Stanovení sazeb pojistného v neživotním pojištění / Pricing in non-life insurance

The aim of this thesis is to determine the premium of motor third party liability insurance. Thesis explores both direct approach to premium cal- culation and calculation using separately calculated claims frequency and claims severity. Emphasis is put on the use of generalized linear models whose theory is also present. Described approaches to calculation are applied on real world data, compared with each other and then final model for premium calculation is selec- ted. Premium is determined with the inclusion of IBNR reserves and expenses. A Legal Analysis of Litigation against Louisiana Educators and School Districts, Before and After the Louisiana Governmental Claims Act

This dissertation analyzed court decisions in injuries on school grounds cases under the Louisiana Governmental Claims Act. The question addressed was: How have the Louisiana courts interpreted the Louisiana Governmental Claims Act in litigation against Louisiana school districts and their employees? The intent of this study was to show how Louisiana's legal system has evolved, and how that evolution affected tort cases involving school boards and school board employees. Doctrinal legal research was the methodology used to answer the research question. To limit the number of cases analyzed, this study only focused on tort claims involving injury on school property. In order to gain a broad perspective, tort claims cases filed prior to the 1974 Louisiana Constitution, cases filed after the 1974 Louisiana Constitution, and cases filed after the 1995 Louisiana Liability Limits Amendment, and the Louisiana Governmental Claims Act of 1996 were analyzed. By analyzing the tort claims brought against Louisiana school districts and employees during the various time-periods, it was clear to see how the case rulings reflected the frequent changes of the Louisiana Constitution and its' laws. In the end, the state continued to control who could sue them and how much they would pay in damages.

An investigation into the use of construction delay and disruption analysis methodologies

Delay and disruption (DD) to contractors’ progress, often resulting in time and cost overruns, are a major source of claims and disputes in the construction industry. At the heart of the matter in dispute is often the question of the extent of each contracting party’s responsibility for the delayed project completion and extra cost incurred. Various methodologies have been developed over the years as aids to answering this question. Whilst much has been written about DD, there is limited information on the extent of use of these methodologies in practice. The research reported in this thesis was initiated to investigate these issues in the UK, towards developing a framework for improving DD analysis. The methodology adopted in undertaking this research was the mixed method approach involving first, a detailed review of the relevant literature, followed by an industry-wide survey on the use of these methodologies and associated problems. Following this, interviews were conducted to investigate the identified problems in more depth. The data collected were analysed, with the aid of SPSS and Excel, using a variety of statistical methods including descriptive statistics analysis, relative index analysis, Kendall’s concordance and factor analysis. The key finding was that DD analysis methodologies reported in the literature as having major weaknesses are the most widely used in practice mainly due to deficiencies in programming and record keeping practice. To facilitate the use of more reliable methodologies, which ensure more successful claims resolution with fewer chances of disputes, a framework has been developed comprising of: (i) best practice recommendations for promoting better record-keeping and programming practice and; (ii) a model for assisting analysts in their selection of appropriate delay analysis methodology for any claims situation. This model was validated by means of experts’ review via a survey and the findings obtained suggest that the model is valuable and suitable for use in practice. Finally, areas for further research were identified.

This study addresses how political and professional claims directed at teachers change, and in many ways challenge teachers’ professional autonomy, as well as affect preconditions for meaning-making in pedagogic practices. Focus is placed on political steering and its implications for teacher education and teachers’ work in schools. Professional tensions between claims for system-oriented success de-fined as goal achievement versus a communicative understanding are analysed within a conceptual framework of steering and meaning. Based on official educational policy documents as well as teachers’ development projects the analysis revolves around issues concerning core competencies in teacher education and professionalisation processes. The empirical material comprises the Swedish 2001-teacher education reform and the Swedish National Higher Education Agency’s criticism of that part of teacher education which is obligatory for all teacher students (AUO). Moreover, grounds for educational policy that lead to the introduction of individual development plans (IUP) in school are analysed. Additionally, comments on circulated proposals submitted by universities and teacher organisations in connection with Bologna and the IUP-reforms are subject to analysis. In terms of methodology, the study primarily draws upon theories of communicative action, critical discourse analysis and theories of the professions. The results indicate that emphasis in educational policy is placed on the clarification of goals, progression and assessment practices in schools and teacher edu-cation. Thus teachers and teacher educators need to address functional steering claims which demand commitment and loyalty for political reforms. This entails that teachers’ professional autonomy is restricted. Teachers are encouraged to take difficult decisions and act strategically in order to maximise the pedagogic outcome based on economic and political claims for excellence, collaboration, and a clear-cut steering direction. Professionalism now appears to connote quality control by way of more specified formulations and assessments towards learning outcomes. Political rhetoric stipulates as essential that teachers determine knowledge progression and boundaries between the various exam and knowledge levels. Teachers are also to expound internal documentation in order to fulfil system-related claims. The study illustrates how conditions and preconditions emanate from shared profes-sional considerations, competencies and convictions, and that teachers need to be able to discuss these. However, this is challenged by a continuously increasing management by documents. In light of recentralised steering, claims are directed at teachers who are now to create transparency, quantifiable criteria for assessment and employability. Based on the teachers’ development projects, the results indicate that teachers are critical of how the education system is subjected to increasing pressure due to a stream of reforms and evaluations. Politicisation and economisation of education underscore a need for pragmatic and strategic actions within the profession. In contrast to experiences of political lack of vision, impellent user orientation and marketisation, universities and teachers claim that critical communicative-oriented pedagogy boost professional autonomy. Moreover, the study indicates that teachers’ positions and professional identities vary depending on the perceived validity of the political claims. Claims for objectivity, simplification, clarity and functional criteria for assessment are countered by claims for in-depth meaning-making and consideration of the complexity and knowledge instability that is constitutive of pedagogic practices. Ultimately, this study illustrates a professional shift within the teacher body towards notions of objectivity and individualisation, thereby threatening teachers’ critical discussions of their organisation and work.

Zobecněné lineární modely v upisovacím riziku / Generalized Linear Models in Reserving Risk

In the presented thesis we deal with the generalized linear models framework in a claims reserving problem. Claims reserving in non-life insurance is firstly described and the considered class of models is introduced. Consequently, this branch of stochastic modelling is implemented in the reserving setup. For computation of the risk associated with claims reserving, we need a predictive distribution of future liabilities in order to evaluate risk measures such as Va- lue at Risk and Conditional Value at Risk. Since datasets in non-life insurance commonly consist of a small number of observations and estimation of predictive distributions can be complicated, we adopt a bootstrap method for this purpose. Model fitting, simulations and consequent measuring of the reserving risk are performed within the use of real-life data. Based on this, an analysis of fitted models and their comparison together with graphical outputs is included. 1

The purpose of my thesis called "The recognition and enforcement of judicial decisions within the European Union" is to compare two laws of EU Private International Law, which deal with this question - the Brussels I Regulation and the European Enforcement Order Regulation, as well as evaluate application of these Regulations by the Court of Justice of the European Union (European Court of Justice) and by national courts of two of member states of European Union - the Czech Republic and the Kingdom of Spain. The basic instruments for this research are description, analysis and comparison. The thesis is composed of six chapters, each of them dealing with different aspects of recognition and enforcement of judicial decisions. Introductory chapter defines basic scope of this thesis. This diploma thesis deals with the personal injury in the Czech legal order according to the current legislation in the current Civil Code and in the new Civil Code. The work is divided into six chapters. The first chapter provides a basic introduction to the legal liability. The second chapter gives an interpretation to each of the assumptions of liability and describes some of the changes that the new Civil Code brings to these legal institutions. The third chapter discusses some general institutes with damages related, as is the way and the extent of damages, limitation of the claims for the compensation with regard to the new civil code. The fourth chapter is devoted to each of the non-pecuniary claims for damage to health and life, which can be found in the Civil Code, which include pains and suffering, aggravation of social position, compensation after the death of the close person and the satisfaction provided in the case of the intervention in the right to the protection of the personality. The subject of this chapter is also the issue of compensation for personal injury and determining the amount of compensation. Linkages between economic agents in form of financial assets might contribute to transmission of shocks between different parts of the economy. Aim of this thesis is to enrich the ongoing discussion about the spread of contagion through the economy. We provide an analysis of financial interlinkages in the Czech economy and using the contingent claims analysis (CCA) model we attempt to quantify risks in the system that that are implied by the existence of these linkages. We use different techniques within the framework of the model to obtain various indicators that can be used to assess stability of the system. Using simulations we find that size of losses due to riskiness of debt depends strongly on the origin of a shock and it is higher for shocks originating in the household sector than for shocks originating in the sector of the non-financial corporations. We also find that size of a decrease in capital of the banking sector needed to cause a distress in the system as relatively high and stable in time. Cette thèse cherche à renouveler les cadres d’interprétation sur la conflictualité autour de la ressource en eau au Mexique, en adoptant une approche constructiviste des conflits hydriques. A travers l’analyse détaillée de deux situations de conflit sur l’eau liées à l’urbanisation dans l’Etat du Morelos, et l’étude de la façon dont les groupes mobilisés formulent le problème, nous mettons en évidence que les conflits sur l’eau n’expriment pas uniquement une demande d’accès à l’eau, mais aussi des revendications d’ordre patrimonial : les communautés paysannes se mobilisent pour préserver certains points d’eau, certaines infrastructures (réseaux d’eau, réservoirs), qui ont pour eux une signification particulière. Même si dans le Morelos, les réseaux d’eau sont le support d’une culture hydraulique singulière, le projet patrimonial ne répond pas seulement à la volonté de conserver certaines traces qui se trouvent menacées de disparition et revêt des enjeux politiques et identitaires pour les communautés agraires, qui ont subi de profonds bouleversements à la suite des réformes du statut des terres ejidales. Cependant, la dimension patrimoniale n’est pas prise en compte par les acteurs publics de l’eau, et la conflictualité reste latente. / This dissertation aims at renewing interpretations on water conflicts in Mexico, by adopting a constructivist approach. Through the detailed study of two water conflicts linked to urbanization in the State of Morelos and the analysis of the way the actors formulate the problem, we show that water conflicts don’t only express demands on water access, but also patrimonial claims: peasant communities mobilize because they want to preserve some water points, some hydraulic infrastructure (water networks, water tanks) that have a special meaning for them. Although in Morelos, water networks have given rise to a specific hydraulic culture, the patrimonial project is not only linked to the will of preserving a cultural heritage that may disappear and has a political and identity relevance for peasant communities that have been deeply shaken up by the land reforms of the nineties. Nevertheless, water public actors do not take patrimonial claims into account, and conflicts are latent.

Tourism-led development in South Africa: a case study of the Makuleke partnership with Wilderness Safaris

PH.D., Faculty of Humanities, University of the Witwatersrand, 2011 / Through a case study of the relationship between the rural Makuleke community and the regional tourism operator Wilderness Safaris, this thesis examines the impact of tourism partnerships on community development in post-­‐ apartheid South Africa. The study considers the tourism component of the ‘Makuleke model’, a concept used frequently in academic and popular literature to refer to the community’s landmark land restitution case involving the Kruger National Park (KNP). Thirty years after experiencing a forced removal by the apartheid regime, the Makuleke community in 1998 was able to regain their lost land (the Pafuri area of Kruger National Park) and benefit from it through conservation and tourism. The Makuleke have partnered with three tourism operators, their main concessionaire being Wilderness Safaris. Their contractual agreement obliges the tourism company to pay lease fees to the Makuleke Communal Property Association (CPA) and to employ Makuleke residents. To further community development, Wilderness Safaris established a joint venture with the Makuleke CPA, and also runs an environmental education programme for children. Evidence for this thesis was collected over a two and a half year period (from May 2007 to December 2009) using three methodological approaches: archival research, participant observation and semi-­‐structured, open-­‐ended interviews. In analysing the Makuleke CPA-­‐Wilderness Safaris partnership, findings reveal that ten years after the land claim, the commended ‘Makuleke model’ is neither as conceptually coherent nor as practically successful as is commonly supposed. I argue that although the model denotes success, a closer scrutiny of its foundations, assumptions and context expose inherent forces and practices that hinder its long-­‐ term effective implementation. Influenced by post-­‐development theory, I question perceptions of equality in benefit distribution, critique the juxtaposition of traditional with modern values, and examine contestations over power within the Makuleke community. I demonstrate how these features undermine the potential for the genuine transformation and broad-­‐based social upliftment that tourism-­‐led development purposes to achieve at Makuleke. My research findings confirm post-­‐development theoretical propositions that criticise the contradictions in orthodox development procedures and call for a rethinking of the premises upon which approaches to community upliftment through tourism are generally founded.
