“Doing” gender in South Africa : footprints of tension for transgender persons

Text in English / The ‘doing’ of gender in our society is constructed along the lines of power, knowledge and being. Power structures angle knowledge and understanding of transgender people and transgender lives in a way that relegates them almost to the museum to be observed as a spectacle or exotic objects. The emphatic frames of man and woman, even in South Africa where the Constitution is considered and understood to be liberal and generous, the life of a transgender body is an Other life. One is either male or female; any other form of doing and being gender suffers peripherisation and classification as special, different, strange or any other exteriorising definitions. This dissertation attempts to question the power or the tyranny of categorisations and classifications of man and woman, drawing from various discourses such as the medico-legal discourse classification. It further looks at how gender is being performed by transgender people. Further it aimed at gaining an in-depth understanding of the experiences and challenges of transgender people with regards to doing gender within a gendered society. The findings within the dissertation tells us, that the performativity of gender is not a neutral space, but enacted by various power structures and those who live outside the norms such as the transgender people, they are subjected to precariousness. It this dissertation seeks to contribute to an unmasking of some easy but harmful assumptions about gender and sexuality. Gender and sexuality may not be taken for granted and assumed according to fixed templates but they are fluid, mobile and flexible beyond the limits of convention. / Psychology / M.A. (Psychology (Research Consultation))

Vers une définition genrée du réfugié : étude de droit français / Towards a gendered definition of refugee : french law case study.

Cette thèse se donne pour objet de tester, dans le contexte spécifique du droit français, la véracité et la pérennité des critiques féministe puis genrée de la définition du réfugié consistant à dénoncer la non-prise en compte des persécutions subies par les femmes et les minorités sexuelles dans le cadre de l’élection audit statut. Et c’est un constat mitigé qui ressort de l’étude car, en dépit des nombreuses pressions internationales et européennes invitant à une analyse genrée de la notion, ces critiques héritées des années 1980 apparaissent, dans une large mesure, encore d’actualité. Certes, le phénomène d’exclusion des persécutions liées au genre qu’elles dénonçaient s’est quelque peu affaibli, en ce que les persécutions subies par les femmes et les membres des minorités sexuelles ne sont, par principe, plus exclues du champ de la définition du réfugié. Mais il n’existe cependant toujours pas de volonté, politique ou juridictionnelle, visant à les intégrer pleinement dans l’analyse. En effet, les efforts consentis pour leur prise en compte se révèlent encore insuffisants, laissant demeurer des obstacles subtils à leur intégration, des obstacles d’autant plus délicats à identifier et à surmonter. / The purpose of this thesis is to test, in the specific context of French law, the veracity and durability of feminist and gendered review of the refugee definition, which consists in denouncing the failure to take into account persecutions suffered by women and sexual minorities in the election process. It is a mixed conclusion that emerges from the study because, despite the numerous international and European pressures calling for a gendered analysis of the concept, these criticisms inherited from the 1980s still appear, to a large extent, to be relevant. Admittedly, the exclusion of gender-related persecution that they denounced has somewhat weakened, because persecutions suffered by women and members of sexual minorities are no longer excluded, as a matter of principle, from the scope of the refugee definition. However, there is still no political or jurisdictional will to fully integrate them into the analysis. Indeed, the efforts made to take them into account are still insufficient, leaving subtle obstacles to their integration, obstacles that are all the more difficult to identify and overcome.

An exploration on the challenges faced by youth in lesbians, gays, bisexuals, transgender and intersex relationships at Mkhuhlu Location, Mpumalanga Province, South Africa

MGS / Institute for Gender and Youth Studies / This study seek to explore the challenges that are faced by youth in lesbians, gays, bisexuals, transgender and intersex (LGBTI) relationships at Mkhuhlu location. The study argues that this cohort, just like any other, should be afforded human rights, and the choice to be in lesbians, gays, bisexual, transgender and intersex relationships. Research has shown that those who believe sexual orientation is inborn are more likely to have tolerant attitudes towards lesbians, gays, bisexuals, transgender and intersex people, whereas those who believe it is a choice have less tolerant attitudes. The study was undertaken at Mkhuhlu location and the respondents were males and females in lesbians, gays, bisexuals, transgender and intersex relationships. A feminist epistemological approach to doing research guided the process of data collection while also employing a qualitative approach in interpreting the data. An exploratory design was used to gain a broader understanding in the challenges that youth in lesbians, gays, bisexual, transgender and intersex relationships are faced with every day. A Sample of 10 respondents from Mkhuhlu location was selected. Non-probability sampling was used and snow-ball sampling method was also used to draw the required sample. The data was collected through the use of guided unstructured interviews. The findings in this study reveal that LGBTI youth have faced various challenges in their daily lives. LGBTI people face considerable levels of stigmatization, discrimination and harassment in their daily lives. These challenges have negative impact in the lives of LGBTI youth and also bring various emotions, which include intense sadness, anxiety, loneliness, discomfort in social situations, and feeling overwhelmed. The study also found that there are strategies that can be employed in order to alleviate the challenges of LGBTI youth, through education the misperception that LGBTI sexual interest is uncommon and sinful may be corrected if realistic, developmentally appropriate sex education is made accessible to the public. / NRF

Practicing the law of human dignity

Die philosophischen Grundlagen der Meta-Dimension des Rechts auf Menschenwürde lösen eine Fragestellung aus, die die Grenzen der Disziplin des Rechts übertrifft: wie könnte das Transzendentale als ein Aspekt der Bedeutung von Menschenwürde dargestellt werden? Das Beharren auf der nicht-Bestimmung des Menschenbildes oder auf dem Begriff ‚Gott’ in der Präambel des Deutschen Grundgesetzes, wie es sich in der Deutschen Dogmatik widerspiegelt, gepaart mit dem Bestreben nach einer Fall-zu-Fall ad hoc Konkretisierung dessen, was Menschenwürde bedeutet, inspiriert diese Untersuchung von ‚etwas fehlt’ [‘something missing’]. In postmoderner Art und Weise beschreibt diese Geschichte das Gesetz der Menschenwürde als Trojanisches Pferd und bietet hermeneutische und literarische Grundlagen für eine affirmative Haltung gegenüber einer ''leeren'' Rede im juristischen Diskurs. Die Forschungsfrage erweckt und umkreist die polemisch verbrämten Begriffe von ‚Leere’ und ‚Black Box’: Warum erscheint der Rechtsbegriff der Menschenwürde ‚leer’? Oder wie ist er ‚leer’? Warum und wie ist er eine ‚Black Box’? Wie erscheinen Manifestationen des Konzepts abstrakt wie Universalien, aber im Einzelnen konkret? Die ontologischen, sprachlich-analytischen und phänomenologischen philosophischen Erkenntnisse, vorgestellt im ersten Kapitel, bilden die Linse, durch die fünf maßgebliche Fälle des Bundesverfassungsgerichtes – über Abtreibung, lebenslange Freiheitsstrafe, Transsexualität, staatliche Reaktion auf Terroranschläge und die Gewährleistung eines menschenwürdigen Existenzminimums – im zweiten Kapitel analysiert werden. Die philosophischen Quellen werden nicht als Momente im langen Verlauf der Menschenwürde in der Geschichte der Ideen eingeklammert. / The philosophical underpinnings of what may be called the meta-dimension of the law of human dignity trigger a question that surpasses the boundaries of the discipline of law: how could the transcendental as an aspect of human dignity meaning be portrayed? The insistence on non-determination of the Menschenbild [human image] or ‘God’ in the Preamble to the German Basic Law [Grundgesetz] reflected in German legal doctrine, paired with the commitment to case-by-case ad hoc concretization of what human dignity means inspire this story of ‘something missing’. In postmodern fashion, this story portrays the law of human dignity as a Trojan Horse and provides hermeneutic and literary foundations for an affirmative stance towards ‘emptiness’ talk in legal discourse. The research question rekindles and twists polemically framed ‘emptiness’ and ‘black box’ contentions: Why does the legal concept of human dignity appear ‘empty’? Or, how is it ‘empty’? Why and how is it a ‘black box’? How do manifestations of the concept appear abstract as universals and concrete as particulars? The ontological, linguistic-analytical, and phenomenological philosophical insights presented in Chapter One compose the lens through which five benchmark Bundesverfassungsgericht cases – on abortion, life imprisonment, transsexuals, state response to terrorist attacks, and the guarantee of a dignified subsistence minimum – are analyzed in Chapter Two. The philosophical sources are not bracketed as moments in the long course of human dignity in the history of ideas.

This paper takes a look at what homosexual themes are present in the literature anthologies in current use, and then suggest a teaching unit and methodology for how one can implement these topics into a literature class.
