Reflections from psychoanalysis on justice, law and legality in Peru / Reflexiones psicoanalíticas acerca de la justicia, la ley y la legalidad en el Perú de hoy

This article proposes a reflection on the irrational aspects of justice and legality that remain veiled in the debate on the difficulties of judicial reform processes in our region and which are expressed harshly in gender violence. Psychoanalytic contributions on culture state that the existence of the unconscious (the instinctual life of the subject) is that which enables the establishment of the law. From this perspective, conflict is inherent in human beings and the anxieties it arouses cannot be bypassed or denied. Therefore, the establishment of limits and a healthy expression of aggression depend on the internal construction of legality in the subject. On the intersubjective level, the mismatch between the expectations of the population and justice operators is associated with the confusion between social reality and the real (Lacan), generating a basic misunderstanding to be solved. As a method, fundamental psychoanalytic concepts are employed and situations of violence against women from Peruvian rural communities are discussed. The paper concludes that it is essential to any process of change or reform to work around the elaboration of anxieties that block the task in institutions and groups. This work facilitates access to justice, while generating new knowledge in this field. / El presente artículo propone una reflexión sobre los aspectos irracionales de la justicia y la legalidad que permanecen velados en el debate sobre los procesos de reforma judicial en nuestra región. Estas dificultades se expresan de manera descarnada en la violencia de género. Los aportes psicoanalíticos sobre la cultura permiten postular que la existencia del inconsciente (la vida pulsional del sujeto) es aquello que posibilita la instauración de la ley. Desde esta perspectiva, el conflicto resulta inherente al ser humano y las ansiedades que este despierta no pueden ser soslayadas o negadas. Por ello, la instauración de límites y la expresión saludable de la agresión dependerá de la construcción interna de la legalidad en el sujeto. En el plano intersubjetivo, el desencuentro entre las expectativas de la población y los operadores de justicia se asocia con la confusión entre la realidad social y lo real (Lacan), generando un malentendido básico a resolver. Como método, se emplean conceptos psicoanalíticos fundamentales y situaciones de violencia contra la mujer de comunidades rurales peruanas. Se concluye que es imprescindible, para cualquier proceso de cambio o reforma, permitir espacios para elaborar las ansiedades que bloquean la tarea en las instituciones y grupos humanos. Esta labor facilita el acceso a la justicia, a la vez que genera un nuevo conocimiento en este campo.

An issue that has always caused controversy, both in the theory and in the practice, is the application of the law over time, which becomes more complex in terms of its non-retroactivity or retroactivity. In the present article, the author develops theretroactivity of the most favorable rule principle. First, the author describes the concept and fundamentals of retroactivity. Then, he reports its normative support and its delimitation. Finally, the author exposes the most discussed and controversial assumptions on its application and non-application, making parallels with its regulation in Spain. / Un tema que siempre ha causado controversia, tanto en la teoría como en la práctica, es la aplicación de la norma jurídica en el tiempo, la cual se complejiza en cuanto a su irretroactividad o retroactividad. En el presente artículo, el autor desarrolla el principio de la retroactividad de la norma más favorable. En primer lugar, describe el concepto y fundamentos de la retroactividad. A continuación, informa sobre su sustento normativo y su delimitación. Finalmente, expone los supuestos discutidos sobre su aplicación e inaplicación, haciendo un paralelismo con su regulación en España.

Este estudo aborda a viabilidade de enfrentamento, pela autoridade julgadora em processo administrativo fiscal, do argumento de inconstitucionalidade da lei que determina a exigência do tributo. Procede-se a uma análise crítica, a partir de precedentes dos Conselhos de Contribuintes do Ministério da Fazenda, da solução usualmente adotada, de não-conhecimento da irresignação do contribuinte, sob o fundamento da reserva de jurisdição. A proposta defende a possibilidade de pronunciamento do julgador administrativo, com efeitos para o caso concreto, além de sustentar a hipótese como um direito do contribuinte, à luz da garantia constitucional do devido processo legal e dos princípios da legalidade, da moralidade e da eficiência. / This study has the purpose of analyzing how the judge when ruling on administrative and fiscal lawsuits has the possibility of challenging the constitutionality of specific tax laws. Critical analysis has been done based on case laws from Taxpayers Councils at the Treasure Department, unknown taxpayers’ confrontation, and jurisdiction. This paper presents the possibilities the judge has when analyzing the suit and the defendant’s right related to constitutional guarantees concerning the due process of law and the principles of legality, morality and effectiveness.

A multiplicação dos acordos regionais de comércio e a consolidação do sistema mercantil multilateral na estrutura GATT/OMC colocaram a compatibilidade entre as iniciativas localizadas e as normas gerais no centro das atenções do direito do comércio internacional. Nesse contexto, ainda que a doutrina busque reafirmar repetidamente a necessidade de conformação dos sistemas menores com o acordo global, pouco se discute o real conteúdo dessa harmonização exigida em razão, principalmente, da extrema abertura textual dos termos dos tratados que tratam das exceções às cláusulas gerais multilaterais. Em resposta a essa instabilidade, propõe-se neste trabalho o afastamento dos requisitos objetivos em favor da compreensão dos axiomas gerais do sistema internacional de comércio como chave da conformidade do particular com o multilateral. Essa releitura proposta à unidade do direito internacional econômico exige que se entenda, primeiramente, a teorização positivista tradicional, isto é, o estudo de perspectivas teóricas como as de Hans Kelsen e H.L.A. Hart, para que, em um segundo momento, seja possível lançar mão de ensaios como os de Martti Koskenniemi para a compreensão da aparente fragmentação do direito internacional atual. No que se refere especificamente à compatibilidade, sugere-se o estabelecimento de um panorama conceitual a partir da divisão de sua abordagem em quatro distintos prismas: o legal, o doutrinário, o do sistema de exame de compatibilidade e o jurisprudencial. Compreendido o contexto teórico aplicável atualmente ao debate entre a unidade e a fragmentação do direito internacional e estabelecidos os entendimentos atualmente disponíveis à compatibilidade, torna-se possível introduzir, finalmente, a universalidade como solução conceitual à conformação do geral com o específico no sistema mercantil internacional. Nesse sentido, o código universal da legalidade idealizado por Klaus Günther aplica-se dedutivamente e, com o auxilio do Minimalismo Moral de Michael Walzer e do Interesse Comunitário de Bruno Simma, induz o estabelecimento de axiomas gerais como conteúdo à compatibilidade do regional com o multilateral no sistema internacional de comércio. Estabilizada a proposta no plano teórico, percebe-se ser possível aplicá-la, ainda, empiricamente à análise específica da relação existente entre a OMC, a ALADI e o MERCOSUL. / The propagation of regional trade agreements and the consolidation of the multilateral market system in the structure of the GATT/WTO placed the compatibility between the local initiatives and the general rules in the center of the international trade law studies. In this context, even though the doctrine confirms several times the requirement for conformation of the smaller systems with the global agreement, there are very few discussions about the real content of this required harmony, mainly because of the extreme indetermination of the terms of the treaties that establish the exceptions to the multilateral general clauses. As an answer for this pointed instability, this study proposes the displacement of the objective requirements in favor of the comprehension of the general principles of the international trade system as the key of the conformity of the particular with the multilateral. This proposal for a new understanding of the unity of the international economic law requires, firstly, the comprehension of the traditional positivist theories, it means the approach of authors like Hans Kelsen and H.L.A. Hart, and, just after that, the study of theories as the ones proposed by Martti Koskenniemi for the comprehension of the apparently fragmentation of the international law nowadays. Specifically with respect to the compatibility, it is suggested the establishment of a division of its conceptual approach in four different fields: the legal, the doctrinaire, the one of the multilateral conformity system of examination and the one of the case-law. After the comprehension of the theories applied in the debate between the unity and the fragmentation of the international law and the establishment of the available understandings of compatibility it is possible to introduce, finally, the universality as a conceptual solution for the conformation between the general and the specific in the international market system. The universal code of legality idealized by Klaus Günther applies deductively and, supported by the Moral Minimalism proposed by Michael Walzer and the Community Interest of Bruno Simma, induces the establishment of general principles as the content of the compatibility between the regional and the multilateral in the international trade system. As long as the proposal seems stabilized, it is possible to realize that it can be applied, empirically, for the specific analysis of the relationship that exists between the WTO, the LAIA and the MERCOSUR.

O presente trabalho analisa as hipóteses em que cabe às agências reguladoras exercer função normativa (compreendida como a edição de textos normativos gerais e abstratos), examinando a natureza dessa função, suas relações com as outras competências e instrumentos normativos do Poder Executivo e do Poder Legislativo e o controle jurisdicional que se realiza sobre essa atividade das agências reguladoras. Nessa tarefa, é examinada a evolução doutrinária e jurisprudencial, no sistema brasileiro e nos ordenamentos jurídicos que mais nos influenciaram nessa matéria, sobre a compreensão a respeito dos princípios da separação dos Poderes e da legalidade. As principais questões enfrentadas referem-se à identificação dos limites da válida edição de atos normativos pelas agências reguladoras, ao regime jurídico aplicável a essa figura normativa e às possíveis soluções para eventuais conflitos de normas envolvendo atos normativos editados pelas agências reguladoras. / This paper examines the assumptions according to which it is possible for the regulatory agencies exert regulatory function (understood as the enactment of general and abstract normative texts), examining the nature of such function, its relations with other powers and legislative instruments used by the Executive Branch and the Legislative Branch and the judicial review over the activities performed by the regulatory agencies. In this task, it\'s analysed the doctrinal and jurisprudential developments, in the Brazilian system and the legal systems that most influenced Brazil in this area, on the understanding about the principles of separation of powers and legality. The main issues addressed relate to identifying the limits of valid normative acts enacted by regulatory agencies, the legal regime applicable to such normative figure and possible solutions for conflicts of rules involving normative acts issued by regulatory agencies.

A presente dissertação possui por objeto discutir o controle judicial da atividade normativa das agências reguladoras no direito brasileiro. O trabalho é dividido em três partes. Na primeira, é analisa a evolução do princípio da separação de poderes ao longo dos séculos XIX e XX, bem como a receptividade dele no início do século XXI, notadamente em virtude do processo de retirada do Estado da intervenção direta na economia, como prestador de serviços aos cidadãos, e sua recolocação como regulador das atividades econômicas. Também é analisada na primeira parte como tais mudanças econômicas e sociais implicaram em uma alteração do papel do Poder Judiciário que, inicialmente criado como o menos ativo dos poderes, tornou-se órgão central para a efetivação dos direitos da democracia contemporânea. Na segunda parte, é analisada a atividade normativa das agências reguladoras, com a defesa da tese da delegação legislativa, bem como com a verificação dos requisitos procedimentais e materiais que devem ser observados pelas agências reguladoras na expedição dos atos normativos e de como tais requisitos acabam por limitar a discricionariedade dos entes reguladores. Na terceira parte, é feita a verificação do controle judicial da regulação, tendo como premissas a adoção pelo direito brasileiro do sistema da unidade de jurisdição e as diferenças funcionais entre o Judiciário e a Administração no estabelecimento de políticas públicas, com a defesa de que o controle judicial dos atos normativos das agências reguladoras deve se dar de modo negativo, ou seja, sem que o Judiciário possua competência para a estipulação da política regulatória a ser seguida, e de forma responsiva, ou seja, com a análise das consequências do controle judicial sobre o setor regulado, devendo o magistrado analisar não apenas os aspectos de legalidade do normativo questionado, mas também a finalidade do sistema regulado e os impactos que a decisão judicial terá sobre ele. / The object of the current thesis is to discuss the judicial control of the normative activity of the regulatory agencies according to Brazilian law. This paper is divided into three parts. At first, the evolution of the principle of the separation of powers across the Nineteenth and the Twentieth century will be analyzed, as well as the reception of such principle in the early Twenty-one century, especially due to the process of disengagement of the State from the direct intervention in the economy (as a provider of services to the citizens) and its replacement as a regulator of economic activities. Also in the first part, it will be analyzed how such economical and social changes caused a modification of the role of the Judiciary branch which, initially, was created as the less active of the State powers, becoming the central body for the effectiveness of the contemporary democracy rights. The second part analyzes the normative activity of the regulatory agencies, with the defense of the thesis of legislative delegation, as well as with the verification of the procedural and material requirements that must be observed by the regulatory agencies in the issuance of normative rulings and how such requirements end up limiting the discretion of the regulatory bodies. In the third part the verification of the judicial control of such regulation is carried out, having as its premises the adoption, by Brazilian law, of the unity of jurisdiction system and the functional differences between the Judiciary branch and the Public Administration in the establishment of public policies, being defended that the judicial control of the regulatory agencies normative rulings must be made in a negative manner, i.e., without the Judiciary having the competence for the stipulation of the regulatory policy to be followed, as well as in a responsive manner, i.e., with the analysis of the consequences of the judicial control over the regulated sector, being the magistrate responsible for analyzing not only the aspects of legality of the questioned normative rulings, but also the objective of the regulated system and the impacts of the judicial decision on it.

Recuperação judicial de empresas: atuação do juiz / Judicial Corporate Reorganization: Judge\'s Role

Esta dissertação tem como objeto a análise da atuação judicial no âmbito dos processos de recuperação judicial de empresas, regulados pela Lei nº 11.101 de 9 de fevereiro de 2002 (\"LRE\"). No primeiro capítulo, são introduzidas as limitações do trabalho e as principais questões a serem respondidas ao longo do texto. No segundo capítulo, são expostos os panoramas histórico e jurídico da LRE, para que se extraiam os verdadeiros objetivos tutelados pela lei e o diálogo destes objetivos com a atuação do Poder Judiciário. No terceiro capítulo, são propostos três níveis de intervenção judicial no bojo do processo de recuperação, sendo eles: (a) o controle de legalidade estrita, por meio do qual o juiz verificará a observância aos requisitos e vedações impostos pela LRE ao conteúdo do plano de recuperação e à sua votação; (b) o controle de legalidade material ou controle de juridicidade, por meio do qual o juiz avaliará se o conteúdo do plano e sua votação atendem aos princípios gerais orientadores do ordenamento brasileiro; e (c) o juízo de viabilidade, por meio do qual o juiz, usando de critérios objetivos sugeridos pela doutrina, avaliaria o mérito do plano de recuperação judicial para averiguar se, além de atenderem aos critérios de legalidade, as disposições do plano de recuperação atingem os objetivos traçados pela LRE, no sentido de tutela da empresa viável e tutela institucional do crédito. No quarto capítulo, são retomadas as conclusões alcançadas ao final de cada um dos subcapítulos. / This study aims at the analysis of the role played by judges in connection to the proceedings of judicial corporate reorganization established under Federal Law No. 11.101, dated February 9, 2002 (\"LRE\"). In the first chapter, the limitations to this study and the main questions to be answered herein are introduced. In the second chapter, the legal and historical backgrounds of LRE are presented. In the third chapter, we propose three (3) different levels of judicial intervention related to the judicial corporate reorganization procedure: (a) the control of strict legality, by means of which the judge will monitor whether the reorganization plan and the deliberation organized for the plan to be voted are in compliance with the requirements and prohibitions imposed by LRE; (b) the control of substantive legality, through which the judge will assess whether the plan\'s content and its voting meet the general principles that govern Brazilian legal system; and (c) a feasibility judgment, by means of which the judge, using some objective criteria suggested by doctrine, evaluates the merits of the judicial reorganization plan to determine whether, the recovery plan provisions reach the goals set by LRE, in the sense of protection of viable companies and institucional credit.

This attitude has been perpetuated over the absolute, social and liberal state models for maintaining order and power. In absolutism the truth was identified with of the sacredness of the laws. In liberalism the truth was instrumentalized by pure worship of the rationality of the laws. In the welfare state, even with the semantic expansion, the jurisdiction and power remained correlated. In Brazil, the weak representation in political society favored to monism state that favored the face paternalistic and interventionist. With the imbalance social and expansion of social rights was an escalation in the search of legal protection for the restoration of equality. In the same in proportion that cognitive freedom of the judiciary, there was increased demand that triggered the process to discredit the basis of judicial decisions. In contrast, it is found, through statistical data, that the decisions of first instance is more propitious moment for the realization of the principles of cooperative interactions and orality, and therefore the conclusion of the dispute by conciliation procedure. Denying such a stance, there are speeches in favor of legality, which reinforces the double degree of jurisdiction as a constitutional guarantee, and therefore, unremovable, although this understanding is in misalignment franc with the normative interpretation of legal precedents. The practical result of this dissent is that systematic incursions appellate become unviable the unborn principle of efficiency. The model of the syllogism, still applicable in various situations, allowed way to juridical posture amplified and broke the barrier of absolute, assuming the plausible and reasonable. Had establish the conflict between the legality that legitimizes to appellate systematics and the legality of the efficiency and the equity. Issues such as legal defense and wider debate by appellate process commune to the detriment of those, the example of some questions concerning the procedures collegiate as "judgment-list" and also by comparison of procedural small reforms which extending the powers of judge and allowed to effectiveness of judgments. The landscape scene shows the new projection of Legal Institutions for their restoration and resizing. However, part of the jurisdiction, which is one, uncomfortably, has been ruled out of this process. The base jurisdiction, the accuracy of the strong stamp of legality appellate, are not incorporated as an element of composition of conflicting solutions, behold, its decisions are systematically repulsed. The contemporary juridical posture, apanage of a system of rules and criteria weighting diversified, erected by increasingly plural societies, apparently is consistent in more with this intricate cultural process whose philosophical debates travels the supposed succession between Modernity and Postmodernity / O Estado é um ente vocacionado ao controle e centralização da sociedade. Essa postura tem se perpetuado ao longo dos modelos estatais absoluto, liberal e social pela manutenção da ordem e do poder. No absolutismo houve a verdade identificou-se com a acepção da sacralidade das leis. No liberalismo a verdade foi instrumentalizada pela pura adoração à racionalidade das leis. No Estado Social, mesmo com a abertura semântica, a jurisdição e o poder mantiveram- se correlatos. No Brasil a frágil representatividade da sociedade no plano político deu azo ao monismo estatal que favoreceu a face paternalista e intervencionista. Com o desequilíbrio social e a expansão dos direitos sociais ocorreu a escalada em busca da tutela jurisdicional para a restauração da igualdade. Na mesma proporção que se deu a liberdade cognitiva do Judiciário, ocorreu o aumento da demanda recursal que deflagrou o processo de desprestígio das decisões judiciais de base. Em oposição, fica constatado, através de dados estatísticos, que nas decisões de primeira instância ocorre o momento mais propício para a concretização dos princípios da cooperação intersubjetiva e da oralidade, e portanto a conclusão do litígio pelo procedimento conciliatório. Negando tal postura, existem discursos em prol da legalidade que reforça o duplo grau de jurisdição como perfil de garantia constitucional, e portanto, inafastável, embora esse entendimento se encontre em franco desalinhamento com a interpretação normativa e com os precedentes jurisprudenciais. O resultado prático desse dissenso é que as sistemáticas incursões recursais inviabilizam o nascituro princípio da eficiência. O modelo do silogismo, ainda que aplicável em várias situações, cedeu espaço a juridicidade amplificada que rompeu a barreira do absoluto, admitindo-se o verossímil, o razoável. Instaurou-se o embate entre a legalidade que legitima a sistemática recursal e a juridicidade da eficiência e da equidade. Questões aduzidas como a ampla defesa e ampliação do debate pelas vias recursais comungam em desfavor dessas a exemplo de indagações acerca de alguns procedimentos colegiados como julgamentos em lista e, também, pelo cotejo das minirreformas processuais que alargaram os poderes do magistrado e possibilitaram a efetividade das decisões judiciais. O panorama macrossistêmico demonstra a nova projeção das Instituições Jurídicas pela sua revitalização e redimensionamento. A jurisdição deve ser célere e calcada o mais próxima possível da verdade; porém, o novo modelo de decisão justa é aquela que se apresenta mais sob a forma do desapego ao conceito do universalizante, das visões totalizantes, da unidade e das certezas absolutas. O mote é o fractal, o aberto, o plural. No mircossistema jurídico acena-se à tendência da força dos precedentes. Entretanto, parte da jurisdição, que é una, desconfortavelmente, tem sido alijada desse processo. A jurisdição de base, a rigor da forte chancela da legalidade recursal, não se incorpora como elemento de composição das soluções conflituosas, eis que suas decisões são sistematicamente rechaçadas. A juridicidade contemporânea, apanágio de um sistema de regras e critérios de ponderação diversificados, erigidos por sociedades cada vez mais plurais, aparentemente coaduna-se mais com esse intrincado processo cultural cujos debates filosóficos navegam na suposta sucessão entre a Modernidade e a Pós-modernidade

Liminality, Papers and Belonging amongst Zimbabwean Immigrants in South Africa

Philosophiae Doctor - PhD / Introduced in 2010, the Dispensation Zimbabwe Program (DZP) regularised undocumented Zimbabwean immigrants in South Africa. When DZP was closed, the Zimbabwe Special Permit was introduced, which was also replaced by the Zimbabwe Exemption Permit. This thesis examines the lived experiences of Zimbabwean migrants from the time they arrived in South Africa without papers, visas, or permits. It then examines the processes of acquiring DZP papers, processes of replacing it, and how conditions on the permits reinforce a particular notion of belonging for Zimbabwean immigrants. I draw on work inspired by the anthropologist Victor Turner’s (1967) concept of liminality to show that Zimbabwean migrants had been going through various phases of uncertain legal statuses which are all liminal. Through accounts of lived experiences and biographical narratives of migrants who see themselves as ‘entrepreneurs’ in Cape Town, I consider how migrant’s experience the structural effects of documentation and having or not having ‘papers’. It starts with a state of “illegality” because of being an undocumented migrant in South Africa. It proceeds to “amnesty” from deportation following the announcement of DZP. It then proceeds to the filling of application forms for legalisation at Home Affairs. The DZP permits make them “liminal citizens” in that they got political citizenship by virtue of being documented, but at the same time, the migrants do not enjoy full citizenship status economically. There is also “legal suspension” as in the period between applications for replacement of the permit with another for example from Zimbabwe Special Permit (ZSP) to Zimbabwe Exemption Permit (ZEP). The imposition of conditions in permits that it will not be renewed or extended throws them into a condition of “temporary conditional legality”. As a result, the liminality experienced is both existential and juridical. Juridical liminality results from uncertain legal status whether the migrant is documented or not. Juridical liminality is inherent in law and immigration policy. Existential liminality is because the uncertain legal status permeates all aspects of Zimbabwean immigrants’ lives and delimits their range of action in different spheres. This includes jobs, transnational capabilities, business, family, housing, and schooling for their children. Most studies on migration do not extend their arguments beyond that permits matter as they see them as giving immediate access to social and economic rights. In this thesis, I do not only examine how a condition of being an undocumented immigrant shapes aspects of immigrants’ lives but I further examine the experiences of living with temporary visas and their impact on their lives and family. Whereas in a rite of passage, the liminal stage is temporary, Zimbabweans in South Africa are living in chronic liminality. In all phases of liminal legality, the thesis demonstrates state power through documents/visas in shaping migrant lives deepening our understanding of immigrant incorporation, exclusion, citizenship and belonging.

The teacher certification system was introduced in Sweden on July 1, 2011,through the Act (2011: 189), reforming the Swedish Education Act. The purposeof the new certification system was to increase the quality of Swedish schools, toraise the status of the teacher profession and to clarify what preschool andschoolteachers can teach. As a result of this new system, only certified preschooland schoolteachers can be permanently employed in Swedish schools, and onlycertified schoolteachers are able to set grades on their own.The certification of preschool and schoolteachers can be revoked if at leastone of the conditions stated in Chapter 2, Section 23, Paragraph 2 in the SwedishEducation Act (2010:800) is met. The Teachers Responsibility Board (Lärarnas-ansvarsnämnd) was formed, in part, in order to make decisions regarding revo-cations of teacher certifications. The Teachers Responsibility Board´s decisionscan be appealed to the Administrative Court.The purpose of this essay is to investigate whether Chapter 2, Section 23, Par-agraph 2, in the Swedish Education Act about revocation of preschool andschoolteacher’s certification fulfills the requisites of clarity and predictability,which follow from the constitutional principle of legality.Case laws from the Teachers Responsibility Board and from the Administra-tive Court have been used, to a large extent, in this essay to examine how thedecision-making bodies have interpreted and applied the aforementioned legalprovision.The conclusion is that Chapter 2, Section 23, Paragraph 2, in the SwedishEducation Act doesn´t fulfill the requisites of clarity and predictability that followfrom the constitutional principle of legality because this legal provision is vagueand ambiguous.The teacher certification system is a relatively new system, and there is a lackof research on the subject, which justifies the need to investigate this topic fur-ther.
