At the outset, this topic is researched from the standpoint of general procedural theory, in order to classify it within the context of its fundamental institutes. Later, this topic is looked at from the standpoint of general contract theory, confronting the problem regarding its defects and nullities. With these definitions, basic notions are established of the institute, such as concept, terminology, legal nature, guiding principles and a suggested classification. With the support of these technical cornerstones, the central problem is found, which is the pragmatic analysis of typical and atypical procedural contracts in Brazil's New Code of Civil Procedure. O trabalho trata das situações de incerteza na técnica processual civil, analisando causas, efeitos e, principalmente, meios adequados para o tratamento dessas situações. Defende a idéia de que os litigantes não podem ter seus direitos processuais cerceados pela falta de objetividade na técnica processual, circunstância na qual deverá ser privilegiada a eficácia dos atos das partes. Nos três primeiros capítulos, é estudada a função do processo perante o direito material (aspecto positivo da instrumentalidade do processo), seu formalismo e sua flexibilidade, acentuando-se a aplicação da instrumentalidade das formas e do dever de saneamento das irregularidades processuais (aspecto negativo da instrumentalidade do processo). No capítulo quarto, são identificadas as crises de certeza no direito processual, suas fontes e os melhores meios de se evitá-las. No capítulo quinto, é justificada, à luz do direito processual vigente, a necessidade de manutenção da eficácia dos atos processuais realizados em zonas de incerteza. Por fim, nos capítulos seis e sete, o trabalho trata da fungibilidade recursal e da incerteza relativa aos pressupostos formais da ação rescisória, propondo meios de se permitir que os atos processuais realizados em zonas de incerteza produzam todos os seus efeitos, ainda que a opção dos litigantes divirja daquela adotada pelo juiz. / The present dissertation deals with the uncertainty about Brazilian civil procedure techniques, analyzing causes, effects and, chiefly, adequate means of treatment of such issues. It argues that the litigants may not have their procedural rights suppressed by the lack of objectivity on procedural law, situation in which the efficacy of their acts must be privileged. In the first three chapters, it studies the function of the procedural Law considering the substantive Law (positive aspect of procedural instrumentality), its formalism and its flexibility, enhancing the applicability of the norm of instrumentality of the forms and the judges obligation of remedying procedural irregularities (negative aspect of procedural instrumentality). In chapter four, crises of uncertainty of procedural law are identified, its sources as well as the best ways to avoid them. In chapter five, the needs of maintaining the efficacy of the parties acts in situations of uncertainty are justified considering the current procedural Law. At last, in chapters six and seven, the study addresses the rule of commingling remedies and the matter of uncertainty related to the procedural requisites of the termination action, proposing that the procedural acts performed in zones of uncertainty will produce all their effects, even if the option made by the litigants be different from that made by the judge.

Deklarativt minne hos universitetsstuderande med dyslexi : Undersökning av igenkänningsminne efter oavsiktlig inkodning

Utifrån the procedural deficit hypothesis (PDH) antas det deklarativa minnet vara intakt hos personer med dyslexi. Detta styrks av studier som visat att deklarativt minne är intakt eller förstärkt hos barn med SLI eller dyslexi då det undersökts med icke-språkliga minnestest. Personer med dyslexi som genomgår universitetsstudier antas kompensera för sina svårigheter på olika sätt, bland annat med det deklarativa minnet. I denna studie har deklarativt minne undersökts i form av visuellt igenkänningsminne efter oavsiktlig inkodning. Deltagarna utgjordes av 11 universitetsstuderande med dyslexi samt en kontrollgrupp på 26 universitetsstuderande utan dyslexi. Resultatet indikerade ett intakt deklarativt minne hos personer med dyslexi. En trend till att de även har ett förstärkt minne efter 24 timmar jämfört med kontrollgruppen kunde skönjas men var inte signifikant. Prediktionen att deklarativt minne används som kompensation i allmänhet samt för nedsatt läsförmåga kunde inte styrkas. Andra möjliga kompensatoriska strategier och förmågor än deklarativt minne diskuteras. / Based on the procedural deficit hypothesis (PDH) declarative memory is assumed to be intact in people with dyslexia. This is supported by studies showing that declarative memory is intact or enhanced in children with SLI or dyslexia when examined using non-verbal memory tests. People with dyslexia who undergo university studies are assumed to compensate for their difficulties in different ways, including with the use of declarative memory. This study examines the aspect of declarative memory that is visual recognition memory after incidental encoding. The participants were 11 university students with dyslexia and a control group of 26 university students without dyslexia. The results showed an intact declarative memory in people with dyslexia. A possible trend that they also have an enhanced memory after 24 hours compared with the control group could be seen but was not significant. The prediction that declarative memory is used as compensation in general and for impaired reading skills could not be substantiated. Other possible compensatory strategies and abilities besides declarative memory are discussed.

This article examines the close relationship between criminal procedure and constitutional law within a democratic State framework as well as the guarantees provided from a constitutional point of view in accordance with the current context of human rights globalization. Then, the author approaches us to criminal procedure main principles and guarantees, procedural models historically formed. Finally, it presents an interesting Criminal Procedural Code analysis describing guarantees, principles and procedural models recognized in our country. / Este artículo reflexiona sobre la estrecha relación entre el proceso penal y el derecho constitucional en el marco de un Estado democrático, así como sobre las garantías que debe brindar desde la óptica constitucional y en el actual contexto de globalización de los derechos humanos. A continuación nos aproxima a los principales principios y garantías del proceso penal, y a los modelos procesales históricamente configurados. Finalmente, el artículo nos presenta un interesante análisis de Código Procesal Penal, describiendo las garantías, principios y modelo procesal reconocido de nuestro país.

Justice, governance and climate change : designing fair and effective climate institutions

Multilateral efforts are yet to produce meaningful action on climate change. Part of the problem with these approaches is a perceived lack of fairness among state actors. Whilst academic discussion has traditionally focused on the issue of distributive fairness, very little has been said about procedural fairness in this respect. To this end, this thesis analyses principles of procedural justice in order to develop practical policy measures for institutional design. It does so in four steps. First, it argues that procedural justice is important for reaching a mutually acceptable agreement when there is reasonable disagreement about the substantive ends that collective action should achieve. Second, it develops several principles of procedural justice that should govern the decision-making processes of climate institutions. This includes principles that govern who should participate in decisions, how these decisions should take place, and how transparent they should be. Third, it considers the relative value that procedural justice should be given against other important ends. In doing so, it proposes that procedural justice is a fundamental feature of fair and effective climate institutions. Finally, it considers what this means for climate institutions in practice by determining a set of pragmatic policy prescriptions that can guide the design of climate governance institutions.

Third Party Intervention and Relationship Outcomes: Extending Social Exchange Theory Through the Incorporation of Intermediaries

Most dispute resolution is between employers and employees, family or friends, neighbors, and other groups who have continued contact after they leave the courtroom, mediator's office, or agree to contract terms. Because of such ongoing relationships, a vital component of any kind of dispute resolution is how conflicting parties feel about each other after the process is over. Although previous conflict resolution research focuses primarily on the perceived fairness of the third-party, process or outcome, my dissertation centers around how the two parties engaged in the process perceive each other and their relations. Specifically, I ask how intermediaries' intervention in a resolution process affects disputing individuals' perceptions of fairness of one another, general positive regard toward one another, and predictions for positive future interactions with one another.I explore the relationship between third party intervention and such relationship outcomes using two experimental methods, vignettes and laboratory research. In each experiment I vary the level of third party intervention (high, low, absent), while holding dispute resolution outcomes constant, and then measure disputants' perceptions of one another. I also test three potential intervening mechanisms for the relationship between intervention and perceptions - procedural fairness, situational attributions, and salience of conflict.Results indicate that third party intervention does affect perceptions disputants' have of one another and that such results vary based on the method used. In the vignettes, the method typical of research in third party intervention, intervention is negatively related to perceptions of the other party. However, the opposite is true in the laboratory experiment. The results from the laboratory suggest that third party intervention is positively related to perceptions of the other party and that both the increased likelihood of situational attributions and decreased salience of conflict with high third party intervention partially explain this relationship.Implications of these results, and potential areas of future research, are discussed.

Video-based Fire Analysis and Animation Using Eigenfires

We introduce new approaches of modeling and synthesizing realistic-looking 2D fire animations using video-based techniques and statistical analysis. Our approaches are based on real footage of various small-scale fire samples with customized motions that we captured for this research, and the final results can be utilized as a sequence of images in video games, motion graphics and cinematic visual effects. Instead of conventional physically-based simulation, we utilize example-based principal component analysis (PCA) and take it to a new level by introducing “Eigenfires”, as a new way to represent the main features of various real fire samples. The visualization of Eigenfires helps animators to design the fire interactively through a more meaningful and convenient way in comparison to known procedural approaches or other video-based synthesis models. Our system enables artists to control real-life fire videos through motion transitions and loops by selecting any desired ranges of any video clips and then the system takes care of the remaining part that best represent a smooth transition. Instead of tricking the eyes with a basic blending only between similar shapes, our flexible fire transitions are capable of connecting various fire styles. Our techniques are also effective for data compressions, they can deliver real-time interactive recognition for high resolution images, very easy to implement, and requires little parameter tuning.

This dissertation considers the issue of the injured party and his protection in criminal proceedings. The aim of the paper is not only to provide a comprehensive summary of the position of the injured party in criminal proceedings, but to make reference to shortcomings in the existing legal regulation of this institute and propose changes for the future. The methods used in the paper are primarily interpretative, analytical-synthetic and comparative. The author made use of information ascertained by studying primary and secondary sources. The paper is divided into four main chapters, in addition to the introduction and conclusion, and these are themselves divided into sub-chapters. The first chapter looks at defining certain fundamental terms directly linked to the issue of the injured party and his protection in criminal proceedings. Here we find an explanation of the term "the injured party" itself, both at a general level and in terms of individual specifics, and the separation of injured parties into two groups. This chapter also includes a definition of the term victim and of ancillary proceedings. The diploma thesis deals with the issues of the concept of criminal custody. The aim is to discuss the appropriate effective legislation, point out some problematic issues related to it and provide a broader look at the institution of custody. The work is divided into 10 chapters, which are divided into two parts. Part 1 focuses mainly on the analysis of detention rules contained in Section 1 of Chapter 4 of the Criminal Procedure Code. Preceding this, personal freedom is defined, summarized from the perspective of constitutional law and the definition of personal freedom in international law, and an examination of the institution of custody and subsequently its general character in terms of criminal law is undertaken. The second part is then devoted to the four chosen issues in some way connected with the institution of custody and that in terms of the issue of the right to be heard in the remand proceedings, custody in juvenile proceedings, control mechanisms for upholding of the rights of persons in custody and a prisoner's right to vote.
