The secondary purpose of this dissertation is to demonstrate that the alterations imposed to Social Security by the Constitutional Amendments 20/98 and 41/2003 should respect the acquired rights of insured and servants, who, at the time of edition of said amendments, complied with the requirements necessary for retirement. The justification for the choice of the theme of this work is developed by reason of the serious doctrinaire and jurisprudential dissents on the extent and limits of Constitutional Amendments 20 and 41, the stone clauses, unfolded into acquired right and juridical safety of the public insured and servants. This work investigates, too, the constitutionality of said Constitutional Amendments in accordance with the fundamental principles inserted by the constituent assembly. Constitutional Amendments 20/1998 and 41/2003 modified the security concept itself, redefining untouchable juridical paradigms, such as, for instance, the juridical safety and acquired right statutes. The hypothese raised is the following: the rules that provide on the social security rights and guarantees are social to attain the nuclear problem of this dissertation, one started from analysis of the process of constitutionalization of Constitutional Amendments 20/1998 and 41/2003, in order to check whether such amendments are consistent with the will of the constituent assembly / O objetivo central desta dissertação é investigar a relação entre as Emendas Constitucionais n. 20/1998 e n. 41/2003 e o equilíbrio financeiro e atuarial nos regimes de previdência social. O objetivo secundário é demonstrar que as alterações impostas pelas Emendas Constitucionais n. 20/98 e n. 41/2003 à previdência social deveriam respeitar os direitos adquiridos dos segurados e servidores que, à época da edição das referidas emendas, preenchiam os requisitos necessários para requerer a aposentadoria. A justificativa para a eleição do tema deste trabalho se dá em razão das sérias divergências doutrinárias e jurisprudências acerca do alcance e dos limites da referidas emendas em relação às cláusulas pétreas, desdobradas no direito adquirido e na segurança jurídica dos segurados e servidores públicos. Lança-se a hipótese de que as alterações oriundas das Emendas Constitucionais n. 20/1998 e n. 41/2003 visaram estabelecer o equilíbrio financeiro e atuarial para a previdenciária social, com a mudança no financiamento dos regimes de previdência social. A metodologia adotada seguiu o método dedutivo. A utilização de precatórios como forma de extinção de créditos tributários / The use of court-ordered debt payment to settle taxes

A presente dissertação focaliza a utilização do precatório judicial como meio de extinção do crédito tributário. Parte-se da seguinte hipótese: é possível a utilização de precatórios como forma de extinção do crédito tributário? Em quais situações? Para que se possa responder com segurança às indagações acima, são analisadas as modalidades de extinção do crédito tributário previstas no Código Tributário Nacional, especificamente o pagamento e a compensação, apontando-se os seus requisitos essenciais e as limitações impostas pelo ordenamento jurídico para a realização de ambos. Com suporte nessas considerações são fixadas as premissas que servirão para o enfrentamento das teses envolvendo a extinção dos créditos tributários por meio de precatórios. A partir disso, adentra-se ao estudo dos precatórios, desde a sua origem no Direito Constitucional Brasileiro, até o seu atual regramento na Constituição da República. São também estudadas as mudanças empreendidas após a promulgação da Constituição Federal de 1988, com destaque para as Emendas Constitucionais n° 30 de 2000 e 62 de 2009. Isso porque as referidas emendas instituíram, respectivamente, o parcelamento decenal e o regime especial de pagamento de precatórios vencidos, que ensejaram as grandes questões em matéria tributária que são enfrentadas nesta oportunidade, como a utilização de precatórios em compensações ou como garantia da execução fiscal. Ao final do trabalho são expostas as conclusões obtidas. / This dissertation focuses on the Court-Ordered debt payment to settle taxes. Starts with the following hypothesis: it is possible to use a Court-Ordered debt payment for pay a tax debit? In what situations? To respond this questions safely, was studied the conditions for the payment of tax debit, specifically the payment in the tax law and compensation, pointing to their requirements and limitations imposed by law. This rules will used to be set the possibility to pay a tax debit with the judicial order. After this, will be studied the court ordered in the Brazilian Constitutional Law and the changes performed, especially the Constitutional Amendments No. 30 of 2000 and 62 of 2009. That\'s because those amendments introduced like the special parceling for payment the public debt are the focus of the the major questions concerning tax matters that were worked at this opportunity. At the end of this work will be exposed the conclusions.

A teoria do Poder Constituinte Derivado de Equivalência às Emendas Constitucionais busca abarcar por completo o fenômeno jurídico da aprovação de tratados e convenções internacionais sobre direitos humanos como equivalentes às emendas constitucionais, nos termos do §3º do art. 5º da Constituição, inserido pela Emenda Constitucional nº 45/04. Após a descrição crítica do panorama constitucional, doutrinário e jurisprudencial em que foi engendrado este novo dispositivo do art. 5º e o procedimento pelo qual foi aprovada a incorporação da Convenção sobre os Direitos das Pessoas com Deficiência e de seu Protocolo Facultativo como equivalentes às Emendas, seguem as três partes essenciais e imprescindíveis que compõem a abordagem do tema. A primeira está voltada à caracterização da presença de uma nova manifestação de Poder Constituinte, com o objetivo de oferecer soluções coerentes e consistentemente respaldadas em um arcabouço teórico comum para toda a problemática envolvida, que será especificamente examinada a partir das questões enfrentadas na Parte II. Já a terceira parte está mais atrelada às questões materiais, ao se preocupar com o objeto da equivalência constitucional: se esta inclui todo o diploma internacional; exclusivamente os direitos humanos nele previstos; ou também normas de outra natureza, abstraindo e projetando conclusões a partir da experiência concreta da Convenção. After critically describing the constitutional, jurisprudential and doctrinaire panorama in that was engendered in this new device of art. 5º and the procedure by which the incorporation of the Convention on the Rights of Persons with Disabilities and its Optional Protocol was approved as equivalent to the Amendments, follow three essential parts that make up the approach to the subject. The first is directed to describe the presence of a new manifestation of constituent power, with the goal of providing solutions coherent and consistently backed into a theoretical framework common to all the problems involved, which will be examined specifically from the issues faced in Part II. This study examined the policy letters and verbal testimony transcripts submitted by interest groups to the United States Department of Education (USDE) in response to the proposed regulations pertaining to the implementation of the 1997 reauthorization of P. L. 105-17, Individuals with Disabilities Education Act (IDEA). Specifically, this study analyzed the emerging themes in the area of discipline. Responses were received from the following interest groups: (a) school administrators, (b) parents, (c) teachers, (d) state educational agencies (SEAs), (e) national educational organizations, and (f) members of the United States Congress. In addition to analyzing the emerging themes, the study compared these themes to ones found in the current literature and court cases.

Alleoni / Resumo: Existe interesse na busca de alternativas para a implantação do sistema de plantio direto em áreas anteriormente cultivadas no sistema convencional de preparo do solo ou sob pastagens, sem a incorporação prévia do calcário, realizando-se a calagem superficialmente desde o estabelecimento do sistema, desde que não haja impedimento físico ao crescimento radicular. Nesse sentido, o gesso agrícola, por ser mais solúvel e apresentar relativa mobilidade no solo, é apontado como alternativa para correção das camadas subsuperficiais do solo em curto prazo, podendo ser utilizado como um produto complementar ao calcário. Dessa forma, o trabalho objetivou avaliar a influência da aplicação superficial de calcário e gesso, na implantação do sistema de plantio direto, sobre as características químicas do solo, o teor de cátions solúveis na parte aérea das culturas, o crescimento radicular, a nutrição e produtividade de culturas anuais, em região de inverno seco. O experimento foi conduzido nos anos agrícolas de 2002/2003 e 2003/2004, na Fazenda Experimental Lageado, localizada no município de Botucatu (SP), em um Latossolo Vermelho distroférrico, anteriormente conduzido no sistema convencional de preparo do solo. O delineamento experimental foi em blocos casualizados com parcelas subdivididas e quatro repetições. As parcelas foram constituídas por quatro doses de calcário dolomítico (0, 1.100, 2.700 e 4.300 kg ha-1), com PRNT = 71,2%, visando elevar a saturação por bases para 50%, 70% e 90%, respectivamente. As subparcelas foram constituídas pela ausência e aplicação de 2.100 kg ha-1 de gesso agrícola (6 x teor de argila em g kg-1, na camada de 0,20-0,40 m de profundidade). (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: There is great interest to search alternatives to establish the no-tillage system in fields previously cultivated on conventional tillage or on pasture, with no lime previous incorporation, using superficial liming since the beginning of system, if don't have physical impediment to root growth. Thus, the phosphogypsum, that is more soluble and with high mobility, has been an alternative to correct the subsuperficial soil layer, in a short time, and can be used as a lime complementary product. Therefore, the objective of this work was to evaluate the effects of lime and phosphogypsum surface application during the establishment of no-tillage system, on the soil chemical characteristics, on the content of water-soluble cations, in the crop shoot, on the root growth, on the nutrition and yield of annual crops, in a dry winter region. The experiment was carried out during the agricultural years of 2002/03 and 2003/2004, in an experimental area located in Botucatu County, São Paulo State, Brazil (48º 23' W and 22º 1' S) on a Haplorthox, before used with conventional tillage system. A randomized complete block design, in split-plot scheme, and four replications was used. The plots were composed by four dolomite limestone levels (0; 1,100; 2,700; and 4,300 kg ha-1), with Neutralization Power = 84.3% and Reactivity = 84.5%, aiming raise the base saturation to 50%, 70%, and 90%, respectively. The subplots were composed by without and with phosphogypsum application (2,100 kg ha-1 = 6 x clay content (g kg-1) in 0.20-0.40 m depth layer). For the summer crops a split-split-plot scheme were used. Valorisation de biodéchets pour la restauration de sites dégradés de Nouvelle-Calédonie / Biowaste valorization for restoration of New Caledonian degraded sites

Les biodéchets tels que les boues de stations d’épuration ou les fientes de poules peuvent être utilisés pour l’amendement organique des sols. En Nouvelle-Calédonie, l’accroissement démographique a pour conséquence une augmentation de la production de ces déchets. Aussi, la gestion et le devenir de ces derniers est une problématique majeure pour les collectivités. D’autre part, il existe de nombreux sites dégradés liés à l’activité minière. Il s’agit notamment des sites miniers après exploitation, caractérisés par un substrat ultramafique, auxquels s’ajoutent les zones industrielles.L’objectif de cette thèse cherche à apporter des données sur la valorisation des biodéchets (boues d’épuration et fientes de poules) pour la restauration de sites dégradés. Trois types de site sont sélectionnés : un ferralsol non remanié, un ferralsol remanié par l’activité minière et un site industriel. A partir de ces études indépendantes, nous tenterons de répondre à l’opportunité de revégétaliser un site à partir du stock de graine du sol d’origine ou de végétalisé un site dépourvu de son sol d’origine par plantations. Sur ces 3 sites, il a été suivi les variables biométriques, chimiques des végétaux et les variables chimiques et physico-chimiques des substrats.Les résultats sont, dans l’ensemble, encourageants avec des effets très positifs sur la croissance végétale. La quantité de boue à apporter sera à moduler en fonction des objectifs à obtenir entre production végétale et diversité spécifique. La faible biodisponibilité des ETM du sol semble être favorable à l’épandage de biodéchets sur ces substrats spécifiques pour la réhabilitation des sites dégradés. / Biowaste like biosolids or poultry can be used for organic amendment of soils. In New Caledonia, the demographic development involves an increase in waste production and the management of these ones is highly important for local authorities. On the other hand, there are numerous degraded sites issued from mining activity. In particular mining sites after exploitation, characterized by an ultramafic substratum, and industrial sites The objective of this thesis consists to bring data on biowaste valorization (sewage sludge and poultry) for degraded sites restoration. Three kind of degraded sites are selected: a not-reorganized ferralsol, a ferralsol reorganized by the mining activity and an industrial site. From these independent studies, we try to evaluate the opportunity of revegetalization from the seed bank of the original soil, or vegetalized a site free of original soil by plantations. On these 3 sites, it was followed the biometric, chemical variables of the vegetal species and chemical and physico-chemical variables of the substrata. The results are encouraging, with positive effects on plant growth. The biosolids quantity should be modulating according to the objectives to obtain between plant production and specific diversity. The low bioavailability of the ETM seems to be favorable to the biowaste manuring of these specific substrata for the rehabilitation of the degraded sites.

EVALUATING SOIL PHYSICAL AND CHEMICAL PROPERTIES FOLLOWING ADDITION OF NON-COMPOSTED SPENT COFFEE AND TEA FOR ATHLETIC FIELDS

Physical and chemical properties of non-composted spent coffee (CF) and tea (T) suggest they may have applications as soil amendments for improving poor soils. Studies were conducted to determine 1) the effect of amendments on grass growth and soil properties, 2) the effect of incorporation versus surface application of amendments on soil properties, and 3) the effect of amendment application frequency on grass growth and soil properties. In the first study, amendments were mixed with sand and planted to bermudagrass. Treatments included CF, T, and peat moss (PM) mixed with sand, and 100% sand as a control. In the second study, amendments were topdressed onto a sand base with different timings. Pots were either aerified or not. Treatments included T, CF, PM, and a control. Nutrient contents and soil CEC and OM under CF and T treatments were equivalent to or greater than PM treatments. Tea showed comparable grass cover to the PM treatment, while CF showed an inhibitory effect to grass growth in the first year of the study. Aerification showed no benefit. Additionally, a field study was conducted to evaluate CF and T on surface hardness, VWC, and quality after trafficking. Differences were not observed among treatments.

An evaluation of the parametric amendments of legislation relating to the distribution of retirement benefits upon divorce

<p>This thesis will examine the effects of divorce on the benefit payable to a member of a retirement fund, where divorce has occurred before the member has reached retirement age. In&nbsp / particular, parametric (that is, piecemeal) amendments to the relevant legislation will be analysed in order to outline the development of the legislation relating to divorce and the consequent distribution of&nbsp / assets (including retirement savings). The previous and current legal position in South Africa relating to divorce and retirement savings will be set out and critically analysed to determine whether the current position can be regarded as an improvement upon the previous legal position, or whether other and/or new problems in this area have been created. Parametric amendments to&nbsp / relevant legislation have thus far been the subject of many cases in our courts and adjudicative tribunals. A systemic overhaul of a particular area of law is a useful tool in providing legal certainty&nbsp / and clarifying the laws applicable to that area. This thesis will therefore argue in favour of a systemic overhaul of the legislation applicable to the allocation of retirement benefits at divorce, as opposed to the ineffectual parametric (i.e. piecemeal) amendments that have been implemented thus far. An essential aspect of this study is a comparative study of South African legal principles&nbsp / relating to retirement benefits and divorce with the legal principles of this subject in the United Kingdom (UK).</p>

A movement of one's own?: American social movements and constitutional development in the twentieth century / American social movements and constitutional development in the twentieth century

This dissertation examines the interaction between American social movements as they pursue their constitutional rights. The public law literature is dominated by a topdown approach to the study of constitutional politics, frequently focusing on the impact of Supreme Court decision-making. Instead, I explore constitutional politics from the bottom-up, analyzing constraints on social movement organizations as they formulate their constitutional strategies. Social movements must always be keenly aware of the actions of their peers who also seek to exploit the Constitution for their own benefit. My findings indicated that social movements recognize this competitive relationship with other social movements and treat their fellow constitutional claimants accordingly, acting to contest claims unfavorable to their cause, co-opt claims of other groups that have shown promise, and even form coalitions with their peers where an adjustment of their own claims to accommodate their coalition partners will likely net a greater return than going it alone. These negotiated constitutional claims have resulted in significant, durable and often ironic or unexpected shifts in constitutional development. / text
