Julgamentos parciais de mérito no processo civil individual brasileiro / Partial judgments on the merits in Brazilian individual civil procedure

Trata-se o presente estudo de monografia de conclusão do curso de mestrado em Direito Processual Civil, no âmbito da pós-graduação da Faculdade de Direito da Universidade de São Paulo (FDUSP), sob a orientação do Professor Doutor Paulo Henrique dos Santos Lucon, depositada no mês de janeiro do ano de 2013. Esta dissertação de mestrado trata dos julgamentos parciais de mérito no processo civil individual brasileiro, por meio do estudo da utilização da técnica da sentença parcial, que embora sem previsão expressa e literal no ordenamento jurídico brasileiro (diferentemente do que ocorre em alguns sistemas estrangeiros), pode ser utilizada, com cautela, a fim de concretizar princípios constitucionais, como a celeridade, a efetividade e a isonomia, além de contribuir para que se faça justiça no caso concreto. No primeiro capítulo, explica-se a pertinência do tema escolhido como objeto de estudo e faz-se uma breve introdução. No segundo, são explicados, em breve síntese, os temas mais importantes relacionados ao objeto em análise, como o conceito de mérito e a teoria dos capítulos de sentença. O terceiro capítulo é destinado ao delineamento dos julgamentos parciais já existentes no sistema, a respeito dos quais não se insurge a doutrina. O quarto destina-se a analisar e enfrentar as críticas à possibilidade de julgamentos parciais de mérito no ordenamento jurídico brasileiro. No quinto capítulo, são apresentadas e discutidas questões técnicas decorrentes da cisão do julgamento. O sexto capítulo trata sobre as sentenças parciais no âmbito da arbitragem. No sétimo, são analisadas as perspectivas dos julgamentos parciais em face do projeto de novo CPC e de seu substitutivo. Por fim, foram elaborados alguns parágrafos à guisa de conclusão e listados os livros e artigos utilizados como base para a realização do presente estudo. / This study is a monograph of Master\'s degree in Civil Procedure, under graduate of the Law Faculty of the University of São Paulo (FDUSP), under the guidance of Professor Paulo Henrique dos Santos Lucon, deposited in the month of January, 2013. This dissertation addresses the partial judgments on the merits in Brazilian civil procedure, through the study of the use of the technique of partial award, that although no express provision in the literal Brazilian legal system (unlike what happens in some foreign systems) can be used with caution in order to achieve constitutional principles, such as speed, effectiveness and equality, as well as contributing to make justice in each case. In the first chapter, the paper explains the relevance of the topic chosen as an object of study and makes a brief introduction. In the second, explains, in brief summary, the most important issues related to the object in question, as the concept of merits and chapters sentence theory. The third chapter is directed to the partial judgments that already exist in the system, without protest from the doctrine. The fourth intends to analyze and address the criticisms of the possibility of partial judgment in the Brazilian legal system. In the fifth chapter, the study presents and discusses technical issues concerning the theme. The sixth chapter deals with the partial awards under arbitration. In the seventh, it analyzes the prospects of partial judgments on the new CPC project and its replacement. Finally, the paper ends with a few paragraphs drawn as a conclusion and a list of the books and articles used as the basis for the realization of this study.

Artical 2 of civil procedure code establishes the main aims of civil litigation:defence of violated subject rights and licit interests, proper applying of law when hearing civil cases and passing judicial decisios,swift restoration of legal peace,interpretation and development of law. The essential goal of master's final thesis is to investigate how the above mentioned aims of procedure are implemented in the judicial practice. The author claims that procedural aim of proper appliance of law in the practice of Lithuanian courts is interpreted as the duty of court to identify material truth.The author as well analyses the influence of the recent reform of civil procedure unto the rapidity of litigation and states that there still exist some negative practice in pastponing the hearing of the case when there are no serious reasons for such procedural decision instesd of passing a default judgement or appying procedural penalties. It is generalished that the new Code of Civil procedure established better premises to materialise the essential aims of the procedure.

The infringements of civil procedure were already defined in the procedural law of 1964 in Lithuania. They always used to determine the absolute nullity of legal proceedings and decreed judgement. Currently these procedural breaches are regulated in final enumeration of the second and third parts of 329 article of valid civil procedure Lithuanian code.

The creativity of the European Court of Human Rights is analyzing in the first part of work. Rights of access to the court and restrictions on access are analyzing in the second part of the work. Right to a fair hearing is analyzing in the last part of the work. The main attention is concentrated to these fair hearing principles, wish has been developed by the Court – right to an independent and impartial court, right to a public hearing, right to a hearing in a reasonable time.

Sociedade e verdade: evolução histórica da prova / Society and truth: historical evolution of the evidence

O presente trabalho cuida de investigar os principais aspectos da evolução histórica do instituto da prova, desde o antigo direito processual romano, passando pelo direito processual medieval, em especial, o direito lusitano, até o momento da última das três grandes Ordenações do Reino, as Filipinas, nos primórdios do século XVII. De início, a pesquisa aborda os vestígios da prova nos povos antigos e no processo civil romano, marcado pelo sistema processual das legis actiones. Posteriormente são analisadas as sucessivas modificações nos períodos subseqüentes (per formulas e extraordinaria cognitio, buscando identificar as mutações que a prova experimentou ao longo do tempo. Na seqüência, ultrapassando o período romano, chega-se ao período da Idade Média e da presença visigótica na Península Ibérica. Com o declínio do reino visigótico e ultrapassando o período da presença árabe, atenção especial será dada ao período da Reconquista, evidenciando o fenômeno da formação da nacionalidade portuguesa e seu antigo direito, de índole consuetudinária, bem representado no direito foraleiro, os Forais, e nas primeiras Leis Gerais. Após, investiga-se o sistema da prova previsto nos três grandes monumentos legislativos lusitanos, as Ordenações Afonsinas, Manuelinas e Filipinas. Trata-se, pois, de uma investigação na área da História do Processo Civil, com o objetivo de oferecer uma visão abrangente das origens do instituto da prova no moderno processo civil brasileiro, de longevas e inegáveis raízes lusitanas. / This study examines the key features of the historical evolution of the Evidence (Proof) under the Portuguese medieval law, from the emergence of ancient Roman civil procedure through the compiling of the last of the three great codifications (Ordenações Filipinas), in the early of 17th century. Reviewing the vestiges of legal practices concerning the evidence among the ancient peoples and mainly on the Roman civil procedure, marked by the procedural system of the legis actiones, next, the study analyses successive modifications to the evidence in the subsequent periods (per formulas e extraordinaria cognitio), and seeks to identify changes over time. The account then moves on from the Roman period to the Middle Age and the period of the Visigoth presence on the Iberian Peninsula.With the decline of the Visigoth kingdom and the period of Arab presence, special attention will be paid to the period of the Reconquest and the phenomenon of the formation of the Portuguese nationality and its ancient laws, based on custom and tradition, well represented by the Forais (ancient laws granted by the King) and the first general Laws (Leis Gerais). After, the study examines the evidence system in the three great Portuguese monumental legislative codifications (Ordenações Afonsinas, Ordenações Manuelinas e Ordenações Filipinas). The study is therefore concerned with the History of Civil Procedure, and its aim is to provide a sweeping overview of the genesis of the evidence in the modern Brazilian civil procedure, with its undeniable Portughese roots from distant past.

South African indigenous courts : challenge for the future

The purpose of this study is to access the viability of traditional African courts in a future legal dispensation in South Africa. The research method used is a study of literature, court decisions and relevant statutes. The development of indigenous courts in South Africa is broadly outlined. As an analogy to the South African court system, the courts of Lesotho, Swaziland and Botswana are used to illustrate the dual systems of courts. Rapid urbanisation is discussed to illustrate that despite the increasing urbanisation, traditional values remain inherent to South African Blacks. Subsequent use of documents disclosed in civil proceedings

Rule 31.22 of the Civil Procedure Rules 1998 provides, as a general rule, that those who receive documents through disclosure during civil proceedings may use them only for the purpose of the proceedings at hand. The general rule is subject to three exceptions, and judges have discretion to authorise subsequent use for other purposes. However, the foundational presupposition underpinning CPR 31.22 is that subsequent use, generally speaking, is improper. The thesis has two primary aims: (1) to demonstrate that the rule governing subsequent use (as developed in the case law) is theoretically and practically flawed, and that maintaining a blanket, general rule against subsequent use is unsound in principle, unjust, and procedurally inefficient; and (2) to generate a normative and procedural framework suitable for reform. Part I outlines the content, origins and operation of CPR 31.22. Through historical analysis, it suggests that presumptively categorising as improper all forms of subsequent use beyond the original litigation contradicts traditional authority. By identifying and examining the three principal rationales said to justify the modern rule, it argues that none affords sound justification. By analysing the exceptions to the rule, including judicial discretion, it seeks to show that such measures are incapable of remedying the defects in the underlying rule. Part II attempts to formulate a theoretically defensible, procedurally viable model for reforming CPR 31.22. It suggests that the presumption against subsequent use should be abolished, and the law reoriented around two central norms: the harm principle and a balancing approach. It tests this theoretical model by applying it to seven paradigmatic categories of subsequent use. Finally, it outlines a possible structure for procedural reform.
