion of the chapter is devoted to the controversy over online reports from the courtroom and their possible regulation by judges. The fourth chapter deals with providing information on criminal proceedings. Apart from legislation, it also offers a view of the case law of the Supreme Administrative Court, the Constitutional Court and the principles of the European Court of Human Rights. Obhájce v trestním řízení / Defence lawyer in the criminal proceedings

Defence lawyer in the criminal proceedings Abstract The defending lawyer is an important institution in criminal law. With this institution a basic principal can be guaranteed, the right of defense. This master's degree thesis is about the defending lawyer in criminal trials in the Czech Republic and Switzerland, its similarities and differences. It consists of an introduction, a body consisting of 7 chapters and a conclusion. The first chapter deals with the historical development of this institution on Czech territory from the 18th century until the present time. It especially emphasizes the effect of historical events on modifications and on the practical observance of written law. The next chapter defines the term defending lawyer under Czech law and explains how someone can become a defending lawyer. It specifies how a defending lawyer should conduct the defense case and explains the differences between elected and nominated lawyers. The following chapters analyse the rights and obligations of lawyers and methods of legal defense. Furthermore, they try to examine the importance and necessity of a defending lawyer in a criminal trial. On the other hand, they show the limitations of defense lawyers and their tactics. The aim of this paper entitled "The Role of the State Prosecutor in Preparatory Criminal Proceedings" is to perform a comprehensive analysis, based on the valid legislation, of the individual actions taken by the State Prosecutor during the preparatory stage of criminal proceedings and to identify their possible shortcomings. The paper consists of five chapters followed by annexes. Chapter 1 presents a comprehensive history of the State Prosecutor's office since its inception to the present with a special emphasis on its historical development in what is now the Czech Republic. Chapter 2 discusses the essentials of public prosecution that come into play during the preparatory stage of criminal proceedings. Chapter 3 deals with the present-day legislation regulating the State Prosecutor's office. It is comprised of three parts. The first part discusses the constitutional foundations of the State Prosecutor's office in the Czech law. The second part provides specifications of the basic organizational structure of the State Prosecutor's office, whereas its responsibilities are described in the third part. Diploma thesis on the Powers of state prosecutor in preparatory criminal proceedings is trying to comprehensively discuss the individual powers of state prosecutor throughout the preparatory process. The role of the state prosecutor's during the preparatory proceeding is completely irreplaceable. Since the beginning state prosecutor is entitled to co-ordinate the police authorities, and thus form the case by defining the criminal act, the definition of the legal classification and by defining the necessary evidence. [pt] O debate sobre a (des)igualdade aflora no seio social dos Estados, especialmente naqueles que implantam uma proposta democrática. Igualdade é pressuposto de democracia e projeta-se também no processo penal. Apesar de afirmar a igualdade de armas entre as partes, identifica-se que as desigualdades materiais não são compensadas dentro do processo público, sobretudo nas sociedade latino-americanas. As garantias processuais acabam afirmando, paradoxalmente, a igualdade de sujeitos desiguais. Esta realidade se agrava no contexto da América Latina quando, tanto o Direito Penal quando o Processo Penal, desempenham uma função de controle de massas, de caráter clientelista, orientado a conter possíveis insatisfações da grande massa de excluídos. O principal objetivo deste trabalho, é pois, compreender a participação do acusado no processo penal, inserido no modelo predominantemente acusatório, procurando harmonizar a garantia de igualdade formal à desigualdade material, a fim de que efetivamente se assegure a garantia de acesso a Justiça Penal a todos os cidadãos. Promover-se-á, dessa forma, uma crítica ao processo penal, onde a participação do acusado, em igualdade de condições formais e materiais, na formação do provimento final deve ser compreendida como pressuposto de legitimação da aplicação do Direito Penal, igualdade essa alcançada, sobretudo, pela afirmação de amplitude de defesa ao acusado pelo Estado. Equality is a presupposition of democracy and also projects itself in the criminal process. Despite affirming the equality between the parts, it is identified that the material inequalities are not compesated inthe public process, mainly in the Latin American societies. The reality is aggravated in the context Latin America when, both Criminal Law ans the Criminal Process, have as its main function Mass Control, of a Patronage system, oriented to contain the possible unsatisfactions of great number of excluded individuals. The main objective of this paper is to understand the participation of the accused individual in the Criminal Process inserted in the predominantly accusatory model, trying to cope with the guarantee of formal equality and the material inequality, so that it effectively reassure the guarantee of access to the Criminal Law to all citizens. The research is based on Teoria do Garantismo Penal ( Criminal Guaranteeing Theory) by Luigi Ferrajoli, that situates the contradictory and the ample defense with jurisdictional technics normatively accepted, assuring the accused, above all the excluded from the neoliberal projects, equality in participation int the formation of the truth to be enclosed by the final provision.

The subject of this diploma thesis is the protection of an injured party in criminal proceedings. Throughout the thesis author analyzes the relevant laws, specialized legal literature and case laws. When there is a debate amongst the professional public, author summarizes the key arguments and provides his own perspective. The paper provides a general definition of the term injured party, which includes a positive and negative definition and distinction between the terms injured party and a victim. The author more closely examines when the injured party is not allowed to exercise his rights. There are also described, from the view of current legislation and also de lege ferenda, the circumstances under which a person is not allowed to join the criminal proceeding as an injured party. Furthermore the author breaks down the rights of an injured party with the emphasis being put on the right of the injured party to consent to prosecution and the right to demand for his/her claims to be satisfied in accordance with the 59/2017 Sb., on the use of funds acquired from property penal sanctions imposed in criminal proceedings, which has been in effect for over a year now in March 2019. This diploma thesis deals with position of a witness in criminal proceeding. The first part, it defines a conception of a witness; focuses on legal process aspects of position of a witness and also on capability to act as a witness in criminal proceeding. The second part, is given attention to performing evidence by witness, to rules of examination of a witness, including rules of examination of witnesses less than 15 years old. The third part defines rights and duties of a witness in criminal proceedings as they result not only from Criminal Procedure Act but also from constitutional principles. There is closer focus on witness' duty to testify, to liability to participate in confrontation and recognition (as special kinds of evidence). Another focus is on some witnesses' rights: rights to deny giving testimony and right to legal help and mainly to right to afford security of a witness. The last, four part deals with institute of crown witness (accomplice witness). This institute is not included into Czech legal system yet.

The dissertation analyses a new theme which has not yet been analysed in Lithuanian research and makes an attempt to reveal the theoretical foundations of the institute of reopening a criminal case. The object of the dissertation is the nature of the institute of the reopening of criminal proceedings, the historical development of this institute, the purposes, features, the existing grounds for the reopening of a case, types, specialness of the types, procedure for the reopening of a criminal case, and the place of the reopening of a criminal case among other forms of control over court judgments. The research has been carried out along two directions.. The first has analysed the theoretical grounds of the institute of reopening a criminal case. The second has evaluated both the norms of the Code of Criminal Procedure which regulate the reopening of a criminal case and the resultant court practice, the analysis of which has determined some of the theoretical conclusions. The research has conformed the hypothesis that the appropriate conception of the reopening of a criminal case as an extraordinary form of control over court judgment and the facultative stage of criminal process enables to safeguard both the lawful expectations of the parties to the process and a fair trial. Disertacinio tyrimo objektas – baudžiamosios bylos atnaujinimo instituto teisinė prigimtis, istorinė raida, tikslai, požymiai, pagrindai, dėl kurių atnaujinama byla, rūšys, rūšių ypatumai, atnaujinimo procedūra bei baudžiamosios bylos atnaujinimo vieta kitų teismų sprendimų kontrolės formų sistemoje. Mokslinis tyrimas atliktas dviem kryptimis. Pirma, analizuoti baudžiamosios bylos atnaujinimo instituto teoriniai pagrindai. [pt] O presente trabalho tem por objeto o estudo a cerca da vedação da liberdade provisória em absoluto pelo legislador ordinário. Busca-se analisar a tensão entre o direito à liberdade provisória e a viabilidade da imposição do cerceamento da liberdade de locomoção em momento anterior à sentença penal condenatória irrecorrível, isto é, o propósito da pesquisa concentra-se na discussão em torno da validade da vedação da liberdade provisória em absoluto pelo legislador ordinário em face do direito à liberdade provisória assegurado no art. 5º, inciso LXVI, da Carta Política/88. A pesquisa apresentará como interlocutor a Teoria do Garantismo Penal elaborada pelo professor italiano Luigi Ferrajoli que permeará o desenvolvimento de todo o trabalho. Para a compreensão do tema proposto, necessário se faz abordar, inicialmente, o instituto jurídico da prisão processual, buscando a legitimidade da restrição da liberdade de locomoção do acusado anteriormente à sentença penal condenatória definitiva em face do postulado constitucional da presunção de inocência, bem como, analisar as singularidades das diversas modalidades de prisão processual previstas no ordenamento jurídico. Em seguida, discorre-se sobre a liberdade provisória, partindo do Código de Processo Penal de 1941 – ainda em vigor –, passando, logo após, para as considerações sobre as alterações realizadas pela Lei 6.416/77, até se chegar à nova ordem constitucional instalada pela Carta Política/88. Por fim, examina-se a relação entre a vedação da liberdade provisória em absoluto pelo legislador ordinário e o discurso de emergência no processo penal. After that, it is discoursed on the free on parole, leaving of the Code of Criminal Procedure of 1941 – still in vigor –, passing, then after, for the consideration on the alterations carried through for Law 6.416/77, until if arriving at the new constitutional order installed by the Charter Politics/88. Finally, it is examined relation enters the prohibition of absolute the free on parole in for the ordinary legislator and the discourse of emergency in criminal proceeding. The considered model develops from the distinction between inherent functions to the criminal persecution inquiry, accusation and judgment proposing, as imperative for preservation of the equitable in the way that the criminal jurisdiction contemplates the interests of the parts, the attribution of each one of them to distinct agencies, considering indispensable the communication and interaction between them, but forbidden the direct interference of one in the activities conferred to any of the others. Through this proposal, formulated by analysis of the Brazilian constitutional text, it searched identification of the devices of the criminal legislation procedural that authorize the direct interference, proposing however the rereading, however the not reception, of them stipulation in face of the accusatory procedural system foreseen by the Federal Constitution. We also examine the trend current to extend public prosecution service attributions, responsible agency for the accusation, also for the criminal inquiry, concluding, first for the impossibility of this magnifying in face of constitutional text and also for its inappropriate in order to preserve the structure of equitable criminal proceeding. / O presente trabalho tem como objetivo principal analisar o sistema processual de cunho acusatório, consagrado pela Constituição Federal brasileira, e identificar os seus desvirtuamentos presentes na legislação processual de modo a resguardar o processo penal eqüitativo, componente do Estado Democrático de Direito. O modelo proposto se desenvolve a partir da distinção entre funções inerentes à persecução penal investigação, acusação e julgamento pregando, como imperativo para preservação da eqüitatividade do modo de como a jurisdição penal contempla os interesses das partes, a atribuição de cada uma delas a órgãos distintos, sendo indispensável a comunicação e interação entre eles, mas vedada a interferência direta de um nas atividades conferidas a qualquer dos outros. Através dessa proposta, formulada mediante análise do texto constitucional, buscou-se a identificação dos dispositivos da legislação processual penal que autorizam a referida interferência direta, pregando ora a releitura, ora a não recepção, do que neles vem estipulado em face do sistema processual acusatório previsto pela Constituição Federal. Examinamos também a tendência atual de ampliar os poderes do Ministério Público, órgão responsável pela acusação, também para o campo da investigação criminal, concluindo, primeiro pela impossibilidade dessa ampliação em face do texto constitucional e, num segundo momento, pela sua inadequação de modo a preservar a estrutura do processo penal eqüitativo.
