La mise en œuvre des différents textes adoptés récemment ainsi que les évolutions jurisprudentielles intervenues ces dernières années ont fait évoluer le rôle du juge administratif (l’excès de pouvoir). Dans bien des domaines, son rôle va en effet désormais au-delà de la simple confrontation d’un acte administratif avec la règle de droit. Au cœur de la décision d’annulation se place désormais, outre l’interprétation de la loi, un relevé et une appréciation des faits, éléments que l’on séparait d’ordinaire à raison du principe de la séparation entre l’administration et son juge.Quelques jurisprudences devenues très classiques, comme d’autres plus récentes, peuvent être considérées comme des manifestations caractéristiques de cette nouvelle tendance du juge à imposer une lecture pragmatique de la légalité, à concevoir une certaine cohérence entre le droit applicable et la réalité des faits, rendant ainsi utile toute annulation contentieuse prononcée dans ce sens. / The role of the administrative judge (the excess of power) has evolved due to the implementation of the various texts adopted recently as well as the developments in the case-law in recent years. In many areas, its role now goes beyond the mere confrontation of an administrative act with the rule of law. At the heart of the annulment decision is a statement and an assessment of the facts, apart from the interpretation of the law, which were usually separated by the principle of separation between the administration and its judge.Some jurisprudence which has become very classical, as well as others more recent, can be considered as characteristic manifestations of this new tendency of the judge to impose a pragmatic reading of the law, to conceive a certain coherence between the applicable law and the reality of the facts, thus rendering useful any annulment contentious pronounced in this sense.

Sometimes related to discussions about the relevance of corporate governance practices on the financial performance of companies, especially in the context of emerging countries, works such as Klapper and Love (2004), Braga-Alves and Morey (2012), Claessens and Fan (2002) and Claessens and Yurtoglu (2013) investigated, in addition to the analysis on the prism of indicators of governance rights, verify that factors associated with governance (such levels legality of countries) could influence the performance of companies. In this perspective, the present study sought to investigate on the effects of corporate governance, expressed through the proposed by Carvalhal-da-Silva and Leal (2005) by examining the relevance in explaining corporate performance model. This research, unlike other works, left a recent methodological proposal (BRAGA-ALVES; MOREY, 2012), focusing on the relationship and interaction of institutional factors (risks specific to the business environment in the country level) and Governance. From a quantitative approach, focused on the correlation analysis - using the Pearson correlation coefficient of - and regression analyzes, using panel data, this study tested the research hypotheses related to the relationship between governance, political and institutional indicators financial performance of publicly traded companies in Brazil, Chile and Mexico in the period 2008-2012. With a total sample of 1245 observations and 249 firms, this study showed a statistically significant relationship between corporate governance and financial performance. Likewise, indicators of political and institutional differences proved significant in the estimated models. The results thus reaffirm that the literature already discussed: higher corporate governance practices are directly related to higher levels of financial performance. The end result of the work , in turn, showed that the interaction proposed by Klapper and Love (2004), between specific factors of the institutional environment of firms and corporate governance can influence, being even more robust than the financial performance of companies individual review of these factors. Among the main contributions of this work may be mentioned the expansion of the empirical results for developing countries , particularly Latin America, and the observed results , regarding the interaction of corporate governance and political- institutional factors of the countries on corporate performance. Among the limitations, in turn, provides an indication of those relating to the formatting of the database - data scarcity and limits to direct research - and the results of Carvalhal-da-Silva and Leal (2005) model / Um dos temas de atual discussão no campo de Finanças, mas ainda em aberto a debates de cunho teórico-empírico, é o da Governança Corporativa. Algumas vezes relacionados a discussões sobre a relevância das práticas de Governança sobre o desempenho financeiro das empresas, em especial no contexto de países emergentes, trabalhos como os de Klapper e Love (2004), Braga-Alves e Morey (2012), Claessens e Fan (2002) e Claessens e Yutorglu (2013) buscaram, além da análise sobre o prisma de indicadores direitos de Governança, verificar se fatores associados à Governança (a exemplo dos níveis de legalidade dos países), poderiam influenciar o desempenho das empresas. A presente pesquisa, diferentemente de outros trabalhos, partiu de uma proposta metodológica recente (BRAGA-ALVES; MOREY, 2012), focando na relação e na interação de fatores institucionais (riscos específicos do ambiente das empresas, em nível de país) e a Governança. Partindo de uma abordagem quantitativa, focada em análises de correlação através do coeficiente de correlação de Pearson e análises de regressões, por meio de dados em painel, a presente pesquisa testou hipóteses de pesquisa relacionadas à associação entre Governança, indicadores político-institucionais e o desempenho financeiro das companhias de capital aberto no Brasil, Chile e México no período de 2008 a 2012. Com uma amostra total de 1245 observações e 249 empresas, o presente trabalho evidenciou uma relação estatisticamente significante entre Governança Corporativa e desempenho financeiro. Da mesma forma, os indicadores das diferenças político-institucionais se mostraram significantes nos modelos estimados. Os resultados, dessa forma, reafirmam o que a literatura já discutira: práticas superiores de Governança Corporativa têm relação direta com melhores níveis de desempenho financeiro. O resultado final do trabalho, por sua vez, evidenciou que a interação proposta por Klapper e Love (2004), entre fatores específicos do ambiente institucional das empresas e a Governança Corporativa, pode influenciar o desempenho financeiro das empresas, sendo até mais robusto do que a verificação individual desses fatores. Entre as principais contribuições do presente trabalho pode-se citar a ampliação dos resultados empíricos para países emergentes, em especial a América Latina; e os resultados observados, no tocante à interação da Governança Corporativa e os fatores político-institucionais dos países sobre o desempenho empresarial. Apresenta-se a dicotomia existente entre a filosofia e a poesia para então demonstrar, apesar disso, como o desenvolvimento e a implementação de um filosófico, e portanto racional, regime político baseado na legalidade, para Platão, não podem prescindir, em certa medida - especificamente para sua efetividade -, da consideração e uso de instrumentos de caráter poético, ou seja, próximos do a-logos. / This is a study of the platonic political philosophy made by the perspective of the rights foundations in the text of the Laws. It begins showing the dichotomy between philosophy and poetry to then demonstrate, nevertheless, how the development and implementation of a philosophical, and therefore rational, political regime based on legality, for Plato, can not do without, to some extent - specifically for its effectiveness -, the consideration and use of instruments of poetic character, i.e., near the a-logos.

nÃo hà / Expropriation and involuntary resettlement are considered the major negative impacts caused by the construction of water works, not only in CearÃ, but in the world as a whole. This study aimed to verify not only the importance of these constructions works , but to point out its main negative impacts , notably among them the expropriation and involuntary resettlement . It was further identified the need to update and regulate the first and only law of CearÃ, which governs on involuntary resettlement , on the legal basis the fundamental principles laid down by the Public Administration . The research also discusses the new social policy introduced by the World Bank concerning the expropriation and involuntary resettlement, within a socio-environmental context. The work also presents legal instruments to guarantee the Public Administration to evict and resettle affected families within a sustainable policy, but having as support the constitutional principle of legality. Key words: expropriation and involuntary resettlement; negative impacts; / As construÃÃes de obras hÃdricas, embora necessÃrias causam grandes impactos negativos a fauna, a flora e principalmente as famÃlias desapropriadas que residem nas Ãreas atingidas pela implantaÃÃo dos projetos. Nesse sentido, o Banco Mundial introduziu no Brasil e, em especial, no Cearà uma nova polÃtica, a do social, criando a figura jurÃdica do reassentamento involuntÃrio. Tudo pelo fato de que as construÃÃes de obras hÃdricas, em especial as barragens, nÃo devem ser entendidas como instrumentos de desorganizaÃÃo social e econÃmica, mas sim como mecanismos necessÃrios para o armazenamento de Ãgua no perÃodo das chuvas. A inexistência expressa da garantia à morte digna no ordenamento legal brasileiro causa desamparos legais e inobservância dos princípios bioéticos, fazendo-se necessárias a regulamentação jurídica com relação ao tema, respeitando a vontade dos pacientes e retirando – quando for o caso – a possibilidade de aplicações civis, administrativas e penais aos profissionais de saúde que praticarem ou induzirem a morte de pacientes em estágio terminal da vida, explicitando os posicionamentos majoritários e as correntes doutrinárias que enfatizam a necessidade de normatização da morte digna como questão de direitos humanos. O princípio da dignidade da pessoa humana, neste cenário, constitui fundamento ao direito de morrer com dignidade, visto que é o epicentro da ordem jurídica brasileira, correlacionado com a autonomia e a justificativa para o consentimento informado dos pacientes terminais, especialmente nos casos de ortotanásia. Com isso, visamos proporcionar a compreensão do conceito humanista sobre a morte digna e as bases para a regulamentação jurídica do instituto na forma da ortotanásia. / The present dissertation has the intention to demonstrate the current conception of dignified death and its repercussion in the Brazilian juridical panorama, approaching – at first – the medical-juridical differentiation of the institutes that study life's terminality. Death and dying have diverse connotations and human behaviour in choosing dignified death permeates contexts which are educational, philosophical, juridical, psychological among others. The express nonexistence dignified death's guarantee in the Brazilian legal system causes lawful abandonment and nonobservance of bioethical principles, juridical regulation becoming necessary pertaining to the matter, respecting the patient's will and withdrawing – when necessary – the possibility of civil, administrative or penal sanctions to the health care professionals who practice or induce the death of terminal patients, explaining the major understanding and the doctrinaire lines which emphasize the necessity of dignified death's standardization as a matter of human rights. The principle of the dignity of the human person, in this scenario, constitutes foundation to the right of dying with dignity, seeing that it is the epicenter of the Brazilian legal order, correlated with the autonomy and the justification to informed consent of terminal patients, especially in cases of ortothanasia. Thereat, providing the comprehension of the humanist concept about dignified death and the foundations to the juridical standardization of the insitute, in the form of ortothanasia, was aimed.

Prohibited means and methods of armed conflicts The goal of this diploma thesis is to analyse more frequent use of Unmanned Air Vehicles (UAV) in armed conflicts under the international humanitarian law. Although the idea to use UAV is not new, there has been a boom of their deployment in last two decades. Technological progress, the transformation of the nature of armed conflicts and the idea of the war on terror are the main reasons why UAVs have become an indispensable tool in war equipment of all the main world's armies. But just like every new technology, also UAVs raise questions about their legality. Therefore, this work aims to assess whether UAVs may represent prohibited mean of warfare or whether their usage is not in contrary to international humanitarian law. The main text of this diploma thesis consists of five main thematic blocks. The first chapter represents an excursion into the history and development of international humanitarian law. It outlines its division into two branches, the Geneva and Haague law. In addition the first part also defines its position within public international law and its interaction with international law of human rights. Lawyering for the 'mad': an institutional ethnography of involuntary admission to psychiatric facilities in Poland

Located squarely within the experiences of legal aid lawyers, with particular emphasis on the challenges they face in delivering effective representation, this dissertation, designed as an institutional ethnography, problematizes the provisions and practices related to involuntary admission in psychiatric facilities in Poland, as well as the organization of legal aid representation in involuntary admission cases. Through detailed accounts of paramedics, psychiatrists, judges, and legal aid lawyers’ work, connected and coordinated by legal and administrative texts, I demonstrate how the disjuncture between institutional regimes and lawyers’ experiences is institutionally produced by the set of legal, professional, financial, and social relations that organize both the involuntary admission procedure and the system of legal aid in Poland. While I start my exploration with legal aid lawyers’ embodied experiences of performing their work, accounting for how that work is organized and coordinated in local sites, this dissertation moves beyond a solo ethnographic description in seeking to discover relations, especially the social and legal relations mediated by the texts that govern these local experiences and practices. I trace the material and discursive practices that operate in key sites to organize the legal aid system, involuntary commitment procedures, and judicial decision-making. In Poland, the overwhelming majority of involuntary commitment cases are taken on by legal aid lawyers, whose work conduct is bound by both the law and a code of professional ethics. In this dissertation, I advance my thesis by closely reviewing the legal context of involuntary commitment; the material practices associated with legal aid lawyers, such as appointment, client access, and remuneration; the processes through which psychiatric documents are created and attached to admittees; and the role psychiatrist-generated texts play in court. I argue that within the context of involuntary admission, lawyering is organized in such a way that legal aid attorneys are unable to perform at their utmost, in a way that would most benefit their clients. Moreover, through my research I show that―despite perhaps their best intentions―legal aid lawyers not only actively participate in the practices that circumscribe the space for their legal advocacy for admittees, but also reproduce the very discourses and practices that objectify people during involuntary admission procedures to psychiatric facilities in Poland. / Graduate

Art Juridified: Legality in Contemporary Art Workings

abstract: Art and law have a troubled relationship that is defined by steep hierarchies placing art subject to law. But beyond the interplay of transgressions and regulations, manifest in a number of high-profile cases, there are more intricate connections between the two disciplines. By expanding the notion of law into the concept of a hybrid collectif of legality, the hierarchies flatten and unfamiliar forms of possible interactions emerge. Legality, the quality of something being legal, serves as a model to show the capricious workings of law outside of its own profession. New juridical actors—such as algorithms—already challenge traditional regulatory powers and art could assume a similar role.
