[pt] Na tentativa de sobreviver e prosperar num mercado
supercompetitivo e
num ambiente caracterizado por mudanças e incertezas como
o atual, as
organizações precisam ser capazes de mudar a si próprias.
O mercado e o
ambiente estão mudando numa velocidade cada vez maior
exigindo que as
organizações sejam ágeis em suas mudanças. No processo de
implementação da
mudança há uma série de negociações que vão definindo o
rumo do que tinha sido
previamente planejado. Dessa forma, se a organização não
possui funcionários
com competência em negociação a mudança pode demorar a
ocorrer e não sair
conforme o planejado. Esse trabalho aborda o modo como os
profissionais
atualmente estão negociando em seu ambiente de trabalho e
se propôs a identificar
as estratégias e táticas de negociação mais utilizadas
pelos profissionais nos
diferentes contextos de seu cotidiano. Trata-se de um tema
que, embora seja
objeto de interesse significativo na literatura
internacional de gestão, não tem sido
tão significativamente abordado nas pesquisas no Brasil. A
pesquisa envolveu
entrevistas com 13 profissionais com funções diferentes e
de mercados variados.
Os resultados mostraram que, entre os profissionais
investigados há estratégias e
táticas variadas de ação nas negociações, em função dos
diferentes contextos. Foi
possível, no entanto, identificar um conjunto de aspectos
percebidos pelos
indivíduos como importantes para o sucesso da negociação,
envolvendo desde a
preparação até a resolução de situações em que ocorrem
impasses ou a
necessidade de abandonar o processo. / [en] In order to survive and prosper in a very competitive
market and in an
environment characterized by changes and uncertainty like
nowadays, the
organizations need to be able change itself. The market
and the environment are
changing faster demanding the organizations to be more
agile in their changes. In
the process to implement the change there are a lot of
negotiations that define the
course of what had been planed before. So if the
organization doesn t have
employees with negotiation skills, the change might take
longer to happen and it
might not come as planed. This work s theme is about the
way the professional
are negotiating nowadays in their work and has the main
goal of identifying
negotiation strategies and tactics that the professionals
use the most in the
different contexts. Although the interest for this theme
is very significant in the
international management literature it have not been
significantly broached in
researches in Brazil. The research involved interviews
with 13 professionals with
different jobs and working in different markets. The
results show that depending
on the context there is a variety of strategies and
tactics among the professionals
investigated. It was possible to identify a group of
aspects perceived by the
individuals as important for the success of the
negotiation, going through the
preparation phase until situations when there is an
impasse or when the person has
to leave the process.

[pt] A presente dissertação faz uso do instrumental teórico da Resolução de
Conflitos a fim de analisar o gerenciamento do conflito que opõe os grupos
nacionalista católico e unionista protestante na Irlanda do Norte. Tal processo
culminou com a assinatura do Acordo de Sexta Feira Santa em 10 de abril de
1998. A estratégia aplicada nas negociações previa a atuação simultânea em duas
frentes: na elaboração de um acordo que estabelecia o compartilhamento de
instituições políticas e na construção da confiança entre as partes concentrada na
questão da deposição de armas pelos grupos paramilitares. Essa dissertação busca
problematizar a mediação como um processo de resolução de conflitos de
natureza elitista que encara o conflito como um problema essencialmente de
barganha. Compreende-se que a mediação não encoraja a reconciliação entre as
comunidades antagônicas e a geração de uma cultura de cooperação política,
falhando em promover a confiança entre as partes e ocasionando impasses na
implementação do acordo de paz. Embora a mediação tenha sido fundamental
para oferecer uma alternativa política para as partes beligerantes, o conflito na
região permaneceu latente com a escalada da violência em momentos cruciais de
progresso das negociações. Este estudo conclui que a concretização do acordo
deveu-se muito ao esgotamento da sociedade civil e ao reconhecimento das partes
da impossibilidade de vencer o conflito pela via armada. Essa conclusão aponta a
necessidade de se complementar a abordagem elitista com iniciativas de resolução
de conflitos constituídas no seio da sociedade civil para explicar a evolução do
processo de paz na Irlanda do Norte rumo à transformação do conflito e à
construção de uma paz positiva. / [en] This dissertation analyzes from a Conflict Resolution perspective the
process of conflict management between catholic nationalists and protestant
unionists in Northern Ireland. This process ended with the signature of the Good
Friday Agreement in April of 1998. The strategy employed in the negotiations
presupposed a twin track approach: the elaboration of a power sharing political
arrangement and the implementation of confidence building measures for the
decommissioning of arms by paramilitary groups. This dissertation aims to
problematize mediation as an elitist conflict resolution process that considers
conflict essentially in terms of a bargaining problem. Mediation is understood as a
process that does not encourage the reconciliation of antagonist communities and
the generation of a culture of cooperation, failing to promote confidence between
the parties and imposing setbacks in the implementation of the peace agreement.
Although mediation was able to offer to the belligerents parties a political
alternative, the conflict in the region remained latent, with the escalation of
violence during crucial moments when the negotiations were moving forward.
This study concludes that the peace agreement was achieved much due to the
disengagement of civil society in the conflict and the recognition of the parties
that they would not win the conflict by forceful means. This conclusion points to
the necessity of complementing the elitist approach with civil society conflict
resolution initiatives in order to explain the evolution of the peace process in
Northern Ireland towards conflict transformation and positive peace.

[pt] A Guerra da Bósnia (1992-1995) foi finalizada com os
Acordos de
Dayton, que garantiram 49 porcento dos territórios aos
sérvio-
bósnios e 51 porcento aos
bósnios muçulmanos e croata-bósnios. O pacto previa a
construção de um
Estado multiétnico, que garantisse a convivência
pacífica
após a carnificina que
marcou a beligerância entre os três grupos. Apesar de
garantir o fim de um dos
mais sangrentos conflitos europeus desde o fim da
Segunda
Guerra Mundial, o
acordo de paz parece não ter solucionado de fato os
problemas que levaram os
três grupos étnicos a entrar em conflito durante o

Agreements that gave 49 percent of the territories to the
Bosnian
Serbs and 51 percent to the
Bosniacs and Croatian Serbs. The pact previewed the
creation of a multi-ethnic
State that assured a peaceful living after the bloodshed
that marked the conflict
among the three groups. Despite the accomplishment of
ending one of the most
bloody European conflicts since the end of the Second
World War, the peace
agreement seems not to have really solved the problems
that made the three
ethnic groups confront themselves during the Yugoslavian
disintegration
process. It means that the accord ended the war, but kept
a latent warring
atmosphere among the parties. In a perspective of conflict
resolutions models
that criticizes a traditional and utilitarian approach of
the agreements signed at
Dayton, this work analyzes the rights and wrongs of the
first seven years of the
implementation process, questioning the transference of
the war to the political
arena and, specially, the prolonged international
interference to keep the
peaceful ambiance among the communities that forms the
post-war Bosnia. For
the development of this work, the traditional models of
conflict resolution as
well as the rigid State response are questioned, with the
aim to present other
outcomes to put the warring parties together, with the
possibility of a new
political community.

Este é o enfoque principal deste trabalho. / [en] The security-development nexus is not a new topic on the international stage. For many years, multilateral actors, such as the United Nations, as well as many states have been concerned with this connection. Regarding Brazil, the development theme has been a concern for the country’s foreign policy, in a more structured way, since the 1950’s. It must be highlighted, however, that when talking about development this referred to Brazil’s economic development, in a manner where the security-development nexus meant trying to attract more investments to advance national economic expansion. Domestic and systemic circumstances ended up contributing, at the beginning of the 21st Century, to the export of a Brazilian view as an attempt to contribute to the resolution of several international conflicts. This is the main focus of this thesis.

Especificamente, o trabalho pretende avaliar em que medida a teoria polivagal explica os bons resultados dos processos restaurativos da Justiça Restaurativa de Porto Alegre com adolescentes em conflito com a lei. A teoria polivagal apresenta uma nova psicofisiologia dos comportamentos violentos e desafia a psicologia a criar novas abordagens de reparação de danos e prevenção da violência. A idéia é avaliar a possível contribuição que a psicologia poderia oferecer aos novos paradigmas de resolução de conflitos da Justiça e da cultura da paz. / [en] The aim of this work is to reflect on the place of the psychologist in restorative practices of Justice from the perspectives of the discoveries of neuroscience, especially the theory of polivagal sub regulation of autonomic nervous system (ANS), developed by neuroscientist Stephen Porges. Specifically, the study aims to evaluate the extent the theory polivagal explains the goods results of the restorative process of Restorative Justice in Porto Alegre with adolescents in conflict with the law. The theory polivagal presents psychophysiology of violent behavior and challenges the psychology to create new approaches to repair of damage and violence prevention. The whole idea is to evaluate the possible contribution that psychology could offer to new paradigms
of resolution of the conflicts of Justice and the culture of peace.

[pt] Os conflitos armados contemporâneos vêm desafiando os estudos de
Resolução de Conflitos no que tange aos meios e métodos empregados, dentre os
quais a mediação é um dos mais utilizados na contemporaneidade. O presente
trabalho discute a necessidade de mudança de paradigma no tocante ao enfoque da
mediação internacional. Argumenta-se que, dadas as particularidades dos conflitos
armados contemporâneos, envolvendo diversos atores, nacionais e internacionais,
e variadas causas raízes, muitas delas originadas do colonialismo e do processo de
descolonização, a mediação internacional, implementada, tradicionalmente de
forma top-down, em torno das grandes mesas de negociações e envolvendo
autoridades e mediadores internacionais, por si só, não se tem mostrado suficiente
para a construção da paz sustentável. Neste diapasão, este estudo visa refletir sobre
a chamada mediação local como meio alternativo de resolução pacífica de
conflitos, principalmente, no contexto de disputas localizadas em Estados de grande
fragilidade institucional. Ademais, no estudo de caso, discute-se o conflito na Líbia,
país que atravessa uma crise de alcance transnacional e de proporções severas há
mais de uma década, nos setores político, econômico-financeiro, social e de
segurança, decorrentes de duas guerras civis sucessivas, iniciadas no contexto da
Primavera Árabe. A partir do caso estudado, conclui-se que, em conflitos
prolongados e complexos, a mediação local pode se constituir como meio mais
adequado para iniciar um processo de construção da paz, servindo para fortalecer a
mediação internacional de âmbito nacional, cujos acordos só conseguem ser
implementados se houver adesão no nível subnacional. / [en] Contemporary armed conflicts have been challenging Conflict Resolution
studies regarding the means and methods used, among which mediation is one of
the most used in contemporary times. This paper discusses the need for a paradigm
shift regarding the approach to international mediation. It is argued that, given the
particularities of contemporary armed conflicts, involving various actors, national
and international, and various root causes, many of them originating from
colonialism and the decolonization process, international mediation, traditionally
implemented in a top-down, around large negotiating tables and involving
international authorities and mediators, by itself has not proved to be sufficient for
the construction of sustainable peace. In this vein, this study aims to reflect on the
so-called local mediation as an alternative means of peaceful conflict resolution,
especially in the context of disputes located in States with great institutional
fragility. In addition, the case study discusses the conflict in Libya, a country that
has been going through a crisis of transnational scope and severe proportions for
more than a decade, in the political, economic-financial, social and security sectors,
resulting from two successive civil wars, initiated in the context of the Arab Spring.
Based on the case studied, it is concluded that, in prolonged and complex conflicts,
local mediation can be the most appropriate means of initiating a peacebuilding
process, serving to strengthen international mediation at the national level, whose
agreements can only be implemented if there is buy-in at the subnational level.

[pt] Normas são aplicadas em sistemas multiagentes como mecanismos capazes de restringir o comportamento dos agentes de software com o objetivo de alcançar uma ordem social desejável. Entretanto, essas normas podem entrar em conflito, como por exemplo, uma norma que proíbe um agente de realizar uma determinada ação e outra norma que obriga o mesmo agente a realizar a mesma ação no mesmo intervalo de tempo. A decisão do agente sobre quais normas serão cumpridas pode ser definida com base nas recompensas e punições normativas e nos objetivos do agente. No entanto, em determinadas situações a avaliação desses atributos pode não ser o suficiente para permitir que o agente efetue uma tomada de decisão satisfatória. Nesse contexto, foi elaborada uma abordagem que considera traços de personalidade em agentes de software para aprimorar o processo de resolução de conflitos normativos e a escolha dos planos para tomada decisões, além de realizar a comparação da abordagem proposta com diferentes abordagens encontradas na literatura. / [en] Norms are applied in multiagent systems as mechanisms capable of restricting the behavior of software agents in order to achieve a desirable social order. However, norms eventually can be conflicting - for example, when there is a norm that prohibits an agent to perform a particular action and another norm that
obligates the same agent to perform the same action in the same period of time. The agent s decision about which norms to fulfill can be defined based on rewards, punishments and agent goals. Sometimes, this balance will not be enough to allow the agent to make the best decision. In this context, this proposal introduces an approach that considers the agent s personality traits in order to improve the plan decision-making process and resolving normative conflicts. Our approach s applicability and validation is demonstrated by an experiment that reinforces the importance of considering the norms both in the agent and society s points of view.

of the Palestinian Authority (Palestinian self-government)
and the implementation
of the peace agreements with Israel. It was observed, on
one hand, that the
structure created for a political solution for the Israeli-
Palestinian conflict
constrained the institutionalization of the Palestinian
self-government which
started in 1994. On the other hand, it was verified that
the process of formation
and consolidation of this institution had impacts on the
Palestinian domestic field
(internal opposition and governability); and affected its
capability for
implementing the terms of the agreements, influencing, in
turn, the evolution of
the peace process between 1994 and 2004. This study aimed
to cover breaches in
the literature of international conflict resolution on the
implementation phase of
the agreements and on the degree of institutionalization
of an actor involved in a
peace process.

[pt] Tendo como referencial teórico o instrumental do campo da
resolução de conflitos, esta dissertação aborda as
implicações da segurança nas operações de peacekeeping
multidimensional. Através dos elementos verificadores da
resolução do dilema de segurança interno, discute-se a
importância da segurança para o sucesso do peacekeeping no
pós-Guerra Fria e para a reconstrução das estruturas
estatais. Para isso, foram estudadas as missões na Bósnia-
Herzegovina e em Serra Leoa, ambas consideradas bem
sucedidas pela ONU e cujos mandatos previam ações no campo
de segurança e da reconstrução sócio-econômica do Estado.
Ficou claro que o sucesso do peacekeeping multidimensional
não reside apenas na garantia da segurança, vista como a
ausência de ameaça militarizada: em função de sua própria
natureza, essas operações dependem também da abordagem de
questões não-materiais. Contudo, esses aspectos não são
comumente estudados pelos teóricos do campo. Perceber a
importância de suprimir a violência estrutural e preservar
a diversidade cultural é essencial para o novo
peacekeeping. Não fazê-lo é ignorar as causas que deram
origem ao conflito e correr o risco de vê-lo acontecer
novamente. Faz-se crucial, também, a vontade política da
comunidade internacional de agir, sem a qual a cooperação
entre as partes dificilmente acontecerá. Assim, percebe-se
que o objetivo das operações de paz no pós-Guerra Fria não
se limitaria a encerrar a violência direta, mas buscaria
desenvolver cada missão dentro de suas particularidades,
permitindo resolver os conflitos a partir de suas causas e
impedindo que a guerra ocorra novamente. / [en] Using as reference the theoretical field of conflict
resolution, this dissertation discusses the effects of
security in wide peacekeeping operations. Based on an
analysis of the elements of the internal security dilemma,
this dissertation discusses the importance of
consolidating the security in the post-Cold War peace
operations held by the UN and the state-building process.
The empirical studies reported in this work were both
considered successful by the UN, having fulfilled their
mandates with activities and programs developed in the
security and socio-economic reconstruction arenas. The
view expressed in this dissertation is that security,
understood as the absence of militarized threats, is not
enough to guarantee the completion of the mission: as wide
peacekeeping deals with threats both in the military and
the non-military arenas, it demands both material and non-
material approaches, although the latter is not commonly
studied by conflict-resolution researchers. Tackling
structural violence and preserving cultural diversity has
become essential for the success of wide peacekeeping.
Failing to do this is to ignore the causes of the
conflict, at the risk of seeing violence return. It is
also necessary to count with the support of the
international community, which is essential to the
cooperation between parties. The dissertation concludes
that wide peacekeeping is not aimed only at the resolution
of the conflict, but rather intends to deal with its
causes, treating each mission as unique in its
particularities and limitations and preventing the
conflict return.

A explosão de conflitos em grande medida represados durante as décadas anteriores, desencadeados por controvérsias sociais no geral muito enraizadas, forçou uma reinvenção da disciplina. Multiplicam-se demandas práticas por maior inclusão e transparência na condução de processos de paz, de modo que hoje dificilmente uma negociação que não faça acenos à população terá grandes chances de ser vista como legítima. Ao passo que especialistas começam a se debruçar sobre formas de promover a inclusão sem ao mesmo tempo entulhar a mesa de negociações de pontos de vista distintos, vai-se comprovando aos poucos que a paz inclusiva é também a paz durável. Esta pesquisa objetiva contemplar essa discussão por um ângulo menos usual - o da representação política. Ao invés de pensar na inclusão como instrumento de criação da representatividade, averiguaremos o papel da representação em possibilitar (ou não) a inclusão. Argumenta, portanto, que é preciso pensar a inclusão através da representação, e não o contrário. Para isso, será erguida uma ponte teórica entre os campos da Resolução de Conflitos e da Ciência Política. Acredita-se, em última análise, que a representação concretizada pelas mesas de negociação ajuda a explicar o surgimento de padrões de inclusão e exclusão em processos de paz. / [en] While it constitutes a practical and theoretical concern for a much longer time, after the Cold War, Conflict Resolution became simultaneously more important and more complex. The explosion of conflicts largely suppressed over the previous decades, unleashed by ingrained social controversies, forced reinvention upon the discipline. Practical demands for greater inclusion and transparency in the handling of peace processes multiplied, which explains why today hardly ever a negotiation that does not consider popular needs will have great chances of being seen as legitimate. While specialists start to tackle ways to promote inclusion without, at the same time, hoarding the negotiation table with too many different points of view, it is becoming increasingly clearer that an inclusive peace is also a durable peace. This research aims to contemplate this discussion through a less usual lens - the one of political representation. Instead of thinking about inclusion as an instrument to achieve representativeness, we will evaluate the role of political representation in allowing (or not) for inclusion. It argues, thus, that it is necessary to reflect on inclusion through representation, not the other way around. In order to do that, it will build a theoretical bridge between the fields of Conflict Resolution and Political Science. Ultimately, the political representation put forth by negotiation tables may help explain the emergence of inclusion and exclusion patterns during peace processes.
