Ce mémoire vise à évaluer les réformes consistant à encadrer le pouvoir de nomination que confère la prérogative royale au premier ministre. Notre étude s’inspire largement de l’institutionnalisme historique en science politique et des analyses en termes de « path dependency ». Selon cette approche, lorsque les décideurs amorcent une trajectoire de politique publique, leurs décisions subséquentes auront tendance à suivre la même direction. À partir des documents gouvernementaux et des transcriptions de comités parlementaires, ainsi que de l’exemple de la Grande-Bretagne, ce travail cherche à évaluer si les réformes visant à contraindre le pouvoir de nomination du premier ministre canadien ont suivi une trajectoire « path dependent ». Nos conclusions nous amènent plutôt à constater qu’en ce qui concerne les nominations, le Canada est plus monarchique que la Grande-Bretagne. Pour le Canada, l’impression générale qui se dégage à la fin de ce mémoire n’en est pas une de « path dependence » mais plutôt d’incrémentalisme disjoint. / This paper aims to assess the reforms that regulate the appointment power conferred by the Royal Prerogative to the Prime minister. Our study is largely based on historical institutionalism in political science and analysis in terms of “path dependency”. This theory argues that once policymakers begin a course of public policy, their subsequent decisions will follow the same direction. Based on governmental documents, transcripts of parliamentary committees and the example of Great Britain, this work seeks to assess whether the reforms to constrain the appointment power of the Prime Minister of Canada validates the “path dependence” approach. Our findings leads us rather to see that with regard to appointments, Canada is more monarchical than Great Britain. Our general conclusion is that the Canadian approach is not “path dependent” but can be better described as “disjointed incrementalism”.

Abbatial elections : the case of the Loire Valley in the eleventh centuryHowie, Catriona V. January 2015 (has links)
This thesis examines a series of documents described as electoral charters, produced in monastic institutions of the Loire Valley from the late tenth to late eleventh centuries. By considering the variations in the formulas used for each charter, the study considers what the charters were saying about power or wanted to project about the powers at play in the events they described. Through this, the thesis demonstrates that the power of lordship projected by such documents was of a very traditional nature throughout the period in which they were being produced. The count's role on each occasion showed him to be a dominant force with a power of lordship composed of possession and rights of property ownership, but also intangible elements, including a sacral interest. By considering the context of events surrounding each charter of election, the thesis demonstrates that elements of this lordship could be more or less projected at different times in order that different statements might be made about the count. Thus, the symbolic expressions of power appear to have been bigger elements or more strongly emphasised in periods when the count's political or military power was under pressure. The differences in formulas used throughout the period of the charters' production demonstrate that, despite the appearance of new elements that may appear to have been important novelties, these processes were likely to have been original to proceedings, and therefore the notions of a reform of investitures taking place in the mid-eleventh century must be nuanced. Instead of demonstrating a mutation in relationships between lord and Church, the documents demonstrate an alteration in style and content, becoming more narrative and verbose and in these ways revealing elements of the process of abbatial elevations that had previously been hidden from view.

Election and removal of members of the governing and supervisory boards of a joint stock company from a com- parative perspective The diploma thesis deals with the ways of the appointment and removal of the members of the governing and supervisory boards of a joint stock company in the Czech Republic and in Great Britain. It focuses on three main areas: the appointment, removal and the eligibility of members of the governing and supervisory boards of a joint stock company. The aim of the thesis is not only to describe the Czech and British legal provisions on these topics, but also to compare and evaluate them. Within the scope apart from other things it attempts to answer these questions: whether the new Czech Companies Act which will come into force on the 1st January 2014 has been influenced to some extent by the British Companies Act 2006 or whether British pattern did not offer any inducement to any change. The thesis consists of seven chapters. The first three chapters analyse legislation of the Czech Republic. They describe legal provisions of the cur- rent Commercial Code and compare them with the provisions of the new Companies Act and the new Civil Code. The next three chapters describe British law. The role of South African Democratic Teachers' Union in the implementation of teacher redeployment policy in schoolsDwangu, Agrippa Madoda 01 October 2019 (has links)
The purpose of this study was to understand what the role of SADTU (South African
Democratic Teachers’ Union) is in the implementation of the Teacher Redeployment
Policy in schools. The Approach to data collection was that of qualitative research.
The methods used to collect data were interviews and literature review. The study
used the interpretive paradigm. The theory applied is the Interpretive
Phenomenological Analysis (IPA) theory. IPA aims to explore in detail how participants
are making sense of their personal and social world. The approach to data analysis
was that of a qualitative research. Qualitative data were organised and arranged
categorically into themes and patterns emanating from the responses of participants.
The data were analysed using descriptive explanations, based on the frequencies and
similarities of the responses. The approach was primarily exploratory, just as would be
expected of a qualitative research design. A combination of purposive, quota and
snowball sampling was used in this research. The main finding in this research is that
the role of SADTU in the implementation of teacher redeployment is not limited to
observation as the policy prescribes. SADTU members go beyond that role and
assume the role of active participation and decision making in the process. The main
recommendation was that the policy should be amended to allow SADTU to
participate actively in discussions and decision making. This will avert the
unnecessary conflicts and instability in schools caused by the suppression of the
union to participate actively. When the Teacher Redeployment Policy was conceived,
the purpose was to achieve equity in teacher distribution by moving teachers from the
historically advantaged White schools to the historically disadvantaged Black schools.
The implementation of Teacher Redeployment Policy is causing more harm than good
in so far as effective teaching and learning in schools is concerned. For most of the
time, teachers are pre-occupied with worrying about how the process of teacher
redeployment is going to affect them instead of focussing on delivering quality
teaching in schools. Teachers who are most fitting to be the ones identified in excess
in some cases enjoy the benefit of escaping redeployment for the simple reason that
they are members of SADTU. At the same time, candidates who do not qualify to be
placed in specific posts are placed into those posts at the expense of the best suitable
candidates because of the biases. The role of the union is not to implement policy, but
also to make sure that the policy is implemented in the spirit and letter in which it was
formulated. The status of the teacher union in the implementation of policy is that of an
observer who only surfaces when an observation is made whether there is unfairness

The role of the Namibia national teachers' union in the development of the staffing norms policy in NamibiaLukubwe, Rosco Misika 11 1900 (has links)
21 March 1990 marked the turning point in the Ministry of Education's policy processes in Namibia when a culture of open debate in policy making commenced. Against this background, this study focused on the role of stakeholders in the policy process with particular reference to the role played by the Namibia National Teachers' Union (NANTU) in the formulation of the staffing norms policy in Namibia. The topic was investigated by means of a literature study and an empirical investigation using a qualitative approach. Data was collected by semi-structured interviews from a small sample of Union and Ministry officials. Findings supported the role of NANTU in what was traditionally perceived a management area of jurisdiction. The role of the teachers' union in policy making is more widely accepted due to professionalism. Findings stressed the significance of stakeholder involvement in policy processes and provided a better understanding of the complex nature of policy. / Educational Studies / M. Ed. The Eastern Cape Department of Education has a constitutional and legislative mandate to provide quality public education in all public schools within the province. The commitment to improve also involves ensuring effective educator personnel provisioning in public secondary xii schools. However, despite various legislative and policy measures relating to educator personnel provisioning, serious concerns have been raised. There have been concerns over the shortage of educators. There are concerns over the lack of suitably qualified educators, especially in Mathematics and Science subjects. Disparities have been noted between legislative and policy directives with regard to educator personnel provisioning and the expectations of educators based on the realities in public secondary schools. The complications and challenges thereof have called upon for the appraisal of educator provisioning. The objective of the study is to describe and explain the nature and place of personnel provisioning in public secondary schools. Thereafter, evaluate its application at selected public secondary schools in the Eastern Cape Province. The basic intention is to prove that the educator personnel provision policy implementation in public schools needs to be examined and possibly changed for effective results. Basically, personnel provisioning is the first step in the personnel process. It is classified into: Human resources determination; and the Filling of posts The process of filling public personnel posts involves recruitment, selection, appointment, placement, transfer and promotion. In evaluating personnel provisioning policy in public secondary schools, a research study has to be conducted. As an integral part of scope of study, the survey area includes public secondary schools, provincial department offices and educator union/association offices. The questionnaire is used as the appropriate data collection instrument for this survey. The total population for the study are provincial department officials, public secondary school principals, school governing body chairpersons and educator unions/associations. xiii When data was analysed and interpreted, there were various significant findings. The respondents’ demographic details provided a significant insight into the study and its findings. They ensured divergence of opinions and understanding of the personnel provisioning. Regarding human resources determination and the filling of posts in public secondary schools, it was found that there are challenges in terms of the employment of suitably qualified educators. These include among other issues educator dissatisfaction and lack of effective procedures in the filling of posts. This also results in educator shortage in public secondary schools.

The purpose of this study was to explore and describe the challenges that a Namibian bank faced in recruiting and retaining skilled employees. The study adopted a qualitative research approach and the data were collected through face-to-face interviews with 20 participants from the Namibian bank. The researcher used the Five-Phased Data Analysis Cycle as described by Yin (2011) to analyse the data. Ensuring trustworthiness, the researcher used Guba's Model of Trustworthiness as cited by Krefting (1990).
The major findings of the study were the shortcomings in the Namibian bank remuneration structure, lack of training and no employee recognition. The recommendations of the study are that the Namibian bank needs to implement training and development for its employees, review its remuneration structure and demonstrate appreciation of staff by showing recognition, better salaries and incentives. / Business Management / M.Com. The predictive validity of the selection battery for trainee pilots in the South African Air ForceFlotman, Aden-Paul 30 June 2002 (has links)
The sample comprised 92 candidates who have completed the Ground School Phase of
the trainee pilot training programme. The independent variables are Raven's Advanced
Progressive Matrices Test, the Blox Test and the Vienna Determination Test. The
dependent variable is the candidates' results after the Ground School Phase of their
training. The results indicated that only the Advanced Ravens test and the Vienna
Determination test (Phase 3} correlate positively with the Ground School Phase results
of the candidates.
The current battery emphasises cognitive abilities and psycho-motor functioning and does
not cover personality traits of prospective candidates. It is recommended that new
instruments are included (to cover the measurement of personality traits), that the sample
size should be increased by promoting pilot training among previously disadvantaged

This study investigates relationship marketing by estate agencies in the residential property
market of South Africa. In determining the residential estate agency's knowledge of relation ship
marketing, an extensive literature study was undertaken on the marketing environment and
broader market, marketing concept, market segmentation and target marketing, the marketing
mix and expansion thereof, as well as customer service and internal marketing.
An empirical study was conducted to determine the residential estate agency's present
knowledge and practices of the basic components of relationship marketing. In the study a
structured questionnaire was mailed to all residential estate agencies which are members of the
Estate Agency Affairs Board. The most significant findings are that: the majority of
respondents do not have mission statements and do not know what a mission statement is; they set
marketing objectives which are communicated to the agents; when appointing new agents they
consider the agent's service orientation and ability to work with clients, but qualifications and
previous experience are not viewed as important; they train estate agents themselves and emphasise
after-sales contact and building of long-term relationships, but do not stress customer behaviour influences; a large percentage do not conduct competitor analyses and
view marketing research as unimportant, but are of the opinion that they have superior market
knowledge and offer the best service quality; they regard the principles of the marketing
concept as important; they engage in a large number of after-sales services, although few
realise that contact after occupation is important; they regard the buyer's financial means as
important and engage in activities to ensure customer service, but do not have formalised
feedback systems to test customer satisfaction; they engage in internal marketing activities,
strive to create a positive corporate culture and try to retain good agents.
In conclusion it can be said that there is evidence that the principles of relationship marketing
are followed by residential estate agencies in South Africa. There are, however, concerns about the
long-term commitment of estate agencies towards their clients because of the lack of
