Approaching the Unfamiliar: How the Religious Ways of Aboriginal Peoples Are Understood in Delgamuukw v. British Columbia (1997)

This thesis will explore how the Supreme Court of Canada understands and frames the religious ways of the Gitksan and Wet’suwet’en First Nations peoples, in the case Delgamuukw v. British Columbia (1997). The case started as a land claims case but at the Supreme Court level it became about whether Aboriginal oral knowledge could be used as historical evidence in a Canadian court of law, in particular for this dispute, as an aid for First Nations peoples to establish title to their traditional territories. The Court decided that Aboriginal oral knowledge could be used as evidence. This thesis does five things: 1. It examines some of the tools that can be used to examine and evaluate how the religious ways of Aboriginal peoples are discussed in law in Canada. Here it focuses on using a broad understanding of religion as “lived” to understand religion. It also establishes a social-scientific method of discourse analysis, drawn from a number of sources, to evaluate legal documents. 2. This thesis explores the socio-legal context in Canada in which Aboriginal peoples and their claims need to be understood. Here the presence of European and Christian views that are still present in society and social institutions in Canada and the way they affect how Aboriginal religious ways are understood is determined. The characteristics of law that make it difficult for Aboriginal claims to be understood and handled adequately in court in Canada are also investigated. 3. The third aspect that this thesis focuses on the markers of the religious ways of Aboriginal peoples in the Delgamuukw case and how are they understood in the Canadian socio-legal context. Here there is discussion of oral knowledge, land, crests, feasting and totem poles and what each might mean for the Gitksan and Wet’suwet’en peoples and how the legal system might have trouble handling them. 4. Analysis of the Delgamuukw case is the fourth part of this thesis. How the law understands and frames the religious ways of the Gitksan and Wet’suwet’en peoples in the Delgamuukw case are investigated. It is determined that the Court downplayed the religious ways of Aboriginal peoples (by “writing out”, by using vague language to refer to it or by not mentioning it at all); it did not do justice to Aboriginal beliefs by labeling oral knowledge as “sacred”; the Delgamuukw decision fell short of really treating oral knowledge as equal to other forms of historical evidence by excluding oral knowledge with religious content; legal adjudicators made pronouncements on the religious uses of land for the Gitksan and Wet’suwet’en and finally; land was quantified, regulated and title was diminished by the ability for the court to infringe on it. What these actions by the Court suggested about how it understands religion and the religious ways of Aboriginal peoples where also contemplated. It was noted that the law characterized issues and used language in particular ways to avoid discussing religion, to discount it as evidence, and used a Christian understanding of religion to comprehend Aboriginal religious ways, which did not do justice to their beliefs. 5. The last part of this thesis questions whether there other ways in which the law, and the majority of non-Aboriginal peoples in Canada, could come to better understand and handle the religious ways of Aboriginal peoples than they did in the Delgamuukw case. It determines that there are a number of indications that suggest that this is possible including, the unique historical situation of Canada, the teaching and communication skills present in many Aboriginal communities, the space opened surrounding the inclusion of oral knowledge as evidence in law, increasing dialogue with Aboriginal communities, and the current revaluation of history. Nevertheless, there is also an ambivalence on behalf of the law regarding whether or not it will go in the direction that could view Aboriginal religious ways in alternative ways which could result in a better understanding these ways on their own terms. The thesis concludes that according to analysis of the Delgamuukw case, law has difficulty understanding and handling the religious ways of Aboriginal peoples in Canada.

Brevets : rédaction et interprétation des revendications, validité et contrefaçon

Ce mémoire traite des brevets d'invention. Le premier volet dresse un portrait global de l'institution juridique du brevet, tout en en rappelant sommairement les fondements économique et philosophique. Après une brève présentation des conditions préalables à sa délivrance, nous discutons des composantes matérielles du brevet, soit la description de l’invention et les revendications. Une attention particulière est portée à la rédaction ainsi qu'à l'interprétation des revendications. Nous traitons ainsi de deux types de revendications spécialisées qui se sont développés avec l'usage, respectivement les revendications de type Jepson et Markush, pour ensuite recenser les principes d'interprétation des revendications que les tribunaux ont établis. Le deuxième volet traite de la validité et de la contrefaçon de brevet. Sur la question de la validité, nous abordons les principaux motifs pouvant entraîner l'invalidité du brevet, soit: l’ambiguïté, l'insuffisance de la divulgation, le double brevet, l'absence de nouveauté, l'évidence et l'absence d'utilité. Enfin, sur la question de la contrefaçon, nous examinons les circonstances dans lesquelles les actes commis par les tiers portent atteinte au monopole du titulaire de brevet. Pour ce faire, nous nous attardons à la portée des droits exclusifs qui sont reconnus à ce dernier. Tant en ce qui a trait à la validité qu'à la contrefaçon, nous recourons à des illustrations jurisprudentielles permettant de constater les incidences litigieuses afférentes, d'une part, aux motifs d'invalidité et, d'autre part, aux actes de contrefaçon. / This thesis pertains to patent law. The first part of the study is an overview of patents, where both economic and philosophical justifications for this legal regime are shortly addressed. After reviewing the requirements for the grant of a patent, we turn our attention to the main sections of a patent, namely the description of the invention and the claims. We then proceed to a thorough analysis of both the writing and construction of patent claims. More specifically, Jepson and Markush claims command our attention, having emerged as widespread methods for writing patent claims. Moreover, principles of claim construction, as devised by courts in the context of litigation, are also examined. The second part of this study pertains to patent validity and infringement. Regarding validity, we discuss a number of irregularities that may be cause for the invalidity of a patent, namely: ambiguity, insufficiency of the disclosure, double patenting, anticipation, obviousness and lack of utility. Lastly, with respect to infringement, we consider the circumstances from which it may arise, based on the actions of a third party alleged to be in violation of the patentee’s monopoly. This is carried by way of appraising the extent of said patentee's exclusive rights. With respect to both validity and infringement, we discuss case law pertaining, in a first instance, to validity issues and, in a second instance, to infringement matters.

A Rural vs. Urban Analysis of Procedures Provided to Medicaid Recipients by Pediatric, General, and Public Health Dentists in the Commonwealth of Virginia: Fiscal Years 1994-1995

Purpose: The purpose of this study was to report the distribution of procedures provided to Virginia Medicaid children by three types of dental providers in rural and urban areas. Methods: Medicaid claims filed for dental patients younger than 21 were obtained and analyzed for fiscal years 1994 and 1995. Dental providers were categorized according to their practice type: general practice (GP), pediatric (PD) and public health (PH) dentists. Each type of practice was categorized as practicing in a Metropolitan, Urban, Rural or Completely Rural location and evaluated for percentages of preventive, diagnostic, and corrective services provided.Results: The number of procedures was shown to differ depending upon: year, practice type, location, significant provider status, and the type of procedure.Conclusion: General, pediatric and public health dentists in Metropolitan and Urban areas perform slightly more diagnostic services and much less corrective services than practitioners in more rural areas.

We discuss heavy-tailed distributions, which describe the probability of large claim oc- curence. We are interested in the use of large deviations theory in insurance. We simulate claim sizes and their arrival times for Cramér-Lundberg model and first we analyze the probability that ruin happens in dependence on the parameters of our model for Pareto distributed claim size, next we compare ruin probability for other claim size distributions. For real life data we model the probability of large claim size occurence by generalized Pareto distribu- tion. 1

Problematika zadlužování v České republice / The problem of public and private indebtedness in Czech Republic

Summary: This thesis deals with the enforcement of judgments, foreclosures, indebtedness in the Czech Republic and some of the phenomena that are associated with it. At first it describes the legal regulation, which treats the conditions under which it is possible to lead the verdict enforcement. If enforced under Act No. 99/1963 Coll. Code of Civil Procedure, as amended, Code of Civil Procedure this procedure is called "enforcement". If enforced pursuant to Act No. 120/2001 Coll. Enforcement Procedure, as amended, this procedure is called "executions." If enforced pursuant to Act No. 280/2009 Coll. Tax Code, as amended, this procedure is called "tax foreclosures". Subsequently, the thesis deals with address data on household debt. Household indebtedness is observed in the time series from 1993 to 2012, for the independent Czech Republic. Household indebtedness will be confronted with debt Czech Republic. Value of debt in both cases continue to rise, but each has the debt of other causes. For households may default on receivables result in forced recovery, which increased costs. The author proposes several kinds of measures to improve the situation. Educational programs should students of secondary schools and colleges as detailed as possible to show the risks of life on the debt. Increased surveillance...

1 Abstract The subject of this work is to monitor a certain section changes the rule of law, regulating the organization and functioning of agriculture in the transition from one mode to another mode and period of stabilization. The work deals with the normative regulation of the Czechoslovak and Czech agriculture in the period of collectivized application form and the second part of the transition period in Czechoslovak and Czech agriculture on the market form. Collectivization and the actual development of the Czechoslovak socialized agriculture is defined as the years 1949-1990, transformation, or rather de- collectivization and the further development of the market, first Czechoslovak and later Czech agriculture, is dated from 1990 almost until today, and this work deals with the investigation of the legislation referred to by 2004, until the accession of the Czech Republic into the European Union. Äldre inskrivningar i fastighetsregistret : Hur bolag hanterat förnyelsekravet och vad blev resultatet av förnyelselagen?

Förnyelselagen innebär att sådana avtalsrättigheter som upprättats och skrivits in i fastighetsregistret innan 1 juli 1968 tagits bort ur registret om inte någon anmälan om förnyelse gjordes till Lantmäteriets Fastighetsinskrivning innan 31 december 2018. Syftet med lagen var att få ett mer aktuellt och tillförlitligt fastighetsregister genom att ta bort inaktuella eller missvisande inskrivningar ur registret. Att inaktuella eller missvisande inskrivningar finns kvar i fastighetsregistret medför olägenheter för såväl rättighetshavare, kommuner som för allmänheten som använder sig av fastighetsregistret för att finna aktuell och relevant information om fastigheter. Inaktuell information i fastighetsregistret medför bland annat merarbete och högre förrättningskostnader i samband med lantmäteriförrättningar. Lagen anses vara effektiv för att komma till rätta med problemet med inaktuella inskrivningar, samtidigt som det framförts oro över rättighetshavarnas utredningsarbete. Syftet med studien är att bidra till en bredare förståelse för hur lagen påverkat rättighetshavare samt att lägga grunden för vidare utredningar inom ämnet. Studien mål är att undersöka hur ett antal utvalda bolag arbetat inför förnyelselagens verkställande. Målet är vidare att klargöra om lagstiftningen, utifrån studiens omfattning, kan anses ha bidragit till ett mer tillförlitligt fastighetsregister som är bättre anpassat till aktuella förhållanden. Studien baseras på en kvalitativ metod. Semistrukturerade intervjuer genomfördes dels med utvalda bolag som är några av de rättighetshavarna för att se hur de arbetat och genomfört eventuella utredningar av inskrivna avtalsrättigheter inför förnyelselagens verkställande. Semistrukturerade intervjuer genomfördes även med representanter från Statliga Lantmäteriets divisioner Fastighetsbildning och Fastighetsinskrivning för att ta reda på vad Lantmäteriets roll varit i arbetet inför och efter förnyelselagen. Slutsatser som kan dras är bland annat att förnyelselagen kan anses ha medfört ett mer tillförlitligt fastighetsregister som är bättre anpassat till aktuella förhållanden samt att bolagen gjort utredningar av inskrivningar i den mån de ansett vara möjlig. / The Renewal Act means that such contractual rights that were registered in the real property register before 1 July 1968 have been removed from the registration if no notification of renewal was made to Lantmäteriet's Property Registration before December 31, 2018. The purpose of the Act is to obtain a more current and reliable real property register by removing outdated or misleading entries from the registry. The fact that outdated or misleading registrations which remains in the property register results in inconveniences for both right-holders, municipalities and the public who use the real estate register to find up-to-date and relevant information about properties. Outdated information in the real estate register entails, among other things, additional work and higher execution costs in cadastral procedures. The law is considered to be effective in overcoming the problem of outdated registered rights. The purpose of the study is to contribute to a broader understanding of how the law influenced rights holders and to lay the foundation for further investigations within the subject. The aim of the study is to investigate how a number of selected companies have worked for the implementation of the renewal act. The aim is also to clarify whether the legislation, based on the scope of the study, can be considered to have contributed to a more reliable property register that is better adapted to current conditions. The study is based on a qualitative method. Semi-structured interviews were carried out with selected companies, which are some of the biggest right-holders, to see how they worked and carried out any investigations of registered contract rights prior to the renewal law's implementation. Semi-structured interviews were also carried out with representatives from the Lantmäteriet's Real Estate formation and Real Estate Enrollment divisions to find out what Lantmäteriet's role was in the work before and after the Renewal Act. Conclusions that can be drawn are among other things that the Renewal Act can be considered to have resulted in a more reliable property register that is better adapted to current circumstances and that the companies have made investigations of enrollments to the extent that they are considered possible.

L’obligation de remise en état est une déclinaison de grands principes et concrétise le droit à l’environnement dans le présent et pour les générations futures. C’est une mesure de police atypique, perméable au phénomène de la contractualisation. Elle est ainsi résolument moderne et transcende la frontière entre droit public et droit privé. Obligation légale d’intérêt général, elle participe à la construction de l’ordre public écologique. Elle peut inspirer de nouvelles actions, et conduire à envisager la reconnaissance d’une obligation générale de remise en état. Le dernier exploitant reste son seul débiteur légal. Or, le constat de grandes difficultés à obtenir la remise en état en cas de liquidation judiciaire est indéniable. En cas de défaillance, le blocage n’est cependant pas total. D’autres obligés peuvent être trouvés dans le groupe de sociétés. Des tiers peuvent aussi être juridiquement tenus par certaines obligations qui participent de la remise en état. Le rôle du propriétaire est incontournable. Ces solutions ont incontestablement le mérite d’exister, mais elles ont pour point commun de n’être que partielles. Ainsi, diverses hypothèses pour une amélioration ont pu être formulées. / The obligation for restoration is an application of general principles and gives concrete expression to the environmental law in the present and for future generations. This is an atypical police measure, sensitive to the phenomenon of contracting. It is thus resolutely modern and transcends the summa divisio between public and private law. As a legal obligation of general interest, it contributes to the construction of ecological public order. It may inspire new actions and lead to considering the recognition of a general obligation for restoration. The last operator remains its sole legal debtor. However, one cannot deny that it is very difficult to obtain restoration in the event of winding up by decision of the court. In case of failure, the blocking situation is however not total. Others indebted may be found in the group of companies. Third parties may also be legally bound by certain obligations that contribute to the restoration. The owner has a key role to play. These solutions undoubtedly have the merit of existing, but they all have in common that they are only partial. Thus, various hypotheses for improvement have been made.

In spite of the existence of excellent works mentioned in the bibliography hereof on lis pendens among such kinds of actions, they are very limited as regards individual actions. We understood that dealing with collective action complying with merely and strictly those rules applicable to individual lawsuits is a mistake, with all due respect. This paper aims at analyzing which are those actions that may be considered as collective indeed. Thus, Civil Public Action, Popular Action, Collective Mandamus, Collective Injunction Order, Direct Unconstitutionality Action, Action for Declaration of Constitutionality, Argumentation of a Basic Principle Breach, Action against Dishonesty in Administration. This paper carries out a preliminary analysis of issues like legitimacy, the very concept of party, the internal formation of lawsuits (parties, claim, and cause of action), the effects resulting from the decision, so that the main issue may be eventually dealt with. It is concluded that there are two criteria of setting lis pendens between those institutions: one of them, traditional, characterized whenever the same internal elements of a lawsuit are present; another, that takes into account the claim s identity, although some internal elements may be different. This thesis points out further contrarily from what is observed in lis pendens for individual actions that in collective actions the lawsuit should not be dismissed, but rather gathered together, by virtue of a possible higher extent thereof, as it can occur with the cause of action, and as a way of preventing the other action s holder s free access to the Judiciary / O trabalho, que ora se apresenta, tem por objeto tratar de uma figura, objeto de constantes polêmicas na doutrina e na jurisprudência, qual seja, a litispendência entre as demandas coletivas e entre estas e as individuais. Nada obstante tenhamos na bibliografia excelentes obras, cuidando da figura da litispendência entre estas espécies de demandas, fazem-no, salvo raras exceções, restritivamente com relação ao processo individual. Entendemos que tratar do processo coletivo com olhos fixos nas regras de processo individual, data maxima venia, configura um erro. O trabalho procura analisar quais são as demandas verdadeiramente coletivas e, assim, encontramos a Ação Civil Pública, Ação Popular, Mandado de Segurança Coletivo, Mandado de Injunção Coletivo, Ação Direta de Inconstitucionalidade, Ação Declaratória de Constitucionalidade, Argüição de Descumprimento de Preceito Fundamental, Ação de Improbidade Administrativa. Procura analisar de modo prévio as questões da legitimidade, do conceito de parte, da formação interna das demandas (partes, pedido e causa de pedir), os efeitos decorrentes da decisão, para que, ao final, possa tratar do tema principal. Conclui que existem dois critérios de configuração da litispendência entre estas figuras: um, tradicional, que se verifica quando da presença dos mesmos elementos internos da demanda; outro que leva em consideração a identidade de pretensão, ainda que distintos alguns dos elementos internos. Observa ainda que, diferentemente do que se verifica na litispendência entre demandas individuais, entre as demandas coletivas, o processo não deve ser extinto, mas reunido, em razão da eventual amplitude, como pode ocorrer com a causa de pedir, e como forma de negar ao titular da outra demanda a liberdade do acesso à justiça
