Cette thèse a pour objectif d'interroger les surprenantes mises à l'agenda européen des politiques de conciliation emploi-famille depuis le milieu des années 1970. En utilisant le modèle des courants multiples développé par John Kingdon et adapté pour l'Union européenne par Nicole Herweg, cette thèse montre que les politiques de conciliation suivent des trajectoires tout sauf linéaire. Elle met en lumière l'importance de la maturité et de la stabilité des trois courants (le courant des problèmes, le courant des solutions et le courant politique) ainsi que le rôle de certains entrepreneurs politiques dans l'explication des mises à l'agenda politiques et décisionnels de ces politiques. Estuda-se nesta tese o conteúdo jurídico do princípio da impessoalidade, previsto no art. 37, caput, da Constituição Federal de 1988, especificamente para fins de parametrização, controle e responsabilidade das decisões administrativas. The essay comprises three main fields of analysis: a) introductory concepts preliminary approach to comprehend the theoretical and the political context in which is developed the scope and the enforcementof the principle of impersonality in the processes that lead to administrative decisions (postpositivism and neoconstitutionalism; the enforcement of principles; public interest; Administrative Law as a system; politic neutrality and the issue of Justice); b) the principle of impersonality within the Administrative Law - analysis of the scope of protection of the principle, aiming to demonstrate that its juridical concept must be considered in a wide open perspective in order to guarantee a strong protection of the constitutional values. In this part, it will be emphasized that the development of a impartial administrative conduct is closely related to the idea of a impartial administrative organization. (historical background; foreign legislation; Brazilian legal doctrine; the principle of the impersonality within the constitutional rules, the specific legislation and the judicial precedents; juridical concept of the principle); c) the enforcement of the principle of impersonality in administrative decisions - In this part it is developed the juridical concept of the principle in the field of the deliberative administrative proceedings. Honório Hermeto Carneiro Leão (1801-1856) foi um dos mais eminentes políticos do Partido Conservador do período monárquico brasileiro. Foi agraciado visconde e marquês de Paraná, nos anos de 1852 e 1854, respectivamente. O ápice de sua carreira foi a presidência do Ministério da Conciliação, entre 1853 e 1856. A trajetória política de Carneiro Leão a partir de 1842 é o objeto central desta dissertação. Não se pretendeu, todavia, recontar sua vida de forma linear, nem simplesmente relembrar laudatoriamente seus serviços ao Império do Brasil. Este trabalho buscou, sobretudo, questionar e desconstruir a memória que uniu indivíduo e Estado e influenciou muitas interpretações sobre cinco importantes acontecimentos políticos do Oitocentos brasileiro: a formação do Regresso conservador; as revoltas de 1842; a Rebelião Praieira; a intervenção na região do Rio da Prata e, por fim, o Ministério da Conciliação. Cada um desses assuntos foi tratado detalhadamente nos quatro capítulos desta dissertação. / Honório Hermeto Carneiro Leão (1801-1856) was one of the most eminent politicians of the Conservative Party of Brazilian monarchical period. He was honored with the titles of viscount and marquis of Paraná in 1852 and 1854, respectively. The apex of his career was the chair of the Conciliation Cabinet, between 1853 and 1856. The political career of Carneiro Leão since 1842 is the main subject of this dissertation. However, it was not intended to recount his life in a linear basis, nor simply laudatorily recall his services to the Brazilian Empire. This study aimed, above all, to question and deconstruct the memory which united the individual and the State and influenced many interpretations of five major political events of the Brazilian Eighteenth Century: the formation of the Regresso; the riots of 1842; Praiera Rebellious; intervention on the Platine region and, finally, the Conciliation Cabinet. Each one of these issues was discussed in detail in four chapters of this dissertation.

The reconciliation, at first glance, seems to represent an indispensable virtue for life in society; an effective mechanism to resolve conflicts expeditiously, to provide social peace; in short: a process in which everyone. wins. This virtuous vision is presented by the Courts and the National Council of Justice (CNJ) and defended for most of the doctrine, being taken as "truth" by society in general. The purpose of the work is to confront this view, as there is reason to believe that the reconciliation can also represent a major obstacle to building a just and egalitarian society, especially with regard to labor relations. It is therefore necessary to address the following questions: is reconciliation, then the "methodological" institutionalization of the famous "Brazilian way" in courtrooms throughout Brazil? It would be official recognition of a compromise, the flexibility between the law and the situation to which it should apply, subordinating to the people that she should obey? The study uses the dialectic method by means of which carries a multidisciplinary analysis of the object. Taking into account its various dimensions, research involving the various characters of reconciliation: workers, employers, lawyers, judges. From a theoretical framework built through bibliographic research and application of instruments of empirical research, this work shows the evolution of reconciliation in national law, its characteristics, the reasons for each character, its effects and its political and cultural relationship with Brazilian society. The labor court conciliation is, above all, a successful strategy to make the invisible social conflict and to solve it only in appearance, through the logic of the "Brazilian way. / Esta pesquisa versa sobre a conciliação judicial trabalhista como meio alternativo de resolução de conflitos em dissídios individuais na Justiça do Trabalho. A conciliação, à primeira vista, parece representar uma virtude indispensável à vida em sociedade; um mecanismo eficaz de solucionar conflitos de forma eficiente, de proporcionar a pacificação social; em suma: um processo em que todos ganham. Esta visão virtuosa é apresentada pelos Tribunais e pelo Conselho Nacional de Justiça (CNJ) e defendida pela maior parte da doutrina, sendo tomada como “verdade” pela sociedade em geral. A finalidade do trabalho é confrontar essa visão, pois há razões para acreditar que a conciliação pode também representar um grande obstáculo à construção de uma sociedade justa e igualitária, especialmente no que tange às relações de trabalho. É necessário, portanto, enfrentar as seguintes questões: seria a conciliação, então, a institucionalização “metodológica” do famoso “jeitinho brasileiro” nas salas de audiência de todo o Brasil? A conciliação judicial trabalhista é, sobretudo, uma estratégia bem-sucedida para tornar o conflito social invisível e para solucioná-lo apenas na aparência, por meio da lógica do “jeitinho brasileiro”.

Paulino José Soares de Souza (1807-1866) foi um dos políticos mais importantes do Partido Conservador no Império. Foi agraciado com o titulo de Visconde do Uruguai em 1855, depois de ter passado pelos Ministérios da Justiça e dos Negócios Estrangeiros em períodos extremamente importantes para a história do Império como a aprovação das reformas do Regresso, o fim do tráfico negreiro intercontinental e as campanhas platinas contra Rosas e Oribe. Subindo o Ministério da Conciliação em 1853, nunca mais voltou a responder por nenhuma pasta ministerial até a sua morte, permanecendo porém ativo como senador e conselheiro de Estado. O período compreendido entre 1853 e sua morte em 1866 é considerado por grande parte da historiografia como um período de ostracismo de Uruguai, idéia essa que começou a ser gestada pelos seus biógrafos do século XIX. Contudo foi nesse período que Uruguai escreveu suas obras. O presente trabalho visa não somente contestar essa idéia, mas expor como nesse período Uruguai deixou antever elementos de um projeto de organização do Estado Nacional. / Paulino José Soares de Souza (1807-1866) was one of the most influential members of the Conservative Party during the Brazilian Empire. He was awarded the title of Viscount Uruguay in 1855, after having served as Minister of Justice and as Minister of Foreign Affairs during extremely important periods for the history of the Empire, involving the reforms implemented by the movement which ultimately led to the organization of the Conservative Party (known as Regresso). After the Conciliation Cabinet took office in 1853, he never again held a ministerial office, but remained active as a Senator and member of the Council of State. The period extending from 1853 up to his death in 1866 is generally considered as a period of ostracism, a notion which was initially suggested by his 19th century biographers. But this was the period during which Viscount Uruguay wrote his major works. This investigation aims not only at disputing the idea of a retirement, but to show that during this period he drafted a project for the organization of the National State.

Manitoban Consensual Non-monogamous Couples' Conciliation of Their Parenting Role and Their Sexual Lifestyle During the Transition to Parenthood

Background: Consensual non-monogamous couples (CNMCs) are viewed less favourably than their heteromononormative counterparts by the general population and by healthcare providers. Research indicates that they are less likely to seek health care and are at greater risk for STIs and HIV. This stigma and judgment perceived by CNMCs can be even further compounded when these couples choose to have a child. No study to date has looked at consensual non-monogamous parenting couples (CNMPCs) during the transition to parenthood. The aim of the present study was to explore Manitoban CNMCs’ perceptions of the conciliation between their parenting role and their sexual lifestyle during the transition to parenthood. Methodology: This mixed methods descriptive, exploratory study used a triangulation design-convergence model. Six participants identifying as CNMCs during the transition to parenthood were interviewed using a semi-structured interview guide as well as completing an online questionnaire. Results: The participants in this sample experienced challenges in regard to their transition to parenthood as many other parents do, yet this transition was more harmonious for some participants compared to others. Consensual non-monogamy (CNM) was a sexual lifestyle chosen either before or during this transition. However, the lifestyle did stop during conception and pregnancy, and was resumed several months after childbirth. Relationship breakdown may occur, but not necessarily associated with CNM. The conciliation of parenting and sexual roles is facilitated when communication and intimacy are present between partners. Participants emphasized the importance of family before their chosen sexual lifestyle. The relationship with health care providers is critical for participants of CNM as it impacts how they seek health care or disclose their lifestyle. This is more important during the transition to parenthood as more challenges can be present. Three phases that CNMCs pass through were also identified, contemplation, acting and incorporation, to integrate CNM as a lifestyle. Discussion: These findings permitted a closer look at the conciliation of the parenting role and the sexual lifestyle of CNMPCs during their transition to parenthood. These findings demonstrated not only how CNMPCs were similar and different from participants in other studies, but also highlighted how they were uniquely distinct. This distinction appears to stem from a certain resilience gained from the three phases of the incorporation of CNM as a lifestyle that appears to buffer these couples in situations of stress. A new proposed model, CNMPCs’ Model of Resilience during the Incorporation of CNM as a Lifestyle While Parenting, is suggested. There is a need for more psychosexual education for perinatal nurses in regard to sexuality minorities such as CNMPCs in the context of the transition to parenthood.

Le présent mémoire s'intéresse aux liens existant entre le rapport au temps des pères et leur rapport à la paternité. Il s'appuie à la base sur un double constat: d'abord, que les rapports au temps des individus, et particulièrement des parents, ont évolué dans les dernières décennies; ensuite, que les hommes et les femmes ne se sont pas adaptés pareillement à ces changements, ce qui fait en sorte que leur expérience du temps et leurs contraintes temporelles diffèrent. Les études sur l'emploi du temps des individus et des parents démontrent des différences marquées entre les genres. Les femmes accordent généralement plus de temps aux activités domestiques et familiales que ne le font les hommes, alors que ces derniers allouent généralement une plus grande quantité de temps à leurs activités professionnelles. Les études sur l'emploi du temps des individus, communément appelées études budget-temps, mettent bien en évidence les inégalités qui touchent les femmes, notamment parce qu'elles consacrent plus de temps que les hommes à des activités non rémunérées. Mais il faut toutefois souligner que ces études sont fondées sur des moyennes qui généralisent à tous les individus d'une population les résultats observés. Or, ces études ne peuvent mettre en relief de possibles distinctions entre les individus d'un même groupe. Le cas de l'emploi du temps des pères soulève d'ailleurs des questionnements puisque plusieurs études récentes indiquent l'avènement de nouvelles formes de paternité et la cohabitation de plusieurs types de pères. Or, les résultats des études budget-temps ou des études comparant les comportements des hommes et des femmes ne laissent-elles pas en plan une richesse et une diversité de comportements qui ne sont pas pris en compte? C'est précisément l'objet de ce mémoire que d'explorer cette question. En effet, en analysant le discours de trente pères montréalais travaillant dans la nouvelle économie sur la conciliation entre la vie professionnelle et la vie privée (CVP), cette recherche tente de relever les liens qui existent entre le rapport à la paternité et le rapport au temps. Les résultats de cette recherche se présentent en deux temps. D'abord une typologie des rapports au temps des pères a été élaborée. Elle propose cinq types de rapport au temps qui ont été trouvés chez les répondants: l'égalitariste, le sacrifié, le multiactif, l'hypertravaillant et le communautaire. En détaillant chacun des types, une attention particulière est accordée aux liens existant entre le rapport à la paternité et le rapport au temps des répondants. Ensuite, les liens entre rapport à la paternité et rapport au temps sont abordés de façon plus globale et mis en contexte. De nombreuses femmes occupent des postes de cadres dans le réseau de la santé québécois et sont aux prises avec le défi quotidien de la conciliation travail-vie personnelle; en plus d'occuper un poste stratégique exigeant une charge de travail colossale, elles doivent concilier d'autres rôles dont ceux de mère et de conjointe. Dans un contexte où l'organisation .du travail est peu propice à l'émergence d'échanges informels et de moments de plaisir au travail, il y a lieu de se demander comment font ces femmes pour préserver leur santé mentale au travail. Cette surcharge de rôles entraîne une souffrance, au sens entendu par la psychodynamique du travail, qui pousse l'individu à élaborer des stratégies défensives pour faire face aux situations vécues. Parmi celles-ci, nous avons déterminé les communications interpersonnelles au travail comme une stratégie incontournable. Nous avons mené cette recherche exploratoire selon une approche qualitative et compréhensive auprès de quatre femmes cadres intermédiaires travaillant dans un centre hospitalier universitaire du Québec. La méthode du récit de vie a guidé la cueillette de données, et nous avons utilisé les outils d'investigation de l'entretien semi-dirigé et du journal de bord. Les données recueillies et l'analyse thématique qui a suivi ont révélé que les paradoxes organisationnels et relationnels sont des sources de souffrance récurrentes qui poussent la femme cadre intermédiaire à adopter des stratégies de communications interpersonnelles pour créer une zone de confort et agir en cohérence avec ses valeurs. Nous avons également compris le caractère soutenant d'un environnement relationnel, tant professionnel que personnel, qui facilite la conciliation travail-vie personnelle, en réduisant les effets délétères des paradoxes organisationnels et relationnels. Les relations interpersonnelles de la cadre, en plus de permettre le plaisir au travail, doivent être significatives, c'est-à-dire utiles, réciproques et intenses.
