EU-Ukraine trade relations are important for both parties: for the EU it is a new market with huge land and labor potential, for Ukraine it is a short-term perspective to modernize it's economy. For now the trade and investment relations are not developed as they can be, in this work we analyze the current trade and investment flows between EU and Ukraine, determine the key partners and industries. In order to bring the relations to the new level, we analyze the possible impact of Free Trade Agreement on the both sides in general and more specifically regarding key industries. The result is the recommendation to continue EU-Ukraine integration, especially in terms of economical cooperation.

The Impacts and Implications of Post-1995 Linkages Between the Codex Alimentarius Commission and the World Trade Organization: Politicization, Deadlock, and Dispute

This thesis examines the impacts and implications of post-1995 linkages between the Codex Alimentarius Commission and the World Trade Organization. Chapters 1 and 2 provide data on the structures, functions, and procedures of the Codex Commission and the WTO and analyze their institutional approaches to risk, danger, risk management and the precautionary principle. Chapter 3 evaluates three impacts of post-1995 linkages between these institutions (the politicization of the Codex Commission, deadlock in the Codex standard elaboration process, and dispute in the WTO) as well as three implications of that linkage (risk v. danger assessment and management, changed interpretations of "science," and changed interpretations of "consensus"). Finally, Chapter 4 applies these impacts and implications to food safety cases. This chapter establishes a framework for understanding issues of food safety, Codex standard elaboration, and WTO dispute settlements in terms of scientific and political consensus and debate. This thesis argues, first, that the post-1995 linkage between the Codex Commission and the WTO changed Codex member state expectations and behaviors relative to standard elaboration procedures and that these changed expectations impacted both member state governments and the WTO. It further demonstrates that the extent of the Codex Commission's ability to elaborate universal standards and the WTO's responsibility for dispute settlement can be explained in terms of scientific and political dispute and consensus. Finally, it illustrates that risk and danger are different concepts, require different food safety approaches, and generate different institutional and national reactions. This analysis addresses existing critiques of the Codex Commission, the WTO, and their post-1995 linkages, examines the potential of both institutions to simultaneously pursue consumer safety and open trade objectives, and points to avenues for future research. / Master of Arts

Projected Economic Impacts of the New Partnership Agreement Between the EU and ACP States on the Senegalese Groundnut Sector

With the signing of the New Partnership Agreement (Cotonou Convention) between the European Union and the African, Caribbean, and Pacific States in June 2000, the trading relationship between Senegal and the European Union (EU) has taken a new direction. Under the new agreement, Senegal must decide by 2004 if it will enter into a Regional Economic Partnership Agreement (REPA) with the EU, similar to a free trade arrangement, or move to an enhanced form of the Generalized System of Preferences (GSP). Given the high percentage of Senegalese groundnut products that are exported to the European Union and the significance of the groundnut sector to the Senegalese economy, this study examines the economic impacts of both options on the Senegalese groundnut sector in conjunction with changes in development funding, infrastructural investments, and structural adjustment policies. Overall, the study finds that the REPA option is the more beneficial for the Senegalese groundnut sector. This result stems partially from the ability of increases in development funding to offset any adverse economic impacts caused by the REPA. Though overall more harmful than a REPA, moving to an enhanced GSP does have the benefit of increasing groundnut (in-shell and shelled) exports by a significant amount. Thus, the Senegalese government must weigh the benefit of a boost in the confectionery sector against the adverse impact on producers caused by the GSP. This study provides needed information for policy decisions by the Senegalese government, and a framework for future modeling efforts pertaining to the Senegalese groundnut sector. / Master of Science

EU-Ukraine Agricultural Trade : Investigating the Effect of the Association Agreement

This study examines the impact of the Association Agreement between the European Union and Ukraine on agriculture trade and agriculture businesses in the region. We argue that the Association Agreement is a Regional Trade Agreement in accordance with provisions of the GATT, and thereby apply established arguments of the positive and negative effects of the Association Agreement. To analyse the impact and establish a trend, we have utilised data from EU’s agricultural imports from Ukraine, Ukraine’s agriculture production output, and EU exports from one of Ukraine’s largest grain exporters. The agriculture commodities used to represent the agriculture data in the analysis are corn, wheat, seed oils, rapeseed, and sunflower seeds.  To support our discussion of the trends depicted in the data, we have applied the principles of the Theory of Free Trade, and its opposing theory, Protectionism. The findings suggest that the Association Agreement has facilitated a policy shift in the Ukrainian agriculture industry towards EU and away from Russia. However, we cannot limit out the possibility that this shift was inevitable with or without the Association Agreement considering Russia’s aggression towards Ukraine since 2014. Ukrainian agriculture exports to the EU have gradually increased since the implementation of the Association Agreement, and we infer that the Association Agreement plays a role in this increase. Our findings also suggest that agriculture businesses in the frontline five countries have been negatively impacted by the Autonomous Trade Measures which were introduced under the Association Agreement, but we argue that this was never the intention of the legislation. Lastly, we find that Multilateralism is achieved through a regionalist policy in this specific case, but that due to unforeseen circumstances does not reach its full potential.

Charter of Fundamental Rights and Basic Freedoms of the Czech Republic guarantees each person a right to own property. However, to protect this fundamental right, a secondary legislation must state which things can be refered to as property and which ways to create the ownership are legally relevant. Civil law of the nowaday Czech Republic has gone through a significant history. As to a part of the Austrian Empire, the later Austro-Hungarian Empire, the austrian legislation had been applied in the lands of former Kingdom of Bohemia and here it remained in force even after the fall of Austro-Hungarian Empire, when a new country, the Czechoslovakia, was formed. The regulation contained in the Allgemeines bürgerliches Gesetzbuch (ABGB), in other words the austrian Civil Code of 1811, was built mostly on Roman law basis. Such an influence can be exhibited e.g. on the provisions about things in legal sense and their divisions or about the ownership of things and means of its creation. In the lands of former Kingdom of Bohemia, the ABGB stayed in use until 1950, when it was succeeded by a new Civil Code. The Civil Code of 1950 was a result of only two year long process of recodification, that should create new rules for a new system based on the idea of socialism, leaving the Roman law principles behind....

O objeto de estudo desta dissertação é a abrangência subjetiva da cláusula compromissória, especificamente daquela celebrada por sociedades pertencentes a grupos societários. O problema, ainda novo no Brasil devido ao desenvolvimento recente da arbitragem em nosso país, já foi objeto de muito debate na Europa e nos Estados Unidos, onde a arbitragem é usada há muitos anos como método alternativo de resolução de conflitos. No âmbito da arbitragem comercial internacional, consolidou-se, tanto na jurisprudência como na doutrina, a teoria da unidade econômica dos grupos societários. Ela reconhece a especificidade do problema que a presença de agrupamentos de sociedades suscita na arbitragem, devido, essencialmente, à dupla realidade que eles representam unidade diretiva e econômica e diversidade jurídica. Nesta dissertação, procuramos expor as bases sobre as quais essa teoria, consolidada na prática comercial internacional, se assenta. Se no Brasil o tema não foi suficientemente discutido, podemos aprender as lições daqueles que não só já debateram exaustivamente a questão como, também, parecem já ter encontrado uma solução, ainda que ela não seja indene de críticas e ainda mereça ser aperfeiçoada. De início, tentamos conceituar e caracterizar os grupos societários. Em seguida, fizemos um apanhado de casos emblemáticos da jurisprudência arbitral e estatal, de diversos países, que recorreram à teoria da unidade econômica do grupo. Nosso intuito foi verificar a solução conferida ao problema por aqueles que se depararam com ele no caso concreto. Depois, procuramos expor a visão da doutrina sobre a teoria da unidade econômica do grupo, para podermos concluir onde reside o problema central da questão. Ao fim, discutimos o possível obstáculo, apontado por alguns autores, à aplicação da teoria no Direito brasileiro. / The purpose of this paper is to discuss who are the parties to the arbitration agreement, especially regarding the convention executed by companies that form part of a group. The issue, still topical in Brazil due to the recent development of the arbitration in our country, has already been subject to much debate in Europe and in the United States, where arbitration has been used for years as an alternative dispute resolution method. In international arbitration, the group of companies theory has been restated, both within the legal authorities and in case law. Such theory acknowledges the specificity of the issue raised by the presence of groups of companies in arbitration, especially due to their dual characteristics managerial and economical unit and legal diversity. In this paper, we have sought to settle the basis over which such theory, already settled in the international commercial arbitration practice, is construed. Since in Brazil the subject hás been scarcely discussed, we may learn lessons from those who have not only exhaustively debated it but who also seem to have found a way to solve it, even if it is not immune to criticism and still ought to be improved. We have initially tried to clarify the notion and the characteristics of the groups of companies. We have subsequently gathered a number of illustrative arbitral and state case law, from different countries, which have made use of the group of companies theory. Our aim was to verify the solution given to the issue by those who have actually been faced with the problem. Then, we have tried to present the legal authoritys view on the group of companies theory in order to conclude where the issue is in fact centered. In the end, we have discussed a possible obstacle, which certain authors have raised, as to the application of the theory in the Brazilian Law.

<p>Dagens affärsklimat ställer höga krav på bolag beträffande strategiska val på en allt mer globaliserad marknad. I uppsatsen föreslås att denna eskalerande globalisering kan vara associerad med bolagens framgång. Internationella bolagsförvärv och fusioner samt de initiala avsiktsdeklarationer som förkommer vid dessa transaktioner blir då centrala faktorer att beakta för bolagen, i sökandet efter förbättrade resultat. Baserat på detta skildrar uppsatsen innebörden av en initial avsiktsdeklaration, närmare bestämt ett Letter of Intent (LOI). Uppsatsen belyser innebörden av ett LOI ur ett strukturellt, juridiskt och praktiskt perspektiv. Den strukturella och praktiska innebörden av ett LOI återges genom två, för uppsatsen, exklusiva undersökningar. Den första undersökande delen beskriver strukturen för ett LOI genom att betrakta praktiska exempel som använts, vid bolagsförvärv och fusioner, i publika aktiebolag. Resultatet visar att strukturen samt de klausuler som ingår i ett LOI till viss del varierar. Oräknat det återfinns generaliserat, i undersökningen, följande klausuler i ett LOI: Bakgrund, Syfte, Villkor, Förbehåll, Sekretess, Exklusivitet, Due Diligence (DD), Tidplan, Avslut, Ersättning, Lagval samt Skiljedom. Den andra undersökande delen, om den praktiska innebörden av ett LOI, är baserad på intervjuer med personer som är aktiva ledamöter i bolagsledningen för större publika aktiebolag. Undersökningens sammanvägda resultat pekar på att ett LOI bör innehålla klausuler och preciserade villkor för en tilltänkt affär. I praktiken torde ett LOI innebära en framtida utfästelse om att ingå avtal eller samarbete mellan bolag.
