Interculturalidade, direito e direitos indígenas / Interculturality, theory of law and indigenous rights

Neste trabalho nos propomos a analisar as possibilidades e limites de um paradigma intercultural para o Direito na América Latina, tendo em vista: i. a produção da literatura especializada a respeito do tratamento jus-político da alteridade cultural nas últimas 5 décadas e situando a proposta intercultural nessa bibliografia; ii. verificando as características específicas da América Latina para a integração jurídica e consolidação democrática que propõe a interculturalidade e iii. buscando na afirmação e no desenvolvimento dos direitos indígenas elementos que indiquem caminhos para a interculturalidade na região. Para tanto parte-se da formulação de categorias para a organização do conhecimento produzido na temática e sua colocação no contexto contemporâneo (capítulo 1). No que respeita à conceituação da interculturalidade, buscou-se trabalhar a partir dos debates especializados e do léxico teórico e político que perpassa o termo, de modo que se eximiu do propósito de conceituar a partir do plano normativo. A diferença do conceito desenvolvido a partir do texto normativo, método comum ao Direito, tratou-se de ampliar os conteúdos implícitos no debate intercultural a partir de sua relação com os campos teórico-científico e político-social (capítulos 2 e 3). Por fim, fez-se o esforço de análise sistêmica da normatividade internacional relacionada ao tema indígena buscando os elementos de interculturalidade que tal sistema oferece. Na conclusão apontam-se ainda alguns campos de pesquisa interculturais para a teoria do direito. / The aim of this thesis is to analyse the limits and possibilities of a intercultural paradigm to the Theory of Law in In Latin America, considering: i. the extent academic production of the last 5 decades towards the jus-political treatment of alterity and placing interculturality amongst it; ii. verifying the specific characteristics of Latin America to the juridical integration and to democracy consolidation which is proposed by the interculturalism; and iii. seeking in the process of consolidation and development of indigenous rights some of the elements that indicates the paths to the interculturality proposals in the region. In this purpose this work initiates its analysis by proposing some categories in order to organize the knowledge produced in this field and its locus in the contemporary context (chapter 1). In the conceptualization of the interculturality the method chosen was to get its initial meaning by the contents and terms theoretical and political debates on the issue. In this sense, in spite of being a very common recourse in civil law systems to make use of the normative or legal conceptualizations, it was not the choice of method in this work. The reason why the traditional method was not chosen is that it was considered crucial to the object of this research to show the implicit contents in the intercultural debate departing from its lexical connotation in both theoretical-scientific and social-political fields (chapters 2 and 3). At last, there is an effort to analyze systematically the international law related to the indigenous peoples\' rights, searching for the intercultural elements offered in it. In the conclusive pages, some new intercultural research fields in Theory of Law are pointed out.

Availability and utilization of indigenous leafy vegetables (ILVs) found in Limpopo Province and the response of a selected ILV to planting density and nitrogen fertilizer rate

Agricultural Management (Agronomy)) -- University of Limpopo, 2018 / A survey study identified indigenous leafy vegetables (ILVs) utilized by rural communities in Limpopo Province in the three districts of Capricorn, Sekhukhune and Vhembe focusing on their availability, agronomic practices, marketing, medicinal and cultural roles, as well as their nutritional value. An ILV that was highly preferred and with good marketing potential was identified for further studies on its response to planting density and nitrogen fertilizer rate. A questionnaire survey was used to gather information about types of ILVs utilised, their production practices, marketing of ILVs and their importance in medicinal and cultural roles. Data collected were subjected to analysis using the Statistical Package for Social Sciences (SPSS) using descriptive statistics. Results showed that there were 45 different types of ILVs identified from the three districts in Limpopo Province. Farmers indicated that cultivation of these vegetables was mostly done from October to January in Sekhukhune and Capricorn district while in Vhembe it was practiced all year round. Most of farmers in Vhembe district used inorganic fertilizer during planting while farmers in Sekhukhune and Capricorn districts used organic fertilizers such as cattle manure. Irrigation was commonly used in Vhembe district through furrow irrigation system whereas in Capricorn and Sekhukhune districts most farmers relied on rainfall. Farmers indicated that harvesting was done at an early growing stage of the crop. Indigenous leafy vegetables were mostly marketed in local communities. Several ILVs were identified as preferred and regularly consumed as vegetables. Spider plant (Cleome gynandra) and nightshade (Solanum retroflexum) were identified as the most consumed ILVs in the three districts. Comparing the market potential of the two vegetables, S. retroflexum was chosen for further studies on its response to plant density and nitrogen fertilizer rate. The first study investigated the effect of varying plant density (inter and intra-row spacing) and the second study evaluated the response of intra-row spacing and nitrogen fertilizer (LAN-28%N) rate on growth and yield of S. retroflexum during 2014 (April to May) and 2015 (March to May) growing seasons. The plant density experiment was laid out as a 3 x 4 factorial arrangement in a randomised complete block design (RCBD) with three replications. The treatment factors were 3 inter-row spacings of 30, 45 and 60 cm and 4 intra-row spacings of vi 7.5, 15, 22.5 and 30 cm. The data collected included plant height, plant vigour, number of leaves and branches per plant as well as plant leaf yield. Data were subjected to analysis of variance (ANOVA) using STATISTIX 10.0 package and mean treatments were separated using Turkey HSD at 5% probability level. The results revealed that growth parameters (plant height, plant vigour, number of branches and leaves) and plant leaf yield were significantly influenced by the combined inter and intra-row spacings. Closer inter-row spacings of 30 cm and 45 cm, and intra-row spacings of 7.5 and 15 cm produced the highest values of parameters and plant leaf yield. The combined spacings of 30 x 7.5 cm produced the highest plant leaf yield. The second study was also laid out as a randomised complete block design (RCBD) with three replications. The treatments were 6 x 2 factorial arrangement: 6 levels of nitrogen (LAN-28%N) at 0, 20, 40, 60, 80 and 100 kg N/ha and two intra-row spacings of 15 and 30cm. Inter-row spacing of 30 cm was used. The nitrogen fertilizer was applied a week after transplanting and repeated a week after first harvesting. Data was subjected to analysis of variance (ANOVA) using STATISTIX 10.0 package. Where significant differences were detected, means were separated using Turkey HSD at 5% propability level. The results suggested that both nitrogen fertilizer and spacing can be used to enhance growth and leaf yield of S. retroflexum vegetable. Nitrogen fertilizer rate and plant density significantly (P≤0.05) affected plant growth and plant leaf yields. Growth parameters and leaf yield were optimised using closer spacing of 15 cm and applying nitrogen at 60 kg N/ha. The application of 60 kg N/ha and 15 cm spacing was therefore recommended for the production of S. retroflexum as a vegetable, if planted at 30 cm inter-row spacing. The indigenous African languages are key components of their respective cultures. The survival of the language is, in some way, dependent on the print media (newspapers) (Salawu, 2004:8). In addition, the indigenous language newspapers have cardinal roles of promoting previously marginalised languages, preserving indigenous cultures and upholding democracy. Nevertheless, these newspapers are struggling to sustain themselves in the print media industry. It is, therefore, critically important to examine the factors that adversely affect the sustainability of these newspapers.

This research is motivated by the fact that although researchers and academics worldwide acknowledge that it is very difficult to objectively define and discuss the terms ‘leader’ and ‘indigenous leader’ yet many tend to dismiss offhand such indigenous concepts of leadership as ubuntu as primitive, barbaric and irrelevant to modern institutions without examining them in detail.

Indigenous practices of pregnant women at the Dilokong Hospital of the Greater Tubatse Municipality in the Limpopo Province

Thesis (M.CUR.) -- University of Limpopo, 2014 / Indigenous practices (IPs) are experiences generated by people who are living in a specific region context and a specific cultured group. IPs are shaped by cultural traits that are passed from one generation to the next. The practices are rooted and embedded in such a society and, therefore, the practices become part of the people’s lifestyle. It is difficult to try and change these practices, since people have adhered to them throughout their entire lives. The believe system plays a major role in health care seeking behaviour of individuals because they are informed by the IPs that are observed in their environment (Shaik & Hatcher, 2005). IPs are stored in people’s memories and are expressed in songs, dances, beliefs, rituals, cultural values, myths, and healing of diseases by using herbs. During pregnancy, IPs are still applied worldwide. Ayaz and Efe (2008) indicate that it occurs mostly in Turkey and Africa where women’s reassurance is depending on the local context and meaning of pregnancy. THE PURPOSE OF THE STUDY To determine indigenous practices of pregnant women at the Dilokong Hospital in the Greater Tubatse Municipality of the Limpopo Province.This was achieved by the exploring and describing the indigenous practices of pregnant women in the antenatal (ANC) clinic of the maternity ward at the Dilokong Hospital.. DESIGN AND METHOD A qualitative, descriptive, explorative and contextual research design was used for the participants to describe the indigenous practices by pregnant women. Data was collected by means of unstructured one-on-one interviews in maternity unit of the ANC clinic at the Dilokong Hospital of the Greater Tubatse Municipality. Ethical considerations as described by Denosa (2000) were adhered to in order to ensure the v quality of the study. The criteria for trustworthiness were observed as stipulated in Babbie and Mouton (2009).Fifteen pregnant women were interviewed. FINDINGS AND RECOMMENDATIONS Four themes with sub-themes emerged from the data analysis by using Tech’ṡ open coding approach (Creswell 2006, Botma, Greef, Mulaudzi & Wright, 2010). Four themes were emerged namely; indigenous practices based on ancestral knowledge; indigenous practices based on spiritual diviners versus church principles; restricted practices versus instructions followed during pregnancy and labour and indigenous practices during labour and delivery. It is recommended that a national IP strategy needs to be developed to provide a framework and platform to support and promote grass roots IPs into mainstream development in the health care system in relation to midwifery practice. CONCLUSION The study findings indicated that IPs were regarded as an honourable health intervention by THPs, families, and pregnant women. They showed trust in methods used to preserve pregnancy, labour, and delivery, although, the indigenous practices by pregnant women still continue. Indigenous practices such as cords around their waists, are still observed during physical examinations. However, there is a reduction of prescribed potions mixed with cool drinks for use to accelerate labour and to prevent negative consequences because the potential toxicity has been explained during the provision of health education. These findings call for health care professionals to emphasise training and workshops for the THPs church diviners that are the fundamental principle of effective implementation of IPs to enhance improvement in the prevention of complications during pregnancy, labour and delivery. An examination of the use of a human behaviour model for natural resource policy design and implementation by government (central and regional) agencies

In recent years, one of the most significant pieces of environmental legislation in New Zealand has been the Resource Management Act (New Zealand Government 1991) that has empowered local government agencies to manage the use of natural resources in their regions. Three Government Departments have been responsible for developing policies directly relating to the use of natural resources in New Zealand. The Department of Conservation has been mainly concerned with the management of natural resources on public land. The Ministry for the Environment has particularly addressed environmental policy issues of national significance. The Ministry of Agriculture and Forestry has worked with New Zealand's agricultural, horticultural and forestry industries to encourage sustainable resource use and development for the benefit of all New Zealanders. In general, local and central government agencies carrying out policy analyses have drawn upon highly goal driven theories such as Rational Choice or Incremental Policy Theories or alternatively they have applied more loosely framed theories such as Systems Policy Thinking or Garbage Can Theory. Policy formulation and instrument selection may have been based upon instrumentalist, proceduralist, contingentist or constitutivist selection criteria, depending upon the assumed influence of peoples' behavioural and social contexts in addition to the technical characteristics of the tools themselves. However, there has been a limited range of policy theories to guide the integration of policy analysis, and formulation and operational planning into a management strategy for effective policy delivery. Such theories would have assisted policy agencies to identify the human and social behaviours most closely related to policy issues and to better match policies to differences in the political and social context of each of the issues that they were dealing with. In academic articles a number of behaviour models from social psychology have been used to explain and predict human behaviour. One of those, the Theory of Reasoned Action (TRA) has a long history of use in research and application. It has been adapted to suit the needs of policy makers in human health, marketing, and education. Applications of the TRA have been reported to have achieved coefficients of determination for behaviour of on average, 53% in one study and 71% in another. Some of the modified models based upon the Theory such as the Theory of Planned Behaviour, have in themselves been able to make additional contributions to peoples' understanding of how to explain and predict human behaviour in more complex situations. In this report, unless otherwise stated, references to the TRA are inclusive of all associated models, such as the Theory of Planned Behaviour. This thesis has examined the application of the Theory of Reasoned Action in the formulation of environmental policy. Five research questions were considered. 1. Could a human behaviour model based upon the Theory of Reasoned Action be developed sufficiently for environmental policy makers to explain landowner behaviour associated with managing indigenous vegetation? 2. How well could the social psychology model of human behaviour based upon the TRA have predicted public responses to a policy programme? 3. How well could the social psychology model of human behaviour based upon the TRA have distinguished between the policy-intervention needs of different stakeholder groups? 4. How much have peoples' values, attitudes and beliefs affected their behaviour? 5. What would be the immediate antecedents to peoples' behaviour and how have they led to behaviour change? This has been a quantitative study to develop and test models of human behaviour specific to the preservation of indigenous vegetation. Three data sets were compared from surveys of peoples' bush protection behaviour, the establishment of indigenous woodlots and the protection and planting of riparian areas with indigenous vegetation. The results from the analyses have shown that accounting for peoples' intentions could have been used to improve the estimates of peoples' use of policy-desired practices. The coefficients of determination in multivariate equations to predict peoples' natural resource behaviour based upon non-specific (external) variables, varied between 3 - 10%. By including intentions in the models, the level of explanation increased to 10 - 17%. The results may have been lower than expected from other examples in the literature due to poorly specified measures of behaviour relative to the measures used for intentions. When it came to estimating intentions (rather than the actual behaviours), the TRA variables in regression equations achieved coefficients of determination of 55 - 75% and these provided a measure of how well the underlying values, attitudes and beliefs could have given policy makers an understanding of peoples' behaviour. Comparing the beliefs of people with high and low intentions to perform the behaviours, clear differences have been identified that could have been the basis of policy strategies for behaviour change. After analysing and considering these examples, this thesis has argued that the TRA could be used in the future to provide policy agencies with an increased level of understanding of human behaviour and so enable them to formulate policy interventions for achieving predictable levels of behaviour change.

For a labourer worthy of his hire : Aboriginal economic responses to colonisation in the Shoalhaven and Illawarra, 1770-1900

This thesis presents a narrative of Aboriginal economic responses in the 19th century to the colonisation of the Shoalhaven and Illawarra regions of New South Wales. It explores the competing claims of articulation theory and dependency theory about the intersection of colonial and indigenous economies. Dependency theory claims that settlers destroy the indigenous mode of production to permit the expansion of their own economic system. They exploit indigenous labour which then becomes dependent on capitalist sources of subsistence. Articulation theory, as modified by Layton (2001) to recognise the bi-directional nature of contact, posits that the rate of capitalist penetration into indigenous economies is variable and that the non-capitalist mode of production may be preserved to create a self-supporting source of labour. The contrasting theories are assessed in this thesis by determining the contribution different strategies made to Aboriginal subsistence. Historical evidence is used to assess each strategy. The main source of information is from Alexander Berry's Shoalhaven estate, where Aboriginal people lived from settlement in 1822 until they were moved to a reserve in the early 1900s. The analysis suggests that contrary to previous research, Aboriginal people gained the majority of their subsistence from fishing, hunting and gathering until 1860. Strategies that depended on the colonial economy such as farm work, trading, living with settlers and stealing made only minor contributions to Aboriginal subsistence. After 1860, European land use intensified and Aboriginal people were further alienated from the land. The contribution of hunting and gathering contracted as a result. Dependency on government assistance increased, particularly after the foundation of the Aborigines Protection Board in 1882. Fishing remained an important source of food and cash. Maritime resources were not commercially exploited to a significant extent until the closing years of the 19th century when Aboriginal people were provided with boats and nets to assist their efforts. The historical evidence demonstrates that articulation theory offers a more realistic approach than does dependency theory when analysing the intersection of colonial and indigenous economies. This is because articulation theory can predict variable outcomes. The variable outcome suggested by the Shoalhaven and Illawarra data are that hunting, gathering and fishing economies have the resilience to withstand the colonial encounter if sufficient resources are made available.

This dissertation documents and interrogates the process of Storyweaving, which has been authored and developed by Spiderwoman Theater, the longest running Native theatre company in North America and the longest running feminist collective in the world. Storyweaving is a distinct process that governs the dramaturgical structure and performed transmission of this company’s play texts on the contemporary stage. However, Storyweaving predates written history. It has been (and remains) specific to tribal storytellers across this continent. The reclamation, then, of this aesthetic legacy by contemporary Native storytellers is a crucial act of recovery, which imagines and architects a functional framework for a Poetics of Decolonization that may be adopted and adapted by tribal artists from myriad nations to create works (on the page and stage) that will effect the healing, transformation and survivance of their communities. Chapter One examines the early personal and professional histories of the Miguel sisters who are Spiderwoman’s founders. Through an exploration of their socio-economic positioning, their difficult home life, the racialized narratives by which they were defined outside the home and their artistic development within these impossible conditions, this chapter unpacks instances of personal and familial resistance to the forces of colonization and reveals the seamless weave that so inextricably binds art and life. Chapter Two documents the early history of Spiderwoman Theater and offers a processual analysis of its transformation from a multi-racial, feminist collective to an American Indian theatre troupe, charting the personal decolonization of the Miguel sisters and the intersection of this very personal transformation with the politically (re)vital(izing) creation of a decolonizing aesthetic. Chapter Three engages with this aesthetic to clearly demonstrate how it works within and through the living bodies who utilize it in the rehearsal studio. Next, I examine Spiderwoman’s published texts to reveal the ways in which the Storyweaving process has shaped the affects of these works on the artists and their audiences. Finally, Chapter Five names and evaluates the benefits of Spiderwoman’s legacy and estimates its future benefits as Spiderwoman’s heirs take up its process and adapt it to meet the needs of their communities.

Identity and environmentalism in zapatista public discourse on the montes azules biosphere reserve

Since they first emerged into the public consciousness in 1994, the Zapatista National Liberation Army (EZLN) has gathered considerable attention and support on the world stage for its struggle with the Mexican federal government over the issue of indigenous rights. The Zapatistas are now popularly viewed as indigenous rebels standing up for indigenous rights against the neoliberal economics. Yet comparatively less attention has been given to its struggles with the federal government over an area of protected land within the Lacandón jungle known as the Montes Azules Biosphere Reserve. The conflict is centered on a large settler population within the Reserve and whether it is a threat to the jungles viability. The environmental group, Conservation International (CI) believes that they are, yet the settlers enjoy the support of the EZLN, who opposes any attempt to move them. Despite this dispute, the two organizations claim seemingly similar goals. CI has declared that it is dedicated to local control over conservation projects. Meanwhile, EZLN has been fighting for greater local political power in regards to indigenous government. More striking still, is that this matter has placed the EZLN in direct opposition to the Lacandón Maya, even though it has portrayed itself as the defender of all of Mexicos indigenous people.<p>It is these apparent contradictions between the EZLNs political positions and the actual sides of the conflict that make the struggle over Montes Azules worth examining. Beyond the simplified statements of public platforms, the objections of the EZLN to the reserve and its supporters to the Lacandones position are rooted in historical conflicts over decision making on landholding. The EZLN feels that the government has constantly excluded indigenous farmers from decision making over this matter to their detriment and thus it feels that local control over land is a fundamental part of indigenous life. As such its position on Montes Azules must be understood in terms of how its ideas of being indigenous come into conflict with the Lacandón Mayas territory in the reserve and CIs position on the settler population. In this way indigenous identity is seen not merely as a matter of cultural significance, but a foundation for a concrete political agenda, which is articulated in the EZLNs stance over Montes Azules.
