La définition des incorporels en droit fiscal / Definition of intangible assets in taxation lawAssous, Lionel 09 July 2012 (has links)
Définir une immobilisation en droit fiscal implique de se référer à des critères permettant préalablement d’identifier l'existence d'un actif mobilisable et d'en mesurer le coût d'inscription à l’actif. La difficulté réside dans le fait que le Code général des impôts contient une seule disposition, l'article 38 quinquies de l’Annexe III qui prévoit que : « les immobilisations sont inscrites au bilan pour leur valeur d'origine.... ». Si le code traite de la mesurabilité il reste muet sur l'identification. En l’absence d’une définition purement fiscale, il convient de se retourner vers le droit comptable. En effet, il ressort de l’article 38 quater de l’Annexe III du Code général des impôts que "les entreprises doivent respecter les définitions édictées par le Plan comptable général, sous réserve que celles-ci ne soient pas incompatibles avec les règles applicables pour la détermination de l'assiette de l'impôt". A cet égard, le plan comptable général définit un actif comme « un élément identifiable du patrimoine ayant une valeur économique positive pour l’entité, c'est-à-dire un élément générant une ressource que l’entité contrôle du fait d’événements passés et dont elle attend des avantages économiques futurs ». Cette définition est la conséquence d’une réforme profonde de notre comptabilité. En effet, la comptabilité a connu un bouleversement, depuis le 1er janvier 2005, toutes les entreprises cotées de l’Union européenne devant présenter leurs comptes consolidés selon des normes comptables internationales. Par ailleurs et toujours sous l’influence des normes comptables internationales, la comptabilité interne a désormais tendance à privilégier une approche économique au détriment d’une conception traditionnellement patrimoniale. La définition des immobilisations incorporelles confirme parfaitement cette évolution et pour certains reflète même, à terme, la disparition d’un droit comptable et fiscal spécifiquement français. / For a definition of a fixed asset in Taxation Law we must be guided by those criteria that in the first instance enable the identification of an underlying asset and the calculation of the acquisition cost for that asset. The difficulty resides in the fact that the General Taxation Code contains only one provision, article 38 quinquies (fifth section) of Appendix III which stipulates that: “Fixed assets shall be recorded on the balance sheet at their original value”. Although the Code deals with measurability it falls silent on identification. In the absence of a purely fiscal definition, we need to turn to accountancy law. In this regard, it emerges from article 38 quater (fourth section) of Appendix III of the General Taxation Code that "businesses shall comply with the definitions set out by the General Accountancy Plan subject to these not being incompatible with the applicable regulations for the calculation of tax brackets". In this regard, the General Accountancy Plan defines an asset as “an identifiable component of property having a positive value for the entity, i.e. a component generating a resource that the entity controls owing to previous events and from which it anticipates future financial advantage”. This definition is the result of a profound reform of our accountancy practices. In fact, accountancy has been in a state of upheaval since 1st January 2005, when all listed companies within the European Union were required to publish their consolidated accounts in accordance with international accountancy regulations. What is more, and also under the influence of international accountancy regulations, internal accountancy now tends to favour a financial approach to the detriment of a traditionally asset-based approach. The definition of intangible fixed assets fully confirms this trend and for some it heralds the ultimate disappearance of any specifically French accounting and taxation law.

A Contabilidade, na qualidade de Ciência voltada à administração e a economia, envolve, a um tempo, um valor específico e uma prática abrangente, na medida em que tem por função orientar, controlar e registrar eventos econômicos proporcionando informações para a tomada de decisões. Esse conceito exige, portanto, dos seus profissionais, uma visão sistêmica, holística e interdisciplinar, que lhes possibilite um desempenho de qualidade. No entanto, as estratégias de ensino utilizadas, ainda hoje, têm priorizando os aspectos operacionais da Contabilidade, em detrimento da sua capacidade informativa, que implica necessariamente juízo de valor. Visando contribuir para dotar o ensino da Contabilidade Geral em nível de 3º grau de um instrumento de aproximação entre a teoria e a prática que reflita melhor a realidade das empresas e suas necessidades das informações contábeis para a tomada de decisões, esta pesquisa objetiva a apresentação de um simulador de transações, em forma de jogo, aplicado ao ensino da Contabilidade Geral. Por meio da pesquisa-ação, desenvolve-se a modelagem de um simulador de transações, em forma de jogo, desdobrando analiticamente a tomada de decisão num processo de planejamento, execução e controle, valendo-se para isso da teoria dos jogos, levando o aprendiz a tomar decisões e fazer julgamento de valor. Ao elaborarmos um simulador de transações e aplicá-lo em sala de aula, a nossa contribuição reside não na estratégia em si, mas, antes, no processo de comunicação, motivando o aluno a participar de uma situação simulada. Importa, sobretudo, a representação, ou seja, a ficção que obriga a trabalhar não apenas tendo em vista o real, mas aquilo que tem a aparência de real, e que possibilita o interesse do jogo para o aluno. Conclui-se da pesquisa que o uso do simulador de transações, em forma de jogo, estimula e favorece o aprendizado dos conteúdos propostos pela disciplina de Contabilidade Geral, proporcionando ao aprendiz a visão abrangente desejada. / Accountancy as a Science oriented to management and economy involves at the same time an specific value and more encompassing practices based on the purpose to guide, control and record economic events providing information for decision making. This concept demands, however, a systemic, holistic and interdisciplinary view from professionals to achieve high quality performance. Nevertheless, teaching strategies used both in the past and today have prioritized the operational aspects of Accountancy to the detriment of its informative ability which involves a judgment of value. The goal of this study is to help in providing an instrument that can bring together theory and practice in the teaching of General Accounting Level 3 that better expresses business reality and the needs of accountable information for decision making. In addition to the presentation of a simulator of business transactions as a game applied to the teaching of General Accounting. This model representation of business transactions as a game will be developed by means of action-research. This game will analytically unfold the decision making during the planning, performance and control of a process using the theory of games and leading the learners to make decisions and judge values. The key factor of this representation of business transactions and its application in class will not be the strategy itself, but the communication process. It will encourage the students to participate in a simulated situation. All in all, the key aspect is the role play, or in other words, the fiction that encourages the work not only having real facts, but also with the representation of real-life situation and this will increase students interest in the game. The final conclusion of this study is that the use of a simulator of business transactions as a game encourages and favors the learning process of the subjects proposed by General Accounting, therefore providing the students with the desirable comprehensive view.

The process of responding to graduate examinations in Accountancy colleges: Construct validation / Proceso de respuesta a examen de egreso en contabilidad: validación de constructoCastañeda Figueiras, Sandra, Varela Romero, César W., González Lomelí, Daniel 25 September 2017 (has links)
The construct validity of six hypothesized dimensions was explored for an Accountancy majorgraduation examination, in order to understand the underlying process of responding. Using answers from 313 examinees to an intentional sample of 17 objective items administered on large scale, a confirmatory factorial analysis was carried out, with a Multi-Trait Multi-Method matrix (MTMM): Traits represented three cognitive operations required to solve the items and the methods represented three knowledge fields of the content. Each item was linked to a cog- nitive operation and to a knowledge field. The resulting model showed convergent validity in two constructs and its manifest variables and divergent only between technical and combined knowledge. Thus, the answering process was explained, simultaneously by the Understanding operation influenced by Theoretical knowledge. Implications to understanding the answering process in this type of examination through construct validation are discussed. / Se investiga la validación de constructo de seis dimensiones que están en la base del examende egreso de una licenciatura en contabilidad, con el fin de entender el proceso de respuesta subyacente. A partir de las respuestas a 17 ítems objetivos aplicados de manera grupal a 313 participantes seleccionados según muestreo intencional, se realizó un análisis factorial confirmatorio MRMM, en el que se representaron tres operaciones cognitivas demandadas para resolver los ítems y los métodos, así como los tres campos de conocimiento del contenido que se evalúa en ellos. El modelo resultante muestra bondad de ajuste, validez convergente entre dos constructos y sus variables manifiestas, además de validez divergente solo entre el conocimiento técnico y el combinado. El proceso de respuesta fue explicado, simultáneamente, por la operación comprender, influida por el conocimiento teórico. Se discuten las implicancias para comprender el proceso de respuesta en este tipo de examen a partir de la validación de constructo realizada.

meer uitgebreide rol in die uitleg van die inkomstebelastingwetgewing, en

Die werkstuk oorweeg dan die rol wat rekeningkundige beginsels en praktyk
in die uitleg van die inkomstebelastingwetgewing in beide Australie en die
Verenigde Koninkryk gespeel het. Die gevolgtrekking word gemaak dat
rekeningkundige praktyk in beide hierdie jurisdiksies 'n meer uitgebreide rei in
die uitleg van inkomstebelastingwetgewing as in Suid-Afrika gespeel het. Die
mening word uitgespreek dat Suid-Afrika baat kan vind deur 'n soortgelyke
benadering te volg as wat in bogenoemde jurisdiksies gevolg word.
Die werkstuk sluit dan af deur die voor- en nadele van 'n stelsel te ondersoek
waar die belasbare inkomste en rekeningkundige inkomste ooreenstem. Die
gevolgtrekking word gemaak dat 'n mate van ooreenstemming aan te bevel is,
maar dat volkome ooreenstemming nie sinvol is nie. Die inagneming van
rekeningkundige beginsels in die uitleg van inkomstebelastingwetgewing kan
bydra om die optimale graad van ooreenstemming te bereik. / ENGLISH ABSTRACT: Traditionaly accounting principles and practice played a very limited role in the
interpretation of the income tax legislation in South Africa.
This study starts off by investigating the role that accounting principles and
practice played to date in the interpretation of the income tax legislation in
South Africa. The conclusion is reached that accounting principles played a
limited role. The principles of interpretation of legislation is then considered
and a conclusion is reached that there is scope for accounting principles and
practice to play an extended role in the interpretation of the income tax
legislation, especially in the interpretation of the gross income definition and
the general deduction formula.
The study then considers the role that accounting principles and practice
played in the interpretation of the income tax legislation in both Australia and
the United Kingdom. The conclution is reached that in both these jurisdictions
accounting practice played a more extensive role in the interpretation of
income tax legislation than in South Africa. The opinion is expressed that
South Africa can benefit from a similar approach as was taken in the abovementioned
jurisdictions.
The study concludes with an investigation into the advantages and
disadvantages of having the calculation of taxable income conform to the
calculation of income for accounting purposes. The conclusion is reached
that conformity to some degree is advisable but that total conformity is not
sensible. Taking accounting principles and practice into account in the
interpretation of income tax legislation can help attain the optimal degree of
conformity.

Exploring the role of the lecturer in developing self-regulated learning skills in studentsWilmot, Lanelle Jean 05 February 2015 (has links)

(Accountancy))--University of the Witwatersrand, Faculty of Commerce, Law and Management, School of Accountancy, 2014. / This paper reports the findings of an action research intervention designed to explore the student experiences of a lecturer’s role-modelling specific cognitive self-regulated learning (SRL) skills on third year Financial Accounting students’ motivation and strategies for learning. The intervention involved a series of enrichment tutorials with a pilot group of Financial Accounting III students at the University of the Witwatersrand, Johannesburg. A mixed methods research approach was used in the study. Qualitative data was collected in the form of verbal and written feedback from group participants and the lecturer’s research diary. Quantitative data was gathered by means of the Motivated Strategies for Learning Questionnaire (MSLQ), which was used to measure the students’ motivations and strategies for learning before and after the intervention. The intervention involved a lecturer role-modelling specific learning skills through the use of active learning activities. The skills role-modelled focussed on the following MSLQ learning strategies: rehearsal, organisation, elaboration, critical thinking, meta-cognitive self-regulation, and time and study environment management. Results suggest that role-modelling in an active learning environment does help students to implement SRL skills and experience the value of using the skills. Students reported making changes to their learning approaches to Financial Accounting III as a result of the intervention. Additionally the study identified the need for students to be taught the academic discourse of financial accounting within the course content.

Para isso, foi realizada uma pesquisa junto às empresas Cooperativas da Serra gaúcha e Região Metropolitana da Grande Porto Alegre do Estado do Rio Grande do Sul, constantes no cadastro da Organização das Cooperativas do Estado do Rio Grande do Sul (OCERGS), obtido junto ao Sistema de Crédito Cooperativo (SICREDI Serrana). Os métodos utilizados foram à pesquisa de campo e levantamento, sendo que os dados foram coletados por meio de questionário e de entrevista. A amostra efetiva do questionário foi constituída por trinta Cooperativas, sendo que dezessete com Contabilidade interna e treze com Contabilidade externa. Já a amostra efetiva das entrevistas foi constituída por sete Cooperativas, todas com Contabilidade interna. Accounting professors will now be accountable for teaching their students to think critically, analyze, and evaluate information. The pressure to change accounting higher education cannot be ignored with the new version of the CPA exam, released in April 2017, which now tests analysis and evaluation skills. Have the professors made the changes in their classrooms that will help their students to be successful with this format of questioning? This research seeks to find whether professors have indeed embraced pedagogy that will enhance students’ ability to develop higher order thinking skills. The study begins by explaining changes to the CPA exam. The study provides literature review of the accounting education process, traditional methods of teaching accounting, suggested methods of teaching accounting for enhancement of critical thinking, and identified reasons for resistance to changing teaching methods. The survey is designed to identify current teaching methods in accounting classrooms. The survey seeks to discover what methods are being used to develop higher order thinking skills. The results show that lecture and demonstration of problems are still the predominant method of instruction in accounting classrooms, and these methods are not typically endorsed by research in terms of developing critical thinking, analysis and evaluation skills.
