SPECIES AND GENOTYPE DIVERSITIES OF YEASTS IN THE CLINICAL AND NATURAL ENVIRONMENTS IN HAMILTONMaganti, Harinad Babu 10 1900 (has links)
<p><strong><br /></strong></p> / <p><strong>In Canada the incidence of yeast infections have increased over the past decade, which in turn has resulted in the increased mortality and morbidity rates among the immuno-compromised patients. Yeasts are ubiquitous in nature and constitute a healthy portion of human skin and gut flora. Factors such as the urban settings and food have been previous shown to influence the yeast flora people harbour. This makes us believe that to effectively tackle the rising yeast infections in Canada we need to not only conduct epidemiological yeast studies in clinical settings but should also understand the diversity and distribution of them in the urban environment. This thesis constitutes of an epidemiological fungemia study and an urban environmental yeast profiling study conducted in the city of Hamilton.</strong></p> <p><strong> </strong></p> <p><strong>In the first chapter of the thesis I discuss the results of the epidemiological candidemia study. We noticed that over the past decade the mean age of the population with candidemia in hospitals within Hamilton has increased by 10 years. DNA fingerprinting analysis suggested that 33% of the blood stream</strong><strong><em>Candida</em></strong><strong> </strong><strong>isolates from January 2005 to February 2009 belonged to 18 clusters, some of which were shared between wards and hospitals. we found that for each of the four species, strains isolated closer to each other temporally were overall genetically more similar to each other as well, which suggested that nosocomial sources likely caused repeated candidemia infections. The study is the first of its sort in Canada and the results of this chapter are expected to aid infection control practitioners in the Hamilton hospitals and make the stay of patients in hospitals safer.</strong></p> <p><strong> </strong></p> <p><strong>In the second chapter, we discuss the diversity and distribution of yeasts prevalent on trees in and around Hamilton. We identified a total of 88 environmental yeasts belonging to 20 species (based on ITS sequence data). The yeast populations were highly heterogeneous in both species and genotype composition. Among the 14 tree species sampled, yeasts were frequently found on cedar, cottonwood and basswood. Interestingly all the</strong><strong> <em>Candida parapsilosis</em> </strong><strong>strains were found from pine tree only. Using a Structuring Approach to Assess the Mechanical Properties of Cellulose Nanocrystal-Based Thin Films / Mechanical Properties Of Cellulose Nanocrystal Thin FilmsGill, Urooj January 2017 (has links)
The goal of this work was to quantify the mechanical properties of cellulose nanocrystal (CNC)-based thin films using a polystyrene (PS) structuring approach. This structuring approach was used to biaxially wrinkle CNC-polymer and all-CNC films, in order to assess how changes in the film fabrication process affected the elastic modulus of these films. All films were prepared on pre-stressed PS substrates and structured by heating them above the glass transition temperature of PS, which caused the substrates to shrink and the films to wrinkle biaxially. CNC-polymer films were prepared using the layer-by-layer approach, where three parameters were modified to obtain films of varying compositions: 1) type of polymer (xyloglucan, XG, or polyethyleneimine, PEI), 2) polymer concentration (0.1 wt% or 1 wt%), and 3) film thickness (i.e., number of deposited bilayers). After these films were structured, their elastic moduli were calculated to be 70 ± 2 GPa for CNC-XG0.1, 72 ± 2 GPa for CNC-PEI0.1, and 32.2 ± 0.8 GPa for CNC-PEI1.0 films, indicating that the mechanical properties of CNC-polymer films changed with film composition. This structuring method was also found to provide a humidity-independent measurement of the modulus due to the irreversible nature of the wrinkling. Next, to prepare all-CNC films, CNC suspensions were evaporated under conditions designed to control the film thickness (using 0.005 wt% – 8 wt% CNC suspensions) and CNC nanoparticle orientation (chiral nematic, isotropic, or uniaxial). Suspensions were dried slowly under vacuum, quickly by heating, or by spin-coating to form films with chiral nematic, isotropic, or uniaxial (radial) CNC orientations, respectively. Following structuring, these wrinkled films showed unique morphologies that changed with nanoparticle orientation, suggesting that their mechanical properties are dependent on the CNC orientation within the films. The work presented in this thesis implies that the mechanical properties of films fabricated from hygroscopic bio-based nanomaterials can be assessed in a humidity-independent way by using the structuring method presented. Quantifying the mechanical properties of these films is critical to assess the potential applications of CNCs, where CNC-based materials may be used in developing paper-based electronics, extracellular matrix mimics, and plant cell wall mimics. / Thesis / Master of Science (MSc)

to find ourselves immersed in a world in which events have a tendency to unfold and overtake us in unforeseeable and novel
ways that defy comprehension; a crisis of meaning takes place and conventional sensemaking is disrupted. Our need to
imaginatively construct new meanings that allow us to understand what is going on and to work out how to respond becomes
ever more pressing. We do live in interesting times. The emergence of the new, however, challenges current established
ways of knowing and opens a creative space for radical learning to take place. Novelty stimulates the generative process by
which organizations and individuals learn, adapt to and cope with the exigencies they face in order to survive and progress.
Such radical learning occurs when creative linguistic interventions in dialogue opens up semantic spaces whereby new terms
are coined and old ones broken up, combined and/or redeployed in novel ways, in an effort to give expression to the fresh
circumstances experienced or new phenomena observed. We call this kind of imaginative linguistic intervention semantic
transformation. In this paper we argue that it is this semantic transformation that promotes radical transformational learning.
Such semantic transformation is predicated on the improvisatory character of dialogue as a form of communication. We
explore how, through this dialogical process of semantic transformation, we discover the resources and means to respond to
the vagueness and equivocality experienced, by exploiting language in novel ways in our attempts to make sense of and
account for such experiences.

Structuration non-linéaire de verres oxydes par laser femtoseconde dans le proche infrarouge / Nonlinear femtosecond near infrared laser structuring in oxide glassesRoyon, Arnaud 17 June 2009 (has links)
La structuration laser femtoseconde en trois dimensions rencontre un intérêt grandissant du fait de sa facilité de mise en œuvre et des nombreuses applications qu’elle peut couvrir dans le domaine des composants photoniques. Des structures telles que des guides d’onde, des réseaux de diffraction, des mémoires optiques ou des cristaux photoniques peuvent être fabriquées grâce à cette technique. Son emploi sur des verres oxydes est prometteur car ces derniers présentent des avantages certains ; ils sont très résistants au flux et au vieillissement, leur composition chimique peut être changée facilement afin de s’adapter à un cahier des charges précis. On les retrouve déjà dans les amplificateurs Raman, les fibres optiques, les lasers à fibres, etc… Le travail de cette thèse s’articule autour de deux grands axes. Le premier axe consiste à caractériser les propriétés optiques linéaires et non-linéaires de matériaux vitreux massifs afin d’optimiser leur composition en vue d’une application particulière. Dans ce contexte, les propriétés optiques non-linéaires, leurs origines physiques (électronique et nucléaire) ainsi que leurs temps de réponse caractéristiques (de quelques femtosecondes à quelques centaines de picosecondes) sont décrits dans le cadre de l’approximation de Born-Oppenheimer. Ainsi, la silice fondue et plusieurs verres sodo-borophosphates contenant différentes concentrations en oxyde de niobium ont été étudiés. Les résultats montrent que les propriétés optiques non-linéaires dans la silice fondue sont majoritairement d’origine électronique, alors que dans les verres sodo-borophosphates, la contribution d’origine nucléaire peut devenir prépondérante lorsque la concentration en oxyde de niobium dépasse 30%. Le second axe s’articule autour de la structuration des matériaux. Trois échantillons commerciaux de silice fondue présentant des conditions de fabrication différentes (donc des taux d’impuretés distincts) et irradiés avec un laser femtoseconde proche infrarouge ont été étudiés. Les défauts induits par laser ont été identifiés au moyen de plusieurs techniques de spectroscopie. Elles ont montré la formation de centres colorés ainsi qu’une densification au niveau de la zone irradiée. Leurs propriétés optiques linéaire (indice de réfraction) et non-linéaire (susceptibilité du troisième ordre) ont été mesurées. De plus, la structuration de la silice fondue à l’échelle sub-micrométrique sous forme de « nano-réseaux » est observée et la biréfringence de forme induite par ces structures est discutée. En plus des échantillons de silice fondue, plusieurs verres oxydes présentant des compositions chimiques très distinctes ont été étudiés. Un verre sodo-borophosphate contenant de l’oxyde de niobium exhibe des micro-craquelures et des nano-crystallites après irradiation. Un verre silicate contenant ou non de l’argent dévoile des structures en anneau fluorescentes ou en « nano-réseaux ». Un verre zinc phosphate contenant de l’argent présente lui aussi des structures en anneau fluorescentes, d’une taille de l’ordre de 80 nm, bien inférieure à la limite de diffraction. Des techniques pompe-sonde sous microscope ont été mises en œuvre sur ce dernier verre pour étudier l’interaction laser-verre. Le mécanisme d’absorption de l’énergie lumineuse pour ce verre est l’absorption à quatre photons. La densité d’électrons libres générée est de l’ordre de 1017 cm-3, ce qui permet de conclure qu’un gaz d’électrons plutôt qu’un plasma se forme pendant l’irradiation laser. / Three-dimensional femtosecond laser structuring has a growing interest because of its ease of implementation and the numerous possible applications in the domain of photonic components. Structures such as waveguides, diffraction gratings, optical memories or photonic crystals can be fabricated thanks to this technique. Its use with oxide glasses is promising because of several advantages; they are resistant to flux and ageing, their chemical composition can easily be changed to fit the well-defined requirements of an application. They can already be found in Raman amplifiers, optical fibers, fiber lasers, and other devices. This thesis is based on two axes. The first axis consists in characterizing the linear and nonlinear optical properties of bulk vitreous materials in order to optimize their composition with a particular application in view. Within this context, the nonlinear optical properties, their physical origins (electronic and nuclear) as well as their characteristic response times (from a few femtoseconds to a few hundreds of picoseconds) are described within the Born-Oppenheimer approximation. Fused silica and several sodium-borophosphate glasses containing different concentrations in niobium oxide have been studied. Results show that the nonlinear optical properties of fused silica are mainly from electronic origin, whereas in the sodium-borophosphate glasses, the contribution from nuclear origin becomes predominant when the concentration of niobium oxide exceeds 30%. The second axis is based on the structuring of materials. Three commercially available fused silica samples presenting different fabrication conditions (therefore distinct impurity levels) and irradiated with a near infrared femtosecond laser have been studied. The laser induced defects have been identified by means of several spectroscopic techniques. They show the formation of color centers as well as a densification inside the irradiated area. Their linear refractive index and nonlinear third-order susceptibility properties have been measured. Moreover, the structuring of fused silica at the subwavelength scale into “nanogratings” is observed and the form of birefringence induced by these structures is discussed. In addition to the fused silica samples, several oxide glasses presenting very distinct chemical compositions have been studied. A sodium-borophosphate glass containing niobium oxide exhibits micro-cracks and nano-crystallites following irradiation. A silicate glass with or without a silver component reveals fluorescent rings or “nanograting” structures. A zinc phosphate glass containing silver also presents fluorescent ring structures, with a size of the order of 80 nm, well below the diffraction limit. Pump-probe microscope techniques have been performed on this glass to investigate the laser-glass interaction. The absorption mechanism is determined to be four-photon absorption. The generated free electron density is ~ 1017 cm-3, which suggests the conclusion that an electron gas rather than a plasma is formed during the laser irradiation.

Système multi-agents pour l'auto-structuration du trafic aérien / Multiagent system for air traffic self-structuringBreil, Romaric 03 October 2017 (has links)
La gestion des flux de trafic aérien (ATFM) cherche à structurer le trafic de manière à réduire la congestion dans l'espace aérien. La congestion étant causée par les avions volant dans les mêmes portions de l'espace aérien en même temps, l'ATFM organise le trafic dans les dimensions spatiales (ex. le réseau de routes) et dans la dimension temporelle (ex. séquencement et fusion de flux d'avions atterrissant ou décollant aux aéroports). L'objectif de cette thèse est de développer une méthodologie qui permet au trafic aérien de s'auto-structurer dans les dimensions spatiales et temporelle quand la demande est élevée. Cette structuration disparait quand la demande diminue. Pour remplir cet objectif, un système multi-agents a été développé, dans lequel les avions coopèrent pour structurer le trafic. Les systèmes multi-agents possèdent plusieurs avantages, incluant une bonne résilience aux perturbations, la résilience étant la capacité du système à modifier ses décisions de manière à retrouver un état stable après l'occurrence d'une perturbation dans son environnement. Dans ce système, trois algorithmes sont implémentés, visant à réduire la com- plexité du trafic de trois manières différentes. Le premier algorithme permet aux agents avions volant sur un réseau de route de réguler leur vitesse de manière à ré- duire le nombre de conflits, un conflit se produisant quand deux avions ne respectent pas les normes de séparation. Le deuxième algorithme permet aux avions de résoudre les conflits quand le trafic n'est pas structuré par un réseau de routes. Le troisième algorithme crée des réseaux de routes locaux temporaires pour structurer le trafic. Les trois algorithmes implémentés dans ce système multi-agents permet de réduire la complexité globale du trafic, qui devient plus simple à gérer pour les contrôleurs aériens. Ces algorithmes sont appliqués à des exemples réalistes et sont capables de structurer le trafic de manière résiliente. / Air Traffic Flow Management (ATFM) aims at structuring traffic in order to reduce congestion in airspace. Congestion being linked to aircraft located at the same position at the same time, ATFM organizes traffic in the spatial dimension (e.g. route network) and in the time dimension (e.g. sequencing and merging of aircraft flows taking off or landing at airports). The objective of this thesis is to develop a methodology that allows the traffic to self-organize in the time and space dimensions when demand is high. This structure disappears when the demand diminishes. In order to reach this goal, a multi-agent system has been developed, in which aircraft cooperate to structure traffic. Multi-agent systems have several advantages, including a good resilience when confronted with disruptive events, resilience being the ability of the system to adapt its decisions in order to get back to a stable state when confronted to a disruption in its environment. In this system, three algorithms have been implemented, aiming at reducing traffic complexity in three different ways. The first algorithm allows aircraft agents flying on a route network to regulate speed in order to reduce the number of conflicts, a conflict occurring when two aircraft do not respect separation norms. The second algorithm allows aircraft to solve conflicts when the traffic is not structured by a route network. The third algorithm creates temporary local route networks allowing to structure traffic. The three algorithms implemented in this multi-agent system allow to decrease overall traffic complexity, which becomes easier to manage by air traffic controllers. This algorithm was applied on realistic examples and was able to structure traffic in a resilient way.

L'extension de la morphologie mathématique au domaine de la couleur ou du multi/hyperspectral en traitement et analyse d'images n'est pas élémentaire. La majorité des approches se sont focalisées sur la formulation mathématique des opérateurs sans prendre en compte le sens physique ou perceptuel de l'information couleur/spectrale.Les outils développés dans ce travail s'inscrivent dans un nouveau formalisme générique basé sur une fonction de distance. Cette construction permet d'utiliser les opérateurs morphologiques dans le domaine de la couleur ou du multi/hyperspectral en adaptant la fonction de distance. De plus, le choix de la fonction de distance rend les opérateurs valides au sens de la perception ou de la physique.Face aux nombre croissant d'approches existantes, des critères de sélection ont été développés afin de les comparer les différentes écritures de morphologie mathématique. Ces critères sont basés sur le respect des propriétés théoriques des opérateurs, sur les propriétés métrologiques et sur l'efficacité numérique.Grâce à un formalisme prenant en compte l'information perceptuelle de la couleur et intégrant une définition valide des éléments structurants non-plats, deux types d'opérateurs de plus haut niveau ont été définis. Le premier est un détecteur d'objets spatio-colorimétrique passant par la définition d'un gabarit spatial et vectoriel. Le second, est le calcul de spectres de textures vectoriels. L'extension des deux propos au spectral a été réalisé et ouvre de nouvelles questions scientifiques. / Mathematical morphology extension to colour or multi/hyperspectral domain in image processing is not straightforward. Most approaches have focused on the mathematical translation of the operators without taking into account the physical or perceptual sense of colour/spectral information. The developed tools in this work are part of a new generic formalism based on adistance function. This construction allows using morphological operators in colour or multi/hyperspectral domain by adapting the distance function. Moreover, the distance function choice validates the operators in the perceptual or physical sense.In front of the increasing number of existing approaches, selection criteria are developed in order to compare the different mathematical morphology constructions. These criteria are based on the validation of the theoretical properties of operators, on the metrological properties and the computational efficiency.With a formalism taking into account the perceptual information of colour and integrating a valid defnition of non-flat structuring elements, two kinds of highest level operators are defned. The frst is a spatial-colorimetric object detector through the defnition of a vectorial and spacial template. The second is the computation of vectorial texture spectra. The spectral extension for both tools is made and opens new scientifc questions.

Este trabalho trata da questão de aprendizagem presente frequentemente entre estudantes do ensino médio e de um curso de Licenciatura em física: a dificuldade em empregar corretamente concepções científicas em questões que se referem a fenômenos termodinâmicos, mesmo tendo já passado pelo ensino desse conteúdo na escola. A pesquisa considera a importância de estabelecer conexões entre áreas de conhecimento complementares e essenciais para promover um ensino consistente; o resgate das raízes filosóficas da termodinâmica, fazendo emergir as estruturas que permitem a elaboração de seu arcabouço teórico em diferentes períodos históricos constitui uma base da pesquisa. Esse resgate nas aulas de física proporcionaria as condições para a emergência das potencialidades criativas dos sujeitos envolvidos no processo de ensino/aprendizagem e poderiam talvez possibilitar aos estudantes fazer uso dos conceitos científicos quando necessário. A análise das pesquisas de Kuhn sobre a conservação da energia e do conceito de obstáculo epistemológico de Bachelard reforçou nossa crença na importância de revolver o passado da ciência na busca das estruturas que sustentam a produção científica de uma época. Essas estruturas orientam a análise do corpus da pesquisa constituído pelas respostas escritas dos estudantes, para questões de termodinâmica e pelas ideias encontradas nos originais de Carnot e Clausius; o levantamento dos estruturantes, bem como as contribuições de outras pesquisas didáticas, resultam em subsídios relevantes para o planejamento de boas situações de ensino. Assim espera-se poder reverter as percepções prévias inadequadas dos estudantes em outras percepções mais amplas apoiadas nos princípios organizadores do conhecimento. / This work is concerned with a Physics learning problem that frequently appears both among secondary school students and also with scienc teaching students: the difficulty for adequately using Physics conceptions regarding to thermodynamics phenomena even after this content has been seen in their scholl activities. The research considers the importance of establishing connections between complementary knowledge areas that are essential for consistent teaching; a recall of the thermodynamical philosophical roots may favor the emergence of structures that have led to its theoretical framework in different historical periods and this has been taken as the basis for this research. This recall in Physics classes favors conditions for the emergence of a creative potential involved in the teaching/learning process and could perhaps enable students do use scientific concepts when necessary. The analysis of Kuhn\'s research on energy conservation and on Bachelard epistemological obstacle concept strengthened our belief on the importance of looking into the past of science in search of structures that sustain the scientific production of na epoch. These structures pointed towards an analysis of the research corpus a constituted by students answers and to thermodynamics questions found in Carnot\'s and Clausius\'s originals; the identification of such structures as well as work by other didactic research authors as relevant contributions for planning favorable teaching situations. Therefore it is expected that students inadequate previous conceptions may be reverted into broader perceptions based on knowledge organizing principles.

Previous issue date: 2017-03-13 / The present research had as main goal to understand the formative potential of the visual productions in the process of reading and cultural constitution of the subjects in the Quixabeira State High School, located in the city of Quixabeira / Bahia. These productions were developed during the participation of the learning subjects in the structing project "Artistic Patrimonial Education" (EPA) promoted annually by State of Bahia?s Educational Department in their high schools. The photo books are produced with historical research and pictures of cultural patrimony (material and immaterial) of the of the subjects? hometown, which were taken with cameras of their smartphones. This data collection was aimed with the purposes of: to analyze the visual productions (photo books), in order to understand their relevance in the reading and cultural constitution of the subject; to recognize the profile of the students who participate in the Artistic Patrimonial Education project in this school; to analyze the collected material(photo books and testimonials of the subjects), observing their socio educational and interpretive potential, from the perspective of critical understanding of visual culture; and to reflect on the process of producing the photo books in the formative processes of the learning subjects as readers and producers of meanings. This is qualitative approach research, inspired by the hermeneutic perspective, which is also used as a method of analyzing the data collected during field research. The methodological procedures performed during the research were analytical observation of photo books made in 2013, 2014 and 2015 in this state high school; a discussion meeting with the participation of ten (10) learners who were part of the project in the 2014 and 2015 editions. Semi-structured interviews with some of the subjects who participated of the EPA project, as well as with teachers of the high school who were also advisors in the project. This study is based on the theoretical field of Visual Culture, where the image is understood among the subjects as having meanings, in a critical perspective of their social roles and functions, from the simple appreciation of images to the formation of interpreters and producers of visual texts. / A presente pesquisa teve como objetivo maior compreender o potencial formativo das produ??es visuais no processo de constitui??o cultural e leitora dos sujeitos no Col?gio Estadual de Quixabeira, localizado na cidade de Quixabeira/Bahia. O levantamento das informa??es visou analisar as produ??es visuais (?lbuns fotogr?ficos) com o intuito de perceber sua relev?ncia na constitui??o do sujeito cultural e leitor; conhecer o perfil dos estudantes que participam do projeto Educa??o Patrimonial Art?stica na referida unidade escolar; analisar os materiais coletados (?lbuns e depoimentos dos sujeitos) observando o seu potencial s?cio educativo e interpretativo a partir da perspectiva da compreens?o cr?tica da cultura visual; e, refletir sobre o processo de produ??o dos ?lbuns nos processos formativos dos sujeitos aprendentes enquanto leitores e produtores de sentidos. ? uma pesquisa de abordagem qualitativa, inspirada na perspectiva hermen?utica que ? utilizada tamb?m como m?todo de an?lise dos dados levantados durante a pesquisa de campo. Os procedimentos metodol?gicos utilizados foram: observa??o anal?tica dos ?lbuns fotogr?ficos referentes aos anos de 2013, 2014 e 2015 nesta unidade; um encontro de discuss?o que contou com a participa??o de 10 (dez) aprendentes que participaram do projeto nas edi??es de 2014 e 2015. E entrevistas do tipo semiestrutruada com alguns dos aprendentes participantes do projeto EPA e tamb?m docentes orientadores do projeto no referido col?gio. Esse estudo baseia-se no campo te?rico da Cultura Visual, onde a imagem ? compreendida como portadora de significados entre os sujeitos numa perspectiva cr?tica dos seus pap?is e fun??es sociais, passando da simples aprecia??o de imagens para a forma??o de sujeitos int?rpretes e produtores de textos visuais.

Previous issue date: 2018-03-27 / Nenhuma / No Estado Democrático de Direito a verdadeira práxis reside na efetiva concretização dos direitos e garantias fundamentais dos indivíduos, e não mais unicamente na realização da vontade concreta da lei. É função da Justiça tutelar os direitos, prestando-se o processo como o meio pelo qual a parte pode alcançar a tutela almejada ao direito em crise de efetividade. Ocorre que, a duração do processo muitas vezes desponta como óbice a gerar prejuízos e situações injustas, lançando ônus precisamente sobre aquele que se encontra na condição de merecedor da tutela jurisdicional. Nesse sentido, fala-se então em tutelas diferenciadas, que prestam-se como meios de regulação provisória da crise de direito em que se encontram o(s) litigante(s). O Código de Processo Civil (Lei nº 13.105/2015)
promoveu grandes mudanças em sede dessas tutelas, ditas ‘tutelas provisórias’, que são remédios processuais, em termos efetivos, para a busca de celeridade na prestação jurisdicional, seja para salvaguardar um direito, para satisfazê-lo, ou mesmo para reconhecê-lo como evidente. Daí que fala-se em um redimensionamento do tempo, a fim de tratar aquilo que François Ost já denominou de destemporalização do Direito. Contudo, para além de uma análise dogmática de todas as inovações advindas com a nova legislação, se mostra necessária uma investigação da própria práxis em sede de cognição sumária, como forma de verificar como o Estado-juiz, a um nível qualitativo, as tem prestado. Nesse especial, surge a Teoria Estruturante do Direito de Friedrich Müller, preocupada diretamente com a
concretização da norma (e, assim, do próprio Direito). É uma teoria que parte de um viés indutivo, sendo considera pós-positivistas, isto é, apta a superar os limites dos positivismo jurídico (mera formalidade em detrimento da substancialidade). Diretamente ligada a corrente jusconstitucionalista (constitucionalismo contemporâneo) que aproxima o Direito da realidade, permite além de maior racionalidade ao trabalho do judiciário, a concretização de direitos e normatividade da norma decisória voltada ao caso concreto. No estanto, não se pode desconsiderar que os provimentos jurisdicionais, à luz do Estado Democrático de Direito, devem abarcar os conceitos de ‘coerência e integridade’, vetores principiológicos pelos quais
todo o sistema jurídico deve ser lido. Nesse viés, possibilita-se o diálogo da TED com
a Teoria de Ronald Dworkin, inclusive porque o novo Código de Processo Civil adotou os preceitos dworkinianos como “ferramentas” aptas a diminuir o voluntarismo judicial, sem, contudo, refletir como objetivo a promoção de tutelas exaurientes (onde há maior grau de certeza jurídica quanto à controvérsia). Tomando-se em consideração este cenário e sendo esta uma área da processualística onde denuncia-se o protagonismo judicial, surge a celeuma: como a Teoria e Metódica Estruturante de Friedrich Müller pode contribuir para a concretização da norma decisória em cognição sumária? Essa estruturação da norma reflete à promoção de coerência e integridade’, incentivando, por conseguinte, a uma teoria da decisão judicial que se coadune com o Estado de Direito fruto de uma democracia constitucional? / In the Democratic State of Right, the real practice lies in the effective realization of the fundamental rights and guarantees of individuals, and no longer solely in the realization of the concrete will of the law. In this special, there is Friedrich Müller's Theory of Law, concerned directly with the concretization of the norm (and thus of the right itself). It is a theory that starts from an inductive bias, being considered post-positivist, that is, able to overcome the limits of legal positivism (mere formality to the detriment of substantiality). Directly linked to the current
jusconstitutionalism (contemporary constitutionalism) that approximates the law to the reality, it allows, in addition to a greater rationality to the work of the judiciary, the concretization of rights and provides the normativity to the decisory rule directed to the concrete case. In this respect, it can not be disregarded that jurisdictional appeals, in the light of the Democratic Rule of Law, should embrace the concepts of 'coherence and integrity', the principle vectors by which the entire legal system must be read. In this bias, is it possible the dialogue between TED's and Ronald Dworkin's Theory, also because the new Code of Civil Procedure adopted the Dworkinian precepts as "tools" capable of diminishing judicial voluntarism, without, however, reflect that as an objective of promoting tutelages in exhaust cognition(where there is
greater degree of legal certainty about the controversy). Taking this scenario into account and being an area of the procedural where the judicial protagonism is denounced, there is a stir: how can Friedrich Müller's Theory and Structural Methodology contribute to the realization of the normative decision-making in summary cognition? Does this structuring of the norm reflect the promotion of 'coherence and integrity', thus encouraging a theory of judicial decision that is consistent with the rule of law resulting from a constitutional democracy?
